When I first spoke with Alyson Seligman, I was struck by her incredible story of resilience and determination after being suddenly paralyzed thirteen years ago due to a rare, chronic condition. Not only did she overcome this challenge, but she now uses her voice to educate and empower others who may be dealing with similar invisible illnesses, as well as helping businesses create a more inclusive environment for employees with disabilities. In this episode, we have an eye-opening conversation about the importance of understanding and complying with the Americans with Disabilities Act (ADA) and how employers can better support their employees with invisible illnesses. Throughout our discussion, Alyson shares valuable insights on the ADA's interactive process and the steps employees can take to request and receive the accommodations they need to thrive in the workplace. We also explore how employers, HR professionals, and coworkers can make a difference by fostering a welcoming and inclusive environment, providing reasonable accommodations, and avoiding judgment of those making requests for accommodations. Alyson's personal experience managing her invisible illness and working remotely offers a powerful perspective on the benefits and challenges of accommodating disabilities in the workplace. Finally, Alyson provides practical tips for employers to engage in the interactive process effectively and shares information about her own speaking engagements. As a motivational speaker, Alyson is passionate about helping businesses and individuals create supportive cultures that empower employees with disabilities and invisible illnesses. So, give this episode a listen, and don't forget to rate and review the show to help us reach more listeners who are interested in creating a more inclusive workplace and complying with the Americans with Disabilities Act. Employers are required to provide reasonable accommodations unless they would cause an “undue hardship” on the employer's operations. An “undue hardship” is significant difficulty or expense for the employer. The PWFA goes into effect on June 27, 2023. Artificial Intelligence can be used to streamline the various processes used in the recruiting and hiring process. There are many benefits including a reduction of time for all parties involved, as well as a decrease in expense, greater efficiency and overall standardization of the hiring process. However, there is a concern that the information inputted into the system may have the opposite of the intended effect, and rather than standardize the process, may overly limit or even disqualify members of a protected class. This creates potential liability and risk for the employer.in the episode, I discuss the use of artificial intelligence in the workplace, and best practices to help ensure compliance with the law.If you enjoyed this episode, follow me on social media, leave a review and share with a colleague!Connect with Karly WannosFollow Karly on Facebook, Instagram and LinkedinJoin our Private Facebook Community for HR and BusinessesLETS WORK TOGETHER: Have questions? I have litigated many employment lawsuits over the years and can typically pin point the reason why the employee decided to sue the employer, rather than just moving on. Here are the top reasons why:1. The employee was terminated but wasn't aware he was doing a bad job at work.2. Employee didn't know why he was fired3. Employer gave a negative reference to the new prospective employer4. Other people did the same things and got away with it5. Toxic managers6. The employee was forced to quit because of the toxic environment7. Things changed after they complained to HR.Listen to the episode and let me know what you think.LETS WORK TOGETHER: Have questions? In this episode, we will discuss termination of employees. Employees my be hired with the best intentions for the work relationship to work out. However, sometimes the relationship breaks down, and the employer and employee need to part ways. If the employer determines it must fire an employee, can it give a vague reason, such as "its not working out" or does the employer need to give the reason for the termination? HINT: The answer to this question, and my recommendations for best practices (in certain situations) are different.Resource Mentioned in this Episode:The Employer's Termination Checklist: A Guide to Terminating an At Will Employee and Avoiding Retaliation Claims. The onboarding process is very important for several reasons. First, it's one of the first impressions the company will make on the new hire. The systems, processes, how he/she is introduced to the day to day of what he/she will be doing. If the first impression is chaos, confusion, overwhelm, this is how the employee will perceive that the entire company is run. In comparison, if the employee is met with a warm welcome, properly intrude to the processes and systems, and has a chance to experience the culture, he/she will feel better about the decision to join the company. In the long run, this will serve to Limit overwhelm and reinforce the clear expectations and improved retention rates. In this episode, we will discuss:Automations New hire paperworkThe first day of workKey employment policiesFollow upAre you interested in scaling your business by hiring? After the interview, the offer letter is potentially the next major interaction a prospective employee may have with your business. Offer letters are important for legal purposes and to prevent litigation. Many states have at-will employment, so there may not necessarily be a contract at the time of hire. However, for at will employment states, there should be an offer letter. In this podcast episode, we are discussing the dos and don'ts of offer letters. I discuss what should be included, and what you should not include. For example, include specifics like start date, rate of pay (include hourly or annual salary) and when bonus or commission will be paid. You will also want to include that the employment is at will. A few things you want to keep out are verbiage that mentions the duration of the job or what constitutes grounds for termination, as this may inadvertently create a contract in an otherwise at will state. What do businesses needs to look out for in terms of employment laws in 2022? In this episode, we are discussing the top employment law areas for 2022. There were a lot of changes with the pandemic, whether employers had to require certain protective measures, allow employees to work from home or require vaccines. Knowing what is ahead can help you plan the areas you need to watch out for, and keep an eye on. Here is what we discuss:[3:50] Work from home requests disguised as request for an accommodation based on a medical condition. [6:35] Online Harassment - employees may be less professional when communication is online, which may lead to more harassment type claims[7:46] Wage and Hour Issues - improper time keeping; contacting employees after hours by text/phone; employees arriving to work late If you enjoyed this episode, leave me a review or share with a friend!✅ LISTEN to The Employment Experience on Apple Podcasts, Spotify and Stitcher ✅ REVIEW: Write a review- this helps us reach more business owners and HR Professionals✅ If you found the episode helpful, share this post on social media and tag me @karlywannosMedia Kit. Cannabis is currently illegal at the federal level, but over half the states have a comprehensive medical marijuana program and others allow for recreational use (as of the date of this recording.) Due to the constant change of the law in this area, employers have many unanswered questions about what is and is not permitted relative to cannabis in the workplace. My guest this week is Rachael Ardanuy, Denver-based Cannabis Business attorney and founder of a boutique law firm specializing in cannabis law for businesses. Rachael has dedicated her career to advising, educating and advocating for entrepreneurs, business owners and other cannabis industry participants.Listen as we discuss the current state of the law, areas where employers need to proceed with caution, and best practices for business moving forward. In the episode, we discuss the following:Can Employers fire someone for marijuana use? What happens when a new hire tests positive on a drug test? Will Employers be liable for discrimination if I terminate an employee who fails a drug test?GET EMPLOYMENT LAW UPDATES VIA E-MAIL!
