We continue our Best of 2024 episodes with an  episode from the Democracy Decoded podcast, with host Simone Leeper. In the end, the worst of everyone's election fears — political violence, overt foreign interference or a razor-thin margin between Kamala Harris and Donald Trump leading to a hotly contested legal battle — did not come to pass. Instead, Donald Trump won a plurality of votes for president, and did so decisively. On January 20, 2025, he will once again become the country's most powerful executive. His victory raises weighty questions for the experts at Campaign Legal Center. Trump ran explicitly on a platform of behaving like an authoritarian, promising to fire U.S. civil servants, threatening opponents with jail, and brandishing military force against would-be dissenters. As his return to power approaches, we grapple with a paradoxical election, in which voters declared their preference for the candidate who repeatedly threatened the American system as we know it.Joining Simone in this episode are Trevor Potter, CLC's president and founder, and CLC senior vice presidents Paul M. Smith and Bruce Spiva. They offer their forecasts for the uncertain years ahead and explain what this election did (and did not) signify about the health of American democracy.Read the full transcriptHost and Guests:Simone Leeper litigates a wide range of redistricting-related cases at CLC, challenging gerrymanders and advocating for election systems that guarantee all voters an equal opportunity to influence our democracy. Prior to arriving at CLC, Simone was a law clerk in the office of Senator Ed Markey and at the Library of Congress, Office of General Counsel. She received her J.D. cum laude from Georgetown University Law Center in 2019 and a bachelor's degree in political science from Columbia University in 2016.Trevor Potter is President at Campaign Legal Center. A Republican former Chairman of the Federal Election Commission (FEC), Trevor was general counsel to John McCain's 2000 and 2008 presidential campaigns and an adviser to the drafters of the McCain-Feingold campaign finance law. To many, he is perhaps best known for his recurring appearances on The Colbert Report as the lawyer for Stephen Colbert's super PAC, Americans for a Better Tomorrow, Tomorrow, during the 2012 election, a program that won a Peabody Award for excellence in reporting on money in politics. The American Bar Association Journal has described Trevor as “hands-down one of the top lawyers in the country on the delicate intersection of politics, law and money.” Trevor is the author of several books and manuals on lobbying regulation and disclosure, campaign finance and federal election law. He has provided testimony and written statements to Congress on federal election proposals, campaign finance regulation and, recently, the effects of the January 6th attack on our democracy. He has also taught campaign finance law at the University of Virginia School of Law and Oxford University, and he has appeared widely in national broadcast and print media. During the 2020 election season, Trevor was named to the cross-partisan National Task Force on Election Crises.Bruce Spiva is Senior Vice President at Campaign Legal Center. He is an attorney and community leader who has spent his over 30-year career fighting for civil rights and civil liberties, voting rights, consumer protection, and antitrust enforcement.Over the past three decades, he has tried cases and argued appeals in courtrooms across the country, including arguing against vote suppression in the United States Supreme Court in 2021. In 2022, in his first run for public office, Bruce mounted a competitive run in the primary election for Washington, D.C. Attorney General. In addition to founding his own law firm where he practiced for eleven years, Bruce has held several leadership and management positions as a partner at two national law firms. Most recently, Bruce served as the Managing Partner of the D.C. Office and on the firm-wide Executive Committee of Perkins Coie LLP, where he also had an active election law practice. He first-chaired twelve voting rights and redistricting trials across the country, and argued numerous voting rights appeals in U.S. circuit courts and state supreme courts during his tenure at Perkins.Paul M. Smith is Senior Vice President at Campaign Legal Center. He works directly with CLC's talented team of litigators to protect and advance American democracy through innovative litigation strategies.Paul has four decades of experience litigating a wide range of cases. He has argued before the U.S. Supreme Court 21 times and secured numerous victories, including in the important cases advancing civil liberties and civil rights, Lawrence v. Texas, the landmark gay rights case, and Brown v. Entertainment Merchants Ass'n, which established First Amendment rights of those who produce and sell video games. In addition, Paul has argued several voting rights cases at the Supreme Court, including Vieth v. Jubelirer and Gill v. Whitford, involving partisan gerrymandering, LULAC v. Perry, involving the legality of Texas's mid-decade redrawing of congressional districts and Crawford v. Marion County Election Board, involving the constitutionality of a voter identification law. He served as counsel for amici in several key campaign finance merits cases including McCutcheon v. I'm chatting with Erin Levine, the founder and CEO of Hello Divorce, about why the push to get rid of no-fault divorce is seriously bad news—especially for women. No-fault divorce has enabled people to leave marriages without having to prove things like abuse or cheating and it makes women safer. The GOP wants to repeal or restrict no-fault divorce. We're here to break down why that's a huge problem. Erin, a lawyer-turned-CEO, has been shaking up the divorce world with Hello Divorce, a platform that makes the whole process smoother, easier, and less stressful. In this episode, we discuss what no-fault divorce is, why it matters, and what could happen if it's taken away. Spoiler alert: it's not good. Featured topics: No-fault divorce: What it is, and how it differs from fault-based divorce (4:55) How no-fault laws help victims leave unsafe marriages (6:55) Why the rollback of no-fault divorce would be disastrous (32:17) What you can do to ensure no-fault divorce protections remain in place (34:16) Learn more about Erin Levine: Erin Levine is not your typical attorney. With over a decade of experience in litigating complex family matters, she saw the need for a kinder, easier and more affordable pathway out of marriage and into the next chapter of life. To achieve this, Erin set out to revolutionize the broken divorce system and founded Hello Divorce, a venture capital backed, tech-enabled platform, that combines self-service online tools with integrated expert advice, making it easier for everyone to navigate their lives and finances with less stress and mess. Erin's innovative approach to the divorce process has earned her media mentions from the legal industry and beyond, with recent features in Vice, Forbes, American Bar Association Journal, Business Insider and TechCrunch. Ultimately, Erin is on a mission to help separating couples empower a better life ahead and has helped thousands of Americans reorganize their lives and families through a framework that levels the playing field between spouses so they can sort things out fairly, avoid missteps and reimagine their next (best) chapter. Send us a Text Message. In 1997, Peter Heyberger was convicted of residential burglary and attempted residential burglary. It was his third conviction, and so, under California's “Three Strikes” law, Mr. Heyberger's minimum sentence was 25 years to life in prison. He was sentenced to 65-years to life.  In 2019, California passed HB 2942—a Prosecutor-Initiated Resentencing bill that gave California prosecutors the discretion to reevaluate past cases and recommend lower sentences.  And so it was, in 2020, that Santa Clara County District Attorney Jeff Rosen reviewed Mr. Heyberger's file and made a recommendation that, after serving twenty-three years of his sentence, led to Mr. Heyberger's release.  Hillary Blout is the former California Prosecutor who helped draft and pass the California legislation that paved the way for Mr. Heyberger's release.  While working as a prosecutor, Hillary came to believe that court sentences were longer than necessary to achieve the goal of rehabilitation.  She left her job as a prosecutor and began working on sentencing reform.  In 2019, she founded “For the People”—an organization dedicated to passing and implementing Prosecutor-Initiated Resentencing laws across the country. She has written for The Washington Post, Newsweek, USA Today, Bloomberg, and the American Bar Association Journal.  At this point she has secured the passage of Prosecutor-Initiated Resentencing laws in several states, and her work has led to the resentencing of close to 1,000 people.  Justin Danilewitz and Geonard Butler spoke with Hillary Blout about her own experience, and the future of Prosecutor-Initiated Resentencing.

When a global genetic experiment goes awry and canines stop wagging their tails, mass hysteria ensues and the species is systematically euthanized. But soon, Mechanical Tail comes to the rescue. The company creates replacements for “man's best friend” and studies them on Dog Island, where 17-year-old Nano Miller was born and raised. Nano's life has become a cycle of annual heartbreak. Every spring, she is given the latest robot dog model to test, only to have it torn from her arms a year later. But one day she makes a discovery that upends everything she's taken for granted: a living puppy that miraculously wags its tail. And there is no way she's letting this dog go. Arin Greenwood is an animal writer and former lawyer living in St. Petersburg, Florida, with her husband, Ray, and their beloved pets. Arin was animal welfare editor for The Huffington Post. Her stories about dogs, cats, and other critters have appeared in many publications including The Washington Post, The Dodo, The Today Show's website, Slate, Creative Loafing, the American Bar Association Journal, Best Friends Animal Society's magazine, and more. She now writes and edits for animal nonprofits. Arin is also the author of Tropical Depression and Save the Enemy. Kyle Johannsen is a philosophy instructor at Trent University and Wilfrid Laurier University. The purpose of the census was to determine their military strength as well as to distribute the family land grants in Canaan.  At the time, women held no property rights. When a man died, his inheritance went to his sons. If he had no sons, it went to his brothers. But the five daughters of Zelophehed felt this was unfair. So together as a group, they went to Moses to express their concerns in order to change the laws. The story of Zelophehad’s daughters confirms that God treasures women. He doesn’t see us as second class citizens. He knows our name, He supports our right to be heard, and He listens to what we have to say. He loves us, each and every one of us. Perhaps you’ve not been feeling very loved. For that matter, you feel like you’re not being heard. I encourage you to take your concerns to God. It’s ok to express your frustrations. It’s alright to let Him know you’re upset. He wants to hear from you. He’s waiting to hear from you.For Further Study Numbers 26:33 Numbers 27:1-11 Numbers 36:1-12 Joshua 17:3 Additional Reading All of The Women of the The Bible by Edith Seen All the Women of the Bible by Herbert Lockyer Fearless Daughters of the Bible by J. What happens when you realize that you're the bottleneck inhibiting your business's growth and profitability? Nina Kaufman is a business attorney and small business champion who caught my attention with her Checklist for Small Business Owners. Here are the first few questions: Ever feel like you can take time off even one day a week seems unrealistic Ever miss time from a family vacation because you were back in the office fighting fires Are you fed up not making the kind of money that can support the life you want to lead Are you working way too hard for way too little money to show for it Do you feel constrained and frustrated by your inability to make a greater impact in the world If your business is based on your knowledge and expertise, you're a professional services business. And the trap that many professional services businesses fall into, says Nina, is you can only sell the number of hours you have available to give to clients.  Suddenly you're a slave to your own business, and the vision of being your own boss is distressingly like working for a terrible boss. When Nina found herself in that trap, in your small law practice, she took it as a challenge: what are the essential elements for building a million dollar road map where you leverage, rather than sell, your expertise. When Nina Kaufman asks: when would it be a good time to think about redesigning your business model so that it's more self-sustaining and less dependent on you? She's really wondering : When would the answer be it be NOW? Nina L. Kaufman, Esq., owner of Ask The Business Lawyer, is an award-winning small business attorney, speaker, and Entrepreneur Magazine online contributor. Nina has a personal mission of offering straight-talk legal to bolster your business. Companies in the consulting, creative, and professional services arena save time, money, and aggravation with the foundation of contracts, agreements they need for success. — the legal bedrock they need to build self-sustaining companies. Her creative approaches to serving the small business community garnered her the SBA's 2011 regional Women in Business Champion of the Year Award. Her multi-faceted business model, developed from over 15 years of small business legal experience guides knowledge economy firms through the legal issues they face in starting and running their own companies. Her humorous, practical understanding of the issues that cause deer-in-the-headlights paralysis is reflected in the titles of some of her programs: What is the solution to small business slavery? How do we choose business partners who won't [BLEEP] us? How can we train our clients to pay us? Do you know where you intellectual property is tonight? and she has been featured in the Wall Street Journal, U.S. News & World Report, Crain's NY, Forbes.com, SmallBusinessComputing.com, PINK magazine, The New York Law Journal, the American Bar Association Journal, and Entrepreneur magazine and has appeared on MSNBC and Fox Channel 5's Good Day NY program. Nina is an educator at heart, which is reflected in her approach to legal services and pricing models, her writing, her professional speaking, and the online resources she has created for entrepreneurs at askthebusinesslawyer.com. I'm taking her up on her offer to Livelihood listeners for her Million Dollar Map program.
