February 16, 2023 Everything Co-op continues its commemoration of Black History Month with an interview of Pastor Keith Davis, President and CEO of the Camden Dream Center's Technology Training School in Camden, New Jersey and Julian D. Miller, Esq., founding Executive Director of the Reuben V. Anderson Center for Justice, at Tougaloo College in Mississippi. Vernon and his guests will discuss Black Food Sovereignty. Reverend Keith Davis is a pastor and community leader, technologist, and thought leader in technology and workforce development. He is President and CEO of the Camden Dream Center's Technology Training School, and co-chair of the National Initiative for Cybersecurity Educations (NICE) working group to promote career discovery and multiple pathways to high-paying cybersecurity jobs. Julian D. Miller, Esq., is the founding Executive Director of the Reuben V. Anderson Center for Justice and the co-founding Director of the Reuben V. Anderson Institute for Social Justice at Tougaloo College in Mississippi, where he also serves as an assistant professor of political science. He is a lawyer and community activist who is committed to economic, social, and racial justice through grassroots-led efforts to shift policy in a direction that uplifts all poor and working people. The 2023 theme for Black History month is Black Resistance. The theme explores how “African Americans have resisted historic and ongoing oppression, in all forms, especially the racial terrorism of lynching, racial profiling, and police killings.” As societal and political forces escalate to limit access to and exercise of the ballot, eliminate the teaching of Black history, and work to push our country back into the 1890s, we can only rely on our capacity to resist.

Host New York journalist Rachel Monroe looks at the life and work of Keith Davis and other fisheries observers who spend months at sea monitoring the catches and activities of fishing vessels as the sole overseer for malpractice and mistreatment. It's far from easy work. Often seen as the enemy, fisheries observers are alone with crews who usually don't speak english with no way to contact anyone off the boat. Davis's disappearance isn't as rare as anyone might hope. On average in the last decade one fisheries observer has gone missing a year. This podcast looks not only at the disappearances and mysteries deaths of observers but other secrets of the global fishing industry like mistreatment of crew, smuggling, and human trafficking and slavery. Each episode is about 25 minutes long with the last episode coming out in November of 2022. They're made up of narrative backstory and interviews both anonymous and not. WYPR's news partner at the Baltimore Banner reports this morning that Baltimore State's Attorney Ivan Bates has dropped the case against Keith Davis, who has already been tried four times for the murder of Kevin Jones in 2015.During his campaign for State's Attorney, Bates had indicated that he would drop the charges against Davis. He recused himself from the review process of the case, which took place after he took office early this month. Former State's Attorney Marilyn Mosby has long held that Davis is guilty of this crime, and she was planning on re-trying him in May of this year. In two of Davis' four trials, juries were not able to come to a unanimous verdict. In the other two trials in which juries did reach a guilty verdict, judges overturned those verdicts. The Banner is also reporting that yesterday, The Baltimore State's Attorney's Office declined to file criminal charges against two Baltimore Police officers who shot and killed Donnell Rochester. That shooting was the subject of several protests. An investigative report concluded that in February of last year, Rochester, an 18 year-old from Odenton, was driving in the direction of an officer when police opened fire. Prosecutors concluded that the shooting was lawful self-defense. This week, there were leadership shake-ups at two city agencies. Jason Mitchell, who came to Baltimore from Oakland, California, 20 months ago, announced that in April, he will resign his position as the Director of the Department of Public Works. And Donna Drew Sawyer, the CEO of the Baltimore Office of Promotion and Arts was forced out of her position after Mayor Brandon Scott demanded her resignation. Well, I don't know about you, but I worry about this next generation. The young people who went through COVID, there's all kinds of mental health issues. And in our nation's junior highs and high schools, it's not being addressed. They're just not equipped. Today, it's Midday on the Law. Tom's guest for the hour is David Jaros, associate professor of law at the University of Baltimore School of Law, and Faculty Director of the School's Center for Criminal Justice Reform. Baltimore City State's Attorney Marilyn Mosby did not prevail in the primary election held last month, so she will not return to office for a third term in January. She will, however, return to federal court next month to face charges that she committed perjury when she applied to use funds from her retirement account for a down payment on some property in Florida, and that she lied on a mortgage application. How did the indictment on these charges, which were announced in January, affect her chances in the primary, in which she placed last in a three person race? Would the charges brought against her by federal prosecutors have been brought against someone who was not a public official? Should elected leaders be held to a higher standard than the rest of us? Mosby's successor will be Ivan Bates. He will not face opposition in the general election in November, so he will be sworn-in as the next State's Attorney on January 2nd. One of Marilyn Mosby's most controversial decisions during her tenure was the decision to pursue a fifth trial in the controversial case of Keith Davis, Jr., who is accused of murdering Kevin Jones in 2015. Mr. Davis is scheduled to be tried again in May, 2023. He remains in jail, despite the fact that Ivan Bates has said he would not pursue a new trial. Will he remain there for the next five months? And in the case of the murder of Timothy Reynolds, the bat-wielding motorist who confronted some squeegee workers near the Inner Harbor last month: is the charge of first degree murder against the 15-year-old boy who allegedly shot him the appropriate charge for this young defendant? At age 22, Andi picked up an old acoustic guitar after she had her son so she could write her own songs and sing to her new born. Even though she had been singing her whole life, singing while playing the guitar quickly went from a hobby to a passion. Andi wrote and wrote and then wrote some more. As the music and lyrics poured out of her, she performed across Southern Texas in festivals and fairs. Spending some time as a musician in the few years following, it never became full time. Today, another in Midday's continuing series of Conversations with the Candidates: 2022. Tom's guest is Baltimore City State's Attorney Marilyn Mosby. Ms. Mosby is standing for re-election to a third term as Baltimore's top prosecutor. She is one of three candidates in the July 19th Democratic primary, a race that pits her against the same two opponents she beat, handily, in 2018: Ivan Bates and Thiru Vignarajah. Marilyn Mosby drew national attention when she indicted the six officers in the Freddie Gray case in 2015. None of those indictments resulted in a conviction, but Ms. Mosby became one of the country's highest-profile progressive prosecutors. Her policies have drawn the ire of those on the political right, including Maryland Governor Larry Hogan, who has been an outspoken critic. That is not to say that those on the left have been completely enamored with Ms. Mosby. Advocates for Keith Davis, Jr., have mounted a highly organized and vocal campaign to pressure Ms. Mosby to drop her plans to try Mr. Davis for murder for the fifth time.But in addition to controversies surrounding her decisions as the State's Attorney, Ms. Mosby has been no stranger to personal controversy as well. She is scheduled to stand trial in federal court in September for perjury and making false statements on a mortgage application. She has called the investigation that led to her indictment politically and racially motivated. Marilyn Mosby is 42 years old. She is a graduate of Boston College Law School and Tuskegee University. She served as Assistant State's Attorney for Baltimore from 2005 to 2012. She became a litigator for Liberty Mutual Insurance in 2012, a position she held until she announced her plans to run for State's Attorney the following year. Today on Midday, we are going to talk about the case of Keith Davis, Jr., who is accused by the Baltimore State's Attorney of murdering Kevin Jones in 2015. Mr. Davis has already been tried four times for this murder. Two of those trials ended in hung juries. The other two, including the most recent one, ended in guilty verdicts that were overturned. Mr. Davis remains in jail while awaiting his fifth trial, which is currently scheduled for May, although it could be delayed. This case has garnered a lot of public attention, largely due to the efforts of Mr. Davis' wife, Kelly, and a passionate and vocal group of advocates who for years have been critical of State's Attorney Marilyn Mosby and the prosecutors in her office. These advocates have been working to bring the details of the case to wide attention. One of those advocates is DeRay Mckesson, who joins us today. DeRay is an activist and co-founder of Campaign Zero, an organization founded to combat police violence. Campaign Zero has taken-up the cause of Mr. Davis, claiming that Ms. Mosby's prosecution is due to what the group calls “vindictiveness and personal and political animus.” That was the language used in a motion to dismiss the case filed on March 8 by Deborah Katz Levi, the Director of Special Litigation at the MD office of the Public Defender. We made the State's Attorney's Office aware of the fact that we would be talking about this case today on Midday. Citing that it is an on-going legal matter, they declined to participate in the conversation. Here's what's happened in the case so far: Kevin Jones was shot to death in June of 2015, as he walked to work at Pimlico Race Course in Northwest Baltimore. In 2016, Keith Davis was tried on charges of armed robbery of a cab driver, a charge for which he was acquitted. He was, however, convicted of illegal possession of a firearm and sentenced to five years in prison. In 2017, he was charged in the murder of Kevin Jones. Davis' trial in May of that year ended in a hung jury. He was re-tried in that case several months later. In that trial, he was found not guilty of first-degree murder, but guilty of second-degree murder. That verdict was overturned because the court found that the prosecution had not informed the defense and the jury of the background of one of the witnesses, a jailhouse informant. A third trial, in June of 2018, also ended with a hung jury. A fourth trial, in February of 2020 ended in a guilty verdict. Mr. Davis, who maintained his innocence, was sentenced to 50 years in prison. That guilty verdict was overturned because of problems with questions that were posed to potential jurors. Each of these trials were presided over by different judges, and prosecuted by different lawyers from the State's Attorney's office. Last December, Mr. Davis turned down a plea bargain that would have reduced his sentence to 15 years. As mentioned earlier, Mr. Davis remains in jail, awaiting a fifth trial. We do not know whether or not Keith Davis killed Kevin Jones. There is certainly ample evidence that he did not, but two juries have been convinced by evidence at trial that he is responsible for Mr. Jones' death. Ms. Mosby has said that prosecutors are pursuing this case to bring justice to Mr. Jones' family. Mr. Davis' supporters are seeking justice for him, as well. (In an unrelated case, Mr. Davis has been charged with attempted murder for an alleged fight he had in jail with another inmate. That fight took allegedly place in June 2020. Mr. Davis wasn't charged until May, 2021. The delay is cited by Mr. Davis' lawyer as proof that Baltimore State's Attorney Marilyn Mosby waited until Mr. Davis was granted another trial in the other murder case before charging him with something else. Again, this is according to a motion to dismiss his case filed on his behalf.) Host Tom Hall notes that he has not attended the trials, and does not claim to know every detail of this complicated case. Tom has, however, read recent motions filed to the court by the State's Attorney's office and the public defender, Deborah Katz Levi, on behalf of Mr. Davis. DeRay Mckesson is here to explain why he and his organization, Campaign Zero, think the case against Mr. Davis should be dismissed. DeRay is the host of the Pod Save the People Podcast and the author of On the Other Side of Freedom: The Case for Hope. In 2016, he was a candidate in the Democratic primary for Baltimore Mayor. Tom Hall has known DeRay for several years, and believes him to be a thoughtful advocate for whatever causes he champions. He is happy to give him the opportunity to share his perspective and to respond to some of the points the State's Attorneys have made in the motions they filed in this case a couple of weeks ago. Before Tennessee began its historic 1985 championship season, it was loaded with quality running backs. Keith Davis, Charles Wilson, Pete Panuska, William Howard and Big Sam Henderson were just some of the veteran backs who would be counted on. Nowhere in the preseason media guide was there any mention of a walk-on named Jeff Powell. In spite of his low profile Jeff Powell would go on to be remembered for one of the all time great runs in Tennessee football history when he came "roaring down the greensward of the super dome" in the 1986 Sugar Bowl against the Miami Hurricanes. Last year we had a great chat with ended up on their show, and since then a lot has changed--both for Keith and myself. Since I've been studying the psychological aspects of how cults (and some evangelical churches too) control, manipulate and coerce their followers, I wanted to see if Keith's experiences in evangelicalism matched up to the classic markers of cults as laid out by psychologist Robert Lifton in his 1981 article, "Cult Formation." In our exploration of the cult-like aspects of evangelicalism, Keith and I discuss theology and coercion--why the dogmas of evangelicalism, along with the mind control aspects, have affected us psychologically and in other ways--and how we're recovering from it all.
