In this episode, my guest is Ohio House Representative Jena Powell. We discuss her bill to end abortion modeled after the Texas Heartbeat Law that authorizes private individuals to sue anyone performing or aiding in abortions and will protect preborn humans from fertilization. With the imminent overturning of Roe v. Wade, state legislatures need to move expeditiously to enact protections for the unborn. The Texas Heartbeat Law has survived in the courts, and Ohio House Bill 480 is patterned after the Texas law. For this very reason, HB 480, if passed should become law in Ohio and be enforced irrespective of the US Supreme Courts' determination in Dobbs v. Jackson. Little signed the Idaho Heartbeat Bill, which bans abortions after a preborn baby's heartbeat can be detected. But because of ongoing court cases, the legislature felt it was necessary to include a trigger mechanism so that the new Heartbeat law would not become enforceable until after a similar law in another state was upheld by a federal appellate court. Then something spectacular happened. Just a few months after the bill was signed by the governor, the United States Supreme Court allowed the Texas Heartbeat Law to go into effect. This was a tremendous victory. Although it did not "trigger" enforcement of the Heartbeat Law in Idaho because of technical reasons, it blazed a viable pathway to begin saving preborn babies right away in Idaho. Sen. Patti Anne Lodge (R-Huston) and Rep. Steve Harris (R-Meridian) have sponsored the new changes adding a private enforcement mechanism that would become effective thirty days following signature by the governor. On Friday, this new bill was presented to the Senate State Affairs Committee. And the committee voted to "print," or introduce, the bill (now SB 1309). If Texas is any indication, this simple addition to the Idaho Heartbeat Law will likely save more than 1,000 preborn babies every year. Lord willing, we could be just sixty days away from preventing most abortions in the state after six weeks of pregnancy. Little signed the Idaho Heartbeat Bill, which bans abortions after a preborn baby's heartbeat can be detected. But because of ongoing court cases, the legislature felt it was necessary to include a trigger mechanism so that the new Heartbeat law would not become enforceable until after a similar law in another state was upheld by a federal appellate court. Then something spectacular happened. Just a few months after the bill was signed by the governor, the United States Supreme Court allowed the Texas Heartbeat Law to go into effect. This was a tremendous victory. Although it did not "trigger" enforcement of the Heartbeat Law in Idaho because of technical reasons, it blazed a viable pathway to begin saving preborn babies right away in Idaho. Sen. Patti Anne Lodge (R-Huston) and Rep. Steve Harris (R-Meridian) have sponsored the new changes adding a private enforcement mechanism that would become effective thirty days following signature by the governor. On Friday, this new bill was presented to the Senate State Affairs Committee. And the committee voted to "print," or introduce, the bill (now SB 1309). If Texas is any indication, this simple addition to the Idaho Heartbeat Law will likely save more than 1,000 preborn babies every year. Lord willing, we could be just sixty days away from preventing most abortions in the state after six weeks of pregnancy. In this episode of Life Matters, Brian Johnston takes an in-depth analysis of the state laws recently examined by the Supreme Court. He explains, in particular, the Texas law which authorizes private individuals taking civil action against an abortionist. While Brian‘s educational background is in comparative languages, he has worked for many years in the legal world, not only as an advocate (lobbyist) for many years in Sacramento and the various state capitols of the West, but as a young man he spent several years working as an assistant at a Los Angeles entertainment law firm. Drawing on this experience, Brian explains the stark contrast between the two states' abortion laws recently considered by the US Supreme Court. The Louisiana law simply draws a line at 15 weeks gestation and prohibits abortion beyond that date. The Texas law - the so-called “heartbeat law” - requires an abortionist to check the gestation of the pregnancy and if it's six weeks or more, to also check for the beating heart of the child. As the human heartbeat can be monitored as early as 18 to 21 days from conception, any competent medical professional would be able to find the heartbeat of the six week-old child. But the most important aspect of the Texas law is that it does not create a crime when an abortionist performs an abortion. Instead it allows any individual citizen who is harmed by an abortion to be able to seek relief in civil court for that harm. Brian goes to great lengths to explain the dramatic difference in the two types of law - civil and criminal. They require completely different standards of evidence, and offer very different answers for the harms done by the lawbreaker. The discussion of prosecutorial discretion is particularly important. The best and most startling example of the contrast between civil and criminal law can be found in the two cases of O.J. Simpson and the Simpson-Brown murders. While the criminal trial dragged on for weeks and ultimately ended in an acquittal, when the Brown family had a chance to sue O.J. for the harm of killing their daughter and sister, the case was settled in an afternoon. He was found guilty, and because they had clear standing. They suffered clear arms because of his actions, and were given an award of millions of dollars. This can hardly compensate for the intentional loss of life, but the purpose of the civil law is to give individuals their day in court and the ability to address an injustice, a serious wrong done to them . Brian gives several humorous examples of why the difference between civil and criminal law should be very clear to all of us. As a point of fact, in modern society you can be sued for nearly anything. Whether that suit will prevail is another matter. But if serious harm has been done and you can demonstrate standing to the court that YOU were harmed by an abortion, an individual - such as the father of the child, or the grandparents of the aborted child, clearly have a very, very reasonable case in seeking justice for the unnecessary destruction of that life.

Right off the get go I found myself talking about how women need men and I share pretty openly about my relationship with my ex-husband and how we co-parent. Then we talk about the Texas Heartbeat Law. Not surprising Abbie and I both think abortion is murder. But we talk about solutions for preventing pregnancy and problems in the adoption and foster system etc. We both share from our own childhoods about our experiences with sports and music as I pose the question: Should parents push kids into playing sports? We talk about when drinking alcohol is a problem and some solutions to “unwine” when you want to unwind at the end of day. Some fun topics we discuss throughout were: favorite candy bars, the stages of showering, not having periods when nursing, the stages of hair falling out throughout and post pregnancy, how often we wash our hair, and we end on a light note about crotch deodorant and what a disgusting concept it is! The Texas Heartbeat Bill went into effect on September 1, even after abortion proponents asked the Supreme Court to block it. On August 31, abortion providers raced to complete as many surgical abortions across the state as possible, and in the past ten days pregnancy centers have seen an influx in the women they serve. On this episode of All Things we look at the positives and negatives of this new law. Of course we rejoice that 80-90% of abortions in Texas have now been prevented. Babies have been saved and women have been spared violence. For this we rejoice! But there are some things about this law that are troublesome, and it's not likely to remain in effect for the long haul. We have work yet to do. In addition to talking about the law itself, we look at the flimsy foundation of Roe v. Wade. Abortion proponents frequently refer to it as “constitutional” and “settled law.” And while it's true that the Supreme Court deemed abortion a constitutional right in 1973, you'd be hard pressed to find where exactly in the Constitution such a right exists. Further, past laws that were deemed Constitutional and settled were rightly overturned—for example slavery, and preventing women from owning property and voting. Calling a law constitutional or settled does not make it just.Next we take a look at the reality of how harmful abortion is to women. Things like: there is a 155% increase in risk of suicide for women who've had abortions; more than 80% of post-abortive women say they probably would not have aborted if they hadn't been so heavily encouraged to do so; and 57% of women who receive an abortion do so because of a recent traumatic event such as unemployment, a breakup, or falling behind on rent or mortgage. Vulnerable women who are unexpectedly pregnant need support, not abortions. Offering abortion is one-dimensional, uncreative, traumatizing, and lazy, whereas offering pregnant women wrap-around support leads not only to her child's future life, but also to holistic health in the mother's life as well.A pregnancy resource center in Colorado responded to the Texas bill this way and I wholeheartedly agree: “Alternatives believes in the humanity of the preborn and the woman. We value legislation that protects both. We believe the Texas Heartbeat Act needs to be accompanied by other legislation that works to provide women with the support for affordable childcare, access to housing, protections for pregnant students in high school and on college campuses, and equity for pregnant women in the workplace. With legal protection and resources like these, women can make choices that are based on the amount of support they have versus being backed into terminating their pregnancy as their only option.”Again, we have work yet to do.
