Introduction or Abstract           Nancy Ross Gooch was a Black woman whose family—the Gooch-Monroes, owned most of Coloma, specifically the area around Main Street. Coloma, a small city in El Dorado County, is where James Marshall discovered gold at Sutter's Mill in 1848. If it weren't for her family's stewardship of the land, this town might not exist, yet Californians do not know her name. Children in Coloma and residents in the nearby towns of Placerville nor Sacramento know this important history. It is time to change this.           September 9, 1860, is California Admission Day. 2025 marks its 175th Anniversary. It is a perfect time to remember the life and legacy of this powerful Black woman who symbolized industry, intelligence, faith and forgiveness, Mrs. Nancy Ross Gooch (Aug. 1811-Sept. 17, 1901).            The way people live in the minds and hearts of future generations is by naming institutions after them, by erecting monuments, by continuing their work, by calling their names. In a state the size of a country, California should have more public art honoring its citizens, especially this women, California pioneer and citizen, Nancy Ross Gooch. Welcome to Supreme Court Opinions. In this episode, you'll hear the Court's opinion in Sheetz v El Dorado County. In this case, the court considered this issue: Is a monetary exaction imposed by a local government as a condition for a building permit exempt from the “essential nexus” and “rough proportionality” requirements established in Nollan v California Coastal Comm'n and Dolan v City of Tigard, simply because the exaction is authorized by local legislation? The case was decided on April 12, 2024. The Supreme Court held that the Fifth Amendment's Takings Clause does not distinguish between legislative and administrative land-use permit conditions. Justice Amy Coney Barrett authored the opinion for a unanimous Court, holding that the California Court of Appeal erred in holding that the Nollan/Dolan test does not apply to permit conditions imposed by legislatures. The Takings Clause requires the government to provide just compensation when it takes private property for public use, and this applies equally to all branches of government. Neither the text of the Constitution, the historical understanding of eminent domain (the power of the government to take private property for public use), nor the Court's own precedents support exempting legislatures from the requirements of the Nollan/Dolan test. This test, which is based on the unconstitutional conditions doctrine, requires that permit conditions have an “essential nexus” to a legitimate government interest and be “roughly proportional” to the impact of the proposed development. These principles apply consistently across physical takings, regulatory takings, and the unconstitutional conditions doctrine, regardless of whether the condition is imposed by a legislature or an administrative agency. Justice Sonia Sotomayor authored a concurring opinion, in which Justice Ketanji Brown Jackson joined, pointing out an antecedent question that was not raised in this case: whether the permit condition would be a compensable taking if imposed outside the permitting context. Justice Neil Gorsuch authored a concurring opinion to argue that the Nollan/Dolan test cannot operate differently when an alleged taking affects a “class of properties” rather than “a particular development.” Justice Brett Kavanaugh authored a concurring opinion, in which Justices Kagan and Jackson joined, clarifying that the Court has not previously decided—and in this case explicitly declined to decide—whether “a permit condition imposed on a class of properties must be tailored with the same degree of specificity as a permit condition that targets a particular development.” The opinion is presented here in its entirety, but with citations omitted. I've mentioned before that the land is our common denominator. We may have differing ideas and approaches but generally, at least in my experience on a local and regional level, people are willing to listen, make compromises, and change the way they do things if you take the time to talk through it with them and have it makes sense. My guest on this episode of All Land is Beautiful is Spencer Davies, owner and one of the directors at Trespasser Productions, a production company based out of Placerville, California. Spencer and I connected several months ago working on a video to highlight the legacy conservation project in El Dorado County, the El Dorado Ranch State Wildlife Area. I guess you could say that we clicked from the beginning, but not because we necessarily agreed on everything. I would say that is was more based on both of our willingness to listen and discuss our differing opinions on land management and conservation. This episode is a bit different from the rest as Spencer isn't a biologist or representing a conservation organization, but he instead represents what I think is a critical connection for nonprofits and government agencies working in land protection and natural resource management. One of the biggest challenges these organizations face is translating their work into something that the general public can see and interact with. Trespasser Productions has made a name for itself in the commercial industry, but has taken on more recent work with organizations like American River Conservancy, the El Dorado-Georgetown Resource Conservation District, Calfire and US Forest Service, taking a technical production approach to capturing and presenting grassroots community efforts. We talk through this, along with Spencer's upbringing, the beginnings and growth of Trespasser Productions and the how they've found success outside of the Hollywood scene, and how Spencer has found excitement and fulfillment supporting his community the best way he can, through film.

Adia White, News Editor at North State Public Radio unpacks the response to the wildfire, the lessons learned from previous blazes, and what comes next as residents begin to recover. This stoppage came at the start of a severe heat wave which has seen temperatures reach the triple-digits, and already led to the death of at least one person. The high court ruled that local “impact fees” imposed on newly constructed homes can be challenged in court. This is a significant win for property rights because these fees can add a substantial amount of money onto the price of a home.   The case began with a lawsuit by George Sheetz in California's El Dorado County. That's in the foothills heading toward Lake Tahoe. Sheetz is a 72-year-old retiree who applied for a permit in 2016 to build an 18-hundred square foot manufactured home on a small lot that is zoned for residential use. This week the Tahoe TAP podcast brings you Cody Bass, current Mayor of City of South Lake Tahoe and Founder/Executive Director of Tahoe Wellness Center. Cody Bass was born into cannabis, but ventured into cultivating cannabis at the age of eighteen in the hills of Mendocino. He purchased his first parcel of land at twenty five to cultivate cannabis. This property is now licensed with Mendocino County for the legal cultivation for Tahoe Wellness Cooperative. Cody founded Tahoe Wellness Cooperative in January of 2009 and continues to serve as the Executive Director. Mayor Bass was initially elected to City Council in November 2018. He was re-elected in November 2022 to serve a 4-year term. In December 2022, he was appointed to serve as the Mayor Pro Tem for 2023. During his 2023 tenure, he also served as a board member for the Tahoe Transportation District, PADMA, and the Lake Tahoe Visitor's Authority Board. Investigating California Jail Deaths CalMatters Reporter Nigel Duara discusses his investigation into jail deaths in the state which found that despite Gov. Sacramento City Council approves a bilateral ceasefire resolution. Also, how California is harnessing artificial intelligence. Finally, El Dorado County author and illustrator of “A River Called Home: A River Fable.” Sacramento Votes on Bilateral Ceasefire The Sacramento City Council passed a Gaza ceasefire resolution just before midnight on Tuesday, after hearing from dozens of public comment testimonies. Officials approved the resolution in a 6 to 1 vote, with only Councilmember Lisa Kaplan opposing it. Councilmember Mai Vang was absent, due to a previously scheduled commitment. The resolution was crafted by Jewish and Muslim leaders in the community, and formally calls for Israel to stop bombing Gaza and the West Bank, as well as for Hamas to end attacks against Israel. The proposal also urges the release of Israeli hostages and Palestinians who are held without charge - as well as denouncing antisemitism and Islamophobia. Joining us is Sacramento Mayor Darrell Steinberg and Basim Elkarra, Executive Director of the Sacramento Valley chapter of the Council of American-Islamic Relations (CAIR), to discuss last night's city council vote. California Testing AI for Efficiency California is harnessing artificial intelligence - using generative AI to ease traffic congestion, improve emissions goals, and increase safety on roadways. More than 400 celebrate historic Native American monument in Capitol Park honoring tribeson whose land the state Capitol now standsState marks Native American Heritage Month by unveiling 10thtribute in the park commemorating California heroes & protectors SACRAMENTO—On a cool, breezy Sacramento morning, more than 400 tribal members, dignitaries and students gathered to unveil the first-ever Capitol monument acknowledging tribes residing in California and their millennia-long, resilient presence on land now known as California.The historic tribute specifically recognizes the Sacramento region tribes of Wilton Rancheria, Ione Band of Miwok Indians, Chicken Ranch Rancheria of Me-Wuk Indians, Tuolumne Band of Me-Wuk Indians, Buena Vista Rancheria of Me-Wuk Indians, and Shingle Springs Band of Miwok Indians.The new monument is the tenth addition to a park memorializing California's firefighters, veterans, and public safety officers. It is the first addition to the park since 2009, when the statue of Thomas Starr King was brought to California from Boston. King was a Civil War-era minister, orator, and abolitionist. The park was envisioned in 1863 as a place to reflect and celebrate the state's history and natural beauty, according to the Capitol Park website. Assemblymember James C. Ramos—first California Native American elected to the Legislature since statehood in 1850—authored AB 338 in 2021, which authorized the monument.Ramos said, “This monument—now a centerpiece of Capitol Park—adds a new and long overdue chapter to California's relationship with its tribes. As a state, we are beginning to tell our history from a broader, more complete, and accurate perspective by including the voice of California Native Americans.” He added, “As Native Americans, we have been invisible, romanticized, minimized, or disparaged for centuries. That is not easily or quickly undone. But today I am proud to be Native American and proud to be a Californian.”The Miwok skirt dancer portrayed in the monument is modeled after William J. Franklin Sr., the late respected Miwok leader and cultural dancer. Franklin played a critical role in preserving Miwok dances and traditions, and helped build three Northern California roundhouses, dedicated spaces for Native American ceremonies, songs, dances, and gatherings. Sacramento sculptor Ronnie Frostad designed the project.“Mr. Franklin was a teacher of Native culture and he understood that our stories, songs, and culture need to be shared and taught to new generations,” Ramos said. “He would have been pleased to see so many students here, of all ages—and particularly proud to see students from a school recently named Miwok.” Until June, Miwok Middle School was named after John Sutter, who enslaved Native people during California's Gold Rush period.Wilton Rancheria Chairman Jesus Tarango stated, “Today's unveiling signifies the start of a new era at the California State Capitol. The FDA's old guidance required gay and bisexual men to wait three months following their last sexual contact with another man. With the new FDA guidance, all potential donors are now screened using a series of questions that assess individual risk of HIV, regardless of gender or sexual orientation. School Districts Approve Controversial Gender ‘Outing' Policy School board meetings have now become the public battleground over parental rights versus a child's right to privacy at public schools. Two school boards in recent weeks, including Rocklin, have passed controversial policies that would require teachers to identify transgender and gender non-conforming students to their parents. Originally from the Central Coast of California, Escobar currently resides in Cool, El Dorado County. He has been involved in the photography industry for decades, running the photography store Reflections on Broadway in Santa Maria. In addition to his photography work, Escobar is passionate about running and has participated in numerous races. He has also coached cross country, spending nine years at Righetti High School and six years at St. Joseph. The iconic Rubicon Trail is colosed. After what has been deemed an illegal closer done by El Dorado County Parks and Rec. The Board of Supervisors has retroactively approved the closer due to their granted power because of the county's State of Emergency. Now making the Rubicon Trail is closed for the next 60 to 120 days. Founder and CEO, Kim has always known she was destined to work with animals and has devoted her life to working in pet care. After living in Concord for many years, she relocated her family to Pollock Pines, CA, in 2016, to raise goats and (more) chickens. She has 4 cats and a dog as well. Kim splits her time between the Bay Area and El Dorado County to maintain a close connection with her sitters, her clients and their loving pets. This episode is an interview with Anthony Pedro Founder and Leader of Future Fire Academy and Benjamin Crew Executive Director of Failing Forward Youth Outreach. Two important non-profits that help both at-risk youth and rehabilitate formerly incarcerated individuals through mentorship and education.Ben Crew is a husband, father, firefighter, Executive Director of Failing Forward Youth Outreach Foundation, Ironman triathlete, Ultra-distance runner, a lifelong student, a formerly convicted felon, and a proud board member of Future Fire Academy. As a teen Ben struggled to find his place in the world.  He lost a brother to a heroin overdose and a sister to suicide.  In 2005, he was fortunate to find sobriety and people that were willing to love him until he was able to love himself.  Failing Forward Youth Outreach (FFYO) is a program dedicated to helping at-risk youth through motivational speaking and group discussion with firefighters and other community leaders. FFYO is a group of volunteers who are creating an invaluable impact on society by connecting Firefighters and community leaders to at-risk youth. Many FFYO volunteers have overcome adversity and recognize that adversity builds character.  We focus on the solution. This is accomplished through motivational speaking, group discussion, and mentorship. During Anthony's time in prison he was able to qualify for the California Correctional Center Fire Department where he spent three years at an all hazards station that responded off prison grounds.Upon Anthony's return home in 2018 he immediately applied to his local fire department.  Seeing the passion Anthony had to serve his community, he was offered a second chance as an Intern Firefighter Reserve.Anthony's story is not average. In fact, most firefighters returning home find it difficult to get back into the fire service for one reason or another. After seeing the need for job placement assistance in the fire service for those returning home after serving at fire camps and fire houses while incarcerated, Anthony knew he had to pay it forward. He had made it!Future Fire Academy is a nonprofit fire academy serving El Dorado County and Northern California.
