Delaney Engler was nominated as a Beck's Player with Heart for her commitment and passion on and off the field and court. The thing she loves most about high school sports is the team aspect and the positive culture that it provides. Living in a small community has allowed her to play multiple sports with several of her classmates. This core group of girls has not only served as talented teammates but also lifelong friends. She is extremely grateful for the incredible opportunities that she has been introduced to throughout high school sports. Competing at such a high level alongside her best friends is an experience that she will truly never forget. Throughout her high school career, Delaney has had successful varsity careers in volleyball, softball, and basketball. Additionally, she currently serves as her school's FFA chapter president and the Southeast District FFA treasurer. She is also involved in the National Honor Society, and Student Council, and serves as her 4-H Club secretary. Through living in a small community, Delaney has had multiple opportunities to lend a helping hand to charitable organizations. Specifically, she spends the majority of her summer volunteering with youth sports league organizations and providing sports lessons. It is exciting for her to be able to help grow the athletic skills of young athletes in her community. Additionally, she volunteers at the local ballpark concession stand and Easter Egg Hunts when needed. She has also had the opportunity to volunteer with Café on Vine through her 4-H club and serve meals to the less fortunate. To Delaney, agriculture serves as the traditional backbone of America. Without the agriculture industry, consumers would not be able to eat food, wear clothes, drive their cars, and so much more. The practice of providing products for the American people will never become insignificant. The work ethic that farmers showcase to provide for consumers is truly admirable. Being raised on a diversified livestock and crop operation has taught her firsthand the work that goes into the agriculture industry day in and day out. After graduating high school, Delaney plans to attend Illinois Central College to obtain a transfer degree in animal science and compete on the livestock judging team. This week, I discuss with my colleagues, Dr. Richard E. Engler, Director of Chemistry for B&C and The Acta Group (Acta®), our consulting affiliate, and Kelly N. Garson, Senior Associate for B&C and Acta, our recently released book, titled Chemical Product Law and Supply Chain Stewardship: A Guide to New TSCA, published by the American Bar Association. As listeners know, as a law firm and consulting firm, we do a lot of work under the Toxic Substances Control Act (TSCA) and have gained a significant amount of hands-on practical knowledge about the law, the 2016 Lautenberg Chemical Safety for the 21st Century Act amendments to it, and the transformative impact these amendments have had on business transactions. We set out a year or so ago to write a book that explains TSCA through a business transactions lens. Of course, we explain the law, but we really write as business counselors to enable the regulated community -- importers, chemical producers, finished product manufacturers, distributors, and chemical users -- to be TSCA aware. The law has become, whether you like it or not, an important factor in virtually every business decision. My conversation today with Kelly and Rich focuses on several of their chapters in the book, and they explain how they approached writing a book about a law from the perspective of the business community. This week, I discuss Toxic Substances Control Act (TSCA) developments with my colleague, Dr. Richard E. Engler, Director of Chemistry for B&C and The Acta Group (Acta®), our consulting affiliate. The U.S. Environmental Protection Agency's (EPA) implementation of the 2016 Frank R. Lautenberg Chemical Safety for the 21st Century Act amendments has been a dynamic, evolving, and unpredictable work in progress for almost nine years. Given the new Administration, we are at a most uncertain time because of the lack of clarity regarding what the new leaders at the Office of Chemical Safety and Pollution Prevention (OCSPP) will do to address new chemical review concerns, risk evaluation under TSCA Section 6, and risk management actions resulting from those evaluations. As listeners know, all final risk management rules are being challenged and the disposition of those cases is the subject of considerable speculation. So also is OCSPP's consideration of not yet final risk evaluations and how the new Administration intends to interpret TSCA Section 6 in general. There are growing calls for legislative action to remedy some of Lautenberg's deficits, particularly in the area of new chemicals, another important variable that is destabilizing the status quo. Activist and author Yves Engler has been jailed by Montreal police for criticizing media figure Dahlia Kurtz and her support for Israeli atrocities in Gaza, after Kurtz said Engler's comments made her feel “afraid for my safety”. After Engler wrote about the charges against him, he reported that he was subsequently charged for “harassing the police” by drawing public attention to his case. It's fascinating how everyone who supports Israel always collapses into playing the victim at the earliest opportunity—even western police forces tasked with persecuting Israel's critics. In this episode of the Journey of My Mother's Son podcast, I talk with Joe Engler. Joe played for our organization back in 2003.  He was on our Atlantic Collegiate Baseball League (ACBL) team between his sophomore and junior seasons at Minot State University in North Dakota.  I refer to him as one of my old players, but he never actually played a game for me, he just played in our organization.  He was one of the players who I really connected with while he was with us. Joe and I talk about the life lessons that the game of baseball taught him and how he is using them today in both his work and personal life.  Joe is now an Associate Professor and Director of School Psychology at Gonzaga University. Dr. Engler received his BA in psychology at Minot State University in Minot, ND and his Ph.D. in school psychology at The University of South Dakota in Vermillion, SD. Dr. Engler began his professional career as a school psychologist in Tooele, UT and remains active in the profession through advocacy and leadership at the local, state, and national level. Dr. Engler holds the Nationally Certified School Psychologist credential through the National Association of School Psychologists and is a diplomate in school neuropsychology through the American Board of School Neuropsychology. His research interests include preschool assessment, critical evaluation of psychometric tests, and parental involvement. Joe recently co-authored his second book titled, “Essentials of Addressing Infants, Toddlers, and Pre-schoolers.”  It will be released in early April of 2025. We wrap the conversation up by talking about Joe's recent love for playing music.  He, his wife, and a group of friends recently started the cover band, Close Enough, in which Joe plays lead guitar. Joe was also inducted into the Minot State University Hall of Fame in September of 2024. Engler has received a New York Foundation for the Arts Fellowship in drawing, and an Adolph and Esther Gottlieb Foundation grant in painting. She has been the recipient of two MacDowell residencies, a Yaddo fellowship and a fellowship at Civatella Ranieri, In Umbria, Italy. She spent 2 months in Antarctica as an awardee of a National Science Foundation Antarctica Artists and Writers Grant. Her work has been written about in Art in America, The New Yorker, and The New York Times, among other publications, and she has shown in galleries across the U.S. and in Europe. Her project, A Year on Broadway, was featured on CBS Sunday Morning. Her book, A Diary of the Plague Year: An Illustrated Chronicle of 2020, Metropolitan Books/ Henry Holt/ MacMillan) was published in 2022. Engler lives and works in New York City. Those of us in the Toxic Substances Control Act (TSCA) community know asbestos occupies a special place in TSCA's checkered past, and EPA's final rule is an important chapter in that book. Whether you care about asbestos or not, by any independent standard this final rule is a big deal for several reasons. There is no better expert than Rich Engler to discuss with me what this rule does, what it tells us about EPA's approach to risk management under TSCA, why it is relevant to any chemical undergoing review by EPA, why in all probability neither industry nor the non-governmental organization (NGO) community is happy, and why litigation may well be in our future. Engler, Director of Chemistry for B&C and The Acta Group, our consulting affiliate, the super-hot topic of per- and polyfluoroalkyl substances (PFAS) reporting under the Toxic Substances Control Act (TSCA). PFAS, the class of so-called forever chemicals, are the talk of this town, and likely the talk of many jurisdictions given the intense global scrutiny all things PFAS endure. Rich and I focus our broad ranging discussion on federal TSCA reporting under TSCA Section 8(a)(7).
