Today on Midday, we are going to talk about the case of Keith Davis, Jr., who is accused by the Baltimore State's Attorney of murdering Kevin Jones in 2015. Mr. Davis has already been tried four times for this murder. Two of those trials ended in hung juries. The other two, including the most recent one, ended in guilty verdicts that were overturned. Mr. Davis remains in jail while awaiting his fifth trial, which is currently scheduled for May, although it could be delayed. This case has garnered a lot of public attention, largely due to the efforts of Mr. Davis' wife, Kelly, and a passionate and vocal group of advocates who for years have been critical of State's Attorney Marilyn Mosby and the prosecutors in her office. These advocates have been working to bring the details of the case to wide attention. One of those advocates is DeRay Mckesson, who joins us today. DeRay is an activist and co-founder of Campaign Zero, an organization founded to combat police violence. Campaign Zero has taken-up the cause of Mr. Davis, claiming that Ms. Mosby's prosecution is due to what the group calls “vindictiveness and personal and political animus.” That was the language used in a motion to dismiss the case filed on March 8 by Deborah Katz Levi, the Director of Special Litigation at the MD office of the Public Defender. We made the State's Attorney's Office aware of the fact that we would be talking about this case today on Midday. Citing that it is an on-going legal matter, they declined to participate in the conversation. Here's what's happened in the case so far: Kevin Jones was shot to death in June of 2015, as he walked to work at Pimlico Race Course in Northwest Baltimore. In 2016, Keith Davis was tried on charges of armed robbery of a cab driver, a charge for which he was acquitted. He was, however, convicted of illegal possession of a firearm and sentenced to five years in prison. In 2017, he was charged in the murder of Kevin Jones. Davis' trial in May of that year ended in a hung jury. He was re-tried in that case several months later. In that trial, he was found not guilty of first-degree murder, but guilty of second-degree murder. That verdict was overturned because the court found that the prosecution had not informed the defense and the jury of the background of one of the witnesses, a jailhouse informant. A third trial, in June of 2018, also ended with a hung jury. A fourth trial, in February of 2020 ended in a guilty verdict. Mr. Davis, who maintained his innocence, was sentenced to 50 years in prison. That guilty verdict was overturned because of problems with questions that were posed to potential jurors. Each of these trials were presided over by different judges, and prosecuted by different lawyers from the State's Attorney's office. Last December, Mr. Davis turned down a plea bargain that would have reduced his sentence to 15 years. As mentioned earlier, Mr. Davis remains in jail, awaiting a fifth trial. We do not know whether or not Keith Davis killed Kevin Jones. There is certainly ample evidence that he did not, but two juries have been convinced by evidence at trial that he is responsible for Mr. Jones' death. Ms. Mosby has said that prosecutors are pursuing this case to bring justice to Mr. Jones' family. Mr. Davis' supporters are seeking justice for him, as well. (In an unrelated case, Mr. Davis has been charged with attempted murder for an alleged fight he had in jail with another inmate. That fight took allegedly place in June 2020. Mr. Davis wasn't charged until May, 2021. The delay is cited by Mr. Davis' lawyer as proof that Baltimore State's Attorney Marilyn Mosby waited until Mr. Davis was granted another trial in the other murder case before charging him with something else. Again, this is according to a motion to dismiss his case filed on his behalf.) Host Tom Hall notes that he has not attended the trials, and does not claim to know every detail of this complicated case. Tom has, however, read recent motions filed to the court by the State's Attorney's office and the public defender, Deborah Katz Levi, on behalf of Mr. Davis. DeRay Mckesson is here to explain why he and his organization, Campaign Zero, think the case against Mr. Davis should be dismissed. DeRay is the host of the Pod Save the People Podcast and the author of On the Other Side of Freedom:  The Case for Hope.  In 2016, he was a candidate in the Democratic primary for Baltimore Mayor. Tom Hall has known DeRay for several years, and believes him to be a thoughtful advocate for whatever causes he champions. When Jockey Nik Juarez sat down with Coach Krysta at The Fort Athletic Club for this special episode, we finished the conversation with a quote that Nik lives by: “If you develop a resentment for losing, you'll develop a winning mentality," - Devon Levesque: serial entrepreneur, philanthropist, and fitness enthusiast. Off of the racetrack, Nik is a husband, father, and marathon runner. He is an aspiring ultra runner and tri-athlete, but we've got no doubt he'll have his first Ironman on the calendar within the next 12 months. Nik is also a member at The Fort Athletic Club in Oceanport, New Jersey, where Coach Krysta oversees marketing and one of the Club's boutique fitness studios. Nik calls Monmouth Park racetrack, just down the road from The Fort, his official racing home. He grew up in Maryland, and even though he was quite literally born into becoming a jockey, it wasn't until his first year of college that he took a serious interest in it. Nik is a multiple grade stakes winning jockey: he won his very first stakes race in 2015 on a horse he now owns, Valid, at Monmouth Park. We learned over the weekend, to the surprise of many, that the city of Baltimore has reached an agreement with The Stronach Group, the owners of the Pimlico Race Course in Park Heights, on a plan to redevelop the aging track facility and the surrounding neighborhood, and to keep the Preakness Stakes -- the second jewel in horse racing’s prestigious Triple Crown -- permanently at Pimlico. Joining Tom in the studio to discuss the details of this momentous agreement -- and the work still ahead to implement it -- is Maryland Delegate Sandy Rosenberg. He represents the state's 41st legislative district -- which includes the Pimlico Race Course. Delegate Rosenberg has long been an advocate for the redevelopment of the track complex and for keeping the Preakness at Pimlico. Matt and Steve are talking about this week in sports updates, including: The Riverhounds tied 2-2 with the Tampa Bay Rowdies. They took on FC Cincinnati in The US Open Cup and ended in a 3-1 loss. The Riverhounds are on the road to face Penn FC. Pittsburgh is currently in 4th place with a 9, 12, 5, 17 record. F Romeo Parkes was named to USL Team of the Week after his first goal of the season. The PGA played at Trinity Forest Golf Club in Dallas for the Bryon Nelson Classic. 21-year-old Aaron Wise (South African) took home 1.39 Million and his first win on the PGA Tour. Wise's mom travels with him and when he was in the lead after day 3 he had to make her leave the room during the 4-hr rain delay prior to his Tee Time. His final score was -23 for the tournament. It's time for the Fort Worth Inv. at the Colonial Course in Texas as we're gearing up for the Memorial at Muirfield Village in Columbus. The Preakness Stakes at Pimlico Race Course in Baltimore was a rainy, foggy, muddy mess with Justify by a 1/2 length to win. Bob Baffert (Trainer) is on his bid for his second Triple Crown at the Belmont Stakes in Belmont Park. American Pharoah ended the 37-year drought three years ago. Baffert is now tied with 14 triple crown wins as a trainer and could only be the second trainer to have 2 Triple Crown winners. Belmont is the longest of the 3 races and is the hardest to win. The Vegas Golden Knights move on to the Stanley Cup Final over the Winnipeg Jets. The Caps/Lightning had a very exciting game 7 with the Caps moving on to the final. Of course Pittsburgh is with the Knights mainly because of Fleury, but some other former Pens are on the team as well. Football OTAs have begun and the vets are meeting the rookies and invited free agents for the first time. There is no sign of Lev Bell, and we don't expect him 'til after camp. They have until July 15th to reach a long-term deal. These are voluntary to attend. Nashville is selected to host the 2019 NFL Draft, and Arizona is selected to hold Super Bowl LVII and New Orleans to host Super Bowl LVIII. Rodger Goodell and the NFL have implemented the new standard and rule regarding the national anthem. All personnel on the field during ceremonies must stand and show respect for the anthem, and if they choose not to stand they are able to stay in the locker room or like area off the field for the opening ceremonies. If anyone doesn't stand and show respect for the anthem, the organization will be fined. Each organization can make its own work rule regarding the situation. The commissioner will impose appropriate discipline on league personnel who do not stand and show respect. Does this still leave open what is considered respect or disrespect? The Buccos have dropped 3 in a row to the Padres, and 1 to the Reds and pulled out an extra inning win. The Bucs have been beating the teams that they should, until now. The bullpen is still suspect, but the offense has cooled off. The Bucs were in first place for a day or so, but are now 3 games back in the division. The NL Central is one of the weakest divisions in the MLB. The much awaited call-up of Austin Meadows has been worth the wait. he is 5-11 with 2 homers. Manager, Clint Hurdle, says he is being aggressive, seeing pitches. Clint summed it up in two words: Visualization and Confidence.
