A former staffer filed a police report with both Capitol Police and the Office of Congressional Ethics against Rep. George Santos (R-NY), claiming the congressman sexually harassed him and promised employment while he was an unpaid volunteer. Monday, the incoming U.S. House majority passed new rules, which, among other things, guts the Office of Congressional Ethics.The Guardian and Washington Post report that while the new House leadership can say they didn't SHUT DOWN the bipartisan office, term limits were instituted for staff, likely to force out four professionals currently serving, and giving only 30 days from the beginning of the 118th Congress to find replacements. If they do find staff that quickly, four members now have to approve their hiring and compensation, so slow-walking it would sink the process.So, there may not be enough staff to conduct investigations on the members of Congress who refused to honor subpoenas from the January 6th Committee, or pursue inquiries into newly-sworn-in Congressman and apparent serial liar, George Santos. A January 4th letter signed by 25 pro-voter groups roundly condemned the move as eroding trust in government. QUOTE “Together these changes weaken OCE to the point where the office would struggle to perform its core function, dismantling one of the only ways members of Congress are held accountable for ethics violations.”With the Office of Congressional Ethics defanged, and the change in leadership for the House Ethics Committee, meaningful accountability for Congress is done – for now. Oh, sorry, wrong blood sport. That was U.S. Representative Kevin McCarthy, who was elected Speaker of the House early Saturday morning on the 15th ballot. It was, however, a slugfest, with ultra-Conservative Republicans in the Freedom Caucus, trading votes for key committee positions and rules changes. Such backroom deals are part of Congress.But what raised an alarm for Democracy advocates was a reported deal negotiated as part of Congressional business with a SuperPAC. Salon reports McCarthy openly negotiated with the Congressional Leadership Fund SuperPAC to NOT run and support more moderate candidates against Freedom Caucus-supported ultra-Conservative candidates for open primary seats.In a letter published by Politico, End Citizens United, a money-in-politics watchdog group, complained to the Office of Congressional Ethics, that QUOTE, “McCarthy and House staff acting on his behalf are using official resources to plan and direct campaign & political activities with federal super PACs” UNQUOTE, in violation of House rules, and that McCarthy and agents working on his behalf are directing the political decisions of Congressional Leadership Fund, in violation of the soft money prohibition of the Bipartisan Campaign Reform Act of 2002. In an executive order, Youngkin commanded all state enforcement agencies, boards, and commissions, to report the fines and disciplinary actions they imposed upon those individuals and entities. According to an official statement, a reimbursement process is in the works for his upcoming budget proposal. The governor also announced he will direct agencies to cease any further collection and enforcement of any lockdown-related fines, fees, or suspensions. "I am today requiring a statewide review of Covid-19-related penalties imposed by the Northam administration. The fact that businesses are still dealing with Covid-19 related penalties and fines is infuriating. Livelihoods are on the line," said Youngkin. "In the previous administration, we saw our government shut down businesses, close our schools, and separate us from each other. While we can't undo the damage done during the Northam administration, we are taking action going forward to end COVID-era draconian overreach." California is moving ahead with a bill that would offer gender-transition medical treatment not just to in-state children, but also to kids across America. If passed, California's "Trans Refuge Bill" would allow young people from other states to visit California to receive sex hormones, puberty blockers, and sex-reassignment surgeries. “What's happened is that there are a number of states that have recognized that these medical interventions are incredibly harmful,” says Erin Brewer, the co-founder of Advocates Protecting Children. But California has decided to “open its doors to people who want to access these medical interventions, even though their states have found them to be incredibly dangerous and worth blocking,” she added. Brewer is no stranger to the complexities of gender dysphoria, having herself once thought she was a boy as a child after surviving sexual assault. Today, Brewer says she is thankful she did not take medication or have surgeries to alter her body, and hopes more can be done to provide young people struggling with gender dysphoria counseling and other help they need. Congressman Alex Mooney is accused of accepting impermissible gifts, specifically a vacation to Aruba, in a report issued Monday by the House Office of Congressional Ethics. Demonstrators protesting Senator Manchin in downtown Charleston called on him to vote to end the filibuster. Seven of the protestors were arrested for disorderly conduct. Closing arguments have been delayed in the statewide trial of three opioid makers in Charleston. Investigations are underway after separate cases of bodies discovered, one in the Cheat River in Preston County and one along the Greenbrier River in Greenbrier County. I'm your host Day Al-Mohamed working to make sure you stay informed. In early January, the House of Representatives passed a package of changes to their standing rules. These changes would supposedly enhance the House's ability to exercise its €˜power of the purse'. (Congressman Morgan Griffith (R-VA)). Adoption of procedural rules is pretty normal for any new congress. However, House Resolution 5, which in addition to attempting to move the Office of Congressional Ethics under more direct Congressional control (and which received significant amounts of public outcry), there was also another provision that's received some media coverage in Washington, but didn't quite capture the same level of attention. The Holman Rule. The final version of House Resolution 5 includes the reinstatement of a very old Rule from 1876, called the Holman Rule. Let me start with some background. Congress tends to work along two tracks: authorizing and appropriating. Authorizing legislation is what we usually think of when we say legislation or bills. Congress members vote on language that authorizes specific events, agencies, projects etc. The second track, which most people might not realize is quite so separate is appropriations legislation which is where congress members vote on what to fund and how much to fund it. The Holman Rule is specific to the appropriations track. It allows lawmakers to bring an amendment to an appropriations bill directly to the House floor that retrenches (meaning reduces) expenditures by: the reduction of amounts of money in the bill; the reduction of the number and salary of the officers of the United States; or the reduction of the compensation of any person paid out of the Treasury of the United States. At its core, it would seem the rule is to address saving money and (from a historical perspective) was used to help get rid of corrupt customs officials. Let me give an example of this. In the 1932 Treasury and Post Office Departments appropriations, there was a provision that said: The offices of comptrollers of customs, surveyors of customs, and appraisers of merchandise (except the appraiser of merchandise at the port of New York), 29 in all, with annual salaries aggregating $153,800, are hereby abolished. The duties imposed by law and regulation upon comptrollers, surveyors, and appraisers of customs, their assistants and deputies (except the appraiser, his assistants and deputies at the port of New York) are hereby transferred to, imposed upon, and continued in positions, now established in the Customs Service by or pursuant to law, as the Secretary of the Treasury by appropriate regulation shall specify. . . . So now that you have an idea of how it works, let's look at how things can get complicated. The goal of the rule is to take care of bloated expenditures and to ensure that the executive branch can address poor actors when it comes to agencies. This is about accountability and it allows any rank and file member to focus on specific programs and offices they deem to be wasteful. An example cited by the Washington Examiner (and if anyone has an example given by a legislator who voted for the amendment I'd prefer that), is the story of Elizabeth Rivera of Puerto Rico. She worked at the Department of Veterans Affairs. After pleading guilty to involvement in an armed robbery she was able to get her job back with the agency and win back pay for the period when she had been off the job. I have to admit, I think that would be great use of the Holman Rule. But does it also risk skewing the executive branch of government and its agencies more and more towards the political?

Republicans must remember that they will need to employ legitimate strong-arm tactics to save the country by repealing Obamacare, reforming immigration and refugee resettlement, and reclaiming power from the unelected judiciary. Why expend it on an issue that is nearly impossible to message to their constituents? Ultimate, it would have been better for Republicans to make these changes more gradually and in broad daylight. Nonetheless, on the substance of the Office of Congressional Ethics, the Republican majority was correct. As bad as corrupt members are, the corruption of falsely accusing people of corruption without due process is even worse. Ultimately, it is up to the FBI to investigate criminal charges and up to the members themselves – led by the standing Ethics Committee – to police violations of House rules and ethics. That is why we have elections. The media is being very dishonest, evincing the notion that this office is somehow enshrined into our laws. It was in fact created not by statue but by the very same House rules process Republicans are using now. The unelected body stocked with progressives worked with left-wing groups to try people in the court of public opinion without the accuser having to divulge his name and without informing the member of the investigation. Even members of Congress deserve the right to defend themselves and be afforded due process when being investigated by their political enemies on the taxpayer dime. The existing structure of the Ethics Committee in the Senate and what used to be in place before Pelosi in the House afforded basic due process rights such as witnesses, right to counsel, etc. to members. With that said, it would be one thing if Republicans took a principled stance on other more consequential policy issues. But if this turns out to be their only bold stance of the month – while shirking their responsibility to fully repeal Obamacare and defund the UN – this will prove once again that they have not changed from their modus operandi as the stupid party. Ultimately, Republicans were forced to retreat amidst backlash, as always. Just months before the grueling 2014 congressional election in the 17th Congressional District between Democrats Rep. Mike Honda and Ro Khanna was nearing its climax, a former Honda congressional staffer was blowing the whistle on Honda's alleged commingling of officials and campaign duties. Ruchit Agrawal, the then-Honda staffer, provided internal emails to the Office of Congressional Ethics showing the alleged improper actions, including one that could potentially lead to the end of Honda's 16-year political career this November, if found true. On this week's East Bay Citizen Podcast, Agrawal, however, has surprisingly kind words for Honda and says the incumbent congressman is not unethical as his challenger Khanna suggests. Agrawal also refutes other aspects of the allegations routinely used against Honda in the media, including the allegation that a list of campaign donors was crosschecked with the congressional office to offer additional and improper personal benefits to the contributor.

In this Commentary, Josh Chafetz responds to Paul M. Thompson's criticisms of his proposal for a Congressional ethics oversight body. Chafetz argues that Thompson's position relies on the inapplicable paradigm of criminal law as a model for ethics enforcement. Instead, Chafetz claims, "Congressional ethics is not simply about punishing rulebreakers; rather, it aims to promote public trust in Congress and its members." Under this framework, "it is clear not only that our current system is in shambles, but also that the creation of Congressional Commissioners would be a useful corrective."
