No, David Waldman did not watch the speech, or the Oscars, or the Super Bowl, all right? (The TV's been stuck on the History Channel since David lost the remote.) Greg Dworkin is still on Skype, which is now shutting down, forcing an alternative. Greg will be choosing between Zoom or his dial-up fax machine in the basement, whichever has the most pleasant ringtone. Donald K. Trump presented his State of Denial “address”… It was a “Joint Address” to the Gops who love humiliation, and the Dems, who are learning to. Of course, some Democrats boycotted, but most did not. Some had signs, most did not. Al Green stood up, and was ejected. The rest chose not to join him. Expediency seems to be the hill they have chosen to die on, and there's certainly little disarray there. With Democrats keeping a low profile until 2026 2028 2030… it once again falls upon Trump to do all the heavy lifting. The plan has always been to keep the masses just at the precipice of an uprising, but this administration might be slightly overplaying their hand. (Yes, Steve Inskeep is on Blue Sky) Trump tariffs might sink the stock market, but don't worry, rich people will still get rich even when poor people get poor. Trump's tariffs might hurt Trump voters, but Trump doesn't need them to vote for him anymore. It will take a lot more than mere poverty to ever cool their ardor, though. (Yes, Will Jordan is on Blue Sky) Anyhow, each passing moment is another opportunity to declare victory and completely reverse course, faster than a bro can change his Zyn pouch. DOGE lists 443 federal properties up for sale, because why work in a building that you own, when you can rent it? NVM... the list went away.  Trump is halting enforcement against corporate lawbreakers. Who says he doesn't have empathy for his brethren? However, the Trump Supreme Court says 5-4 that Trump has to follow contractual obligations. Is it too late for Donald to get a full refund on John Roberts?

A concert attendee filed suit against a band's lead singer based on the singer's alleged "onslaught" of blows to the attendee's face, head, and body over a dispute. However, the singer's claimed that the confrontation only became violent when the attendee threw the first punch.  Notable Timestamps [ 00:25 ] - The singer tendered the suit to his insurer, who agreed to defend under a reservation of rights, but is there a duty to defend? [ 01:25 ] - Seventies, eighties, nineties? The crew chats concerts. [ 02:30 ] - This scenario is based on New York Marine and General Ins. Co. v. Ness, 2021 WL 510624 (E.D. Cal. 1/12/21), linked below. [ 03:30 ] - "Four Corners" means looking only at the Complaint, and "Eight Corners" means looking at the insurance policy as well. Both phrases refer to ignoring outside evidence and focusing on the claims made for the purposes of determining the Duty to Defend. [ 04:30 ] - The court determined that the insured's claims raised a factual issue about the insured's intent. The exclusion for Expected or Intended Injury would not apply in cases of self-defense. [ 05:45 ] - The court found that when there are extrinsic facts from the insured, it is incorrect to assume that only the attendee's allegations matter, so they found a duty to defend. [ 06:15 ] - Courts might sometimes punish "creative pleading", but nevertheless often Complaints will include allegations of negligence, which in this case would have prevented a coverage dispute. [ 08:30 ] - States treat "extrinsic evidence rules" differently. Texas courts allow evidence that solely addresses coverage and does not contradict the facts in the Complaint. This scenario would fail the second prong. [ 09:45 ] - Florida would not permit an insurer to allege extrinsic evidence to dispute the duty to defend, whereas Hawaii or New York might. Some caselaw suggests that if an exclusion clearly applies, extrinsic evidence may be allowed. [ 12:20 ] - Expediency drives many of these rules, as well as insurers' decisions between Declaratory Judgment and denial. [ 13:20 ] - One South Carolina case required an insurer to look at extrinsic evidence. [ 14:30 ] - Can an insurer use an endorsement to permit the introduction of extrinsic evidence in disputes about the duty to defend? A Washington court has yet to answer this question in Developers Surety and Indemnity Co. v. Alis Homes, LLC, 2018 WL 1792182 (W.D. Wash. 4/16/18), reviewed at PLRB, Com. Liab. Ins. L. Her work has been published in The Paris Review, the VQR, and The New England Review. She's won a Pushcart Prize and an Elizabeth George Foundation Grant for fiction and has been a finalist for the National Magazine Award. She holds an MFA in Fiction from Washington University in St. Louis.Malavika Kannan is a queer fiction writer who graduated from Stanford University in 2024 with a minor in Creative Writing, where she served as the Creative Writing peer advisor. Her work appears in Washington Post, Teen Vogue, and elsewhere and her YA novel was published by Little & Brown in 2023. From the Chappell-Lougee and Major Grants to the IDA fellowship and the Honors in the Arts program, Malavika feels thankful for the many opportunities at Stanford to nurture her craft and all the people who supported her. Malavika feels very grateful to her mentor Nina Schloesser Tarano, a Jones Lecturer, for all her support. Nina Schloesser Tárano was born and grew up in Guatemala City. She received her MFA from Columbia University. Her work has appeared in Fence and The New Inquiry Magazine. She was a Wallace Stegner Fellow in Fiction 2010-2012, and has been a lecturer in the Stanford Creative Writing Program since 2012

Gernot Wagner is a climate economist at Columbia Business School. His research, writing, and teaching focus on climate risks and climate policy. Gernot writes a monthly column for Project Syndicate and has written four books, including Geoengineering: the Gamble and Climate Shock. Before joining Columbia and serving as faculty director of the Climate Knowledge Initiative, Gernot taught at NYU and Harvard. In this conversation I kept coming back to this hope that climate action could be, in some ways, uncomplicated. If the primary goal is to stop greenhouse gas emissions as soon as possible in order to deal with this as a genuine emergency, it should be simple. But, within the existing system of global capitalism that we have, though, how is that going to happen? Can it happen? I've been trying to think about this by having conversations with people like Gernot, people like Kyla Tienhaara, Seth Klein, Mark Paul and others to try to get to the bottom of it. It's tough, but these interviews, which I'll release in the coming weeks, have been helpful. We're at a point where, according to economists like Robert Pollin, at least 1-2 per cent of global GDP will need to be spent pretty much immediately on investments in renewable infrastructure to radically reduce emissions. Global GDP is about $80 trillion. How does that amount of globally coordinated investment happen under capitalism? It's a huge shift in the nature of the whole economy. One of the reasons I wanted to return to Wagner's writing is that I've been helped a lot by his explanation of the social cost of carbon, and especially by the way he writes about considerations of equity and justice in determining the social cost of carbon. It radically increases the social costs, or damages created, by emissions if we factor in issues of equity. The number skyrockets, validating any and all investments in climate mitigation and adaptation. How could that sort of information become more central to decision-making and policy-making? We definitely get into the weeds here. I'm still processing the discussion we have about “green growth” vs. the “Green New Deal” vs. degrowth. I still can't say where I land on the question of whether decarbonization needs to happen in a textbook degrowth way. It's hard to balance expediency and strategy here, and yet, increasingly, the debate about economic transformation to fight climate change hinges on our receptivity to growth or degrowth. What I like is that there is room here for the debate. We need to rapidly phase-out fossil fuels. That much is certain. In fact, we need to fully ban fossil fuels. How that decision gets made and what form action takes—at what speed and with what consequences—is still an open question.

Israel has formally recognized Morocco's sovereignty over the territory of Western Sahara. For Morocco it was a great diplomatic achievement. For Israel it was an obvious condition for warming the diplomatic ties with the Moroccan kingdom.The United Nations and a large part of the international community still don't recognize Moroccan sovereignty over Western Sahara, but nevertheless Morocco wants legitimization to its occupation of the lands and their valuable natural resources. Former Ambassador Alan Baker, the director of the Institute for Contemporary Affairs at the Jerusalem Center for Public Affairs and a former legal adviser for the Foreign Ministry, spoke to us about the diplomatic expedience of Israel's move. Shady Acres Baptist Church was founded over 100 years ago in the edge of a neighborhood called the Heights. The first church was located at 2104 Bevis in Houston, Texas. Bro. Jack Wood was called in as pastor in the summer of 1974. The church began to grow and after remodeling the building several times, it was decided the church would move to a larger facility. The church bought Inwood Baptist Church on 7330 Vogel in 1985. It was not very long until the new church building on Vogel began to fill up; so for several years, Bro. Wood gathered the men on Saturday night to pray for the corner lot that was next to us. After praying and dealing with the owner of property, God gave us a green light. We bought that property and soon started building an even bigger building on the corner of Victory and Vogel. Because he had a desire to build the building debt free, it took seven years to complete the project. In 1992, Bro. Wood had to have open-heart surgery. The next year he developed diabetes. In 1995 he retired and the church called Bro. Danny Farley as their pastor. Brother Wood traveled for several years until he became very ill and passed away November 12, 1998. Missions was always Bro. Wood's heartbeat. He taught us all to love missions and to give until it hurt. Millions of dollars have gone to foreign fields from this church. It continues to be our main objective.
