This is a topic we've wanted to discuss since early 2019, but teaching stints in Helsinki, and a global pandemic pushed it back almost three years. But we did not forget about the topic of The Right to Be Forgotten! However, in that time, even the phrasing of the topic has changed to The Right to Erasure. Our guest, Anne Klinefelter, Director of the Law Library and Henry P. Brandis Distinguished Professor of Law, catches us all up on the current issues surrounding data privacy and the Internet both here in the US, as well as in the EU. Klinefelter's view of privacy is that while we haven't done a great deal of work to protect individual's privacy in an economic model based on surveillance capitalism, we have done some things. Her vision of the future is that the Internet still has the capability of being the Utopia we once hoped it would be, but it will probably get far worse before it gets better. And those who benefited from the weak data privacy regulations may end up being the very people who come in and change it for the better. We also talked with Molly Huie from Bloomberg Law about the 2022 DEI Framework survey which is now open for law firms. Molly lists out a number of new data points included in the framework, including neurodiversity, origination credit, and partnership tracking topics in law firm diversity efforts.                              The Inimitable Rod Crosby          The Intruders was a rock band formed in El Paso, Texas on 1960. The original members were Rod Crosby, Les Lockhart, Donnie Webb and Bobby Wilson. Bobby Wilson, younger brother of Bill Wilson, drummer for the Rock Kings, started the group. The Intruders first gig was a Texas Western Kappa Sigma dance at the Downtown Hilton Hotel. Their pay was $40  ($10 per person). From that time in 1960 until 1973, Rod Crosby emerged as the band's leader. The original members dropped out along the way. It became known as Rod Crosby & The Intruders, and Rod played full time until 1973, when Rod sought employment in the corporate world. In that 13 year period , the Intruders performed consistently, booked every weekend, and played hundreds of jobs at almost every high school in El Paso, all the NCO Officers Clubs on Fort Bliss, Biggs Air Field, McGregor Range and White Sands Missile Range, countless weddings, college parties, private parties and graduation parties. The group was fortunate to have evolved during a time when the Rock & Roll industry was thriving, growing leaps and bounds. The groups appeal was based off their ability to cover tunes precisely for dancing, always lending themselves to the desires of the audience, as opposed to the band.                     Having performed for thousands of people for the past 60 plus years - Rod Crosby & The Intruders is one of a very few that can make that claim.               In 2009, an entity called the Border Legends of El Paso was created to honor any and all local musicians with a body of performing work over a long period of time.                                          The Border Legends of El Paso entity staged a non-profit concert, annually, to pay tribute to El Paso's musicians, past & present, net proceeds going to charitable causes. The annual concert was produced by Rick Kern and Rod Crosby (co-producers).                      Rick and Rod both had connections to the Bobby Fuller Four. In 1965 Rod was asked by Bobby Fuller to consider joining his group. Rod painfully declined due to his many obligations. The Bobby Fuller Four went to Hollywood to make their mark which they did with I Fought The Law, and more.               However, Bobby was killed due to foul play, shrouded in mysterious circumstances, an unsolved murder to this day that remains on the E channels 10 Most Unsolved Murder Mysteries.                           Two members of the Bobby Fuller Four joined Rod's band not long after the tragedy. Rod picked up the bands musical torch and performs many of the Bobby Fuller Four songs to this day, as well as many of Buddy Holly songs, Buddy being Bobby's and Rod's greatest influence, unknown to either until it was discovered later as friends.                     Current members of Rod's Intruder band are drummer, Rick Benites, bassist, Ed Clore, guitarist, Paul Dillon, guitarist/keyboardist, Rick Armstrong and guitarist Rod Crosby. All members are vocalists, as well. They are still in great demand with many of El Paso's annual high school reunions. He comes from a small town in New Mexico, and is making his way through this world one film or short film at a time. He also had a dog but doesn't anymore! Alex Henderson grew up in Calabasas, played football and graduated from Norther Arizona University. After many concussions he decided to leave the world of sports in pursuit of story telling. He suffers from night terrors and sleepwalking. Harold White, Jr raised in Nashville, TN grew up around 10 brothers and sisters, one of the most positive people in the world, and always knew he was a go-getter since walking at the age of 6 moths. Playing baseball could've paved the the way for his future but storytelling has always been his greatest gift. Alan Chapell returns for the second installment of a two-part series about GDPR (General Data Protection Regulation, and the CCPA (California Consumer Privacy Act). This week, we cover what you need to know in terms of how both will affect brand and human reputations, the right to be forgotten, and what we all sign up for when visiting a digital site. We also talk about being aware of what we post publically, how/if people can really get their private data off public sites, and what’s next in the Wild West of this digital frontier.   Takeaways: [3:49] Alan shares a story about a bank sending him way more data than he needed for a direct mail campaign. This goes to show that our information is not always in the hands of a company that is willing to protect it at all costs and that Facebook isn’t the only business sending out the information of people that they think is protected and private. [9:00] We discuss the Right to Be Forgotten, and the Future of Reputation. When we click yes to agreeing to the “Terms and Conditions,” oftentimes we give up the right to sue, and give up a significant percentage of our rights just by being on the digital platform. [10:20] What goes on Facebook, stays out there in public way after we can delete that one photo. When people post on FB, to a certain degree they are willingly making it now part of the public domain. [13:25] It can be difficult, labor-intensive, and expensive to try to get search engines to remove information. You have to show that it is causing harm, intrusive, inappropriate or problematic in some fashion. [19:10] The same way you can review your credit score and work to dispute false claims or issues, we should have the same right to have our online information reviewed and assessed if it is causing issues. [32:18] Sometimes it’s a data leak, but sometimes it’s companies making bad decisions and deciding to “stalk” their customers. Your phone may power up, but if your service is dead, that could be SIM hacking. Crooks have penetrated operations of the big 4 cell provider to hijack service. Because of the Equifax data breach, criminals know who has money,  target individuals and steal their phone service via phone to usurp 2-factor authentication text codes so they can penetrate financial accounts. The go in a setup wire instructions to send money overseas where it can’t be reclaimed. While financial companies investigate, you’re broke. Get the anti-fraud guarantees and / or written fraud policy info from your financial institutions. Verizon, T-Mobile, Sprint and AT&T have been scrambling to come up with new preventive procedures. Two carriers have gone to no porting meaning you put in place a standing order not to port your number from that carrier. This is another layer to protect your identity, and existing accounts, whereas credit freeze helps prevent fraudulent new accounts.  There’s is a fake grass-roots organization called Free and Fair Market Initiative. The WSJ reports this outfit is principally backed by the Simon Property Group – the big owner of malls around the country, suffering from Amazon taking 6% of retail market share. In addition to Simon, they’re funded by Walmart and  Oracle (a web service competitor). There are plenty of reasons to talk about a company legitimately without sullying their reputation falsely because you’re afraid of the competition. Shame on Simon Malls, Walmart and others, funding an effort to slam Amazon. Two years ago there was a scandal involving Vizio TVs spying on viewers – collecting and selling data to aggregators for ad servers. Piercing people’s privacy, Vizio figured out how to monetize viewing. Update: That problem has gotten worse. The average Americans spends 3.5 hours a day in front of a TV. Since Vizio faced minimal consequences, now other TV makers are up to the same thing including Samsung, TCL and LG.  These makers account for most of the TVs sold in the US. Princeton came up with software to track how this is done. Data houses link up what you watch with your phone,  computer and even purchase activities. Laws designed to protect us are not being enforced. DC’s emersion in senseless partisan battles creates a vacuum that allows for enormous violations of our privacy. Europe’s Right to Be Forgotten gives citizens there the right to shut down data harvesting. It follows the story of a 17-year-old boy seeking to have his past misdeeds forgotten online and the obstacles he faces in doing that. Host Angelique Carson recently got a preview of the play and afterward interviewed director Seema Sueko in this episode of The Privacy Advisor Podcast.

The episode begins with the Governor telling someone to throw something on and stay in that position. As he enters the room, we hear him zipping up his fly. He explains he was out walking the parapet. Lamarr reminds the governor he was to find a new sheriff and was bringing him in for an introduction. Lepetomane takes one look and realizes Hedley has lost his mind. He even asks, "Are you crazy? Can't you see that man is a ni?" Lamarr assures the governor that such a progressive move as appointing a black sheriff might get him a cabinet post! It appears Hedley Lamarr is dangling every carrot he can to win the support of the governor. Lamarr gets a sudden bolt of inspiration and nearly chokes on his mint. As we end the episode, Hedley and Bart arrive at the Governor's office. He is no where to be found, but we can hear a woman giggling and him saying, "Not in the ear!" Hedley announces his arrival. Lepetomane asks if it is important to which Lamarr says it is extremely crucial. Julia and Ellen have been focusing on the right to be forgotten ("RtBF") for several years, and have done laudable work seeking transparency from its foremost actor, Google [disclosure: I was one of the signatories to the referenced letter]. The RtBF is a prime example of the clash of privacy, information, information platforms and power in technology today, and getting one's head around its complexity requires an interdisciplinary understanding of technology law and policy.
