Die beiden Podcaster können auch Entscheidungen loben: Ab Minute (20:09) sprechen Härting und Brink über eine Entscheidung des BAG v. 20.2.2025 – 8 AZR 61/24, in der die Parteien über einen Schadensersatzanspruch gemäß Art. 82 Abs. 1 DSGVO wegen einer verspäteten Auskunft stritten. Der Kläger befürchtete einen Kontrollverlust und dass die Beklagte ,,Schindluder“ mit seinen Daten treibe. Das BAG sah keine substantiierte Darlegung eines immateriellen Schadens.

Ashleigh Barrowman and I first met in Marlborough — Waterfall Bay to be precise. We were hosting hospo folk and wine retailers for a few days foray into MANA Winegrowers — a Marlborough collective of like-minded producers hell bent on sharing the love of the region through the lens of organic farming. At that time, Seresin was still a MANA member, which meant we had the very good fortune of kicking back in the bach of winery owner and Hollywood famous DOP, Michael Seresin (If you've watched Dawn of the Planet of the Apes, Harry Potter and the Prisoner of Azkaban, then you know his work). The pad, a piece of perfection by Architect Pete Bossley, set the scene for an extremely memorable few days talking shitski with people from the booze biz. Ashleigh and I clicked. I really enjoyed her company and we threatened each other with keeping in touch after that gig was over. We didn't. But – I did watch on with deep admiration when she resurfaced a few years later visibly determined to dedicate herself to the craft of making jolly good wine. Ashleigh's pathway into making her own gear was not known to me at all. Abschließend sprechen Niko und Stefan (27:56) über das Urteil des OLG Frankfurt a.M. (10.07.2025 - 6 UKl 14/24): Die Deutsche Bahn wollte den Erwerb von „Spar“- und „Super-Sparpreistickets“ nur gegen Mailadresse oder Handynummer ermöglichen – einer Unterlassungsklage von Verbraucherschützern gab das OLG nun statt. Eine Einwilligung sei mangels Freiwilligkeit nicht wirksam, für die Vertragserfüllung seien die Angaben ebenso wenig erforderlich wie für die Verwirklichung überwiegender berechtigter Interessen. So viel Scheitern war selten!

Die Zahl der Zivilprozesse ist seit 20 Jahren stark rückläufig, zugleich dauern die Verfahren immer länger. Liegt es an den Anwältinnen und Anwälten, deren Schriftsätze immer länger werden? Liegt es an dem vielfach unstrukturierten Vortrag der Parteien, den die Richterinnen und Richter oft nur mühsam durchdringen können? Brauchen wir Regeln zum strukturierten Parteivortrag? Kann verstärkte Digitalisierung hilfreich sein? Wird KI die Arbeit der Gerichte erleichtern oder kann KI ganz im Gegenteil dazu führen, dass Schriftsätze noch umfangreicher und unübersichtlicher werden? Niko Härting hat kürzlich vor „Gemächlickeit“ in der Justiz gewarnt (https://rsw.beck.de/aktuell/daily/magazin/detail/editorial-njw-2025-22-probier-s-nicht-mit-gemaechlichkeit). Leif Schubert, der seine Karriere als Associate einer Großkanzlei begann und dann in die Justiz wechselte, hat ihm entschieden widersprochen. Müssen sich Gerichte noch viel entschiedener um beschleunigte Verfahren bemühen, gesetzliche Fristen strikt einhalten und den Parteien viel frühzeitiger als üblich Hinweise erteilen, um eine ausufernde Schlacht der Schriftsätze einzudämmen? Brauchen wir nicht Regeln der „strukturierten Prozessleitung“ mit frühzeitigen Videoterminen, um die Verfahren nicht ausufern zu lassen? Aquel acto, celebrado en la Plaza Matriz, frente al Cabildo de Montevideo, reunió a una multitud de civiles, autoridades políticas y militares que juraron respetar y hacer cumplir aquella carta magna. El texto proponía un gobierno republicano y representativo, con poderes separados y derecho al voto. Sin embargo, al ser aquel un voto censitario, ese derecho estaba restringido a ciertos grupos de la población y quedaban excluidas mujeres, peones de sueldo, soldados de línea y analfabetos, entre otros. A pesar de estas limitaciones, la Constitución de 1830 fue un avance significativo que marcó el nacimiento del Estado uruguayo como nación independiente y soberana. A 195 años de aquel acontecimiento, ¿qué representa hoy aquella Constitución? ¿Qué legado dejó? ¿Qué conserva nuestra Constitución actual con aquella de 1830?

Enfin, reconstruire pour « gagner des élections ». « Je veux faire se lever une vague bleue », a-t-il lancé en pensant aux municipales de mars 2026. À droite, la victoire de Bruno Retailleau signe le retour d'un espoir après plus de dix années dans l'opposition et une succession de revers électoraux dont LR ne s'est jamais vraiment remis. Welcome back, wine friends! This episode is all about the rebels — the wild ones — the winemakers who've ripped up the rulebook and gone their own way. We're diving deep into the world of declassified cult wines: the bottles that said "no thanks" to tradition-bound wine laws, and yet, somehow became some of the most expensive, most desired, and most obsessively followed wines on the planet. But before we get to the juicy stuff, let's set the scene. You know those cryptic acronyms on European wine labels — AOC, DOCG, and even Qualitätswein? They're steeped in history, tradition, and legal frameworks that protect the where, the what, and the how of a wine. They're there to ensure quality, consistency, and authenticity.  And yet, to some, those same laws can feel more like shackles than structure. Want to plant Syrah in Bordeaux? Or fancy making an orange wine in Chianti? You can't under AOC or DOCG rules. Even if your wine is mind-blowingly good, if it doesn't fit the mould, it gets dumped in the “Vin de France” or “Vino da Tavola” pile.
