On January 6th, 2021, “On the Media” reporter Micah Loewinger recorded the secret communications of the Oath Keepers on a walkie-talkie app called Zello. After reporting on the findings, Loewinger received a subpoena calling on him to testify in the first Oath Keepers criminal trial last year. In conversations with “On the Media” host Brooke Gladstone, “Death, Sex & Money” host Anna Sale, and Roger Parloff, a senior editor at Lawfare, Loewinger grapples with the consequences of his reporting, and explores what happens when a journalist is forced to testify in court. Plus, Loewinger looks at the nineteen-seventies Supreme Court case United States v. Caldwell to understand the legal precedents for journalists being called on to testify in federal investigations, the limits of First Amendment privileges for the press, and the sometimes tenuous relationship between journalists and the government.  This episode originally aired on “On the Media” on May 26, 2023.

I have been an accidental recruiter for going on 14 years now. I currently work for a company called Zillow. Zillow is really more of a more of a scale up and a startup. I mean, we've been around ten years, so I feel like we're kind of further along on that maturity curve, but we're still smaller. We're about 55 people today, and what we do is that we enable front line workers or desk workers through communication solutions such as Push-to-talk. So we're really big on helping out of all types of industries. We're not industry specific. One cool thing that we do do is we offer our platform for free to first responders. Our second stop was a little ethnic Mexican store we visit from time to time for things Sonia particularly likes, such as plantains and a vanilla flavoring she adds to her coffee. I like their small bags of pasta noodles. Here, we paid the price for a late start to our day, as it was lunchtime and the store was packed. Their shelves are always full. Next was Hobby Lobby. They were busy as well. Sonia only wanted a couple of mixed media pads, so it was a quick in and out, but I didn't see any empty areas. Home Depot was next. A 2x4x8 remains at $3.35. They looked busy as well. If I had to guess, people are ramping up their gardening. Aldi was lastWe found heavy cream this week. I definitely noticed higher prices. The meal replacement shakes I get are at least $2 higher. I stopped in Food City. There is still very little choice in larger bags of dry cat food; I saw mostly generic that I wouldn't feed a dog. There are a lot of recipes online for mug cakes, but we like the simplest, which is to combine one box of angel-food cake mix plus one box of any other kind; no oil needed. They'd had little angel-food cake on recent trips, but today they had multiple boxes of two different brands. Untainted regular gasoline remains at $3.999/gallon. EOC blockaded in-place 501(c)(3) rescue forces eager to collaborate with government agencies to save lives in peril due to Hurricane Florence. Dr. Perrodin interviewed Katie Pechon and Jamie Hough of Triton Relief Group to obtain true, at times horrific, accounts of rescue efforts attempting to assist the Carolinas. WHAT IS TRITON RELIEF GROUP? Triton Relief Group (TRG) is a non-profit, registered, 501(c)(3) organization committed to our goal of providing a helping hand, where it's needed, through rescue, charity, donations and support. TRG has morphed from rescue to providing relief efforts; delivering food, water, medicine and much more. It has a huge store of experience and wisdom with several members with military training and numerous special certifications. WHAT IS A 501(c)(3) AND WHY DOES THAT MATTER? Being "501(c)(3)" means that a particular nonprofit organization has been approved by the Internal Revenue Service as a tax-exempt, charitable organization. "Charitable" is broadly defined as being established for purposes that are religious, educational, charitable, scientific, literary, testing for public safety, fostering of national or international amateur sports, or prevention of cruelty to animals and children. Triton Relief Group ensures that all donations to support the organization are diligently routed to supporting the boots-on-ground efforts of the rescuers – from diesel fuel to meals for weary rescuers. As the organization skillfully uses technology, it has very little overhead and dispatchers work from their homes, not an office complex. WHAT HAS IMPROVED IN RESCUES SINCE LAST YEAR? Katie quickly noted the technology app, Zello, has sharply improved to allow for confidential communications and that TRG follows FEMA response protocols preventing an overlap of rescue dispatches with other agencies. TRG also has a more efficient ticket system and conducts background checks on all members. Despite these gains, significant barriers arose… WHAT IS WORSE THAN RESCUES LAST YEAR? Katie and Jamie, a boat captain who had conducted numerous rescues in Hurricane Harvey, agreed that government EOC, or Emergency Operation Centers, were passively refusing to cooperate with TRG – to the point where TRG had numerous boats in the Carolinas before flooding impacted communities. It's difficult to determine the root bottlenecks in EOC as state governors were openly supportive of not-for-profit rescue forces assisting local municipalities. Through his first-hand stories, Jamie expressed frustration that local governments would call for help, but then refuse to accept it and not explicitly state concerns of liability or, as Dr. Perrodin suggests, perhaps FEMA's EOC's stubbornness was due to the agency's unwillingness to admit that it could not maintain the “social contract” of the government being able to protect its citizens. Dr. Perrodin believes the hesitation resides at the federal level of FEMA EOC and is manifested at sub-levels through informal directives.  The 10th Amendment appears to have supported previous large-scale civilian rescues forces on 09/11/01 and again with Hurricane Harvey in 2017 - both of those with much less technical resources, expertise and scalability of Triton Relief Group. WHAT IF WE OUTLAW CIVILIAN RESCUE FORCES? In the early morning of September 9, 2016, Bill Moore, CEO of the Austin-based walkie-talkie app company Zello, contacted the Middle East Media Research Institute. He was seeking a copy of a report MEMRI had recently published describing how ISIS members and supporters were using Zello, which allows people to send voice messages to each other in private and also public channels. Moore had learned about the findings through a Google Alert.

When we think of rescuers, our thoughts default to police, fire and EMS. However, another group, much less formal, has been significantly involved in natural disaster rescue efforts across the southern US, primarily Louisiana and Texas, for the past decade. That assembly is referred to as the “Cajun Navy” and identifies ad-hoc volunteer groups comprising private boat owners who assist in search and rescue efforts. These groups were formed in the aftermath of Hurricane Katrina and reactivated following the 2016 Louisiana floods and Hurricanes Harvey and Irma. WHAT IS CAJUN NAVY RELIEF? Katie Pechon, Administration & Public Information Officer for Cajun Navy Relief, explains to Dr. Perrodin that the “Cajun Navy” is now a blanket term for variants of the original group assembled after Katrina. This splintering of sub-organizations has introduced representation issues and efforts are underway to unify the group and to acknowledge the primary incident command structure. The core, verified organization is Cajun Navy Relief and it is a not-for-profit 501c that works alongside traditional government units, such as fire departments or National Guard. Yet, the role of the “Cajun Navy”, as a collective response system, is not sanctioned by the government and the function of the Cajun Navy, exactly how it operates, how it dispatches, and how it is sustained, remains hazy to those not directly involved with the group. SOCIAL MEDIA RESCUES. Zello, a company with just 14 employees, had its free “Walkie-Talkie” app become an integral communication tool between responders and people in need. Facebook Messenger was monitored by Katie, and others to create “tickets” to orderly dispatch literally thousands of volunteer rescue missions. REGULATING THE CAJUN NAVY. Ironically, a few legislative bills surfaced in 2016 that would have imposed regulations, such as mandated training and licensing fees, upon this volunteer group. With a smile, Katie stated such acts would be fruitless as the CNR rescuers would respond to those in need and act in the best interest of people over compliance with seemingly frivolous laws. She added that the CNR interfaced efficiently, and was fully embraced by, Texas government officials as Hurricane Harvey hammered the state. The pressing need appears to be ensuring that imposters are scrubbed from response situations. DOING MORE THAN YOU THINK. The YouTube version of this episode includes behind-the-scenes photos of Cajun Navy Relief prying blackened drywall from homes, loading helicopters and comforting tired, grief-stricken people. I was surprised to learn that CNR members are still re-building homes in Louisiana damaged in a flood nearly a year ago! The CNR scales up quickly as a rescue group and then remains, sometimes for months, to sustain recovery projects. This is funded from donations or paid from the wallets of volunteers. This type of “all hands on deck” mentality makes America strong and capitalizes upon the tacit knowledge, kindness and grit of those giving of their time, talents and resources to support rescue efforts - be it a crew in a boat or persons monitoring social media posts for help. Telegram es una aplicación de mensajería y comunicación con altísimos niveles de privacidad. Es como un WhatsApp pero súper seguro y con más funciones como poder sincronizarse con computadoras de escritorio y enviar archivos grandes con toda seguridad y sin compresión. Por ejemplo las notas de voz -tan populares últimamente en Colombia- funcionan igual de bien que en WhatsApp pero con mucha mayor calidad de sonido. También puedes enviar emoticones normales y otros 'nativos' de la aplicación con imágenes más bonitas. Pero además puedes crear tus propios "emoji". Y si envías una dirección web por Telegram, el enlace muestra una vista previa para que sepas de antemano si quieres entrar o no. Eso es utilísimo para ahorrar datos del plan telefónico.Pero la característica más promocionada de Telegram es la privacidad. Por ejemplo tiene mensajes que se autodestruyen al leerse, así como en la versión clásica de Misión Imposible. Quizás esa es la razón por la que se cree que grupos terroristas y beligerantes han estado usando Telegram para comunicarse y para hacer difusión de sus ideologías. Al grabar este episodio podcast, el listado de canales y cuentas que habían sido canceladas por difundir propaganda terrorista era de 78.
