But to get to that point, MSHA will engage in an in-depth investigation triggered by an elevated enforcement action against the company. In this episode, Arthur and Chris review Section 110 of the Mine Act, which authorizes personal liability, and how application of that law looks in the real world. Addressing Employee Complaints: Retaliation and Whistleblower Complaints with the EEOC, OSHA, and MSHAPresented by Kara M. Maciel, Lindsay A. DiSalvo, Nicholas W. Scala, and Mark IshuOver the past several years, employers have seen a significant uptick in retaliation claims filed by employees and investigated by federal agencies. For example, in 2010, only approx. 30% of all charges filed with the EEOC included a retaliation claim, but that number shot up to over 50% in FY 2022. Similarly, the number of total whistleblower complaints filed with OSHA increased significantly in FY 2023, with the vast majority of those complaints – about 71% - filed under Sec. 11(c) of the OSH Act (retaliation based on protected safety acts). The whistleblower complaints filed under Section 105 of the Mine Safety and Health Act have also been on the rise and MSHA is particularly aggressive in its approach to the investigation of these claims, often seeking temporary reinstatement of the complainant for the duration of the investigation, and litigation, if the complainant was terminatedWhen a retaliation or whistleblower complaint is received, employers have a chance to explain why the complaint should be dismissed. However, each Agency handles the investigation and analysis of the evidence differently – using varying processes and burdens of proof to determine whether and how the retaliation complaint should proceed. The strategy and response provided by the employer will depend on the type of complaint and the agency investigating it, but it is generally an opportunity for the employer to provide the information necessary for the agency to conclude its investigation and ultimately close the case file. The responses can, however, create a written record of admissions that the agency could use against the employer. More than 80 years ago, U.S. Labor Secretary Frances Perkins identified silica dust as a deadly hazard. Finally, this past April 16, MSHA, through the Department of Labor, issued a final rule reducing silica dust exposure to better protect America's miners. The Occupational Safety and Health Administration, known as OSHA, also clarified a rule in another major victory for workers this month to ensure workers are able to choose their own representative to join OSHA agents during workplace inspections. Today, we're talking with two USW health and safety experts about both of these new rules' impacts and how the union has been fighting nonstop to keep workers safe, and will continue to do so in the future. In this episode, our guest is Colin Banas, MD, MSHA, Chief Medical Officer, DrFirst. Colin Banas is an Internal Medicine Hospitalist and the former Chief Medical Information Officer for VCU Health System in Richmond, VA prior to stepping down after 15 fulfilling years to pursue consulting. He is proud to have testified before the U.S. Senate and the Office of the National Coordinator (ONC) on the topic of Health IT and the Meaningful Use Program and is a former Health IT Fellow for the ONC. His interests center the role of big-data and analytics on patient outcomes and on novel forms of Clinical Decision Support, those that are outside of the realm of traditional rules and alerts, and include real-time dashboarding and intuitive usability designs. He also helped spearhead the VCU effort to participate in the Open Notes initiative, where patients have access to their clinical documentation in real time. In 2017 Dr. Banas was humbled to receive the HIMSS-AMDIS award for Physician Executive of the Year from his peers. Pharmacy Interoperability: New Opportunities, Persistent ChallengesTopic Summary: Interoperability has been a buzzword for the healthcare industry for many years, but until now, the conversation has centered around how to get doctors and healthcare systems more accurate, complete patient health data for improved outcomes. In 30 years of e-prescribing, the pharmacy's role – at least where interoperable data sharing is concerned - has been viewed from the narrow lens of fulfillment. However, the products involving quartz are everywhere, often in our kitchens, bathrooms and more. Congregational Health and Education Network (CHEN) -  Launched in 2017, CHEN is a 501(c)(3) faith-based initiative with local churches and educational institutions with a primary focus on reducing health disparities for communities of color through education attainment, access to healthcare, and health literacy. Currently, CHEN includes 100 faith-based organizations of all denominations throughout Nashville.  Dr. Jan Gorniak was born and raised in Bronx, NY. She graduated from Lake Erie College of Osteopathic Medicine in Erie, PA. Dr. Gorniak is certified by the American Board of Pathology in anatomic and forensic pathology. She served as a Deputy Coroner/Forensic Pathologist for Franklin County, Ohio from July 2005 to January 2008. She is a member of the National Association of Medical Examiners, the International Association of Coroners and Medical Examiners, and the American Academy of Forensic Sciences, American Osteopathic Association, and the National Medical Association. Dr. Gorniak is also a registered medicolegal death investigator through the American Board of Medicolegal Death Investigators.In November of 2008, Dr. Gorniak was elected to the position of Franklin County Coroner, Columbus, Ohio. She was the county's first full-time forensic pathologist coroner. She was re-elected in November 2012, and served in that position until resigning in October 2014. She went on to work as the Deputy Chief Medical Examiner for the District of Columbia (DC) Office of the Chief Medical Examiner. In the Fall of 2016, she was appointed the Fulton County Chief Medical Examiner (Atlanta, GA).
