The MK Party has dismissed the decision of the Western Cape High Court stopping it's Parliamentary leader Dr. John Hlophe from serving on the Judicial Service Commission as politically driven. In a statement released YESTERDAY evening, the party says it will appeal what it called a 'horror' judgement. It says it will do whatever is necessary to prevent the sitting of the JSC scheduled for Monday 7th October 2024 without Dr. Hlophe..Hlophe, formerly judge president of the Western Cape division, was the first judge to be impeached in democratic SA's history. Freedom Under Law (FUL) says it will legally challenge the Judicial Service Commission's (JSC's) "inadequate" reasons for only filling two of four vacancies at the Supreme Court of Appeal - and snubbing two candidates who it described as "excellent". FUL made the decision to seek a review of the JSC's SCA appointment process after reading the reasons that the commission provided to the Council for the Advancement of the SA Constitution (Casac) about why it only filled half of the Appeal Court vacancies during interviews held last month. "FUL has studied these reasons and is of the view that the reasons are inadequate, and do not address the significant public concerns which were raised about the appointments in the immediate aftermath of the interviews," it said in a statement. "FUL has accordingly resolved to take the JSC's decision in relation to the appointments to the Supreme court of Appeal on review, and is instructing its legal representatives accordingly. As a courtesy, FUL has advised the JSC [of this] today." In a letter sent to Chief Justice Raymond Zondo, the chairperson of the JSC, FUL's Judith February explained that the organisation "has significant concerns about the process followed by the JSC, and the ultimate appointment recommendations" during the SCA interviews. "Accordingly, FUL has resolved to take the JSC's decision on review," she said. That legal action will force the JSC to fully disclose the nearly four hours of deliberations that resulted in the commission appointing Judges Fayeeza Kathree-Setiloane and Maleshane Kgoele to the SCA. While Kathree-Setiloane was clearly a favourite among commissioners (having received 20 votes from a pool of 23 commissioners), the JSC's letter to Casac reveals that some commissioners were "not convinced" by the answers that Kgoele gave in her interview, "and whether these reflected an adequate grasp of legal principles". Those reasons also revealed that unsubstantiated claims of racism and arrogance blocked widely respected Judge David Unterhalter from being appointed to the SCA. The judge had not been asked to address any of these accusations during his interview. Despite being described by SCA Deputy President Xola Petse as one of the "heavy lifters and lawyers of substance" that the Appeal Court desperately needs, following the retirements and promotions of its most senior judges, and being praised for his erudite rulings and solid work ethic, Unterhalter was not appointed to SA's second most powerful court. The only explanation for that non-appointment appeared to lie in unsubstantiated racism claims. "Some commissioners stated that Judge Unterhalter is not a team player and appears to be arrogant and even 'racist'. These allegations were considered by some commissioners to be without substance and baseless," the JSC stated in its letter to Casac - without providing any further details of these claims or who had made them. The JSC also noted that some of its commissioners had considered Gauteng High Court Judge Thina Siwendu - who had competently handled a number of high-profile cases and had much-needed experience as a commercial lawyer and business rescue expert - as "an excellent candidate" who had "written cogently on questions of transformation of society and rule of law". Despite this, "some" unnamed commissioners felt that Siwendu did not have enough experience as a High Court judge, the JSC told Casac.

In the spring of 2019, two women in the Jewish community met and discovered that they shared a mutual need. Despite their experiences of personal healing, and despite supportive connections with family and friends, they each lived with their individual secret. With nobody else to share and identify with, loneliness and isolation were a burden that did not get any lighter with the passage of time.   Thus, the realization dawned that perhaps at times even more meaningful than professional help, survivors and their families need community. This week we are joined by Mike Langone. Mike is the singer for Nippertown based band Black Belt Jones, the promoter of Upstate Punk Rock Flea Market and the bone artist behind Odds, Sweet Things and Dead Ends. "You can't focus so much on why, it's more like how I can make things better", says Langone about his struggles with addiction. Langone made his way to Nippertown via the Lower East Side of Manhattan more than twenty years ago.  Langone took his experience and turned it into a career. First as a CASAC (Credentialed Alcoholism and Substance Abuse Counselor) and now as a Housing Specialist for an Albany, NY based non-profit who helps the homeless population.  Langone expresses how much his life has changed from living the life of an addict. Council for the Advancement of the South African Constitution (CASAC) executive secretary Lawson Naidoo argued on Friday that South Africa's electoral system should be determined by voters and not by political parties. He was speaking in Johannesburg during the Electoral Reform Indaba, organised by CASAC, My Vote Counts, Rivonia Circle, the Ahmed Kathrada Foundation and Defend our Democracy. Naidoo said given the inherent conflict that political parties had in choosing "the rules of the game" – as political parties determined the electoral system in Parliament – voters were left on the margins. He said the voter should determine the electoral system, whether through a comprehensive and satisfactory public participation process or through a referendum. “But as voters, the electoral system is ours, it does not belong to political parties. It is there to facilitate our participation in choosing our representatives and, therefore, we should have a say in that system itself,” Naidoo asserted. He said the country had an electoral system that detached people from what happened in Parliament and from what happened in society. He added that this was something citizens needed to turn around. “And that is why the reform of the electoral system is such a critical aspect of allowing us to facilitate the re-engagement of people with the politics of the country. Not necessarily by becoming members of political parties but by engaging in the political discourse and being able to feel confident that when you go to the ballot box your vote does count and is going to make a difference,” he said. ELECTORAL AMENDMENT BILL The Electoral Amendment Bill currently before Parliament did not facilitate free and fair elections, especially for independent candidates, Naidoo also argued. He said the current electoral system was twisted such that it did not accommodate independent candidates, and explained that the list system was unsuitable. “The reality is that if you are going to be able to effectively accommodate independent candidates, you need a constituency system of some sort, whether it be of a single member constituency, or even as the Van Zyl Slabbert report recommended, a multi-member constituency. It creates, firstly, a closer nexus between MPs and the electorate in that constituency, and secondly it gives independent candidates a better chance of winning seats than the current system does,” he explained. THE STATUS QUO Naidoo said there was deep reluctance by all political parties to change the status quo, albeit for different reasons. “The bigger parties want to hang on to the control that they have over their MPs . . . You fail to toe the party line, you will be removed from office. MPs, therefore, prostitute their oath of office to the party that puts them there rather than acting in the best interest of the people and the country,” he explained. He added that the current proportional representation list system allowed smaller parties a level of representation that they may otherwise not have under a different system. “So they too benefit from the current electoral system.” Naidoo highlighted that all of this was visible in the decrease in levels of confidence in elections and in the country's democracy. He mentioned that if one looked at the statistics of voter turnout at elections in recent years, it should be a deep cause for concern for all citizens, especially young people who seems to be opting out. He noted that in the 2019 elections, of the 9-million eligible people who were not registered to vote, 6-million of those were aged between 18 and 29 years. He supposed that number had probably increased in the three years since.

She emphasizes how codependents often become “rigid” in the way they interact with others where they lack flexibility. Can you relate? Yuliya opens up about ways she was raised in a collectivistic culture which contributed to her codependency since she learned to think of others more than herself.  Yuliya shares examples of feeling codependent with her own children when she was a new mom. She talks about practicing self-care, however, how she “wasn't present and I was thinking about my kids the whole time.” THIS IS SUCH A GREAT OBSERVATION, YES? Just because we start to take care of ourselves and stop being such codependendummies does not mean that we won't experience self-doubt, anxiety, or difficulties in creating new and healthier patterns.  Yuliya then describes how motherhood can be the fertile soil of codependency. Since infants are so dependent on their mothers, it's possible that a mother may become codependent with her children if she keeps putting their needs before her own.  We conclude with Yuliya sharing about ways new moms can avoid being codependent with their children through AWARENESS. She provides some great questions for all of us to reflect on to help us become conscious of our codependent interactions. She also shares ways we, as young women, can combat codependent relationships with our mothers even if we are way older than infants!  Questions for you: What comes up when you hear Yuliya's examples of codependency? The Council for the Advancement of the South African Constitution, CASAC, has applied to the Johannesburg high court to declare unlawful interviews held by the Judicial Service Commission for candidates for the Constitutional Court.  It says that after obtaining a transcript of the JSC's confidential deliberations when it shortlisted the candidates in April, it became clear that they were a 'sham'.  CASAC says it showed there were "no deliberations at all” and it has also asked the court to have the list of recommended appointments set aside. For a while now we heard mention of Lashawn's therapist Amanda Davis, well today she's here to join us as we discuss the mental health of black men, breaking the stigma of going to therapy and her new program called “Crown Your King” where we acknowledge men for doing great things within our community. With the heartbreaking tragedy of losing Oluwatoyin Salau a Black Lives Matter activist who disappeared on Saturday, June 6, 2020, shortly after tweeting about being sexually assaulted the guys challenge themselves by figuring out all the ways to protect black women going forward in hopes this will never happen again. With the heartbreaking tragedy of losing Oluwatoyin Salau a Black Lives Matter activist who disappeared on Saturday, June 6, 2020, shortly after tweeting about being sexually assaulted the guys challenge themselves by figuring out all the ways to protect black women going forward in hopes this will never happen again. Some political analysts say the criticism leveled against specifically the political party list of the ANC, is a sign that voters are maturing. The Independent Electoral Commission has received objections to 53 candidates appearing on the political party lists of nine political parties. The ANC's list contains names of those who have been implicated in allegations of state capture. But in terms of the Electoral Act and the Constitution, from a legal point of view these individuals do qualify to become members of Parliament. Meanwhile Council for the Advancement of the South African Constitution says the legal grounds for formally objecting to the inclusion of particular candidates on the Parliamentary lists are extremely and inappropriately narrow. The Council for the Advancement of the South African Constitution (CASAC) has raised concerns about the role and status of a panel of experts set up to review and weed out laws passed since 1994 that are hindering transformation. Parliament's Independent Advisory Panel, chaired by former president Kgalema Motlanthe, includes former Justice minister Bridgette Mabandla, former Reserve Bank governor Tito Mboweni, land issues expert Dr Anika Claasens, former FirstRand Group CEO Paul Harris and former Auditor General Terrence Nombembe will review the legislation, assess the implementation, identify gaps and propose actions in this regard over the next twelve months. We spoke to CASAC's Executive Secretary, Lawson Naidoo....
