The history of immigration law in the US is a two and a half century parade of heinous, racist, and xenophobic laws. I'm starting to suspect that borders were always about white supremacy, empire, colonialism, and capitalist hegemony. This is a sample of a premium episode. Sign up to listen to the entire episode. patreon.com/wetwired The only exceptions were a few laws passed that merely repealed horrific ones, or traded some decency and humanity for political convenience; still in service of empire or capitalist hegemony. The Alien and Sedition Acts authorized the detention or deportation of people seen as posing political threats to the United States and those from “hostile” nations. Among the acts was the Alien Enemies Act, which authorized the President to detain, relocate, or deport immigrants from hostile countries in a time of war. This was only 8 years after the first law in the US that defined eligibility for citizenship by naturalization, in 1790. Congress limited this right to “free white persons,” meaning white, property-owning men. The framework of US immigration policy hasn't substantively changed since The Immigration and Nationality Act of 1965. Arbitrary numbers cap the number of people who can move to the US, by the accident of their birth in another country. Capital and wealthy people can move freely, of course.

Clay is joined by one of his favorite guests and favorite people, historian Joe Ellis of Vermont. The discussion is about the Trump administration's attempt to pull the Alien Enemies Act of 1798 out of the historical dust and apply it to what it regards as undesirable foreigners in the United States. Two Alien acts, the Sedition Act, and the Naturalization Act were passed by a Federalist Congress during a war scare in 1798, the so-called Quasi War. The Alien Enemies Act permitted the president to deport any foreign person he regarded as a national security threat, without due process, without a hearing public or private, and without the benefit of counsel. In the presidential campaign of 2024 Donald Trump declared that he would be invoking the Alien Enemies Act, which is still on the books. He has begun to deport what he regards as Venezuelan gang members and other undesirables (as he sees them). The federal courts now will have to determine if the Alien Enemies Act is a legal tool in President Trump's campaign to control immigration to the United States. Joe Ellis provides vital and essential historical context for this vexed issue. This interview was recorded on 22 March 2025.

He's a loyalist, a Trump zealot, and potentially one of the more frightening cabinet picks.In 2023, Patel appeared on Steve Bannon War Room podcast and said the following: “We're going to come after the people in the media who lied about American citizens, who helped Joe Biden rig presidential elections. Whether it's criminally or civilly, we'll figure that out.”Did you hear that? He wants to arrest journalists who are against Trump. He wants the lying to be a federal crime. He wants any form of dissent from his party to be punished. Even if it can only end up in civil court, if you're an enemy of his and an enemy of Trumps, you're gonna pay. one way or another. Woodrow Wilson or Franklin D. Roosevelt: which president was worse for free speech? In August, FIRE posted a viral X thread, arguing that Woodrow Wilson may be America's worst-ever president for free speech. Despite the growing recognition of Wilson's censorship, there was a professor who wrote a recent book on FDR's free speech record, arguing that FDR was worse.  Representing the Wilson side in our discussion is Christopher Cox, author of the new book, “Woodrow Wilson: The Light Withdrawn.” Cox is a former member of the House of Representatives, where he served for 17 years, including as chair of the Homeland Security Committee. He is currently a senior scholar in residence at the University of California, Irvine.  Representing the FDR side is professor David T. On November 10, 1798, the Kentucky legislature passed resolutions based on his principles. They not only reaffirmed the Constitution's structure a strict line between delegated and reserved powers, but also laid out how to defend it against violations of the constitution by the federal government. “It's a free country.” Many of us recall saying that as children as we learned that we were American citizens who were endowed with certain rights—such as free speech. We would use those words when we wanted to assert our own rights when we were being bullied or chastised. We would use them to let others know that even if we did not agree with what they were saying or doing, they were within their rights to express certain opinions or to do certain things. How many American adults feel as confident now about expressing our views in public settings as we did when we were children or young adults? In his authoritative but general-reader-friendly new book, The Indispensable Right: Free Speech in an Age of Rage legal scholar and public intellectual Jonathan Turley argues that many Americans nowadays are “speech phobic” and employ terms such as “hate speech” to shut down legitimate discussion of such topics as immigration, government policies during the height of the Covid pandemic and transgenderism. He maintains that free expression is imperative for human flourishing and that stifling it can lead to a spiral of frustration boiling up to rage, which is then repressed by expressions of state rage such as the Palmer Raids and the excesses of McCarthyism. Turley walks us through the history of free speech in America and across today's minefields of topics that can get even average people cancelled—and what forms “canceling” can take. In approachable, fairly short chapters Professor Turley reminds us of how quickly some of the heroes of the American Revolution and champions of liberty devolved into semi-tyrants. His treatment of John Adams and the Alien and Sedition Acts (the latter of which rendered it a crime to, “print, utter, or publish...any false, scandalous, and malicious writing” about the government) is particularly eye-opening and provides crucial background as the reader proceeds through the book. The concept of sedition is a major focus of the book and alerts us as citizens that it is not a matter confined to centuries ago, but a matter very much in the forefront of the American legal and political landscape in the wake what happened in Washington DC in January 2021. Indeed, what we should call what those events is another fascinating focus of the book. Turley argues forcefully and persuasively that January 6 was not an insurrection but a protest that became a riot. This was a brave stance to take given that, as he points out in the book, anyone who argued that January 6 was anything but an insurrection was in danger of being labeled a sympathizer or an apologist for the rioters. Turley's book has become even more of a crucial read in the wake of the anti-Israel protests on college campuses in the spring of 2024. In approachable, fairly short chapters Professor Turley reminds us of how quickly some of the heroes of the American Revolution and champions of liberty devolved into semi-tyrants. His treatment of John Adams and the Alien and Sedition Acts (the latter of which rendered it a crime to, “print, utter, or publish...any false, scandalous, and malicious writing” about the government) is particularly eye-opening and provides crucial background as the reader proceeds through the book. The concept of sedition is a major focus of the book and alerts us as citizens that it is not a matter confined to centuries ago, but a matter very much in the forefront of the American legal and political landscape in the wake what happened in Washington DC in January 2021. Indeed, what we should call what those events is another fascinating focus of the book. Turley argues forcefully and persuasively that January 6 was not an insurrection but a protest that became a riot. This was a brave stance to take given that, as he points out in the book, anyone who argued that January 6 was anything but an insurrection was in danger of being labeled a sympathizer or an apologist for the rioters. Turley's book has become even more of a crucial read in the wake of the anti-Israel protests on college campuses in the spring of 2024. Ditto some shockingly anti-free-speech comments recently by supposedly mainstream Democrats such as John Kerry and Hillary Clinton. We will touch on the status of free speech as an issue in the 2024 presidential election and how free speech has been impacted by the Biden-Harris administration. “It's a free country.” Many of us recall saying that as children as we learned that we were American citizens who were endowed with certain rights—such as free speech. We would use those words when we wanted to assert our own rights when we were being bullied or chastised. We would use them to let others know that even if we did not agree with what they were saying or doing, they were within their rights to express certain opinions or to do certain things. How many American adults feel as confident now about expressing our views in public settings as we did when we were children or young adults? In his authoritative but general-reader-friendly new book, The Indispensable Right: Free Speech in an Age of Rage legal scholar and public intellectual Jonathan Turley argues that many Americans nowadays are “speech phobic” and employ terms such as “hate speech” to shut down legitimate discussion of such topics as immigration, government policies during the height of the Covid pandemic and transgenderism. He maintains that free expression is imperative for human flourishing and that stifling it can lead to a spiral of frustration boiling up to rage, which is then repressed by expressions of state rage such as the Palmer Raids and the excesses of McCarthyism. This is the sixth episode in an occasional series examining influential elections in U.S. history. The most recent episode, Election of 2000, was published on July 11. If you believe American society has never been as politically polarized as it is now, you may not be familiar with the late 1790s. Federalists and Republicans viciously attacked each other, trading accusations of frittering away the Constitution and imperiling the legacy of the American Revolution. The incumbent president John Adams was beset by a crisis with France verging on war. His vice president, Thomas Jefferson, was the leader of the political opposition. In this episode, historian Alan Taylor takes us back to a crazy time: the XYZ Affair, the Alien and Sedition Acts, and Aaron Burr! The election of 1800 had to be decided in the House of Representatives amid scheming to deny Jefferson the presidency. Jefferson's victory brought on the first peaceful transfer of power in the new republic, an important tradition that lasted until the election of 2020.

On November 7, 2023, historians Carol Berkin, author of A Sovereign People: The Crises of the 1790s and the Birth of American Nationalism, and H.W. Brands, author of Founding Partisans: Hamilton, Jefferson, Madison, Adams, and the Brawling Birth of American Politics, joined Jeffrey Rosen for a conversation on political partisanship and nationalism in early America, and how, despite the founders' fear of factionalism, deep partisan divisions emerged almost immediately after the Revolution.
