In this episode, we are joined by Professor Jens Scherpe (Professor of Comparative Law at Aalborg University, and academic door tenant at QEB), and our very own Resolution Cohabitation Committee Chair, Graeme Fraser (Head of Family at William Sturges) to discuss what model of cohabitation law reform should be introduced in England & Wales. This is a seminal moment for Resolution. It has been campaigning to achieve family law remedies for cohabitees almost since its inception in 1983, with it being high on its list of priorities since the mid-1990s. The new government has confirmed they are committed to cohabitation reform, so what shape should that take? What Resolution members know is that the general law is not good enough for families. If you need convincing, Jens guides us to think - do you think cohabiting families are families? If yes, then you need family law remedies (rather than remedies for people with no connection because purpose of family law (unlike general law) is to address societal, financial and gender imbalances that arise from being a family. Which model would you support? Do you think, we should: Assimilate the law for cohabitees – so use the same framework that we do for married couples; OR have aDifference model - so there is a clear difference between the remedy for a cohabiting couple, or a married couple. With all family law remedies, you then need to decide are you: a. Compensating a partner for the loss they have experienced generated by the relationship; OR b. Sharing the fruits of the relationship both parties have participated in. Graeme and Jens explore the law for cohabitees in Scotland, Ireland and Australia to consider the pros and cons of each model. Local MP Grant McCullum has been asking Transpower to compensate people with discounted transmission fees for a year. Nurse practitioners who work in private practice are calling on the provincial government to pay them out of public funds, using a system similar to how it pays family doctors. Right now, patients making appointments to be treated by nurse practitioners in a private practice have to pay out of pocket. The government argues it needs nurse practitioners in the PUBLIC system, in particular, on the new family care teams. It doesn't want to cover fees for nurse practitioners who work in private practices. But that doesn't sit well with the Newfoundland and Labrador Nurse Practitioner Association. Tom Osborne is the province's Minister of Health, and he spoke with the CBC's Darrell Roberts.
The Council of Europe recently voted to use seized Russian assets to fund Ukraine's reconstruction. The US House of Representatives has approved billions of dollars in aid to help Ukraine combat Russia's invasion, also authorising the US government to take frozen Russian central bank assets held in US jurisdictions to help rebuild the country. In April, Ukraine's Register of Damage started taking claims relating to residential property – a first step in the international compensation mechanism, a framework established in response to recommendations by the UN.
In Kansas, individuals must pay a 6.5% sales or use tax when purchasing any vehicle that is primarily stored or used in the state. This is paid either at the dealership or at a county treasurer's office. Ultimately, KDOR is responsible for collecting motor vehicle sales and use tax from dealerships and counties. The Kansas Department of Revenue had procedures to help ensure dealerships remit vehicle tax but was missing several key procedures related to county tax remittance. We saw evidence that KDOR had several procedures related to training and guidance for counties and dealerships as well as procedures related to the monitoring and enforcement of dealerships. However, KDOR was missing several procedures related to the monitoring and enforcement of counties. One county didn't remit taxes for 15 months, resulting in about $11 million in delinquent taxes. Additionally, KDOR's lack of written procedures means efforts to ensure that individual buyers and dealerships are remitting aren't as effective as they could be. And KDOR's MOVRS database had significant errors, preventing us or them from doing a state-wide analysis.
