Dana Kenworthy has dedicated her professional career to serving the people of Indiana—in particular those who have been victims of abuse and neglect.Currently, she serves as a judge for the second circuit of the Indiana Court of Appeals, which is the second-highest court in the state. But prior to her appointment to the Court of Appeals, Judge Kenworthy served as deputy prosecutor in Grant County, where she concentrated on cases primarily involving child abuse, sexual assault, and domestic violence. She then served as a trial judge for 12 years—from 2010 to 2022—before her appointment to the Court of Appeals.Throughout her life, Judge Kenworthy has been guided by the saying “If you see something wrong, fix it.” She's applied this rule—one championed by her mother, her role model—to affect change on behalf of everyday Hoosiers. In recognition of her public service, pro bono work, and volunteer efforts, she has received the Indiana Coalition Against Domestic Violence's Outstanding Prosecutor Award and the Indiana Pro Bono Commission's Randall T. During Brandon Allmon-Jackson's major theatrical productions, he is never seen by the audiences. But as a stage manager fulfilling his dream of working on Broadway, he's the person most responsible for making sure big acts—including The Music Man, Back to the Future, and Sunset Boulevard—go off without a hitch.In the years since he graduated from Ball State in 2012, Brandon has applied the skills he learned in the classroom, along with his dedication and drive, to stand out in the competitive world of commercial theatre. He's also dedicated himself to providing more opportunities for artists of color.In this episode, Brandon talks about how the confidence he built and connections he made at his alma mater helped him advance professionally. When Doing “No Harm” Isn't Good Enough: Bringing beneficence to your clients Curt and Katie chat about ethics again. We look at how therapists decide what is beneficial for clients. We also contrast the concept of “beneficence” (doing good) versus “nonmaleficence” (doing no harm). We specifically explore how to identify when something is in the therapist's interest versus the client's interest as well as what therapists can do when clients hold harmful, untrue beliefs. This is a law and ethics continuing education podcourse. Transcripts for this episode will be available at mtsgpodcast.com! In this podcast episode we talk about how therapists do good, beyond “do no harm” Therapist healthcare ethics are often taught from the perspective that the professional's role is to “do no harm” when providing treatment to clients. Lost in the teachings is that therapists have other obligations to address when providing treatment. This workshop focuses on examples of bringing the principle healthcare ethic of beneficence to therapy to help determine “doing good” for the client's benefit. What is beneficence in the context of psychotherapy? ·      Do what is good for the client and for treatment ·      “For the benefit if the client” ·      Comparing this with the idea of non-maleficence (“do no harm”) which is don't do bad things, but also try to prevent bad things from happening How do therapists decide what is “good” for their client? ·      Assessing the risk of overtaking client autonomy and becoming paternal or parental ·      Balancing all of the core ethical principles and putting them in context for the unique situation for each client ·      Looking at whether therapist self-disclosure is in the benefit of the client ·      Identifying what is therapeutic and beneficial ·      Making sure that therapists move beyond what is comfortable (and not “harmful”) to something that may be less comfortable (and more beneficial) ·      Looking at who therapists choose to work with, balancing therapist self-care and self-protection with what is beneficial to the client and society What are specific concerns to consider when deciding whether a therapist is working for the benefit of the client? ·      Therapy dogs (are they certified and registered, is it in the treatment plan) ·      Contact between sessions initiated by the therapist (who is the contact for? What does the treatment model say about this type of contact?) ·      Have a thought process and document that thought process when deciding what to do as a therapist What can therapists do when clients hold distorted beliefs? ·      Identify: Do the distorted beliefs that the client holds cause (or could cause) harm? ·      Understand: What laws or ethics are relevant to whether the distorted belief should be addressed? ·      Get client consent (or not) to talk about the distorted belief and potentially change the course of therapy ·      Is it necessary to discuss the belief at this time? ·      What countertransference issues could impact the efficacy of the conversation with the client? ·      Will the conversation be helpful and potentially change the client's view? ·      How will the conversation change the course of therapy? ·      Does the therapist have appropriate expertise and training to address the distorted belief? On Episode 138, we're paying respects to our late friend and longtime supporter of Take It Personal, Matt "Barkley" Temchatin. Many of you knew Barkley as @HipHopAutographs, as he was one of the most celebrated hip-hop collectors online. Barkley unexpectedly passed away a few months ago, so we wanted to honor him with our last episode of 2023.  Barkley, like myself, started out doing college radio but his love for hip-hop only grew as he got older. He went on to run a record store and work as a record promoter in Philly, later graduating to a family man. Greg Fehribach is an attorney and the founder of The Fehribach Group, a consulting firm specializing in accessibility, universal design, and compliance with the Americans with Disabilities Act. He is also a proud two-time graduate of Ball State who made history as the first student with a disability to be elected to serve as the University's student body president.On this new season of “Our Call to Beneficence,” Greg talks about how the accessibility of Ball State's campus in the 1970s made him think he had “died and gone to heaven.” Greg's positive student experience compelled him to serve on the University's Board of Trustees from 2004 to 2007.Greg also describes how his Ball State education prepared him for his career as an attorney and as a disability rights advocate at the state and national level. Abstract A background assumption in much contemporary political philosophy is that justice is the first virtue of social institutions, taking priority over other values such as beneficence. This assumption is typically treated as a methodological starting point, rather than as following from any particular moral or political theory. In this paper, I challenge this assumption. To frame my discussion, I argue, first, that justice doesn't in principle override beneficence, and second, that justice doesn't typically outweigh beneficence, since, in institutional contexts, the stakes of beneficence are often extremely high. While there are various ways one might resist this argument, none challenge the core methodological point that political philosophy should abandon its preoccupation with justice and begin to pay considerably more attention to social beneficence - that is, to beneficence understood as a virtue of social institutions. Along the way, I also highlight areas where focusing on social beneficence would lead political philosophers in new and fruitful directions, and where normative ethicists focused on personal beneficence might scale up their thinking to the institutional case. I. Justice is the first virtue of social institutions, as truth is of systems of thought. A theory however elegant and economical must be rejected or revised if it is untrue; likewise laws and institutions no matter how efficient and well-arranged must be reformed or abolished if they are unjust. The only thing that permits us to acquiesce in an erroneous theory is the lack of a better one; analogously, an injustice is tolerable only when it is necessary to avoid an even greater injustice. Being first virtues of human activities, truth and justice are uncompromising. These propositions seem to express our intuitive conviction of the primacy of justice. No doubt they are expressed too strongly. John Rawls, A Theory of Justice, 4 A background assumption in much contemporary political philosophy is that justice takes priority over beneficence. When evaluating social and political institutions, or thinking through questions of institutional design or reform, we should focus primarily on justice. This assumption is often associated with various further ideas, such as that justice but not beneficence is enforceable, that justice but not beneficence concerns rights, or that justice involves perfect duties but beneficence only imperfect ones. It is also typically assumed that justice is institutional, while beneficence is personal. There is much talk of social justice, and some talk of justice as a personal virtue, but, for the most part, we talk only of personal beneficence - not social beneficence. This phenomenon extends beyond the academy. A similar concern with justice permeates our political discourse. Justice operates as a conversation stopper. If the status quo is unjust, this is taken as an almost conclusive argument against the status quo; if some policy promotes justice, this is taken as an almost conclusive argument in favor of the policy. In both political philosophy and everyday political discourse, we do, of course, recognize exceptions to this rule. In the face of a serious disaster, we may need to override justice - we shouldn't really let justice be done though the heavens fall. But these exceptions are generally assumed to be rare - the heavens are only seldom falling. For the most part, then, contemporary political philosophy and discourse follows John Rawls's statement in the above epigraph. Thanks to a prison book group obsessed with the genius of Octavia Butler, Sam is second-guessing his dedication to the text. Has he been missing out? With Twitter and video interviews giving us more and more perspective from the author, how do we change our reading experiences? What happens when authors, like JK Rowling, tell you things about their characters that you can't glean from their writing? Really, though, it's about struggling with how we talk critically about texts. Today I talked to Meredith Hall about her new novel Beneficence (Godine, 2020). A beautiful family is torn apart by a shocking loss, and three of its members blame themselves. It's the middle of the twentieth century, their farm in Maine needs tending, and the seasons move swiftly with specific chores and tasks. The cows need calving, the chickens need feeding, the laundry needs washing, the rugs need airing, the food needs preparing. But each member of the family is numb from their huge loss, and they go their separate ways, telling small bits of the story as their lives unfold. Their dreams and hopes change, and some decisions have harsh consequences, but slowly, through the changing seasons, they struggle to make their way back to the family they once loved. Meredith Hall taught in the MFA program at the University of New Hampshire for many years. In her late fifties, she wrote an essay that won the Pushcart Prize, and on the basis of that encouragement, she was awarded the Gift of Freedom Award, which provided two years of dedicated writing. Her memoir Without a Map was named a best book of the year by Kirkus and BookSense and was both a NYT bestseller and an Elle magazine Reader's Pick of the Year. She was a recipient of the 2004 Gift of Freedom Award from A Room of Her Own Foundation and her work has appeared in Five Points, The Gettysburg Review, The Kenyon Review, The Southern Review, The New York Times, and many other publications. Hall writes while listening to Gregorian chant, and when she is not writing or reading, she is outdoors, finding beautiful wild places. She spends her time in Northern California and Maine, so beauty is available all around her, vital sustenance. She loves and needs the arts and spends each winter in the Bay Area gorging on performances of contemporary dance, modern and classical music, and drama. She wanders museums and galleries a lot. In her late fifties, she wrote an essay that won the Pushcart Prize, and on the basis of that encouragement, she was awarded the Gift of Freedom Award, which provided two years of dedicated writing. Her memoir Without a Map was named a best book of the year by Kirkus and BookSense and was both a NYT bestseller and an Elle magazine Reader's Pick of the Year. She was a recipient of the 2004 Gift of Freedom Award from A Room of Her Own Foundation and her work has appeared in Five Points, The Gettysburg Review, The Kenyon Review, The Southern Review, The New York Times, and many other publications. Hall writes while listening to Gregorian chant, and when she is not writing or reading, she is outdoors, finding beautiful wild places. She spends her time in Northern California and Maine, so beauty is available all around her, vital sustenance. She loves and needs the arts and spends each winter in the Bay Area gorging on performances of contemporary dance, modern and classical music, and drama. She wanders museums and galleries a lot. It reflects on questions such as: What is valuable? What is good/bad? Is this right/wrong? Why do we think this is right or wrong?When we say we want to act ethically, we mean that we want to act according to our values, to what we think is important. Sometimes, we may encounter a situation in which we are not sure what to do because there are many options or courses of actions to choose from. Our values will help guide us in choosing what the right thing to do is. When the situation is such that we have to choose between two different values, we are encountering an ethical dilemma.In the biomedical ethics field, there are many relevant principles, but there are 4 key principles that constitute the most widespread amongst the contemporary Western tradition: Respect for Autonomy, Beneficence, Non-maleficence, and Justice.In order to have a more clear picture of the situation we are dealing with, there are certain tools that help us understand the situation better, and guide us in breaking down what our options are, and having a thorough analysis of their consequences, but mostly setting the ground for an open discussion, knowing who should be involved and what is really at stake. Do I think other team members would do the same in my situation?
