The Trump Administration and the Rule of Law Under Pressure

On March 6, President Trump issued the executive order “Addressing Risk from Perkins Coie LLP,” essentially preventing the firm from doing business with the federal government, stripping its staff of security clearances. It was the first of several presidential orders aimed at law firms that represented clients and/or employed attorneys at odds with Trump. At the same time, Trump and members of his administration have voiced loud opposition to judges who rule against him and, in what many see as a weaponization of justice, have fired members of the Department of Justice without cause. Even the new Attorney General Pam Bondi is breaking with long held protocol by openly defending the administration, taking a partisan position when defending her decision not to investigate the Signal scandal of top national security officers sharing war plans via the public ap, saying: “If you want to talk about classified information, talk about what was in Hillary Clinton's home. Talk about the classified documents in Joe Biden's garage that Hunter Biden had access to.”Are the norms and practices that have maintained the rule of law in the United States straining under the pressure of the Trump administration?Stanford Law Professor David Sklansky, a criminal law expert, joins Pam Karlan for a look at the first 100 days of the Trump administration—and the unprecedented number of executive orders targeting rule of law norms. Sklansky, co-director of the Stanford Criminal Justice Center who teaches and writes about policing, prosecution, criminal law, and the law of evidence, is the author, most recently of Criminal Justice in Divided America: Police, Punishment, and the Future of Our Democracy, was published earlier this year by Harvard University Press. Earlier he practiced labor law in Washington D.C. and served as a federal prosecutor in Los Angeles.Links:David Sklansky  >>> Stanford Law pageCriminal Justice in Divided America >>> Stanford Law pageConnect:Episode Transcripts >>> Stanford Legal Podcast WebsiteStanford Legal Podcast >>> LinkedIn PageRich Ford >>>  Twitter/XPam Karlan >>> Stanford Law School PageStanford Law School >>> Twitter/XStanford Lawyer Magazine >>> Twitter/X (00:00:00) The Rule of Law and Executive Orders(00:15:01) Legal Profession's Response to Political Pressure(00:27:01) Impact on Universities and Academic Freedom(00:37:01) Redefining Pro Bono Work(00:44:42) The Importance of the Rule of Law

Criminal law expert and Stanford Law Professor David Sklansky joins Pam Karlan to discuss his book Criminal Justice in Divided America: Police, Punishment, and the Future of Our Democracy, published in January. In this episode, they explore what he sees as the failures of America's criminal justice system—from overly harsh sentences and prosecutorial abuses to the under-utilization of the jury system—that don't just harm individuals, but erode the very foundations of democratic governance. They also examine the rise and fall of community policing, the role of mental health in police encounters, and the impact of jury service on civic engagement, offering insights into how criminal justice shapes political and social landscapes while proposing steps toward reform.Sklansky, a former federal prosecutor, teaches and writes about policing, prosecution, criminal law and the law of evidence at Stanford Law, where he is also the faculty co-director of the Stanford Criminal Justice Center.Connect:Episode Transcripts >>> Stanford Legal Podcast WebsiteStanford Legal Podcast >>> LinkedIn PageRich Ford >>>  Twitter/XPam Karlan >>> Stanford Law School PageStanford Law School >>> Twitter/XStanford Lawyer Magazine >>> Twitter/XLinks:David Sklansky >>> Stanford Law pageCriminal Justice in Divided America, Police, Punishment, and the Future of Our Democracy >>> Stanford Lawyer magazine online feature(00:00:00) Chapter 1: Criminal Justice and the Erosion of DemocracyPam Karlan welcomes professor David Sklansky and explains the link between the crises of criminal justice and democracy, discussing how failures in criminal law and policy have undermined democratic values. The conversation touches on racial disparities, equal protection, and how the criminal justice system has contributed to public distrust in government institutions.(00:05:15) Chapter 2: Policing and PolarizationKarlan and Sklansky delve into the historical role of policing in fueling political polarization, particularly during the rise of crime as a central political issue in the late 20th century. Sklansky highlights the impact of police abuse on public confidence, the Republican Party's pivot toward tough-on-crime policies, and how bipartisan approaches to policing briefly improved public trust.(00:09:12) Chapter 3: The Rise and Fall of Community PolicingThe discussion focuses on community policing as a promising reform effort that ultimately fell short. Sklansky critiques its limited engagement with younger residents and those affected by police violence. He explains how the movement's failure to address systemic issues, like excessive police violence, eroded its credibility and relevance in modern reform conversations.(00:14:15) Chapter 4: Guns, Policing, and Mental Health CrisesThe discussion explores the connection between America's lax gun laws and police killings, highlighting the role of training and the unique challenges posed by mental health crises. Sklansky offers insights on potential reforms and the influence of state and federal coordination in improving policing.(00:21:32) Chapter 6: The Role of Juries in DemocracyKarlan and Sklansky delve into the jury system as a cornerstone of democracy, discussing its impact on civic engagement, cross-sectional representation, and public trust. They highlight the need for systemic changes to improve accessibility, fair cross-section representation, and community participation in jury duty.

Special Counsel Smith's Report on Trump's Interference in the 2020 Election

In the early hours of January 14, 2024 the Department of Justice released its long-awaited election interference report against President-elect Donald Trump. It was a long and winding road to that moment—and one marked, ultimately, by justice delayed. In November 2022, Attorney General Merrick Garland appointed Jack Smith as special counsel to oversee criminal investigations by the Justice Department into former President Donald Trump's efforts to overturn the 2020 election and his retention of classified documents. The two cases were brought in different jurisdictions—with charges for the classified documents case filed in Florida and the elections case in Washington, D.C. After false starts, the blockbuster Supreme Court ruling on July 1, 2024 that former President Trump is entitled to some immunity from criminal prosecution for actions taken to overturn the results of the 2020 election, and the subsequent re-election of Trump in November, Smith and the DOJ dropped both cases. (Publication of Smith's report regarding the documents case is delayed due to pending charges against co-conspirators.) Connect:Episode Transcripts >>> Stanford Legal Podcast WebsiteStanford Legal Podcast >>> LinkedIn PageRich Ford >>>  Twitter/XPam Karlan >>> Stanford Law School PageStanford Law School >>> Twitter/XStanford Lawyer Magazine >>> Twitter/XLinks:David Sklansky >>> Stanford Law pageCriminal Justice in Divided America, Police, Punishment, and the Future of Our Democracy >>> Stanford Lawyer magazine online feature(00:00:00) Chapter 1: Introduction and the Role of Special ProsecutorsPam Karlan and David Sklansky discuss the history and purpose of special prosecutors, their use in politically sensitive cases, and the implications of their reports. Karlan and Sklansky explore the evidence presented, its connection to the January 6th events, and the debates around releasing such reports. Karlan questions the timing of appointing a special counsel, given much was already public knowledge.(00:08:25) Chapter 3: Prosecution Outcomes and Future ImplicationsKarlan and Sklansky discuss the slow progress of Trump's investigation compared to other January 6th prosecutions. They also cover Trump's promise to pardon convicted January 6th defendants, the fate of unnamed co-conspirators, and the ethical questions surrounding Todd Blanche's involvement at the DOJ. (00:12:16) Chapter 4: Decisions and Legal Strategies in Trump's ProsecutionKarlan and Sklansky discuss the decision not to charge Donald Trump with insurrection, focusing instead on charges like fraud and voter suppression. They analyze why the special counsel avoided certain charges and the challenges of applying existing statutes to unprecedented events.(00:16:30) Chapter 5: The Supreme Court's Role and the Impact on ProsecutionThe conversation explores delays caused by the Supreme Court, including its handling of presidential immunity. Karlan and Sklansky explain how these rulings affected timelines and created legal ambiguities that could influence appeals and the overall process.(00:19:00) Chapter 6: Restoring Trust in Criminal Justice and DemocracyKarlan and Sklansky shift focus to broader implications for democracy, discussing how Trump's prosecutions might deepen distrust in institutions. They consider paths to reform, including bipartisan efforts to reinforce the rule of law and community policing. The episode concludes with reflections on lessons from past legal leaders and the enduring relevance of Robert Jackson's warnings about prosecutorial overreach.

We dove into Evan's background as a poker player, how he looks to exploit biases in his investment process, and how he navigated the ‘20-'21 bubble in growth stocks as a short-seller and value-oriented investor. If you're interested in his work, check out his three letters with thoughts on the bubble (part I - birth, part II - anatomy, part III - apex -“We believe inflation is likely to be the catalyst that ultimately pops the everything bubble” from 2Q21).Books mentioned: The Theory of Poker by David Sklansky.I hope you enjoy the conversation as much as I did. You can listen to it on: Spotify, Apple, at anchor, and via RSS.Through Evan I also found this interesting research paper on poker players as investors: “our findings suggest that skilled poker players are, on average, better fund managers.”“Extant academic work shows that winning poker players are more patient and less susceptible to behavioral biases such as the disposition effect … “patience is rewarded” among winning poker players, and these players tend to avoid “overweight[ing] frequent small gains vis-à-vis occasional large losses.”However, it's not as simple as picking a prominent poker player and hedge fund manager. It seems that after winning public tournaments, these managers take in more capital which leads to a decline in alpha.

In the introduction to No Limit Hold ‘Em: Theory and Practice, poker theorist David Sklansky says that he held off from writing a book about NLHE for so long, because he would often see certain players win consistently, even though their style of play was not technical. The biggest winners were often players who had a feel for the game, understanding their own emotions and the emotions of the other players, being in touch with the moment and knowing how to interpret their intuitions. The game of poker may have changed over the years, however this principle rings true in many aspects of life. As hard as we try to follow the wisdom of our teachers, sometimes it might be justified to go against tradition. As hard as we try to follow our stated values, sometimes it is beneficial to defy them and discover some deeper value, some deeper wisdom. David Sklansky is one of the top authorities on the topic of gambling, author of several hugely successful books. He coined several commonly used terms - such as semi-bluff, implied odds, effective odds. Many of the poker theory concepts that David came up with 40 years ago are still relevant in your games today and maybe forever. He has rubbed shoulders with many of the greats in the industry. Poker players, casino owners, businessmen. In this conversation, David shares some great anecdotes from his encounters with Bob Stupak, Steve Wynn, Donald Trump, and many more. And we also talk about some big stories about cheating and collusion in live games throughout the years. David lifts the curtain up on what's been happening in Vegas in the 70s and 80s when the gambling industry there was still pretty much a wild-west.  Here are some of David's books: The Theory of Poker Applied to No-Limit - https://amzn.to/3eXGGzu Geeking, Grifting, and Gambling Through Las Vegas - https://amzn.to/32EKdxC DUCY? - https://amzn.to/2K23dzL Seven-Card Stud for Advanced Players - https://amzn.to/2IwUTYe   CONNECT:  Subscribe on YouTubel: https://bit.ly/runchuks-yt Subscribe to newsletter: https://www.runchukspodcast.com Twitter: https://twitter.com/RunchuksP Twitch: https://www.twitch.tv/runchukspoker Coaching: https://bit.ly/bts-coaching   PODCAST INFO:  Apple Podcasts: https://apple.co/2XlvTro Spotify: https://spoti.fi/2ECWIAF YouTube playlist: https://bit.ly/podcast-yt   OUTLINE: 00:00:00 Intro 00:02:36 How David Sklansky got into poker 00:10:57 The math and theory of gambling 00:18:10 Bob Stupak – the legendary casino owner 00:24:07 Trump - The Game 00:27:03 Ignorance 00:31:05 The Stratosphere Tower 00:37:23 Gambling exploits 00:44:13 The Theory of Poker 00:57:18 Logic and common sense 01:04:16 Thinking outside of the box 01:15:24 Smart people making mistakes 01:20:54 Think beyond the obvious 01:26:17 Covid research 01:27:47 Father 01:35:08 Finding exploits 01:40:43 The crooked games 01:49:33 Crooked WSOP champions 01:51:33 Mixed games 01:58:39 Cheating in poker 02:05:45 ROI on tournaments 02:08:19 Gambling ideas to find creative solutions 02:17:09 Solving problem of innocent people in jail, and other ideas 02:25:40 Larry Flynt story 02:33:22 Who was cheating and who was not 02:37:47 Collusion 02:40:35 Game selection 02:42:25 Cheating business 02:58:35 Poker Hall of Fame 02:59:41 All it takes is one chapter 03:01:44 Please don't ever say the word EV to me 03:03:19 Algebra and logic 03:11:39 Is Doyle Brunson still a winning player? 03:17:25 Bob Stupak running for mayor of Las Vegas 03:26:49 US elections 03:32:49 Floyd Mayweather story 03:38:03 Morris Chestnut story 03:41:37 What David got from poker 03:45:36 Maybe you better call a doctor 03:48:35 Steve Wynn story 03:54:28 Carl Icahn story 03:58:29 One good thing about not having a real job 03:59:18 Solving problems   If you liked this episode, you might also enjoy some of the following: Mason Malmuth - David's long-time friend and colleague. The two best poker rules you can incorporate into your new trading system

Professional poker players know (as best they can) the expected values of every hand they play. The best of them know what hands to play from what position. Like traders, poker players have to make decisions under uncertain conditions with imperfect information.  They know what the percentages are of their hands improving. For example, if they are dealt a pair of Kings, they know the probability of getting another King to make 3 of a kind (a set of Kings), or quads - four of a kind.  They know what the probability of making a straight if they have two connectors or making a flush if they have two cards of the same suit.  This allows them to the knowledge to know how to bet given the odds and the size of the pot. Yet it's still possible that they can do everything correctly and still lose the hand. That's going to happen quite a bit if you play a lot of poker.  Like in trading, you can become emotionally invested in the outcome of a hand. If you have a pair of Aces, you can get beat from time to time despite Aces being a strong pair.  Professional traders can learn a lot from this type of knowledge. If you trade long enough, you will get beat when everything looks to be in your favor.  I've been long stock that beat earnings estimates, but was greeted with a down market because of some external factor that took everything down with it - including my stock. Not fair you say? No one cares what my definition of "fair" is when trading. Nothing is fair. A good way to become mindful of what you could be in for is to study the winning and losing streaks from your backtested results. Most of them will tell you what you longest losing streak is (duration) and how bad it effected your equity (magnitude).  I think this will help you learn to build your confidence and put things into perspective.  The losing streaks that you'll have by trading a system will pale in comparison to those that you'll need to endure if you are day trading or trying to ready charts or "set-ups." Those are a thing of the past. The modern trader - the trader who is going to set himself up to win for the rest of this decade and into the 2020s will have 100% of his trading rules backtested, know the expected values, and have rules to eliminate sub-optimal trades, and have rules built-in to trade for the marathon of the next 20 years. That does not now nor will include trading based upon charts nor intraday data.  Firms are investing tens of millions of dollars to trade against the short term lovin' traders as they are easy to pick off and bully. Plus, in that space, there are a million suckers born every minute so you've been warned: don't be one of them.  Trading simulation software will allow you to vary start dates, the instruments that you are trading at any given time, how to measure volatility, and how to cut risk during losing streaks.  A great book on how to understand what a poker player learns to contend with is "Getting the Best of It" by David Sklansky.

On this week’s episode of Versus Trump, Jason, Charlie, and special guest Professor David Sklansky discuss the first shoe to drop from the Mueller investigation: the indictment of Paul Manafort and Rick Gates, and the guilty plea of George Papadopoulos. We begin [at 2:00] by describing the legal charges and the key factual takeaways from the charging documents. We're then [at 11:00] joined by Stanford Law Professor and former federal prosecutor David Sklansky to go in-depth on several key issues. We talk with David about the timing of the indictment and the guilty plea, whether Papadopoulos may have been an undercover cooperator, whether Manafort has any viable defenses or could plead guilty, and whether Mueller's job may be in jeopardy at some point down the road. Finally, Charlie and Jason resume their analysis [at 27:10] with a deep-cuts discussion of what these charges say about pretexutal prosecutions, and why Manafort is on house arrest while awaiting trial but many low-levels offenders around the country are not. Please share or provide feedback, and rate us in iTunes. He is part owner and produces educational poker videos for Stoxpoker, a subscription fee based poker coaching site.  After prepping at New Orleans, Louisiana's prestigious Isidore Newman School where Miller was a standout performer on the school's renowned forensics team and in the same graduating class as noted author Christopher Rice and American Idol finalist Judd Harris. He was a member of the U.S. Physics Team. Ed Miller received degrees in both Physics and Electrical Engineering from the Massachusetts Institute of Technology in 2000. Initially, Miller worked as a software developer for Microsoft. After many months of poker playing in the Seattle area, Ed moved to Las Vegas in 2002 where he met Dr. Alan Schoonmaker, the author of The Psychology of Poker . Schoonmaker introduced Ed to David Sklansky and Mason Malmuth of Two Plus Two Publishing, LLC.[3] Ed married Elaine Vigneault in 2005. In 2006, Miller was made over by the Fab Five of the Bravo television show, Queer Eye.  The Queer Eye summary: "You can't be in Vegas without running into a card shark and Ed is that card shark. But you wouldn't know it by looking at him. The wild hair, the overgrown beard, and the overall unkempt look keeps Ed from looking like the high roller that he is. He has a nerdy look but nerdy can be cool. Unfortunately, Ed hasn't gotten the 'cool' part. Even more unfortunate, Ed's parents lost their home during the wrath of Hurricane Katrina. This is a great time for our boys to 'make better' Ed and throw a poker tournament benefiting the relief efforts in New Orleans." After living in Manhattan for two years,  Miller now lives and works in Las Vegas.

In 1981, when even the biggest casinos refused him play, Cardoza gave up professional blackjack card counting and founded Cardoza Publishing, the largest gaming book publisher in the world. Cardoza is the home of a who’s who of authors in the world of gambling, including Doyle Brunson, Daniel Negreanu, T.J. Cloutier, Mike Caro, Tom McEvoy, Mike Matusow and Arnold Snyder. Cardoza is a five-time Gold and Platinum award-winning designer (48th annual awards, National Paperbox Association) and the author of the 432-page bible on publishing, The Complete Guide to Successful Publishing, which the Publisher’s Marketing Association called “the most comprehensive guide on publishing…maybe ever.” The Guide has laid the foundation for thousands of writers and publishers in bringing their dreams to fruition. Cardoza expanded his reach into the world of gambling in 2010 with the purchase of the Gambler’s Book Club (www.gamblersbookclub.com), rescuing a legendary gambling institution with a history dating back to 1964 when founders John and Edna Luckman first opened its doors. Publishers of more than 250 titles—including the first manual on hold'em poker, written by David Sklansky in 1976—and mentioned in over 1,000 others, the store has mentored untold numbers of authors, researchers, documentary filmmakers, and preproduction personnel from Hollywood and television during its almost 50-year history as the reigning authority on gambling publications. John Scarne, Walter Gibson, Sonny Reizner, and the great Harry Houdini are just a few GBC Press authors. Ex-mobsters, FBI agents, and law enforcement personnel regularly shop at Gambler's Book Club, as well as casino owners such as Steve Wynn, Jackie Gaughan, Bob Stupak, Carl Icahn and Jack Binion have patronized the store. In fact, pretty much anyone who was or is anyone in the gambling world has passed through the doors of the GBC. Nick Pileggi (Casino, Wise Guys), Jimmy Breslin (Damon Runyon biographer), and poker legends Brunson and Amarillo Slim are but a few of the memorable book signings that have taken place at the GBC. With the most extensive library of gaming books for sale anywhere, the GBC is an astounding 3,000-book superstore of gambling books—plus a wide range of biographies, Vegas interest items, Mafia titles, and popular games such as chess, backgammon and sudoku.
