This Day in Legal History: Dutch Low Countries Independence from SpainOn July 26, 1581, the Dutch Low Countries signed the Plakkaat van Verlatinghe, also known as the Act of Abjuration, formally declaring their independence from Spanish rule. This monumental document marked the culmination of a prolonged struggle against the oppressive policies of the Spanish Habsburgs, particularly under King Philip II. The Act of Abjuration justified the Dutch rebellion by asserting that a ruler who does not protect his subjects and instead oppresses them loses his legitimacy. The declaration was a pivotal moment in the Eighty Years' War (1568–1648), which ultimately led to the establishment of the Dutch Republic. The Act of Abjuration is often compared to the later Declaration of Independence of the United States, as both documents articulate the right of a people to overthrow an unjust ruler. The Dutch provinces, driven by the desire for religious freedom, economic independence, and political autonomy, took a bold step in severing ties with one of the most powerful empires of the time. The Plakkaat van Verlatinghe underscored the principle that sovereignty resides with the people, a concept that would influence political thought in Europe and beyond.By declaring their independence, the Dutch not only sought to free themselves from tyranny but also set a precedent for future nations seeking self-determination. The Act of Abjuration remains a significant milestone in the history of democracy and the fight for human rights. It symbolizes the enduring struggle for freedom and justice, themes that continue to resonate in contemporary political discourse. The California Supreme Court has upheld Proposition 22, allowing Uber, Lyft, and other gig economy companies to classify drivers as independent contractors. This unanimous decision supports the 2020 voter-approved law, preventing a significant shift in labor costs and maintaining the companies' current business models. Had the ruling gone against Prop 22, these companies would have faced increased costs and operational challenges in California, one of their largest markets.Following the ruling, shares of Uber, Lyft, DoorDash, and Instacart surged, though the gains later moderated. Justice Goodwin H. Liu stated that California's constitution does not prevent voters from passing initiatives affecting workers' compensation. He emphasized that this ruling does not bar future legislative decisions to extend workers' compensation benefits to independent contractors.Gig companies hailed the decision, emphasizing that it reflects the will of millions of Californians. However, labor advocates criticized the ruling, arguing it unfairly burdens gig workers by denying them essential protections like minimum wage, sick leave, and overtime pay. Advocates, including the plaintiff Hector Castellanos, renewed calls for unionization to combat these perceived inequities. The ruling is seen as a victory for gig economy companies but signals ongoing legal and legislative battles. States like Massachusetts, New York, Washington, and Minnesota have tackled gig worker classifications with varying strategies, indicating the complexity and ongoing nature of this issue.California Gig Workers to Remain Contractors, Prop 22 Upheld (2)Justice Elena Kagan has proposed that Chief Justice John Roberts appoint a panel of experienced and respected judges to enforce the US Supreme Court's newly adopted code of conduct. Speaking at a judicial conference in Sacramento, Kagan expressed trust in Roberts to establish such a committee. This suggestion comes amid controversy over reports of lavish gifts received by Justice Clarence Thomas, highlighting the need for an enforcement mechanism to accompany the recently adopted code of conduct.Kagan acknowledged the challenges in determining who should enforce ethics rules for the justices but emphasized the necessity of finding a solution. During her discussion at the US Court of Appeals for the Ninth Circuit's annual judicial conference, she also criticized the practice of justices writing multiple opinions in a single case. She argued that this complicates the work of lower courts and prevents the Supreme Court from providing clear guidance.Kagan specifically mentioned the court's fractured decision in United States v. Rahimi, where seven justices wrote separate opinions despite only one dissent. This case, which upheld a federal gun law related to domestic violence, illustrated divisions among the justices on interpreting firearm restrictions. Kagan's comments follow a term marked by several controversial Supreme Court decisions, including limiting federal regulatory power and providing immunity to former President Donald Trump for certain official acts.Elena Kagan Endorses High Court Ethics Enforcement Mechanism (1)Apple Inc. has agreed to adopt a set of voluntary artificial intelligence (AI) safeguards established by President Joe Biden's administration. These safeguards aim to guide the development of AI technology and encourage companies to protect consumers. Apple joins other tech giants like OpenAI Inc., Amazon.com Inc., Alphabet Inc., Meta Platforms Inc., and Microsoft Corp. in committing to test their AI systems for discriminatory tendencies, security flaws, and national security risks. The companies also pledge to share test results transparently with governments, civil society, and academia, and report any vulnerabilities. This commitment coincides with Apple's plan to integrate OpenAI's chatbot, ChatGPT, into its iPhone voice-command assistant. However, Elon Musk, CEO of Tesla Inc., has threatened to ban Apple devices from his companies if OpenAI's software is integrated at the operating system level, citing security concerns. Musk has his own AI startup, xAI, which has developed a chatbot named Grok.AI technology has become mainstream, but its use in areas like law enforcement, hiring, and housing has faced criticism for fostering discrimination. President Biden has emphasized the benefits of AI while also warning of its potential dangers, advocating for responsible industry practices. Although the White House guidelines are comprehensive, they are not enforceable, relying on companies to adhere to the standards voluntarily. In response to the challenges of regulating AI, Biden signed an executive order last year requiring powerful AI systems to undergo testing to be eligible for federal government purchase. He is set to receive an update on the implementation of this directive. Meanwhile, a bipartisan group of lawmakers in Congress has expressed interest in regulating AI, but legislation has not yet been prioritized.Apple to Adopt Voluntary AI Safeguards Established by BidenManhattan prosecutors argued that Donald Trump's conviction should stand despite a Supreme Court ruling that presidents cannot face criminal charges for official acts. In a recent court filing, prosecutors emphasized that the charges against Trump involved personal conduct, specifically the hush money payment to Stormy Daniels, and were unrelated to his presidential duties. Trump was convicted on 34 felony counts for falsifying business records to cover up the payment made by his lawyer, Michael Cohen, before the 2016 election. Trump denies the encounter and plans to appeal the verdict. Legal experts believe the request to overturn the conviction is unlikely to succeed as the conduct predates Trump's presidency. Trump's defense claimed the prosecution improperly used evidence of his official acts during the trial, including Twitter posts and testimonies from White House aides, but prosecutors argued these were related to personal matters. The judge, Juan Merchan, postponed sentencing to September 18 to allow Trump's lawyers to present their case. If the conviction is upheld, sentencing will proceed, and Trump can then appeal to a higher court.Trump hush money prosecutors say conviction should stand despite immunity ruling | ReutersThis week's closing theme is by Ludwig van Beethoven, a composer of some note.Ludwig van Beethoven, one of the most revered composers in the history of Western music, was born in 1770 in Bonn, Germany. His innovative compositions bridged the Classical and Romantic eras, leaving an indelible mark on music that continues to inspire and move audiences worldwide. Despite becoming profoundly deaf in his later years, Beethoven's prolific output includes symphonies, concertos, string quartets, and piano sonatas, showcasing his genius and resilience. One of his most remarkable works is the Piano Sonata No. 32 in C minor, Op. 111, completed on July 28, 1822. This sonata is the last of Beethoven's 32 piano sonatas, representing the culmination of his explorations in the genre. The piece is notable for its profound depth, structural innovation, and emotional intensity, characteristics that reflect Beethoven's mature style. The sonata consists of two contrasting movements. The first movement, "Maestoso - Allegro Con Brio Ed Appassionato," opens with a dramatic, solemn introduction that sets the stage for the ensuing allegro. This section is marked by its passionate energy, dynamic contrasts, and intricate rhythms, driving forward with a relentless, almost fateful momentum. The movement's thematic material is both complex and expressive, embodying Beethoven's masterful ability to fuse technical brilliance with deep emotional expression. The "Maestoso - Allegro Con Brio Ed Appassionato" serves as a testament to Beethoven's ingenuity and his capacity to convey profound human experiences through music. It challenges the performer with its technical demands while offering listeners a rich, emotional journey. The sonata's significance lies not only in its technical mastery but also in its philosophical depth, inviting interpretations that delve into the realms of struggle, resolution, and transcendence. As we close our week of shows we invite you to immerse yourself in the powerful and evocative sounds of Beethoven's Piano Sonata No. 32 in C minor, Op. 111. Let the intensity and passion of the first movement, "Maestoso - Allegro Con Brio Ed Appassionato," carry you through its intricate and emotive landscapes. Enjoy this timeless piece and allow Beethoven's genius to resonate within you.Without first ado, the first movement of Beethoven's Piano Sonata No. 32 in C minor, Op. 111, enjoy. This week, we review the last three episodes of WandaVision. We discuss the advantages of the MCU venturing more into television, the weekly episodic format of the show, the hype & discussion generated by the show, the reveal of the show's "big bad," the explanation about Pietro, the question of whether Wanda redeemed herself, the episode titles, the outstanding performances, memorable & emotional quotes, and the possible meaning of the final end credit sequence. Put on your most comfy jogging suit, pour an oversized bowl of cereal, and prepare your magical runes as we discuss being charmed, enchanted, entranced, mystified, mesmerized, and bewitched by the conclusion of...WandaVision. What did you think of WandaVision? Were you as enchanted with it as we were, did it evoke mixed emotions, or did the conclusion make you want to abjure the MCU? Did you divine who Agnes was or see past the illusion of Pietro? Do you have an opinion about the necromancy behind new-old-Vision? If the answer to any of these questions is yes... - Then, you can conjure up an e-mail message for us at DiscerningGeeks@gmail.com - Or, you can transmute your message into a tweet @DiscerningGeeks or into a comment on our Discerning Geeks Portal Facebook page. We talk about digital dice: get your crippling addiction digitized. Jay talks about the good ol' Gygaxian days of D&D 1st edition dice, while Jack throws up in his mouth just a little bit. Then we do a deep dive into the eight schools of Magic: from Abjuration's protection, to Conjuring your familiar; from the portence of Diviners to the manipulating Enchanters (we talk about why these are the most evil wizards); from the new realities of Illusion to the overchannels of evocation; and from the oft-maligned necromancers to the criticaly roled transmuters. We look not just at the benefits of each, but the benefits of going deep in each. The idea is simple: instead of making a "swiss army knife" wizard, with spells from all schools, make a more focused practitioner of a particular school. Wear your school colors with pride. And if you are a DM, we have a few ideas how you might want to incentivise this with a couple simple table rules, like making casting costs half-price within your own school of magic. Then stick around to the end: we argue about why Lesser Restoration is better than Greater Restoration -- at least for disease. Welcome to Like Dragon Like Son, a podcast hosted by Jay and Jack Oatway where they discuss everything D&D, from character builds to personal experiences. Stay tuned for new episodes on Spotify or wherever you listen to podcasts. If you love Like Dragon Like Son and want to help us out, you can support us by sharing this podcast with your friends. Podcast 34: The Maine Event! We're all back together and we're gonna hit it hard with some segments and anniversary parties! Abjuration and Cinderlands both celebrated 1 year this week! Shout out to @canspgh - follow them on instagram! They're posting all the can releases from local breweries so follow along and get some cans! This week's brewery of the week is Maine Beer Company! Fairly new to Pittsburgh, but you can find them at all the great spots around Pittsburgh and in Boston. Alex did his research and found out some very cool things they're a part of and how they've developed their brand. Beers: Lunch - IPA 7.0% (Jake) Another One - IPA 7.0% (Nick/Alex) Obviously we discuss the can [bottle] design and the simplicity is incredibly appealing and extremely recognizable. “Do What's Right” is Maine's motto and we discuss what that means and how they're part of the 1% to the Planet non-profit organization. Nick and Sara went to Cinderlands for their can release on Sunday after their 1 year anniversary Pajama Party on Saturday. They were first in line, btw. We discuss the can design and the anniversary glasses, which we're in love with. Saturday night Nick and Sara hit up Abjuration in McKees Rocks. If you haven't been, you need to get there. Really cool spot with super unique beers and a cool mix of independent brewing and the theatre in the building. Beers: RBWv1.1 - Rice Barleywine - 11% MIPAv1.0 - Milkshake IPA - 7.3% BA-RW v1.2 - Barrel Aged Rye Barleywine - 11.7% Abjuration still has cans of both the RBW and MIPA available. Alex wanted to make this an ASMR episode by eating a cucumber very close to the mic. So we're sorry. Sara and Nick give their reviews of the anniversary beers from Abjuration. Alex adds in his experience with Milkshake IPAs. In the mix with the milkshake IPAs we hit on Grist House's Kaboom Kandy series and how we're excited to try Kapow Kandy. Jake tells us the story of his most recent Treehouse visit. He got a new beer called Snow (a wheat double IPA) and he's really excited about it. He drank Trail Magic (German Pils) on the podcast. Jake reminisces over a year of Cinderlands and his absolute love of their beer. The next beer we sampled is called Just Baked by Hitchhiker. A beer brewed with Samoa cookies, this beer is super dark and flavorful. We launched into a conversation about our favorite Girl Scout Cookies. We set aside Just Baked and picked up Did We Just Become Best Friends? from Hoof Hearted. Thanks to Sean P! Extremely smooth and really hop forward. 8.0% DIPA Nick and Alex got a Nintendo Switch! We're playing Mario Kart 8 Deluxe and if you wanna play with us, DM us your gamertag and we'll add you! Nick talked about BCBS and the big beer releases. We then changed gears and discussed the Thank U, Next music video. Yeah, we did. Just tune out if you want? And of course this leads into a debate about Hallmark movies… ugh. We wrap up with a giveaway, so listen to the end this week and we appreciate all our listeners. Cheers!
In today's BONUS episode of Dungeon Boys, we are joined by our Dad. We may now be the second most popular D&D podcast with 3 brothers and their dad DM'd by the middle brother. *We did experience some audio issues during recording, please forgive us.* In this episode, a human paladin, Half-Orc war cleric, and elven Abjuration wizard are tasked with traveling into the Bone Mountains to investigate a mountain which has reportedly awoken and has begun violently shaking and producing avalanches. Podcast 21: We Have a Guest! Our first guest appearance! Welcome Austin! Beer #1: Key Lime Pie Whole Punch - Hitchhiker Brewing : Jake's first experience, it definitely sat for a little longer than ideal but still tasted ok. We drill Austin about his beer drinking history and how Lancaster sucks/doesn't suck. From there we devolved into a discussion about pop punk and emo and metal music. Beer #2: Triple Lustra - Dancing Gnome : Jake and Austin's first time having this. Jake doesn't believe how smooth this is for clocking in at 11%. Check out our post-Lustra day podcast for our full review. Austin gets roasted, but he can take it. We revisited the flagship beer discussion and expanded it to beer descriptions and what we're enjoying and want to see more of at these breweries. Nick, Alex and Sara visited Couch and Abjuration on Friday. We share our experience and a crazy Friday night. Beer #3: Half Lustra - Dancing Gnome Nick and Alex are heading to Shubrew for their 5th anniversary party this coming week. Beer #4: Kaboom Candy 2 (Blueberry + Pomegranate) - Grist House : After a few weeks in the fridge, it was mellowed out a lot on the sour and not much loss of fruit flavor. Austin talks through his experience with Sours and what kind of beers he usually gravitates toward and then we rapid fire questions at him. Beer #5: Burn Your Suit - Eleventh Hour : Lower in alcohol than most BA stouts. Lots of chocolate on the nose but heavy coffee notes and the bourbon rounds it out well without being overbearing. Aged in Four Roses bourbon barrels. Thanks for listening!
Podcast 20: We roll thru gearing up for the week with a bunch of random stuff. Upcoming Events: 8/29 - Couch Brewery Drag Bingo! 9/1 - Stick City Beer and Salt Yoga - Beer Yoga (Mars, PA) 9/1 - Eleventh Hour 1st Anniversary (Lawrenceville, PA) 9/7 - ShuBrew 5th anniversary and 10th Pixelated IPA (Rainbow Road) (Harmony, PA) 9/10 - Jake and Alex's Birthday! 9/29 - Dancing Gnome 2nd Birthday party - Hop Culture/Dancing Gnome @ Dancing Gnome (Sharpsburg, PA) 9/30 - Dancing Gnome anniversary Can Releases! Jake introduces his Dream Breweries list. Hits include Hill Farmstead, Hudson Valley, Industrial Arts, Alchemist, etc. Jake's Beer: Very Green - Treehouse Brewery (8.3% DIPA) Nick and Alex went to the Pittsburgh Brewery Guide release party! Beer 1: I Seen The Light - Mango Helles Lager (Rock Bottom, Roundabout, Helicon) Kinda like a crafty version of IC Light Mango. Beer 2: Basileus - Basil Saison (Hop Farm, War Streets Brewery, Leaning Cask) Lots of basil flavor, dry and refreshing saison. Beer 3: Red Bines - Amber Ale (Dancing Gnome, Hofbrauhaus, Penn Brewery) Great drinking, solid red beer. Lots of malt flavor and well balanced. Beer 4: Open Sesame - Brown Session Ale (Spoonwood, Pittsburgh Bottleshop, Church BrewWorks) Possibly the best beer of the festival. Very dark color, but still extremely light and crushable. We loved this one Beer 5: Gluteus Minimus - Gluten-Free Tulsi Tea Saison (Aurochs, East End, Cinderlands) Alex was a huge fan. Lots of tea flavor and each brewery's style came through in this beer. Beer 6: Watermelon Farmhouse Ale - Blended Farmhouse Ale (Allegheny City, Strange Roots) Definitely had a lot of watermelon flavor but still sour. Beer 7: Milton the Toaster Style - Toaster Pastry Stout (Hitchhiker, Southern Tier, Rivertowne) This one was a great balance of stout and the smores pop tart flavor. Beer 8: Get Out of Tahn - Dry Hopped Norwegian Farmhouse Ale (Grist House, Cobblehaus, CoStar) More pronounced hop flavors but still had the farmhouse character. Dry and light drinking. Beer 9: El Collabo - Brett IPA (Couch, Abjuration, Eleventh Hour) We weren't too keen on this one, but we do appreciate the expansion of the style usage. The brett didn't really shine through in this one. Beer 10: A Mind Full of Weeds - Cream Ale made with Bloody Butcher Corn (Mindful, Full Pint) Very much a cream ale. As a late entry in the day we didn't really get the full effect. Studio Beer #1: Konkey Dong 4UP - Hoof Hearted Brewery (Quadruple Dry-Hopped Triple IPA 9.5%) Thanks Sean P! for the share! Sara didn't like a triple, surprise! Nick liked the beer, Alex found it to be easy to drink. From there the conversation went to the new releases we tried this week and beer trades that we'll have coming up. We're going to have a new segment called the brewery of the week, where we'll highlight a beer from them and focus on something outside of Pittsburgh. Shoutout to our social media follows! Follow Keygen (@djkb412) and The Brew Brotha (@thebrewbrotha) Jake will be in Pittsburgh this coming weekend! Beer #2: Spy Dolphin - Dancing Gnome (8.5% DIPA) We've had this one before, not much has changed, its a great brew. Tune in next week!
