In this episode of The Art Bystander, Roland-Philippe Kretzschmar enters a conversation with Michèle Lamy and Scarlett Rouge.Michèle Lamy is often introduced in relation to Rick Owens, but that has always felt like an incomplete way of understanding her.Born in France's Jura region in 1944, into a family shaped by the Resistance, Lamy studied law in Lyon, attended the philosophy lectures of Gilles Deleuze and worked as a criminal defence lawyer while also performing striptease and cabaret.In 1979, she moved to Los Angeles without having visited the city. There she established her clothing line, created Café des Artistes and Les Deux Cafés, and treated hospitality as a form of theatre.Around 1990, she hired a pattern cutter named Rick Owens. Their working relationship became a partnership in life, and by 2003 they had moved to Paris and were building Owenscorp together. Lamy's work has since moved through furniture, jewellery, music, film, performance and boxing. She has variously described herself as a storyteller, performer and entrepreneur, resisting any single professional title.Joining her is her daughter, Scarlett Rouge, an interdisciplinary artist raised between California and France. The daughter of Lamy and experimental filmmaker Richard Newton, and Owens's stepdaughter, Rouge trained in photography at CalArts before developing a practice across painting, installation, sculpture, video, textiles and performance.Her work draws on myth, symbolic language, Jungian thought and ritual, asking how art might reconnect spirit and matter. Im aktuellen Podcast mit Stefan Brink und Niko Härting haben wir es mit strengen Gesetzen und erleichternden Ausnahmen zu tun: Zunächst sprechen wir (00:34) über das Urteil des LG München I (42. Zivilkammer) vom 31. Juli 2026: Es hat die Ansprüche der GEMA auf Unterlassung, Auskunft und Schadensersatz gegen Suno, einen US-KI-Musikgenerator, überwiegend bestätigt. Bereits im November 2025 verurteilten dieselben Richter Open AI, weil deren KI-Modell ChatGPT auf simple Eingaben hin Liedtexte von Helene Fischer, Herbert Grönemeyer und Reinhard Mey ausgab; sie sahen darin eine Urheberrechtsverletzung (Urteil vom 11.11.2025). Jetzt geht es um Musik. Und hier bietet das LG den Rechteinhabern eine prozessuale Beweiserleichterung an: Erzeugt ein KI-Modell Inhalte, die einem Trainingswerk deutlich ähneln, spricht dies aus Sicht der Richter dafür, dass das Werk auch im Modell enthalten ist. Bereits das Angebot des Musikgenerators verletzt demnach das Urheberrecht der öffentlichen Wiedergabe. Sodann sprechen Niko und Stefan (15:31) über einen Fall, der in aller Munde ist: Eine Frau klagt gegen eine ehemalige Freundin, beide hatten sich über WhatsApp zu den Verhältnissen am Arbeitsplatz der Klägerin in einer Arztpraxis ausgetauscht. Nach einem Streit leitete die ehemalige Freundin die Nachrichten an den Arbeitgeber weiter, der kündigte darauf der Klägerin. Nun begehrt sie Schadensersatz von der Ex, immerhin 7.500 € aus Art. 82 DSGVO. Da eine Übermittlungsgrundlage aus Art. 6 DSGVO offenbar fehlt, stellt sich die Frage, ob die Haushaltsausnahme in Art. 2 Abs. 2 lit. c DSGVO greift. Diese gewährt Erleichterungen, wenn eine Datenverarbeitung „durch natürliche Personen zur Ausübung ausschließlich persönlicher oder familiärer Tätigkeiten“ erfolgt. Der BGH wird hier wohl den EuGH um Rat fragen. Schließlich geht es (28:16) um Metas Smart Glasses: Seit Juni 2026 werden stylische Brillen angeboten, die weit mehr können als Sehschwächen auszugleichen oder die Sonne abzuschirmen. Über eingebaute Lautsprecher lässt sich Musik hören, eingebaut sind 6 Mikrofone und eine 12-MP-Kamera mit 3K-Auflösung mit über 8 Stunden Akkulaufzeit, die kann via KI beispielsweise Texte aus fremden Sprachen übersetzt. All das funktioniert per Sprachsteuerung oder durch Berührung des Brillengestells. Eingesetzt werden sie inzwischen millionenfach von digitalaffinen Menschen, häufig auch von Sehbehinderten und Menschen mit altersbedingtem Hörverlust. In der Kritik steht aktuell der mögliche Kameraeinsatz mit Aufnahmemöglichkeit, bei Metas Brillen gibt es allerdings eine Besonderheit: eine rote LED-Lampe leuchtet an der Brille bei Aufnahmen, um heimliches Fotografieren und Filmen zu unterbinden. Im Sommerloch kümmert sich der Hamburgische Datenschutzbeauftragte um das Tool, er betont: „Es ist nicht erlaubt, andere Menschen gezielt ohne ihre Zustimmung zu fotografieren oder zu filmen. Erst recht dürfen solche Aufnahmen nicht ins Internet gestellt werden. Das Recht auf Privatsphäre gilt auch im öffentlichen Raum.“ Und verschärft: „Scheuen Sie sich nicht, dafür auch den Polizeinotruf 110 zu wählen.“ Das Aufnehmen von Personen mit den Meta Glasses verstoße eindeutig gegen das Datenschutzrecht, zudem sei dieses Produkt klar gemäß § 8 TDDDG zu verbieten – was allerdings der BNetzA obliegt. Auch hier wieder die Frage: Greift für die NutzerInnen der Brille – denn diese sind datenschutzrechtlich verantwortlich - die Haushaltsausnahme in Art. 2 Abs. 2 lit. c DSGVO? Da wären viele erleichtert. Übrigens auch alle, die mit ihrem Smartphone in der Öffentlichkeit Fotos machen. Wir werden sehen …

Niko Härting und Jan Hemann (HÄRTING Rechtsanwälte) sprechen mit Rechtsanwalt Peter Schantz über die von der Bundesregierung geplante Reform des Rechts der Nachrichtendienste, insbesondere was den Bundesnachrichtendienst (BND) angeht. Peter Schantz ist mit dem Thema vertraut und hat für die Gesellschaft für Freiheitsrechte (GFF) eine kritische Stellungnahme verfasst. Schantz befasst sich seit vielen Jahren mit Fragen des Datenschutzes und der Bürgerrechte und war mehrfach an Verfassungsbeschwerden beteiligt. Bis Ende 2024 war er zudem Abteilungsleiter im Bundesministerium der Justiz (BMJ). Härting, Schantz und Hemann sprechen unter anderem über folgende Fragen und Themen: Evolution oder Revolution? Was ist von der Abkehr vom Trennungsgebot zu halten? Strategische Fernmeldeüberwachung („Datenstaubsauger“), welche Änderungen sind geplant? „Staatstrojaner“: Welche Befugnisse soll der BND erhalten? Welche Befugnisse soll der BND im Inland und gegenüber deutschen Staatsangehörigen erhalten? Mehr Befugnisse, weniger Kontrolle? Welche Möglichkeiten des Rechtsschutzes werden Betroffene haben? No sábado, a polícia recorreu à força para inviabilizar uma actividade da Jura, o braço juvenil da Unita, no Uíge, no norte do país, alegando que o encontro estava previsto num "local impróprio". Contudo de acordo com a Unita que dá conta de 31 feridos, dez dos quais em estado grave, as forças da ordem usaram gás lacrimogéneo e munições "de caçadeira" contra militantes e populares, criando o que o secretário-geral desse partido de oposição qualificou de "estado de guerra" no Uige. Estes incidentes -em período pré-eleitoral- não deixaram de suscitar condenações de formações de oposição como a PRA Já, o Bloco Democrático ou ainda organizações como a 'Friends of Angola', sem mencionar o partido moçambicano Renamo, sendo que a própria Unita declarou que "iria deixar de apelar os angolanos à serenidade". Em entrevista concedida à RFI, a activista angolana Laura Macedo evoca o momento que se vive em Angola, dá conta de expressões de intolerância política e analisa os incidentes registados neste fim-de-semana. RFI: Como analisa os acontecimentos de sábado no Uíge? Laura Macedo: A intolerância por parte do governo, nós próprios, a sociedade civil, nós temos sentido quando tentamos organizar alguma coisa na rua. Nós cumprimos todos os procedimentos que a lei exige, a Lei n°16/91, que é a lei sobre o direito de reunião e manifestação. E nós vemos que as autoridades administrativas não querem saber. Eles não ligam nenhuma. Eles não cumprem. A lei, por exemplo, diz que as autoridades administrativas, em caso de algum impedimento, devem responder aos proponentes da acção em 24 horas. Isso nunca aconteceu. Eu nunca vi aqui, por exemplo, nós em Luanda, o pessoal de Benguela, da Huíla, a receberem uma resposta, uma carta das autoridades administrativas a dizerem que não é possível esta actividade "por isto, por isto, por isto". Eles deixam estar aquilo. Recebem a documentação, ignoram e depois, no dia ou na véspera, eles dizem que não, que não podemos fazer esse percurso. Com a Unita aconteceu precisamente a mesma coisa, desta vez no Uige. Eles informaram o governo da província o que é que ia se passar ali. Inclusive, na quinta-feira, que foi o dia da chegada do Adalberto Costa Júnior, o presidente da Unita, a população começou logo a ser impedida de circular na cidade. A polícia de choque estava ali para impedir que a população circulasse. Não entendi porquê. Naquela altura houve algum desconforto da parte de simpatizantes e militantes da Unita também. O MPLA teve o cuidado de durante a semana ir engalanar a cidade com bandeiras deles, fitinhas de bandeiras. Chegou inclusive a pôr uma bandeira perto da sede da Unita, o que causou um desconforto e uma revolta aos militantes e simpatizantes que nunca tinham visto aquilo ali, a não ser junto da sua sede. No acampamento da Jura, há vídeos a circular, houve uma tentativa por parte de jovens da JMPLA invadirem o acampamento da Jura, que era no Negage (no Uige). A Jura faz todos os anos o que eles chamam a "fogueira do militante". Eles fazem-na todos os anos e fazem-na sempre fora de Luanda. Vão sempre para uma província. E eu acho que o MPLA está tão desconfortável, está com tantos problemas dentro dele que tem medo de as comunidades se comecem a aproximar cada vez mais da Unita. Aliás, eles estão a ver as comunidades a cada vez mais apoiarem a Unita. RFI: E precisamente está a abordar a questão das divisões no seio do MPLA. Esta ocorrência, a seu ver, teria, por exemplo, o objectivo ou o efeito, pelo menos, de distrair as atenções sobre o facto de no seio do partido no poder, haver uma luta renhida para aceder à candidatura à presidência do partido e à Presidência também do país? Laura Macedo: O problema é que a ala de João Lourenço e eu vou-lhe chamar mesmo assim, não quer largar o poder. E eles sabem perfeitamente aquilo que João Lourenço fez a José Eduardo (dos Santos). Todos estamos lembrados que José Eduardo largou a Presidência da República, foi forçado e acabou por aceitar. E quando houve eleições e João Lourenço sentou na cadeira de Presidente da República, a primeira coisa que fez, foi tirar José Eduardo da cadeira do MPLA. Porque quem está na Presidência da República, quando o MPLA estiver na Presidência da República, se não mandar no MPLA, sabe que tem os dias contados. Portanto, vai ter que obedecer a quem estiver na cadeira do partido. Então, este é o grande problema. Eu já venho a denunciar há muito tempo de que, não havendo possibilidade de João Lourenço se manter na Presidência da República, porque são só dois mandatos, João Lourenço e os seus assessores e os seus sequazes iam tentar de todas as maneiras, provocar acções que pudessem levar antes das eleições, a uma situação em Angola que nos levasse a um Estado de sítio, onde ele pudesse continuar no poder. Esse é que é o grande problema. Nós vemos muitas coisas absurdas aqui. A Presidência da República está a tomar conta de espaço, está a ceder espaços inegociáveis, como pequenos bosques dentro da cidade, estão a ocupar, estão a ceder a grupos internacionais, com a participação de gente que está na Presidência da República. Nós vemos cada vez mais empréstimos, empréstimos, empréstimos. Ainda agora ouvimos falar de mais um empréstimo de mil milhões (o executivo angolano validou na semana passada um acordo de financiamento entre o Estado e o banco francês Société Générale no valor de mil milhões de Euros para programas de investimento público). Quer dizer, um homem que está em fim de mandato, está a fazer estes empréstimos. Ele sabe, ou devia saber, que não vai ficar mais lá, que não vai poder gerir estes empréstimos. Eu vejo é que eles estão a querer sugar o máximo de dinheiro possível ao Estado. Realmente é a mesma cena que aconteceu aquando da saída do Presidente José Eduardo. As pessoas que o rodeavam, que tinham grande influência sobre ele, também fizeram a mesma coisa. RFI: Relativamente aos acontecimentos deste fim-de-semana, a Unita reagiu dizendo que não iria mais apelar à população a guardar a calma. A seu ver, o que é que isto pode dar? Laura Macedo: Eu também ouvi. Quer dizer que a população tem que começar a agir, agir não atacando. Não é para atacar, é para se manter firme. A população tem que se manter firme, a população tem que conhecer as leis e obrigar as autoridades a cumprirem também a lei. Eu acho que é isto que a Unita quis dizer. Tenho plena certeza que foi isto. E é isto que eu digo sempre. Se a polícia não nos deixa passar aqui, nós ficamos aqui. Isto é uma forma de protesto. Nós fizemos isso o ano passado, quando foi daquelas três manifestações que foram organizadas pela sociedade civil. Eles não nos deixaram fazer o percurso também violando a lei, porque nós não fomos comunicados que não iríamos passar por ali. As autoridades administrativas não alteraram o percurso por nós marcado e, no dia, quiseram que nós mudássemos o percurso no momento e nós não aceitamos. Aconteceu, por exemplo, com a marcha do MEA (Movimento dos Estudantes Angolanos), na senda da subida dos combustíveis e a consequente subida das propinas. E nós paramos na zona do Zé Pirão, um cruzamento que é crucial dentro de Luanda. Estivemos ali quatro horas. O que é que nós vimos? As autoridades a cortarem o sinal da internet. Não houve confusão, não houve repressão por parte da polícia, Mas nós, pura e simplesmente paramos ali. E como é uma zona com muitos prédios, eles ficam com receio de reprimir, porque nós que estamos no chão, eles conseguem nos tirar os telefones. Mas a quem está dentro da sua casa, nas varandas a filmar, eles não conseguem ir buscar os arquivos dessas pessoas. Então eles ficam com receio que saiam as imagens, mas este é o procedimento usual das autoridades aqui do meu país. RFI: Tem observado, à medida que nos aproximamos do período eleitoral, algum nervosismo, manifestações de intolerância política? Laura Macedo: Tenho sim, principalmente por parte dos jovens afectos ao MPLA. A Unita esteve a fazer uma campanha de angariação de novos membros aqui em Luanda e os jovens da Unita andavam sob a égide do seu Secretariado Provincial de Luanda. Andavam com umas mesinhas, a sua bandeira, as fichas de inscrição e paravam em determinadas vias. E o absurdo foi que jovens do MPLA tentavam desmantelar estas mesas, tentavam que eles levantassem dali e, inclusive, usaram as autoridades Administrativas para proibir que estas bancas que a Unita foi montando um pouco por todo o lado, surtissem efeito, como forma de amedrontar a população. Então veja o ridículo. A fiscalização de algumas administrações resolveu aproximar-se destas bancas e pedir um alvará. A Unita não é um partido comercial. Queriam que aqueles jovens, aquelas pessoas da Unita que estavam ali, lhes apresentassem o seu cartão de vendedor ambulante. A Unita não estava a vender nada. A Unita não vende nada. E veja o absurdo, numa nítida provocação aos militantes que ali estavam e como forma de amedrontar quem quisesse se aproximar dessas bancadas. Portanto, isto é um acto de violação do direito do cidadão. E a lei dos partidos permite isso, porque o próprio MPLA faz isso. O próprio MPLA não faz nenhuma actividade, não há uma actividade do MPLA que eles não fechem ruas, por mais pequena que seja. O MPLA põe e dispõe. E aí está o grande problema de não haver eleições autárquicas. Daí, que o MPLA não quer eleições autárquicas, porque nenhum autarca iria permitir, nenhum autarca saído, por exemplo, da sociedade civil, iria permitir que um partido chegue e feche ruas. Os secretários provinciais são o governador provincial em todo o lado, o subsecretário municipal e o administrador. Quer dizer, há uma confusão entre o MPLA e o Estado. Daí que nós chamamos ao MPLA o "partido-Estado". O seu presidente é o presidente do partido, o governador é o secretário do partido, o administrador é o secretário do partido, lá onde ele estiver. E isso é errado. Tem que mudar. E para mudarmos isso, temos mesmo que ter eleições autárquicas. RFI: Entretanto, tudo isto acontece numa altura em que acaba de entrar em vigor a nova lei sobre a desinformação e as 'fake news'. Como é que reage à entrada em vigor deste texto, que desencadeou alguma polémica e uma forte oposição? Laura Macedo: O grande problema aqui com esta lei das 'fake news', como eles lhe conseguiram chamar, é quem é que produz 'fake news' aqui? É precisamente a gente do governo e a gente do MPLA. Nós vimos, por exemplo, só para ter uma ideia, a CNN fez uma matéria sobre os acontecimentos do Uige com a sua legenda própria. O que é que o pessoal do MPLA fez? Mudou a legenda. A legenda está em inglês. Mudou a legenda e colocou dizendo que "um partido da oposição queria tomar uma das províncias de Angola". Isto é que é 'fake news'. Quem produziu? Vamos ver as autoridades policiais a investigarem de onde partiu esta alteração a um pequeno vídeo que até veio lá de fora? Não vamos porque foi gente do MPLA que fez. Esse é que é o grande problema. No dia em que eu escrever alguma coisa, que eu puser alguma nota nas minhas redes sociais que não seja real, ou que eu partilhe alguma nota que não seja real, o que é que vai acontecer? Eles não vão procurar a fonte. Eles vão-me atacar a mim, porque eles andam mortinhos todos por nos calar. Esta lei é igual à lei do vandalismo, que é para nos parar, mas eles não nos vão conseguir parar. Nós estamos aqui, estamos firmes. Nós queremos mudança. Nós queremos um governo que cuide principalmente dos angolanos sem nada. A nossa preocupação é com estes angolanos. Eu não estou preocupada com a minha situação. Estou preocupada com a situação daqueles lá que não tem absolutamente nada.

„Juristen werden überall gebraucht“ – auch im Journalismus: Zum Auftakt unserer Sommer-Serie über Berufsfelder für Juristen sprechen wir über den Weg vom Jurastudium in die Medienbranche.

Was passiert, wenn ein Rechtssystem so überlastet ist, dass die Klärung selbst einfacher Rechtsfragen mehrere Jahre dauert? Und ist Jura nicht perfekt für den Einsatz von KI geeignet - Texte lesen, logische Schlüsse ziehen, Dokumente schreiben? Und werden wir in Zukunft überhaupt noch so viele Anwälte brauchen? Es ist keine Überraschung, dass "Legal Tech" einen absoluten Höhenflug hat. Einer der Superstars in der Branche ist Libra - ein Berliner Startup, das nach nur zweieinhalb Jahren bereits millionenschwere Umsätze verzeichnet und inzwischen Teil von Wolters Kluwer ist, einem der ganz großen Player im Anwaltsgeschäft. In unserem Gespräch mit Viktor von Essen, dem Gründer von Libra, wird uns schnell klar, wie extrem schnell und herausfordernd dies ist. ViktorsTeam hatte in der Nacht davor gerade ein wesentliches neues Release veröffentlicht, und wir konnten live während der Aufnahme die Taktzahl des Startups erleben... Aber es ist eben doch nicht so, dass "die KI" die Anwälte ersetzt. In Anwaltskanzleien lässt sich eine große Zahl von Abläufen tatsächlich vereinfachen oder automatisieren. Dazu braucht es eine große Datenbasis - aber auch viel menschlichen Sachverstand. Letztlich ist Rechtssprechung eben kein mathematischer, rein sachlogischer Algorithmus, sondern das Gestalten von Fairness und Gerechtigkeit von Mensch zu Mensch.

Unser heutiger Gast, Ronen Steinke, hat sich aus seinem Wissen - er ist promovierter Jurist und Lehrbeauftragter - einen hübschen Teppich gewebt, der u.a. aus journalistischer Arbeit für die sz, einem eigenen Podcast und einigen vielbeachteten Büchern besteht, die regelmäßig auf den Bestsellerlisten landen. Und regelmäßig wird die Arbeit des 1983 in Erlangen geborenen und in Nürnberg aufgewachsenen Journalisten ausgezeichnet. Was sicherlich seiner Fähigkeit geschuldet ist, dieses doch recht trockene, umfangreiche und auch einschüchternde Metier nachvollziehbar und alltagstauglich aufzubereiten mit Büchern wie „Jura not alone“ oder „Meinungsfreiheit“. Über Ronen Steinkes Musikgeschmack ist bisher nichts an die Öffentlichkeit gedrungen, über Geschichten aus seiner Kindheit und Jugend konnten wir bislang nur spekulieren. While the podcast team is taking a Radical Sabbatical, Kim is interviewing authors of the books that have had a big impact on her in the past two years.  In this episode, Kim speaks with Steven Johnson, co-founder of Notebook LM, not about AI but about his book, The Infernal Machine: A True Story of Dynamite, Terror, and the Rise of the Modern Detective.  They start with the story of how the Swiss dominated the watch industry for over a century, thanks to a highly decentralized network of cottage laborers in the Jura mountains. The culture of autonomy in the industry was so strong that it turned Swiss watchmakers into some of history's first anarchists, which in the 19th century simply meant self-organization. The movement became associated with disorder and violence after many anarchists adopted Nobel's invention of dynamite as their weapon. The public outcry against their violent attacks on heads of state and industry led to many modern surveillance techniques, including wiretapping and fingerprinting..  Steven and Kim speculate that some approaches to company-building in Silicon Valley have embraced bottom-up self-organization principles of the Jura mountains. They explore how we might have a viable alternative to capitalism and socialism today if anarchists had not embraced dynamite. Nous sommes à Saint-Imier, dans le Jura suisse, vers 1876. L'industrie horlogère prend son essor. Avec elle, le capitalisme impose une nouvelle mesure du temps. Partout surgissent des bouleversements techniques : la photographie, le télégraphe, le rail, la standardisation du travail, l'uniformisation de l'heure. Le film suit plusieurs personnages, parmi lesquels Joséphine, ouvrière et "régleuse" : elle ajuste le balancier, ce minuscule ressort qui fait battre la montre mécanique. Bientôt, elle croise le voyageur russe Piotr Kropotkine et découvre les cercles anarchistes. Unrueh, le film de Cyril Schäublin, place cette ville horlogère au centre de ces transformations. Mais il renverse les codes du film historique : les personnages restent en marge, tandis qu'au premier plan, c'est la machine qui s'impose, une grande machine minuscule : la montre, avec le temps et le balancier. Un mot, Unrueh, qui signifie à la fois ce cœur battant de la mécanique et le désordre qui secoue le monde. Cyril Schäublin, réalisateur du film Unrueh, sorti en 2022, s'entretient avec Andreas Fontana, lui aussi réalisateur.
