Key considerations for medtech companies The medical device regulatory landscape in the EU is undergoing significant regulatory change with the adoption of the Medical Devices Regulations 2017/745 ("MDR") and In Vitro Diagnostics Regulation ("IVDR") 2017/746 at its core. Eucharia Commins, Director, Managed Legal Solutions at KPMG, Nicole Walsh, Director, at KPMG Law and Emma Ritchie, Director, Head of Data Protection and Privacy at KPMG Law, explore the main considerations for medtech companies and how to navigate them. The MDR has been applicable since 26 May 2021, and the transition period ended on 26 May 2024. The IVDR has been applicable since 26 May 2022 with a staggered extension of its transition period, ranging from May 2025 to May 2028, depending on the risk categorisation of the device. For ease of reference, we shall refer to MDR and IVDR as the "Regulations". Key changes Increased Control for National Regulators Interaction Changes with Notified Bodies New / Updated Classification Rules New EU Database on Devices (Eudamed) Better Traceability of Medical Devices (UDI) New Clinical Evidence & Safety Requirements Increased Periodic Safety Update and Vigilance Reporting Requirements "The Regulations aim to improve the safety, performance, and transparency of medical devices." The impacts of the new Regulations The impacts of the Regulations are multifaceted, and this article will focus on key considerations for legal and regulatory departments in medtech companies operating in the EU. Risk management The legal team will be required to liaise with risk management colleagues to conduct a comprehensive risk assessment to identify and evaluate potential risks and areas of weakness. Robust risk management procedures will need implementation to address risks and mitigate potential for non-compliance. If necessary, portfolio strategy colleagues may need to engage in portfolio rationalisation. Consideration will also need to be given to ongoing Notified Body capacity across Europe. There is a requirement to comply with data protection regulations (GDPR) in respect of patient data, clinical data, post-market surveillance information and ensure robust consent mechanisms and data security measures are in place. Contracts The Regulations will require a review of contracts with suppliers, distributors, third-party entities, and intercompany agreements. All processes and agreements need to be aligned with the new legal requirements as specified by the Regulations. This includes addressing both pre-marketing and post-marketing requirements, which may necessitate adjustments to processes and agreements. Additionally, it is essential to review all delegations of authority, powers, or obligations within the supply chain to ensure compliance with the Regulations. While the older regulatory regime addressed only the manufacturers and authorised representatives, the new MDR and IVDR directives regulate importers and distributors, targeting the entirety of the supply chain, right up to the end user. To ensure compliance across the channels, agreements must be shared, harmonised and updated in tandem. Quality agreements between MD manufacturers and suppliers must address the new regime. It is advisable to consider adding clauses that mandate the collection of necessary information from all supply chain partners, such as distributors, third-party suppliers, and sub-contractors. Intellectual property With regard to an organisation's intellectual property, it is advisable to review and ensure all company's intellectual property in particular technical documentation, clinical evaluation reports are prepared and maintained in compliance with the Regulations. It is of note that the Regulations impose labelling and UDI (unique device identification) requirements to enhance traceability and identification of medical devices. The Regulations call for accurate product classification. This will determine the appropriate conformity assessment route a...

In the 1997 film Gattaca, the camera zooms in on a laboratory where embryos are meticulously selected for their genetic perfection. In this creative adaptation of a dystopian future society, genetic engineering and eugenics are the norm, creating a rigid class system based on genetic makeup. In the movie, the camera pans to a couple eagerly awaiting the news of their “designed” child; their faces are a mix of anticipation and anxiety.
It's Wednesday, September 4th, A.D. 2024. This is The Worldview in 5 Minutes heard on 125 radio stations and at www.TheWorldview.com. I'm Adam McManus. (Adam@TheWorldview.com) By Jonathan Clark 55,000 Nigerians killed between 2019 and 2023 The Observatory for Religious Freedom in Africa released a report last month on Christian persecution in Nigeria. Violence in the country has taken the lives of over 55,000 people between 2019 and 2023. Of those, over 30,000 were civilians, including 16,769 Christians. Radical Muslim Fulani herdsmen were responsible for over half of the Christian deaths. The observatory noted, “In states where attacks occur, proportional loss to Christian communities is exceptionally high. In terms of state populations, 6.5 times as many Christians are being murdered as Muslims.” Please pray for the persecuted church in Nigeria, ranked 6th on the Open Doors' World Watch List of nations where it is most dangerous to be a Christian. Psalm 14:4, 7 asks, “Have all the workers of iniquity no knowledge, who eat up My people as they eat bread, and do not call on the LORD? … Oh, that the salvation of Israel would come out of Zion! When the LORD brings back the captivity of His people.” People looking for leaders who will champion religious freedom Pew Research released a survey finding people around the world want leaders who stand up for religious freedom. In the U.S., 64% of adults said it is important to have a leader who stands up for people who share the respondents' religious beliefs. A majority of people in most other countries surveyed said the same thing. Countries with high levels of support for leaders sharing their religious beliefs included Indonesia, the Philippines, Malaysia, India, and Kenya. Countries with the lowest levels of support for this included France, South Korea, Japan, Spain, and Sweden. 7,500 pro-lifers attend India's March for Life Pro-lifers in India held their 2024 National March for Life last month. The event took place in the southern city of Thrissur and drew over 7,500 people. It was the country's largest March for Life. India legalized abortion back in 1971. Now, mothers in the country kill 15 million of their pre-born children per year. Bishop Gerald John Mathias attended the recent march and told Life Site News, “I'm grateful to the youth, particularly the youth taking interest. It's most encouraging for the future of the Church, future of the society, future of families.” Donald Trump champions in vitro fertilization In the United States, former President Donald Trump said he would make in-vitro fertilization (IVF) free for Americans if he is elected. Last Thursday, Trump told NBC News' Dasha Burns “it's helping women [be] able to have a baby....We need great children, beautiful children in our country.” Here's a soundbite from that interview. TRUMP: “So, we are paying for that treatment.” BURNS: “All Americans who want it?” TRUMP: “All Americans that get it; all Americans that need it. So, we're going to be paying for that treatment, or we're going to be mandating that the insurance company pays.” However, many oppose in vitro fertilization as undermining pro-life goals. CatholicVote noted, “We are opposed to any In Vitro Fertilization mandate and will work with [Trump] and his administration to make clear that IVF puts women at risk, and destroys countless innocent living human embryos.” Only 54% of Protestant Evangelical attend church in person Lifeway Research published analysis of a 2024 report by Grey Matter Research and Infinity Concepts entitled “Church After COVID.” The report found only 54 percent of Protestant Evangelicals attend church in-person every week. Prior to the COVID-19 pandemic nearly 90 percent of Evangelicals were attending semi-regularly. Online viewing of services has increased; however, many of those engaging online are also attending in person. The study also found about a quarter of churchgoers started attending their current church since the pandemic, marking significant changes in the makeup of churches post-COVID. Hebrews 10:24-25 says, “And let us consider one another in order to stir up love and good works, not forsaking the assembling of ourselves together, as is the manner of some, but exhorting one another, and so much the more as you see the Day approaching.” Archeological find from Biblical Jerusalem affirms Scripture And finally, the Israeli Antiquities Authority announced the discovery of a stone seal at the City of David National Park in Jerusalem. Archaeologists believe it is from the First Temple period, around 2,700 years old. The seal bears a name inscribed in Old Hebrew script and a winged figure associated with pagan Neo-Assyrian influences. Ze'ev Orenstein with the City of David Foundation told Fox News the seal “joins the list of countless archeological discoveries in the City of David — the historic site of Biblical Jerusalem — affirming Jerusalem's Biblical heritage.” Close And that's The Worldview on this Wednesday, September 4th, in the year of our Lord 2024. EPISODE 199 DETAILS Is IVF, In Vitro Fertilization, Right For Your Herd Understanding In Vitro Fertilization What Is In Vitro Fertilization In Vitro Fertilization (IVF) is the process of creating embryos from oocytes (unfertilized egg cells) by fertilizing them with semen in a Petri dish. Oocytes are first collected from the ovaries of donors by ultrasound-guided follicular aspiration. They are then matured in a Petri dish and fertilized 20-24 hours later. Conventional, sexed frozen, or reverse-sorted semen may be used for fertilization. Oocytes then develop in an incubator for seven days, at which point the resulting viable embryos are transferred into recipients. How Does In Vitro Fertilization Work In-Vitro Fertilization resembles conventional ET by allowing cows to produce multiple calves per year. This is accomplished by generating embryos from elite cows called donors and transferring them into cows with less genetic merit called recipients. After this, there are many differences in the way the procedure works. In IVF, oocytes (unfertilized eggs) are collected using a specially designed probe, fitted with an ultrasound transducer which allows the ovary to be visualized during the aspiration procedure. The technician locates and stabilizes the ovary via rectal palpation of the reproductive tract. The aspiration probe is inserted vaginally where the transducer and ovary meet with only the vaginal wall separating the two. The probe has an attached needle guide that houses a 55cm long needle. This needle will transverse the vaginal membrane and is inserted into fluid filled follicles, containing oocytes, located on the ovary. The contents of the follicles are aspirated out and captured in a searchable filter. The filter is then taken into the lab where it is rinsed and searched using a microscope; the oocytes are then retrieved, counted, and graded. Once the oocytes have been processed they are moved into dishes with special media designed to mature them. The dishes are placed in an incubator for 18 to 24 hours where the maturation process takes place. The following day, semen is added to the dishes containing the matured oocytes and fertilization takes place. The media and incubator are designed to mimic the cow's uterine environment as pertains to temperature, pH, etc. Following fertilization, the oocytes are left in the incubators for the next 7 days as a percentage of them develop into embryos. They can then be evaluated under a microscope and quality graded just as you would conventional ET embryos. The grade one and two embryos are now ready to be loaded into transfer straws and implanted into recipient cows that were in standing heat 7-8 days prior to the transfer date or frozen for transfer at a later date. Potential Applications of IVF, In Vitro Fertilization Embryo production from pregnant donors — Because the cervix and uterus are not penetrated during the process of aspiration, oocytes can still be collected without disturbing the fetus. Donors can be safely aspirated from about 45-100 days of gestation. On rare occasions donors can be aspirated up to 6 months of gestation, as long as the ovaries are accessible to the technician. This application is a good alternative for operations wanting to get a jump on the next generation. In years past, breeders were forced to decide whether to risk future productivity of young donors by flushing them as virgins or just postponing embryo production until after their first calf. By getting the heifers pregnant first, they are already on their way to calving in a normal window with their counterparts. It also works well for those operations that want to keep donors on a 365-day calving interval, and can help reduce reproductive failures such as cysts in donors that remain open for long periods of time. Production from donors that do not make embryos in ET — Various reasons can cause donors to be nonproductive in ET. Blockages, scaring, uterine infections, and un-passable cervixes are some of the more common reproductive tract abnormalities that can be overcome through IVF. Also, donors prone to overstimulation or those that produce a high percentage of unfertilized eggs, generally perform well in IVF Donors that typically fail to stimulate and ovulate little to no ova will not necessarily benefit from IVF. Adding value to semen —With IVF, less semen is needed than in a typical AI or ET procedure because oocytes are contained in small dishes during the fertilization period. This allows for tremendous opportunities. Depending on quality, one straw of conventional semen can fertilize oocytes from as many as 15 donors. This allows breeders to maximize the effectiveness of rare or expensive semen. If sex selected pregnancies are desired the IVF system offers distinct advantages over conventional ET. Quality sexed frozen semen tends to be more effective in IVF because less sperm cells are necessary. Generally 1-2 straws are sufficient per donor, depending on how many oocytes she has produced. Semen does not have to be sexed prior to freezing in order to get sexed pregnancies. Conventionally frozen semen can be sorted for the desired sex prior to fertilization in the IVF process – this is termed reverse sorting. It should be noted that not all bulls will work after reverse sorting. Also, oocytes from high producing donors can be placed in separate dishes making it possible to use more than one sire and still be able to identify the matings of the resulting embryos. Short interval between procedures —The IVF procedure can be repeated more often than conventional ET. Donors are routinely placed on bi-weekly schedules. During a 90 day period a donor could be aspirated up to 6 times. Within a given time frame, more total pregnancies can be created through an IVF program when compared to ET. Other applications — Because donors do not have to be cycling in order to perform the IVF procedure, embryos can be created from cows that have not yet returned to estrus postpartum and heifers that have not reached puberty. Oocytes can also be recovered from the ovaries of slaughtered females or donors prior to a death event. Dr. Zimmerman presented a Real Science Lecture webinar on December 12th, 2023, titled “Not All Rumen-Protected Products Are Created Equal.” You can find the webinar recording at balchem.com/realscience. Clay outlines four attributes of a good rumen-encapsulated product. They are feed and TMR stable, ruminal stable, nutrient bioavailability, and good efficacy biologically in the animal. (6:21)Kari describes a TMR stability test that Balchem has been perfecting based on a paper published in 2016. One to two grams of a rumen-protected product (based on the nutrient composition) is mixed with a half pound of TMR in a Ziploc bag, then the mixture incubates for 0, 6, 12 or 24 hours (based on feeding 1x, 2x, or 3x per day). Once a sample is finished incubating, it's placed in a strainer bag in one liter of distilled water for one minute. Then, the amount of nutrient that was leached into the distilled water is measured. She describes some of the observations and trends they've seen from using this technique on different products. (8:24)Mark asks about the impact of abrasion during the mixing process on encap stability. Kari describes a mineral mix technique using a small ribbon and paddle mixer. In this case, 5-10 pounds of encap product are mixed with 90-95 pounds of a mineral mix for three minutes. Then a sample is analyzed for damage to the encap. Clay does not recommend pelleting any encapsulated product because that will only reduce efficacy. It may not be 100% damage, but it will be significant. (12:41)Scott asks about the freeze-thaw stability of encapsulates. Clay mentions that all of Balchem's encapsulated products are freeze-thaw stable. If a product is not, there will be cracks in the coating and some ruminal stability will be lost. (19:34)When it comes to ruminal stability, matrix encapsulates tend to have lower stability in the rumen, but it varies widely. Some have no ruminal stability; some lose less than 10% in the rumen. Encapsulation is a complex process and there are tradeoffs between some of the steps. For example, between TMR stability or rumen stability and bioavailability, the goal is to find the perfect mix of these to make a high-efficacy product on the farm. Kari describes a rumen stability test that can be conducted on-farm for protected choline and lysine products. Mark describes in situ experiments for rumen stability testing using small Dacron bags in rumen-cannulated animals. He mentions that creating an encap with high rumen stability and high intestinal digestibility is key. (19:58)Bioavailability is key, but methodologies for assessing bioavailability are a limitation. Kari and Mark discuss the pros and cons of various in situ/in vivo techniques, including mobile bag, abomasal pulse dose, and stable isotope. (29:25)Clay mentions that in vitro techniques are a key piece to product development and testing, but may give erroneous results compared to in vivo testing. Kari describes an experiment she conducted with Mark comparing in vivo and in vitro techniques. She suggests that there may be an argument for creating specific in vitro tests built for different types of protected products. For example, for a pH-sensitive product, a step mimicking abomasal enzymes would be important. For a fat-coated product, a step mimicking intestinal enzymes for fat breakdown would be important. Clay cautions that a product with only in vitro data should be regarded with skepticism. (44:25)Biological response in the animal is the key final step. Ultimately, you want independent, peer-reviewed data to prove the efficacy of a product. Mark reminds the audience that even if animals don't respond to a product, there are a host of different issues that could be causing that unrelated to the product being tested. Things like water quality, water quantity, stress, cow comfort - there's a whole laundry list of things to consider. (50:39)In closing, Kari recommends that when picking an encap product, ask for the research that hits the four pillars: TMR stability, rumen stability, bioavailability, and animal performance. Mark suggests that you can't make a bad encap good, but you can make a good encap bad if you aren't careful. Clay agrees that the more data, the better. Lastly, we need more work on the feed stability pillar which has been overlooked. It is a critical piece to encap products being effective in the field. Understanding In-vitro Fertilization As A Christian Reproduction, in vitro fertilization, and all of the questions that go along with it have been making the headlines recently. Did the Southern Baptists really oppose IVF treatments for infertile couples? How can pro-life people be against bringing more babies into the world? Just what issues are there with IVF and other reproduction-assisting procedures? Are there dangers to the parents? Listen in as Lenny explores all those questions and more.
The Southern Baptists are leading the charge against the unethical practices of IVF. But that only addresses 0.1% of the problem of abortions by conception control and intervention. We explain why IVF and abortifacients are contrary to the laws of God. But how does a Christian redeem twisted systems like polygamy, slavery, concubinage, and IVF? This program includes: 1. The World View in 5 Minutes with Adam McManus (Megachurch pastor Robert Morris resigns over moral failure, Vladimir Putin and Kim Jong Un sign pact in China's shadow, German shot put athlete gives glory to God) 2. Generations with Kevin Swanson

Ultraconservative pastor Micah Beckwith scored a stunning upset Saturday to become the Indiana Republican Party's nominee for lieutenant governor. More Indiana students graduate on time, but the state has lost ground in other key educational areas. Southern Baptists voted to oppose In Vitro Fertilization, or IVF, at their national convention in Indianapolis last week. Want to go deeper on the stories you hear on WFYI News Now? Pro-lifers' ultimate goal is to make sure that all children—born and unborn—are recognized as full and equal members of the human race. Alabama's Supreme Court recently took a major step toward making that happen. Not only does Alabama protect unborn children from abortion even in cases of rape and incest, but the state's Supreme Court also recently ruled that frozen embryos are children under the law. Unfortunately, Alabama's legislature quickly moved to undo the full effect of this monumental decision. But the Alabama Supreme Court has provided a roadmap toward protecting the right to life of ALL human beings.
