Der Paragraph §110 BGB erlaubt es minderjährigen Personen im Alter von 7 bis 18 Jahren, Geschäfte auch ohne ausdrückliche Zustimmung der Erziehungsberechtigten abzuschließen. Dies gilt allerdings nur, wenn die Ware oder Leistung mit Mitteln bezahlt wird, die dem Kind oder Jugendlichen zur freien Verfügung überlassen wurden. Dieser Paragraph wird auch als Taschengeldparagraph bezeichnet und ist sicher für alle Podcastzuhörer interessant, die Kinder in diesem Alter haben. Den Kindern haben dadurch auch das Recht, diese Geschäfte alleinverantwortlich zu tätigen. Eltern können daher über nur die Höhe des Taschengeldes steuernd eingreifen. In Österreich gibt es eine ähnliche Gesetzesregelung. Dort ist es der Paragraph 170 Abs. 3 ABGB, welcher auch als Wurstsemmelparagraph bezeichnet wird. Ich wünsche Dir eine erfolgreiche Woche.
