Innocent until proven guilty is the backbone of our legal system, and yet, we don't actually operate that way anymore. People now are brought to trial and assumed guilty until absolute proof of innocence is given. Welcome to the Just Dumb Enough Podcast. A show that acknowledges no one is always an expert, by dispelling misconceptions with real experts. My guest today is James Porfido (Esq). James was a prominent prosecutor with decades of experience serving the state of New Jersey to defend it's citizens. Then, everything revealed it's ugly nature to an extent that could no longer be ignored. James became a criminal defense attorney and worked to represent those who found themselves wrongly accused and without proper representation. While you would think that both sides are working for the greater good, James was abandoned by many and chastised by more. Join us as he explains the true inequality of the justice system, and what you can do to prevent yourself from being another wrongfully convicted statistic.( Www.Unequal-Justice.Com ) ( Www.PorfidoLaw.Com ) ( https://a.co/d/aI5T8ji will take you to: Www.Amazon.Com "UNEQUAL JUSTICE: The Search for Truth to Balance the Scales" ) ( https://www.youtube.com/watch?v=nyPqvYv87NM&ab_channel=REMSCAPE will take you to: Www.YouTube.Com "Every 15 Minutes | Madison High School" ) Let's ask for our lawyers before talking to anyone. I could have easily spent all day talking to James about those major trials of: Casey Anthony, the Menendez Brothers, OJ Simpson, Michael Jackson, Harvey Weinstein, and Scott Peterson. In other news... April is rolling on, and the rankings are more regular: 1. The United States, with Oregon, Washington, and California now at the front. #WestCoastBestCoast 2. England of the United Kingdom. 3. Australia, with Queensland and Victoria all tied up. 4. Canada, with Ontario still on top. 5. New Zealand, back after some time away. I always love seeing the list swings and changes as the show grows. That's it for this week! Have a great week, a great weekend, and I'll see you all back here next week for another new episode! On last week's podcast, Diane talked to The New Yorker's Susan Glasser about the indictment of Donald Trump. One listener emailed after listening to the episode, asking for a clear explanation as to how the former president's behavior compared with other politicians' handling – or mishandling -- of government secrets. So that's what Diane is doing – hosting a conversation about Donald Trump's documents, Hillary Clinton's emails, and Republican charges of unequal treatment. Diane's guest, Mary McCord, is the executive director of Georgetown Law's Institute for Constitutional Advocacy and Protection. She is also a former prosecutor and was Acting Assistant Attorney General for National Security at the U.S. Department of Justice from 2016 to 2017. She explained the next steps in the federal case against former President Trump and why she thinks the charges of unequal treatment don't add up.

Ms. Joppy, a Black nurse claims she faced racial discrimination at an Aurora hospital that led to her being wrongly prosecuted for manslaughter in the death of an elderly patient. We agree. The criminal charges, brought by the Colorado Attorney General's Office, were later dropped at the prosecution's request “in the interest of justice,” a motion to dismiss shows. The Biden DOJ has filed charges against pro-life activists for a peaceful protest where they blocked access to an abortion facility. Pastor Jim Harden is president and CEO of CompassCare Pregnancy Services in New York. Jim pioneered the first measurable and repeatable medical model in the pregnancy center movement, helping over 650 centers nationwide become more effective at reaching more women and saving more babies from abortion. He has written extensively on medical ethics, executive leadership, and pro-life strategy.--On July 12th, Pastor Harden appeared on Crosstalk and gave details concerning how his pregnancy care facility was victimized on June 7th by Jane's Revenge, a domestic terrorist group.--Basically, the overturning of Roe set off a pro-abortion crime wave, the first being the firebombing of a Madison, WI. pro-life organization. Jane's Revenge took responsibility and gave pro-life pregnancy centers 30 days to shut down or face the consequences of continued violence. --After 30 days, the Buffalo, N.Y., CompassCare facility was attacked with multiple incendiary devices resulting in the need to be gutted and rebuilt. Jane's Revenge graffiti was painted on the side of the building. A couple of days later Jane's Revenge released another communique taking responsibility for the firebombing while also communicating that if CompassCare didn't shut down, things wouldn't be so easily cleaned up as fire and graffiti. In other words, they were giving a murder threat.--Undaunted, CompassCare continued to help women in the moment of their crisis and 52 days later, their facility was back up and running.--Planned Parenthood had a site in Kalamazoo, Michigan, that was attacked at the end of July. Within 4 days there was a multi-agency response in which a suspect was found and arrested.

In this week's podcast the National Crawford Roundtable does a follow-up discussion on last week's episode about the FBI Mar-a-Lago raid, but go deeper into the potential for a civil uprising from angry conservatives and what appears to clearly be an unequal system of justice in America. The DOJ just asked a Court to keep it's reasoning for the raid from being released. There were no raids for Hillary Clinton, Hunter/Joe Biden, nor Sandy Berger, the Clinton National Security Advisor who stole Classified Documents from the National Archives by literally stuffing them in his underwear. Last month, a Planned Parenthood clinic in Michigan was attacked by a man, who set the building on fire after it was closed for the day and no one was inside, and the DOJ found him in 4 days and arrested him, while over 100 churches and pro-life pregnancy centers have been attacked, vandalized and fire bombed in just the last 3 months yet no arrests have been made in those cases, even though Jane's Revenge, a known domestic terrorist group, has openly claimed credit for many of the attacks. January 6th protesters are getting several years in prison, many denied bail, many held in solitary confinement after 1 1/2 years yet the DOJ has not gone after BLM or ANTIFA. Why the disparity? Are we hitting a boiling point where American conservatives may start to engage in civil unrest over what appears to clearly be unequal justice under the law?
Of all the toxic things the Biden wrecking operation has inflicted on our country, one of the most corrosive is its relentless, further undermining of the principle of “equal justice under law.” In practice, this entails federal law enforcement treating dramatically differently alleged wrongdoing by prominent Republicans and Democrats. The latest examples involve the Justice Department's reported plans to indict former President Donald Trump on the absurd proposition that he engaged in a seditious conspiracy to overthrow our government on January 6th. Meanwhile, unidentified whistleblowers have revealed that the DoJ and FBI have studiously ignored hard evidence that Hunter Biden and “the Big Guy” – his father, Joe – have actually sold out our country to its mortal enemy, the Chinese Communist Party. Biden's weaponizing of our system of justice really will take down our Constitutional Republic, and embolden the CCP to pile on. This is Frank Gaffney.

Jody David Armour is the author of N*gga Theory: Race, language, Unequal Justice, and the Law, and is a leading national voice in reshaping our legal system. Jody's journey started when he was 8 and his father was arrested causing him and his 7 siblings to go from middle class to living on government cheese. His father taught himself law while in jail and eventually pled his own case in front of a federal court and freed himself. Jody was 14 at the time, and he now teaches his father's precedent-setting case as a Professor of Race and Law at USC. Jody likes to say there are four professions where “word-work” is literally their bread and butter: writers, poets, lawyers and rappers… and how to use words to change the world. In Episode #35 of Saving America, I highlight the inequality of justice between the Ashli Babbitt and George Floyd police shooting responses, Nancy Pelosi's hypocritical defense of Maxine Waters' riot-inciting statements, the ridiculous concept of "equitable math," and the White House's defense of a UN ambassador who declared the U.S. founding documents "racist." I describe Kamala Harris's intent to bypass visiting the southern border in favor of visits to Mexico and Guatemala to beg for a bailout of Biden's disastrous immigration policies, and discuss New York's intention to give economic relief money to illegal immigrants. My guest this week is Dr. Paul Sambataro, a neurocognitive scientist and Director of the Houston Behavioral Health Institute (https://emotionalbudgeting.com/), and author of The Emotional Budgeting Workbook. As always, the opinions expressed in this podcast are mine and my guests' and not the opinions of my university, my company, or the businesses with which I am connected. I am an attorney and speaker as well as the founder and CEO of Claremont Management Group, a consulting firm in Houston, Texas. I'm also a tenured professor and the Associate Dean for Graduate Programs at the University of St. Thomas. I have written and published The Decline of America: 100 Years of Leadership Failures, a thought-provoking, non-partisan book that reviews the last 100 years of American Presidents (from Wilson through Obama), offering not just criticism, but common sense solutions to help fix America before it's too late. The guilty verdicts in the Derek Chauvin trial in Minneapolis made history—and came only after millions of people took to the streets, for months, in hundreds of cities across America; and only after a decade of sustained organizing by Black Lives Matter. Jody Armour comments—he's the Roy Crocker Professor of Law at the University of Southern California, and author of "N*gga Theory: Race, Language, Unequal Justice, and the Law." Plus: Harold Meyerson argues that compelling video of police abuse of power has NOT led to convictions of cops in the past - in the Rodney King case, for example; what's different here is the BLM Movement. Also: Earth Day 2021 is the world's largest civic event—three days of climate action by millions of people around the world, including Joe Biden hosting a global climate summit on April 22 and pledging to take bold action to slash greenhouse gas emissions in the United States in the next 10 years. Mark Hertsgaard, The Nation's environmental correspondent, says that for starters we need to start using the term “climate emergency” rather than “climate issue” or “climate crisis.”

For Black History Month, we're dropping some of our favorite past episodes back into the podcast feed every few days this month. Enjoy! This week we’re revisiting two classic episodes to highlight injustice in how the death penalty has been applied in our city’s history. First, we’re going to visit early Boston, in a time when execution by hanging was a shockingly common sentence for everything from murder and piracy to witchcraft and Quakerdom. During this period, hanging was the usual, and execution by fire was decidedly unusual. This punishment was reserved only for members of one race and one sex, and in Boston’s history, only two enslaved African American women were burned at the stake. After that, we’ll fast forward to the mid-19th century, when it seemed like the death penalty would soon be abolished. After 13 years without an execution in Boston, a black sailor was convicted of first degree murder. Despite the fact that white men convicted in similar circumstances were sentenced to life in prison, he was condemned to death. And despite tens of thousands of signatures on petitions for clemency, he was hanged at Leverett Street Jail in May of 1849. Full show notes: http://HUBhistory.com/182
FEATURING JODY ARMOUR – The US’s system of mass incarceration and racialized poverty go hand in hand. Black Americans are disproportionately criminalized and fill the prison system. While many on the left-liberal part of the political spectrum chalk this up to a racist justice system, not enough link it to the prevalence of poverty in...
Harold Meyerson argues that none of Trump's tactics to hold on to the White House will succeed—the lawsuits are ridiculous, the proposals for Republican state legislatures to send their own Trump electors to Washington won't work. But the fact that Trump got more votes than any Republican in history gives him a lot of power over the party. Also: the huge victories Black Lives Matter won at the polls in L.A. County: Jody Armour explains, starting with electing a progressive District Attorney, George Gascon. Jody's new book is N*gga Theory: Race, Language, Unequal Justice, and the Law. And our TV critic Ella Taylor recommends “Collective,” a terrific documentary about corruption in Romania.

Mike Davis on the Trump voters: Latinos in south Texas and white workers in the rust belt—and Biden’s big mistake: allowing Trump to claim "the economy" as his issue, instead of connecting jobs to controlling the pandemic. Also: Black Lives Matter had massive victories in the elections in America’s biggest county—LA, with 10 million people. They elected a progressive D.A. and passed an initiative to re-imagine public safety by moving 10 per cent of the county’s $5 billion unrestricted budget to alternatives to incarceration, to community services, and barring the county from using the money on prisons, jails ,or law enforcement agencies. On today's show: 2016: Lindsay Graham "use my words against me" says he wouldn't appoint a nominee so close to a general election. 2018: Graham reconfirms his statement that he won't confirm a new SCOTUS nominee in an election year. The destructive impact of these ideas on the fight for racial justice, particularly with regard to police and prisons. How Obama represents the limits of respectability politics. The need for our criminal justice system to move away from retribution and towards restoration and rehabilitation, even in cases of interpersonal violence. On the fun half: Nancy Pelosi offers very little other than "go vote" to save RBG seat from GOP Senate. Pelosi says Dems have arrows in their quiver to protect democracy... asked if she will use them Pelosi says "good morning" and that she's not considering packing the court, wants Trump to "see the light." Saturday: Biden appeal to GOP senators after RBG death: "please follow your conscience." Stephanie Ruhle miffed that Biden is making his campaign "Scranton v. The most recognizable symbol of solidarity with today's movement against racism and police brutality has been to take a knee, an act of protest popularized by Colin Kaepernick. He's the latest in a long line of athlete-activists whose outspoken defiance have helped push forward social and political change in America. What can we learn from these individuals and the movements they are a part of? And what can we learn from the sports world about inclusion, teamwork, and working together to reach shared goals? Our host Varun Soni explores these questions and more in conversation with Jody Armour, professor of law and author of the upcoming book, "N*gga Theory: Race, Language, Unequal Justice and the Law."
Today's number one topic is the people and the police. The Democrats have unveiled a new law to reform police everywhere. Jody Armour, professor of Law at USC, comments -- his new book is "N*GGA THEORY: RACE, LANGUAGE, UNEQUAL JUSTICE and the LAW" forthcoming in August. Next up: Ivanka Watch -- after using pepper balls and flash bang grenades to clear demonstrators for Trump's bible photo-op, the White House said that it was Ivanka's idea -- Amy Wilentz reports. Plus, We can't go to the movie theaters but we can stream them at home. Spike Lee's new film "DA 5 BLOODS" is out now -- film critic Ella Taylor comments.

Democrats in Congress have introduced legislation to reform police practices nationwide and hold bad cops responsible—while LA has spent decades trying to reform its police force. Jody Armour comments—he’s the Roy P. Crocker Professor of Law at the University of Southern California, and speaks widely on Black Lives Matter and the movement’s agenda. His book N*gga Theory: Race, Language, Unequal Justice, and the Law will be published in August. Also: Trump’s disastrous walk across Lafayette Square for that bible photo-op outside St. John’s Episcopal Church apparently was Ivanka’s idea—she’s also been tweeting Bible verses. Justice means getting what you deserve without favor. “Social justice” means getting what you don't deserve because you are favored. We see justice demanded of God's people in Isaiah 1:17, Proverbs 31:8-9, Exodus 23:1-9, Leviticus 19:15, James 1:27 and elsewhere in the Scriptures. Social justice is different. This is a state or doctrine of egalitarianism” which is the notion that all social, economic and political “inequalities” must be removed from society. As it is defined by our culture, “social justice” is justice in terms of the distribution of wealth, opportunities, and privileges within a society. THIS iteration of “justice” is NOT commanded in Scripture. Justice pursues what is right according to an absolute, impartial standard. Social justice pursues what is lacking for certain groups of people based on what is possessed by others. Justice is driven by what is morally acceptable, or what God says is right. Social justice is driven by what is socially acceptable, or what the people say is right. Justice is objective. Social justice is subjective. Justice involves matters that can potentially impact anyone. Social justice involves matters that are believed to only impact specific groups. Social justice doesn't resemble biblical justice at all. Actually, it is injustice, and believers must oppose it.
Throughout the hour, Dave and Deb spoke with the NAACP and law enforcement about unequal justice in the United States. Now they want to hear from listeners.
Rabbi Dov Linzer, Rosh Yeshiva of Yeshivat Chovevei Torah (https://www.yctorah.org/) presents his lecture "Unequal Justice? Jew/Non-Jew Distinctions in Civil and Criminal Halakha) before a roundtable audience at Temple Kol Ami (www.templekolami.org/) in Scottsdale, AZ. ABOUT THIS LECTURE: One of our basic democratic principles is that everyone deserves equal treatment under the law. In religious law, however, there tends to be a privileging of those who are members of the faith over those who are not. While this makes sense in matters of ritual, it would seem deeply unfair, indeed unethical, to apply such distinctions to matters of civil and criminal law. In this lecture, we will see how halakha initially gave warrant for unequal treatment of non-Jews and how over time, due to changing circumstances and attitudes, a number of major halakhic decisors minimized or eliminated these distinctions.
