What's top of mind when attorney Adam Guetzow thinks of the legal and regulatory issues swirling around nursing homes in 2023? Dealing with the realities of perpetually understaffed regulatory agencies — and the potential impact on operations, finances and reputation that can come when surveyors have too many buildings to cover. “We need to confront the issues that they're dealing with and make sure that we're protecting ourselves,” says Guetzow, co-practice group leader of Hinshaw & Culbertson's healthcare practice and an expanding aging services group. In this episode, Guetzow offers specific tips for operators — such as reconsidering your stance on appealing denials of payment for new admission — that might help you weather the storm affecting survey agencies nationwide. It's part of a wide-ranging legal conversation moderated by McKnight's Long-Term Care News Senior Editor Kimberly Marselas.

For decades, companies have used a just-in-time inventory model to reduce excess supply and create a lean production process. But recently, we've seen firms take a more conservative approach with a just-in-case supply used to avoid running out of stock. The pandemic-induced devastation of supply chains put a spotlight on some of the challenges we face and exposed vulnerabilities in the just-in-time model. Does this mean the just-in-time process is no more? What lessons have we learned and what more needs to be done to ensure reliable on-time delivery of goods?   To answer these questions and discuss future inventory management strategies, Host Jonathan Betz sits down with Greg Plemmons, Sr. VP of Sales for Old Dominion Freight Line, and Bob Costello, Chief Economist, and Sr. VP of International Trade Policy and cross-border operations for the American Trucking Associations.   Key Takeaways:   Greg describes the common disruptions in the current supply chain and the lessons shippers have learned over the last three years. [1:12]   Bob shares the idea of a just-in-time-plus model and offers an optimistic outlook for keeping systems up and running during brief lags. [2:18]   Greg highlights the benefits of a close relationship between shippers and their carriers. [3:52]   Bob reflects on the e-commerce trends over the past three years and future-casts business shipping and inventory needs, based on personal consumption data. [5:18]   Beyond a solid relationship with their carrier, Greg details the steps shippers can take to manage changes and mitigate risk. [8:31]   Bob shares competitive data on the important role surface transportation plays in the shipping industry. [9:31]   Greg and Bob weigh in on what will make the just-in-time method work for suppliers and the value of acknowledging drivers. [11:58]   Bob and Greg discuss the challenges and changes of bringing manufacturing back to the U.S. in the near future. [15:22]

Demotion vs. Promotion CPD Propaganda

Chicago Justice Podcast

Chicago Police Department (CPD) officials are experts at using the promotion of officers to the maximum benefit of the agency. Of course when the script if flipped and they have to announce a demotion of a high ranking commander their lips are sealed even though their is a vital public interest in knowing why the official was demoted. The current practice within the CPD to not comment on demotions only provides fuel to drive the rumor mill about why the demotion occurred. In this most recent case the CPD's 1st District Commander Jacob Alderden was demoted by Supt. David Brown. The CPD has said nothing about why he was demoted given that he was promoted just 18 months ago and was the recipient of the CPD's highest honor in 2018 for his actions in a hospital shooting. The CPD's silence has allowed rumors to go public including one that has the demotion tied to Supt. Brown demanding a squad car be placed in front of his favorite restaurant to guard it during an weekend of unrest in Chicago. Another rumor involves the Mayor but since it has not been published I will not repeat repeat it here. Demotions of high ranking officers are of vital public interest especially for those that are concerned with police accountability in Chicago. It is pretty clear that officers within the agency do not trust management at any level. They believe there is always some massive conspiracy behind ever promotion and demotion. The way to counter this is being transparent about each demotion so that the public and the officers can understand the underlying facts surrounding any demotion of high ranking officials and trust the decision making process within the agency. Without it every demotion, whether justified or not, just fuels the distrust between the agency and its officers as well as the public. Modern Digital Applications with Lee Atchison
Five Causes of Poor Availability

Modern Digital Applications with Lee Atchison

Play Episode Listen Later May 20, 2020 11:07

Building a scalable application that has high availability is not easy. Problems can crop up in unexpected ways that can cause your application to stop working and stop serving your customer’s needs. No one can anticipate where problems will come from and no amount of testing will identify and correct all issues. Some issues end up being systemic problems that require the correlation of multiple systems in order for the problems to occur. Some are more basic, but are simply missed or not anticipated. Links and More Information The following are links mentioned in this episode, and links to related information: Modern Digital Applications Website (https://mdacast.com (https://mdacast.com)) Lee Atchison Articles and Presentations (https://leeatchison.com (https://leeatchison.com)) Architecting for Scale, published by O’Reilly Media (https://architectingforscale.com (https://architectingforscale.com)) Application availability is critical to all modern digital applications. But how do you avoid availability problems? You can do so by avoiding those traps that cause poor availability. There are five main causes of poor availability that impact modern digital applications. Poor Availability Cause Number 1 Often, the main driver of application failure is success. The more successful your company is, the more traffic your application will receive. The more traffic it receives, the more likely you will run out of some vital resource that your application requires. Typically, resource exhaustion doesn’t happen all at once. Running low on a critical resource can cause your application to begin to slow down, backlogging requests. Backlogged requests generate more traffic, and ultimately a domino effect drives your application to fail. But even if it doesn’t fail completely, it can slow down enough that your customers leave. Shopping carts are abandoned, purchases are left uncompleted. Potential customers go elsewhere to find what they are looking for. Increasing the number of users using your system or increase the amount of data these consumers are using in your system, and your application may fall victim to resource exhaustion. Resource exhaustion can result in a slower and unresponsive application. Poor Availability Cause Number 2 When traffic increases, sometimes assumptions you’ve made in your code on how your application can scale are proven to be incorrect. You need to make adjustments and optimizations on the fly in order to resolve or work around your assumptions in order to keep your system performant. You need to change your assumptions on what is critical and what is not. The realization that you need to make these changes usually comes at an inopportune time. They come when your application is experiencing high traffic and the shortcomings start becoming exposed. This means you need a quick fix to keep things operating. Quick fixes can be dangerous. You don’t have time to architect, design, prioritize, and schedule the work. You can’t think through to make sure this change is the right long term change You need to make changes now to keep your application afloat. These changes, implemented quickly and at the last minute with little or no forethought or planning, are a common cause of problems. Untested and limited tested fixes, quickly thought through fixes, bad deployments caused my skipping important steps. All of these things can introduce defects into your production environment. The fact that you need to make changes to maintain availability, will itself threaten your availability. Poor Availability Cause Number 3 When an application becomes popular, your business needs usually demand that your application expand and add additional features and capabilities. Success drives larger and more complex needs. These increased needs make your application more complicated and requires more developers to manage all of the moving parts. Whether these additional developers are working on new features,...

What is the backlog and who does it affect? What is the visa bulletin and why are there so many charts? What does this mean for the future? Steve Miller, Feige Grundman, and Lisa Felix answer all of these questions in relation to those seeking the coveted EB-1 visa, and its path to permanent residency in the U.S. They explain what to look for in the monthly visa bulletin, how to read the chart, and provide strategies to better position yourself in line for a green card. Then, they take out the immigration crystal ball and predict the future.
