A brewery's trademark and its subsequent labels are its identity and protecting that involves many steps that involve beverage lawyers, government agencies, keeping tabs on other breweries and so much more. Today we speak to three guests with an eye on trademark protection, homage/parody vs. intellectual property theft and the legal ramifications of what happens when the judicial system has to get involved. This is a fascinating part of the beer world. Guests:Brian Kulbacki of Departed Soles Brewing. Brian is a 2012 Graduate of the American Brewers Guild Brewing School, where he took their Intensive Brewing Science & Engineering course for Breweries in Planning. Prior to that he graduated from Boston College with a double major in Marketing & Finance. He has worked in marketing for the New England Patriots/Revolution and the Lakewood BlueClaws, as well as finance for Major League Baseball and Royal Caribbean Cruise Lines. He has also managed operations for a family business. "We can do this better," is what Christine and Bill said to themselves after spending some years in the craft beer industry, and seeing their own employer evolve quickly from a small regional brewery to an impersonal, corporatized operation. When the making of beer became more about pushing the right buttons on programmed machinery than following their creative passion - they knew it was time to do their own thing. It was the mid-2000s, and the craft beer industry was growing, but with a big discrepancy in the quality of what was coming into the market. There was an opportunity. Traveling through New England from their home base outside of Philadelphia, it was the iconic fiberglass, painted sheep from Pittsfield's Sheeptacular that drew their attention. A first tour of Pittsfield was made memorable when the couple received a remarkably warm welcome by Mayor Jim Ruberto who took the time to meet with the couple personally on a whim. "Where are we in America?" recalls Bill who is still struck how a city's mayor would drop everything to meet with a couple of unknown entrepreneurs to sell the city to them. To some extent, the rest is history as it relates to Christine Bump and Bill Heaton's indelible impact on the Berkshires' restaurant and beer scene. Five years running a restaurant in Downtown Pittsfield led to the pair pouring themselves into their true passion, which of course, is brewing the very best. Big Elm was born, and today, in addition to the brewery and tap room in Sheffield, they have also opened a second tap room in Great Barrington. This week, my guest is Bill Covaleski. He's the brewmaster and co-founder of Victory Brewing Company. This year, Bill and co-founder Ron Barchet are celebrating 25 years of Victory. As someone who has successfully built and run a business for 25 years, Bill drops a lot of knowledge, and I think it's beneficial whether you are running your own business, or have employees that report to you.Bill talks about how he got into brewing, and the decision to start a brewery with his best friend Ron Barchet. We talk about trends in the industry, discussing everything from beer styles, to seltzers and non-alcoholic beer.
