Professor Abdullahi Ahmed An-Na'im is the Charles Howard Candler Professor of Law Emeritus at Emory Law, associated professor in the Emory College of Arts and Sciences, and senior fellow of the Center for the Study of Law and Religion of Emory University. A world-renowned scholar of Islam and human rights and human rights in cross-cultural perspectives, An-Na'im teaches courses in international law, comparative law, human rights, and Islamic law. His research interests include constitutionalism in Islamic and African countries, secularism, Islam and politics and human rights. Our conversation was inspired by his latest book, Decolonizing Human Rights, which challenges both historical interpretations of Islamic Sharia and neocolonial understanding of human rights. Abdullahi proposes a transformation from human rights organised around state-determined practice to one that is focused on what he calls a “people-centric” approach that empowers individuals to decide how human rights will be understood and integrated into their communities. This argument serves as the starting point for our conversation on the complexities, paradoxes and cultural dimensions that challenge a traditional Western perspective on human rights and invites inquiry into what a decolonized, culturally-inclusive alternative might look like. Welcome to The Georgia Politics Podcast! On the show today we discuss another recent SCOTUS ruling that will have far reaching implications on environmental regulation, but didn't get as much publicity as some of the higher profile rulings last term. Sackett v. Environmental Protection Agency was a case decided over the summer that dealt with the scope and limitations of the Clean Waters Act. The case was focuses in large part on defining terms like "waters of the United States", “adjacent”, and “wetlands”. While nuanced and seemingly ambiguous to the non-lawyers listening to the show, the definitions are critical in giving guidance on where developers can build, what permits property owners need receive prior to building, and what properties are protected and regulated by the government. Geoff Toy, an environmental lawyer with Trustees for Alaska, joins the show to help us understand some of these nuances and explain why the case may have not gotten as much attention as some of the others, despite its far reaching impact and its implications. About Geoff Toy Geoff joined Trustees for Alaska in August 2022. Prior to joining Trustees, Geoff spent three years as a staff attorney with the Turner Environmental Law Clinic at Emory University School of Law, working on land use, pollution, and agricultural issues in the Southeast and helping teach environmental law students. He also worked in civil litigation in Atlanta, Georgia after graduating from Emory Law in 2016. During law school, Geoff worked in the Turner Environmental Law Clinic and also interned with the environmental law department at Coca-Cola. Outside of the office, Geoff likes to read, cook, hike, and paint. In addition to some other civil rights anniversaries, 2021 marks 50 years since the Supreme Court decided Younger v. Harris. There, the Court made it extremely hard for federal courts to stop an unconstitutional state prosecution. This “Younger abstention” doctrine has been with us ever since. Professor Fred Smith of Emory Law joins us to discuss what Younger's impact has been and how it has especially made it difficult to fight state court systems that have become de facto debtors' prisons. John Williams, Principal of the Williams Law Group and President of IncNow.com I sat down with my colleague and fellow Emory Law graduate, John Williams, to talk about the differences and challenges of driving both a law firm and an online incorporation business. We spoke about trends in the legal industry and peered into our respective crystal balls about the direction of Delaware corporate law and the opportunities and issues that entrepreneurs face. What percentage of the day is spent lawyering and what percentage is spent running Incnow? What is does your law practice look like? Delaware Corporate law; we hear about other jurisdictions -what is still advantageous about incorporating in Delaware? Corp v. LLC v. Partnership- what steps should people go through in deciding which entity to use? If I’m from New York or any other state, why would I have my business entity incorporated in Delaware? Talk about the formation of your business Incnow- what need does your your business fulfill? Having a law firm to deal with nuance associated with Incnow makes a lot of sense . . . Does that component get used a lot? Technological hurdles? Staffing hurdles? Compliance issues? Challenges of running law firm v. start-up business?  Benefits and challenges of being located in Delaware? Facebook's Mark Zuckerberg using LLC instead of a foundation for his charitable arm?  Will we see that more? http://charitylawyerblog.com/2015/12/15/llcs-as-philanthropic-vehicles/ In addition to traditional S and C Corps, What about B-Corps also known as “Public Benefit Corps” that are chartered to have a broader purpose beyond shareholders- emerging trend or fad? Increased scrutiny of entities and shell companies; increased banking laws and Treasury scrutinizing property purchases - what are you seeing in your business?  What appears to be on the horizon on this front?  (See some of my commentary on the subject from a past article here- Anonymity and Real Estate) Delaware has always had a competent and efficient judiciary which is one of the attractions for many companies locating their corporate situs there . . .What else is Delaware doing to innovate?
