When I read Daniel's biography, I was so impressed with what he has achieved. He admitted to me that his successes were a surprise to him and he could never have imagined the path his life has taken. In fact, he was a high school dropout.Daniel Garza was born in the Central Valley of California, and would migrate with his family annually from their ancestral hometown of Garza Gonzalez in Nuevo Leon, Mexico- throughout California, Nebraska and Washington State following the crop season as farm workers until he was 19 years of age.Daniel Garza began his public service career as congressional staff assistant for U.S. congressman Richard "Doc" Hastings and was later elected as councilman for the city of Toppenish, Washington in 1996. In 2001, he was tapped by the George W. Bush Administration to serve as Deputy Director of External and Intergovernmental Affairs in the Office of the Secretary at The Department of Interior, and was appointed in 2004 to Associate Director of the Office of Public Liaison in the White House. In 2007, Daniel joined Univision to host and co-produce "Agenda Washington", a weekly Spanish-language news talk show covering the issues impacting the U.S. Hispanic community. Mr. Garza was appointed to serve on the Board of The Harvard Journal of Hispanic Policy in 2016, was designated as one of Washington, D.C.'s “Influentials” by Congressional Quarterly Magazine in 2018, and in 2019, Daniel was named 1 of the 50 most influential voices in Washington DC by The National Journal. San Jose’s Raza community has a rich history and tradition of impactful community organizing that goes back to the 1950s and the founding of the local chapter of The Community Service Organization led by Cesar Chavez, Dolores Huerta, Blanca Alvarado, and many others. The emergence of United People Arriba and La Confederacion de La Raza Unida led by Ernestina Garcia, Sofia Mendoza, Rachel Silva and Joaquin Brito in the ’60s led to further political and economic empowerment, culminating in today having 5 members of La Raza, including three women, serving on the San Jose City Council. One activist who remains on the front lines is Danny Garza who can be described as a gadfly: “a person who interferes with the status quo.” Whether the issue is environmental racism, quality of life issues, economic development, gang problems or a host of other issues, Danny is the champion of East Side neighborhood associations in the Plata Arroyo, Cassell and Mayfair areas, people who live like the residents of Sal Si Puedes (get out if you can) barrio did 60 years ago: unequal, forgotten and invisible. Danny possesses the energy, enthusiasm, and a sense of righteous indignation that calls to mind the line in the Teddy Pendergrass song “Wake Up Everybody”: “ The World won’t get no better if you let it be. Wake Up, Everybody!”

Associate Justice, Bobbie Hantz Marconi wrote for the majority who affirmed the Circuit Court's ruling on all counts, Chief Justice C.J. Lynn and Associate Justice Patrick Donovan concurred “We conclude that the Laconia ordinance does not classify on the basis of gender. The ordinance prohibits both men and women from being nude in a public place….That the ordinance defines nudity to include exposure of the female but not male breast does not mean that it classifies based upon a suspect class. ...The ordinance merely reflects the fact that men and women are not fungible with respect to the traditional understanding of what constitutes nudity.” ”Applying the standard, we have little trouble concluding that the defendants have not carried the heavy burden of mounting a successful facial attack to an ordinance analyzed only for rationality. The stated purpose of the ordinance is to uphold and support “public health, public safety, morals and public order.” “ “The dissent faults us for seeking guidance from other courts in ascertaining whether Laconia's ordinance classifies based on gender. However, as demonstrated by the lack of any meaningful discussion of our precedent in the dissent, we have little in the way of help from our own cases in answering this question.” Although there exists no express authority for a city to enact anordinance prohibiting females from exposing their nipples, RSA 47:17, VII(2012) grants the city the power “[t]o regulate all streets and public ways,wharves, docks, and squares, and the use thereof.” Further, RSA 47:17, XIII (2012) grants the city the power “to regulate the times and places of bathing and swimming in the canals, rivers and other waters of the city, and the clothing to be worn by bathers and swimmers.” In addition, RSA 47:17, XV (2012) gives the city the power to “make any other bylaws and regulations which may seem for the well-being of the city” so long as “no bylaw or ordinance” is “repugnant to the constitution or laws of the state.” Justice James Bassett wrote for the dissent, who concurred in part and dissented in part, Justice Hicks joined We agree with our colleagues in most respects: Laconia's ordinance does not violate the defendants' rights to freedom of speech and expression; it falls within the regulatory authority of the City of Laconia; it is not preempted by statute; and it does not violate RSA chapter 354-A. However, we part company with the majority when it rejects the defendants' equal protection claim. We strongly disagree that rational basis is the lens through which the defendants' equal protection challenge should be analyzed. Laconia's ordinance facially classifies on the basis of gender: if a woman and a man wear the exact same clothing on the beach, on Laconia's main street, or in a backyard “visible to the public,” the woman is engaging in unlawful behavior — but the man is not. The majority acknowledges — as it must — that under the New Hampshire Constitution, gender-based classifications trigger strict scrutiny. Yet the majority declines to apply strict scrutiny in this case, reasoning that, because “men and women are not fungible with respect to the traditional understanding of what constitutes nudity,” the Laconia ordinance does not classify on the basis of gender. The conclusion that the ordinance does not classify on the basis of gender, and therefore can be analyzed by applying the rational basis test, does not find support in the plain language of the ordinance, the New Hampshire Constitution, or our precedent. That the ordinance classifies on the basis of gender is self-evident. The ordinance defines “nudity” differently for females and males. By the plain text of the ordinance, a person who appears in a public place showing “the female breast with less than a fully opaque covering of any part of the nipple” violates the ordinance; a male who appears in the same public place without such a covering does not. Laconia, N.H., Code of Ordinances ch. 180, art. I, §§ 180-2, 180-4 (emphasis added). The challenged portion of the ordinance creates a public dress code which only one gender can violate. This is a gender-based classification. The ordinance's stated purpose is to uphold and support “public health, public safety, morals and public order.” Laconia, N.H., Code of Ordinances ch. 180, art. I, § 180-1 (1998). In the trial court, the City asserted that because the defendants were topless, they caused a “disturbance” which “has the potential for violence.” The City also asserted that, because people think of “female breasts in a sexualized manner,” topless women may present other beachgoers with “a mental health issue.” Turning to the ordinance's other stated purposes, “morals and public order,” the City argued to the trial court that women who do not cover their nipples act contrary to “the City's character” and “morals as determined by the city council.” However we, like the United States Supreme Court, “have never held that moral disapproval, without any other asserted state interest, is a sufficient rationale under the Equal Protection Clause to justify a law that discriminates among groups of persons.” https://www.seacoastonline.com/news/20190208/nhs-highest-court-upholds-topless-ordinance https://www.courts.state.nh.us/supreme/opinions/2019/2019012lilley.pdf Suggestions/Feedback Do you have a topic that you would like for us to discuss? In this episode, Al interviews Daniel Garza, HIV advocate, public speaker, and podcaster. From the age of 13, Daniel hid his sexuality until he was "outed" to his family at age 17. He started drinking in his mid-teens and was heavily addicted by the age of twenty, doing crack and cocaine on a regular basis. At the age of thirty, Daniel was diagnosed with AIDS, at the age of 45 he was diagnosed with anal cancer, and at the age of 47 he was diagnosed with diabetes. Daniel speaks very openly about these physical ailments, as well as his mental health and the diagnoses of anxiety, depression, and health-related PTSD. 16 years AIDS survivor, started volunteering shortly after being diagnosed, sharing his story at schools to students interested in health and social services. Over the years he has taught to about 2500 - 3000 students a year. From the Texas Valley, Houston to Orange County. Personally dealing with drugs & alcohol, now clean & sober for about 10 years. Anal cancer survivor for about 2 years and living with a colostomy, he continues to educate students in high school, junior colleges and university about; HIV prevention, cancer, colostomies, depression, PTSD, while fighting stigma and the taboos in the Latino community. In 2016 he became a California certified HIV tester and counselor, he also works with rehabilitation programs in the Orange County area offering education to both staff and residents. As well as leading the Laguna Beach HIV Advisory Committee as chair for the third year. He hopes to one day be allowed to stand in a national stage and share with a larger Latino audience and open their minds and instigate an open conversation about sex, sexuality, and prevention.

El tema que nos ocupa el día de hoy es sobre la reforma constitucional al artículo tercero, mal llamada reforma educativa, puesto que en el aspecto pedagógico no habrá modificación alguna ni tampoco en referencia a planes de estudio y disposiciones administrativas. Además nuestro conductor Eduardo Lara Peniche, acompañado del abogado Joaquín Martínez Moreno y un gran talento estudiantil en materia política, Daniel Garza, explican: ¿Por qué obligan a padres de familia a pagar cuotas escolares?, ¿qué medidas pueden tomar los tutores ante esta situación?, ¿esta reforma tiene objetivos ocultos?
¿Por qué la reforma educativa es tema de interés para los maestros del sindicato y padres de familia?
