No witnesses. No physical evidence. An ironclad alibi. Nevertheless, a Texas jury sentenced Ben Spencer to life in prison for a murder he didn't commit. Journalist and author Barbara Bradley Hagerty shares what it took to set Spencer free.
Author Barbara Bradley Hagerty has written a riveting and important new book about the wrongful murder conviction of a man named Ben Spencer. Ben's experience in the criminal justice system and his decades-long struggle for justice expose the desperate need for criminal justice reform. In her book, "Brining Ben Home: A Murder, a Conviction, and the Fight to Redeem American Justice", Barbara tells Ben's story, shining the harsh light of truth on a system that often seems more intent on closing cases and winning convictions than complying with the legal and constitutional rights of defendants.I had the privilege of providing a blurb for "Bringing Ben Home":"As someone who spent three decades as a trial court prosecutor, I was horrified by the casual callousness that led to many of the wrongful convictions detailed in this important, beautiful, and infuriating work."To purchase "Bringing Ben Home": https://a.co/d/ab3BknOEvents for Ben Spencer and Barb Bradley Hagerty: March 15 and 16, 2025: Tucson Festival of Books (Barb only)1209 E. Dan Cole joins Ben Youngs to react to the news of his omission from Steve Borthwick's England Rugby squad for the 2025 Men's Six Nations. The pair analyse the reasons behind Maro Itoje replacing Jamie George as captain, why Ben Spencer can feel hard done by, and what we can expect from an exciting new crop of players including Tom Willis, Caden Murley and Oscar Beard.
In 1987, Ben Spencer, a young black man from Dallas, Texas was convicted in the killing of a white businessman. He was sentenced to life in prison by an all-white jury. There was no physical evidence linking him to the crime and he had an alibi. Over the years, eyewitnesses recanted their testimony and a judge, after reviewing all the prior evidence, declared Spencer to be an innocent man. Nonetheless, Spencer remained in prison for more than three decades. For seven of those years, former NPR correspondent Barbara Bradley Hagerty follows and followed the twists and turns of this case. Her dissection of wrongful convictions and the criminal justice system is at the heart of her new book, Bringing Ben Home: A Murder, A Conviction And The Fight to Redeem American Justice. Today on The Sunday Story from Up First, part one of a two-part series looking at why it is so hard to get a conviction overturned even when evidence of innocence is overwhelming. Part two is also available now on the Up First podcast feed.Learn more about sponsor message choices: podcastchoices.com/adchoicesNPR Privacy Policy

On the evening of March 22, 1987 a businessman and father were robbed and killed in Dallas, TX. Just a few days later, 22-year-old Benjamine Spencer, a newlywed with a child on the way, was arrested for the crime. A reward for any information on the killing would lead several eyewitnesses to fabricate a story implicating Ben. Despite the fact that he had an alibi and there was no physical evidence linking him to the crime, Ben was sentenced to life in prison. He fought for the next 37 years to finally be declared an innocent man. The cases Bell Atlantic Corp. v. Twombly and Ashcroft v. Iqbal still reverberate through the Federal court system for setting new standards for specificity and "plausibility" in pleadings. Similarly, cases such as World-Wide Volkswagen Corp. v. Woodson are still much discussed and debated for their impact on personal jurisdiction. Episode 3 of our special podcast series marking the 50th anniversary of the first publication of Wright & Miller’s Federal Practice & Procedure discusses the current state of pleadings and personal jurisdiction as they apply to the Federal Rules of Civil Procedure, as well as what potentially lies ahead. Federal Practice & Procedure is one of the most respected and enduring legal treatises. The treatise has been cited by federal courts an astounding 90,000 times, according to Westlaw estimates, and has been cited by the U.S. Supreme Court every year since 1973. In this third episode, Prof. Arthur Miller, founding author of the treatise, talks with Prof. Ben Spencer of the University of Virginia Law School and Prof. Adam Steinman of the University of Alabama Law School. They are co-authors of the volumes of Federal Practice & Procedure dealing with pleadings and personal jurisdiction, respectively, Thomson Reuters is presenting this special podcast series throughout 2019 featuring Professor Miller with leading legal scholars and thought leaders as they explore the issues and challenges facing attorneys practicing before the federal judiciary. Our upcoming episodes will feature a discussion between Prof. Arthur Miller and Justice Ruth Bader Ginsburg, senior associate justice of the United States Supreme Court.

Ben Spencer made it through 6 months on the biggest hardship posting in Korea's EPIK public school program, the rapidly shrinking fishing community of 2000 on Chuja Island, 2 hours north-west of Jeju by ferry. I spoke with him in October and agreed to catch up again at the end of his contract to see how he had maintained morale and motivation in such an isolated environment. In this exit interview two days prior to leaving Korea forever and returning to life, love and home in Ireland, Spencer speaks about life in a one industry community, Chuja's lack of self-sufficiency and why he ended his teaching contract early. He also expands on some Chuja-related topics established by The Jeju Weekly article 'And You Thought Jeju Was Remote' from August, 2009. Spencer's intriguing and articulate prose on Chuja life can be found at OBSERVATIONS FROM THE COUNTRYSIDE at https://countryobservations.wordpress.com/ and his earlier writings can be found at SPENCER COTTAGE INDUSTRIES at https://spencersteaandsympathy.wordpress.com/ Music on this episode courtesy of '60s Korean girl-group THE PEARL SISTERS. Ben Spencer came to Korea expecting modernity on steroids. What he got was the most isolated teaching post in the country--a sleepy fishing settlement on Chuja-do, a small group of islands in the Jeju Strait. He talks to The Korea File about adapting to loneliness and the idiosyncratic community he's found himself in.
