A reading and commentary on Dr. Edwin Vieira's By Tyranny Out of Necessity: The Bastardy of Martial Law, Chapter 4, Section 3. The discussion revolves around the themes of liberty and security, drawing on historical and contemporary contexts. The episode begins with a Samurai maxim, "After the victory, tighten your helmet strap," attributed to Toyotomi Hideyoshi, a Sengoku Jidai warlord who rose from peasant roots to become a de facto leader before Tokugawa Ieyasu's victory at Sekigahara. Hideyoshi's philosophy of preparing for future challenges even after victories is emphasized, highlighting the nature of change and impermanence. The episode then transitions to contemporary political changes, noting favorable shifts towards liberty in December 2024 but also recognizing opposing forces, such as attacks on private property and ongoing global conflicts. The speakers stress the importance of warriors expecting the unexpected and practicing mindfulness, sensory clarity, and equanimity. A significant portion of the episode is dedicated to discussing Dr. Edwin Vieira's book, "By Tyranny Out of Necessity, the Bastardy of Martial Law," which explores the concept of martial law and its implications. The speakers outline the plans and policies for martial law, emphasizing the constitutional remedies available and the role of the Second Amendment in supporting a well-regulated militia. They argue that decentralized, localized execution of law prevents tyranny and highlight tools of liberty like jury nullification, secession, and revolution. The episode delves into the theory of martial governance, where military deployment imposes law and order, potentially leading to the suppression of legitimate governments by rogue officials. The speakers discuss the authority of the occupant in occupied territories, the potential for martial governance to override constitutional protections, and the imposition of censorship, control of communication, and restriction of movement. The speakers also address the potential for a national paramilitary police state, justified by emergencies and war powers, and call for refutation of legal arguments for martial law and governance. They emphasize the importance of martial arts training, armed self-defense, and the need for the public to be organized, armed, and disciplined to maintain constitutional order. Today marks exactly 1,000 days since I joined the army. This means the full-scale invasion has been ongoing for 1,001 days. I insist on this term full-scale invasion because the war began much earlier on the winter of 2014. This was not 1,000 days ago, but 3,926 days ago. This 1,001 days mark the time when the war affected all Ukrainians region, not only the homes of residents of Crimea and Dansk, but literally everyone. Yesterday, I wrote a piece on Substack about how this war was perceived 1,000 days ago by people like me, civilians, who decided to challenge the Russian onslaught and volunteered for the Army. You can read that piece. There is a link to it in this episode's description. Here I will just briefly summarize it. We were very naive and genuinely believed this could all end quickly. End naturally with our victory. But it's important to include the perspective of professional soldiers, or at least who had experienced fighting Russia in Albas in 2014 and the following years. Here's the thing, they also thought it would be relatively quick. However, from where point of view, this "quick" scenario was entirely different from what we imagined. Professional soldiers in those early days did not go out to win, but to die. They went to buy the country time to evacuate government institutions and military reserves closer to the western border. They- and alongside them us- were supposed to act as a break on the Russian army, slowing their advance with our lives. Slow down, not stop. The idea was that by the time the invaders could come closer to a few Western regions where the remnants of state apparatus evacuated to these invaders would already be exhausted and more likely to negotiate. But things turned out very differently. But anyway, this is far from over. A long war still lies ahead.
Curious about the legalities that surround everyday mishaps? Join us as we explore these fascinating topics with Michael Mulligan, a seasoned Barrister and Solicitor from Mulligan Defence Lawyers. We kick off by dissecting a real-life incident where a woman sustained serious injuries after tripping in a pothole at a 7-Eleven parking lot. Michael offers a deep dive into the Occupiers Liability Act in British Columbia, emphasizing the critical need for a reasonable system of inspections and maintenance to counter negligence claims. We'll also touch on the nuances of exceptions, such as for trespassers and specific rural or recreational properties. Our discussion then shifts to a compelling estate dispute involving a father's will and his three daughters. The youngest daughter, despite being raised in a well-off environment by her aunt and uncle, felt emotionally abandoned by her biological father. This emotional complexity led to a court decision enforcing equal distribution among the daughters, stressing the moral obligation of adequate support. Wrapping up, we discuss the responsibilities of Judicial Case Managers in the Provincial Court. Follow this link for a transcript of the show and links to the cases discssed.

In this third and final part of this mini-series with Kenyan artist Omish Njash we begin with me putting to Omish the welcome activism GenZ have picked up and carried forward and how the government has tried to disrupt them. I mention unity as a key principle behind this movement, and here Omish begins the landslide of his thoughts. I could have added all of his text here as quotations but instead I will leave simply a few notable ones for you:“The greatest gift the younger generation has given this country is they have shaken us out of an apathy.”“It was a revolution, but it wasn't a evolution that liberates all the people who deserve liberating.”“There were aspects of our togetherness that were not there. “Thank you so much Omish Njash for your time and wisdom. Trading conditions across Greater Manchester are challenging, with uncertainty over the economy and the future of work leading occupiers to operate with caution, according to Fletcher CRE director John Fletcher. In terms of deal numbers, Fletcher CRE is the highest-placed regional agent on the Radius On Demand Rankings across Greater Manchester for the year to date, with 15 deals over the line totalling 37,704 sq ft of space. Fletcher believes the towns of Greater Manchester benefit greatly from the success of Manchester city centre, but he believes investment is needed both in infrastructure and the right redevelopment if they are to realise their potential. He is also hopeful that Thursday's general election will remove one element of instability and encourage occupiers to commit to decisions.
David Abrams is the co-founder and CEO of HILO, a platform that is digitizing customer experience to create connected communities of people in buildings. David is also host of the TEN, the Tenant Experience Network podcast. David brings his entrepreneurial and marketing background and context to explore commercial real estate landlords', owners', and occupiers' evolving circumstances. He explains why they need to be collaborating to create hospitality-driven, new tech-enhanced environments and programmed experiences for tenants—for each individually and together as a community. TAKEAWAYS [02:29] David takes a while to sort out what he wants to study at college ending up focusing on marketing and accounting. [03:01] David enjoys the ability accounting gives him to explore how businesses operate. [03:49] As a first entrepreneurial opportunity, David gets involved in repositioning a struggling agency. [04:58] Early agency clients span commercial real estate and nonprofit, the latter which David finds especially satisfying. [05:45] Raw Society is launched to focus on critical strategic work before the creative process begins. [07:15] The ESG movement makes building operators start to think about environmental impact. [07:52] What is the effect of the densification of people living and working in central business districts? [09:13] New thinking is first driven by occupants, relating to basic ESG initiatives like recycling. [10:14] Operators go paperless, initiating digital communications their tenants' employees. [11:32] David loves the opportunity to start creating environments that people enjoyed being in. [12:16] The smartest operators recognized they could develop better relationships and community by connecting their tenants. [12:55] The ultimate goal is to improve tenant retention through better customer service and experiences. [14:09] Every building has constant turnover—both tenants and tenants' employees. [14:51] David launches his new company in 2019, gets financing and is in full growth mode when the pandemic hits. [15:37] As an entrepreneur, David recognizes his two choices - give up or dig in. [17:38] With little clarity about the future, they tried to be pragmatic about future technology needs. [21:30] New realizations emerge after a difficult period that extended operators' boundaries. [23:09] Operators realize their responsibility to be involved in spaces beyond their buildings. [24:24] Extra costs can be covered by charging premium rent or sharing new community spaces. [26:20] Connectivity is a huge driver of experience when it is pervasive and consistent. [27:18] Investments go into programming, content, services and staff to offer white glove experiences. [28:51] Office and multifamily categories are all hiring people from the hospitality industry. [29:37] Programming, services, and staffing are becoming integral and significant to buildings' offerings. [31:00] The key factor is not the size of the building, but the commitment of its ownership. [31:49] Across building classes, technology can be an equalizer to provide higher levels of service. [34:05] Technology delivers better experiences and reduces friction when people choose to enter the built world. [35:27] How can we put the power of personalization into the hands of the individual? [36:29] David imagines we are between first and second base in the evolution of office buildings. [37:15] People need to congregate for the right reasons in the right environments to do the right kind of work. [39:49] IMMEDIATE ACTION TIP: Occupiers and landlords need to think beyond the work that needs to get done in an office and co-create experiences that support good work. Consider all the various touchpoints for each person across technology, programming, content, services and staffing. RESOURCES David Abrams on LinkedIn David's company HILO's website HILO on Instagram TEN – The Tenant Experience Network QUOTES “Buildings are not silos. They're part of a neighborhood, they're part of a city and they create community.” “It's a conversation around where should I work on any given day where can great work happen?” “How can we put the power of personalization into the hands of the individual. How can they use technology to better connect and engage with all the various spaces and places in their lives and have it not be top down driven.” “People need to come together for the right reasons in the right environments with the right people to do the right kind of work.” “The occupier and the landlord need to be open minded. They need to think beyond just the work that needs to get done and start to think about creating an experience that will support great work.”

Episode 246-All Things Gaza: In this week's episode of the National Crawford Roundtable we look at how the events in Gaza affect the United States and the upcoming Presidential election. What is the impact of Palestinian Occupiers/Protestors on college campuses? Are Ivy League schools finally reaping what they've sown over the past 60 years? What impact will Biden's Israel Policy toward Israel have on the November election, especially on young voters? How big is this issue compared to something like the Southern Border? Is Biden governing right now or traveling for votes? How is coordinated anti-semitism happening in real-time in an era that supposedly is hostile to "hate speech"? Is there any role the Church can play, or do we just hope all of this goes away?

The rise of ancient empires in the Eurasian continent ushered in the Axial Age, with its ideologies of absolute good and evil and the promise of revolutionary recompense for unheard-of oppression by the Occupiers of the Earth (שכני הארץ). The books of 1 Enoch and Jubilees, quoted by name in the New Testament, still contained in the Bible of the Ethiopic churches, and exerting a massive influence over the entire Christian view of human history, have recently been re-edited and re-translated with reference to the Aramaic and Hebrew originals partially recovered from the Dead Sea scrolls. Their text shows a greater class consciousness than ever, declaring, “it was not ordained for a man to be a slave, nor was a decree given for a woman to be a handmaid: but it happened because of oppression. This lawlessness was not sent upon the earth: but men created it by themselves, and those who do it will come to a great curse,” (98:4) proclaiming, “woe to those who build their houses not with their own labors, and make the whole house of the stones and bricks of sin,” (99:13) while we workers “toiled and labored and were not masters of our labor; we became the food of the sinners.” (103:11) In response to this situation—ambiguously connected with the idea of God's angelic police (עירין “watchers”) and prosecutors (שׂטנין “accusers”) betraying Him and engaging in a kind of mafia side hustle which corrupted some humans so that they began to consume and exploit others—the patriarchs Enoch and Moses are given secret knowledge of the cosmic surveillance apparatus that will bring reward to the just, punishment to the rich, and justice to the victims of oppression. We engage in an extended meditation on the impact of these ideas as a weapon of class struggle, both from above and below, in late antique, medieval, capitalist, and our own techno-feudal times. This week, I met by chance, a person with whom I stood in line at the military enlistment office and served in the same unit in the very first weeks of war where we together defended Kyiv from the Russian offensive. This man is about 20 years older than me. He had already served in the Soviet army, so he was our senior in the first hours before our first officers arrived to take command. After the liberation of the Kyiv region, he was assigned to a unit that was fighting on the very border with Russia. We had not seen each other for about a year and a half. And when we accidentally ran into each other in one of our headquarters, we exchanged news and immediately started discussing our mutual acquaintances with whom we served together in the first days and weeks. It was a very sad conversation. Most of these people are no longer fighting. Some were killed, some were captured, and at least two of 25 to 30 people with whom we signed up for the army together are missing. Many of you're discharged from the army due to illness and injuries. Even rear service did not guarantee people a peaceful life. One of our friends became a military cook relatively far from the front line, but a Russian missile hit the building where his kitchen was located, and he was seriously injured. In general out of those who came with us only about half are stealing the ranks. Even less. And we, those who remained, have changed a lot since the beginning of the war. That friend of mine, whom I met by chance the other day, has lost a lot of weight. He has lost at least a few of his own weight. This is despite the fact that the army feeds really testing and nutritious. This is how constant stress, a constant feeling of danger reflects on him. The stress also affects me very much, but in a different way. I'm losing my teeth since the beginning of the war, in less than two years, I've lost eight of them. Stress becomes an integral part of your life, but it's impossible to get used to it. You just live each day aware. Whatever step you take, every breath you take could be your last. As long as the war continues, there are no safe places or safe times. The stress sometimes gets stronger, sometimes weaker, but it never goes away completely. It becomes a part of you and it works together with Russian occupiers- while we're trying to destroy you from the outside, stress destroys you from the inside and does it very skillfully.
December 8th 2023 Yuriy shares his struggle with illness and the pivotal role of shells in Ukraine's survival. Once again, I'm forced to apologize for my long absence- I have been sick for the past week, I just lay there unable to do anything with a high fever and waited for the time when I would become a human again, not a piece of hot stone. I don't know if it was Covid or the flu, but it was really hard. I was only able to get out of this state by a call from the United States, from a reporter from the Atlantic Magazine. He called me yesterday to get a short comment on what the possible cessation of supplies of shells from the United States would mean for Ukraine. It was supposed to be a short conversation. One main question, a couple of clarified ones, and that's it. The comment is ready, but we talked for almost an hour because these shells are the most important thing for Ukraine now. They are simply the guarantee of our survival. I will try to briefly summarize the main thoughts of my stories so that you understand what I mean. Remember I often mention Russian "meat waves" in this podcast. Suicidal attempts of the enemy to occupy Ukrainian positions by the forces of only the infantry without the participation of any equipment. This suicidal assaults in which the Russians are simply killing their soldiers by the thousands are carried out only because we have artillery and shells for it, thanks to which a thank or an armored personal carrier does not live on the battlefield for more when few minutes. If we didn't have the opportunity to destroy their equipment from a distance the Russians would not attack with suicide infantry. They would simply drive their armor onto our positions into our cities. The occupiers are forced to run on foot to machine guns across mine fields precisely because we still have enough guns and shells for them, thanks to which the occupiers are afraid to send equipment to the battlefield. I called the shells for guns that we receive from the United States, 'a deadly iron curtain' that simply keeps the enemy in the positions it had managed to occupy and does not let it go farther. "What will happen if Ukraine has no shells?" The reporter asked me. The answer is very simple. "If our guns are left without shells, the iron curtain between us and the occupiers will fall. It will be much easier for them to capture new cities and entire regions. Losses among Ukrainian soldiers will increase and increase very noticeably. If we are left without shells, new Buchas and new Mariupols will await us. That is new mass killings of a civilian population in the occupied territories. New tortures, new abuses of elderly children and women." The reporter also asked what people who make decisions in the West about providing or not providing shells need to know. Here too, everything is simple. Imagine you have a warehouse with shells where you are not threatened by anything, where these shells just lie and will never be used. And somewhere there is a country in which real concentration camps will appear without these shells. In which thousands of people will die a very terrible death if where defenders are left without shells. And so you have a very clear choice. Either you keep the shells that you don't really need, and through this you become an accomplice of those who are creating new Auschwitz and Dachaus in the 21st century. Or you do what a human being should do. You give these shells away and save the lives of the elderly and children. Everything is actually that simple. You can't be above this fight. You either help those who are fighting for freedom and life, or you do nothing ever by help without your parents and murderers

(3/23/23) Lawrence West helped found Black Lives Matter Richmond Virginia following massively successful campaigns to take down confederate monuments in his home state of Virginia following the murder of George Floyd. What started as a tiny organization feeding the community known as The Kitchen, evolved into a cadre called The Occupiers that spent more than a year camped out on Monument Avenue to demand the removal of confederate statues. The organization broadened its mission and became one of 26 chartered chapters of Black Lives Matter grassroots. The recent killing of Irvo Otieno by sheriffs and staff inside a mental health facility underlines the urgency of their ongoing activism.
People who live in the Middle East have every right to attack the occupying forces there whose presence they oppose, and those occupying forces do not have any legitimate right to retaliate. Reading by Tim Foley.

Trespassers. The Occupiers' Liability Act 1984 (and in Scotland the Occupiers' Liability (Scotland) Act 1960) requires all owners of property to take reasonable steps to make their premises safe for anyone who enters them, even those who enter as trespassers, if they are aware of a risk on the premises. However, the doctrine of volenti has been applied to cases where a trespasser exposed themselves deliberately to risk: Titchener v British Railways Board, Ratcliff v McConnell, and Tomlinson v Congleton Borough Council. In the first case (decided before the Occupier's Liability Act was passed), a girl who had trespassed on the railway was hit by a train. The House of Lords ruled that the fencing around the railway was adequate, and the girl had voluntarily accepted the risk by breaking through it. In the second case, a student who had broken into a closed swimming-pool and injured himself by diving into the shallow end was similarly held responsible for his own injuries. The third case involved a man who dived into a shallow lake, despite the presence of "No Swimming" signs; the signs were held to be an adequate warning. Drunk drivers. The defense of volenti is now excluded by statute where a passenger was injured as a result of agreeing to take a lift from a drunk car driver. However, in a well-known case of Morris v Murray (Court of Appeal), volenti was held to apply to a drunk passenger, who accepted a lift from a drunk pilot. The pilot died in the resulting crash and the passenger who was injured, sued his estate. Although he drove the pilot to the airfield (which was closed at the time) and helped him start the engine and tune the radio, he argued that he did not freely and voluntarily consent to the risk involved in flying. The Court of Appeal held that there was consent: the passenger was not so drunk as to fail to realize the risks of taking a lift from a drunk pilot, and his actions leading up to the flight demonstrated that he voluntarily accepted those risks. Rescuers. For reasons of policy, the courts are reluctant to criticize the behavior of rescuers. A rescuer would not be considered volens if: He was acting to rescue persons or property endangered by the defendant's negligence; He was acting under a compelling legal, social or moral duty; and His conduct in all circumstances was reasonable and a natural consequence of the defendant's negligence. --- Send in a voice message: https://anchor.fm/law-school/message Support this podcast: https://anchor.fm/law-school/support
This week's conversation centers on the stories of Mary and Elizabeth and what their story can teach us about love, faith, and solidarity. In a moment of Divine joy, Mary utters one of the most famous and radical prayers in the Christian tradition, the Magnificat. In this prayer, Mary proclaims that God's liberation love is at work in her, her cousin, and her community. She proclaims that God will overthrow the occupying colonial Roman Empire. This prayer is amazing, beautiful, and inspirational, but - how should we read this given our status as folks who benefit from occupied colonial land? We end the podcast by returning to last week's conversation. Given the way that Mary and Elizabeth see the Divine in each other, we wonder how this perspective would influence how we interact with others. www.TheLoftLA.org
