A group of seventeen states, predominantly leaning conservative, have risen in contest against California's stringent emissions regulations. These states, spearheaded by Nebraska, find fault in California's Advanced Clean Fleets regulations. These regulations stipulate inevitable cessation of new internal-combustion trucks sales by the year 2036, superseding federal law with what one may perceive as ambitious environmental targets. This legal challenge raises concerns around the forces this mandate imposes on national societal dynamics. Particularly, fears circulate around disruption of supply chains due to the imposed transition towards 'zero emission vehicles'. This transition, critics argue, poses a threat to the efficient rhythm of interstate transportation, a rhythm crucial to the ebb and flow of American society. The legal action, seeking attention at a national level, comments sharply on California's regulations. In the words of the lawsuit, it was a 'stunning gambit'. An evocative phrase, intended to convey the unprecedented nature of encroaching on federal jurisdiction, painting this as an audacious power-play staged by California to ban internal-combustion engines in medium- and heavy-duty vehicles. The lawsuit argues the California's plan not only Macgyvers the law, but it irrationally disregards the logistical and economic realities we are all tethered to. Joining forces alongside Nebraska, we see multiple states: Alabama, Arkansas, Georgia, Idaho, Indiana, Iowa, Kansas, Louisiana, Missouri, Montana, Oklahoma, South Carolina, Utah, West Virginia, and Wyoming. Moreover, the Arizona State Legislature and the Nebraska Trucking Association too have climbed aboard this legal battlewagon. The ensuing lawsuit was lodged in none other than the U.S. District Court for the Eastern District of California. Now, not limited to targeting the Golden State, Nebraska notches up an additional lawsuit. This time the crosshairs are pointed at the Environmental Protection Agency (EPA), accused of enforcing overreaching regulations around tailpipe emission standards for heavy vehicles. The litigants suggest there is a not-so-subtle subtext here, a nudge towards pushing manufacturing companies to favor production of electric vehicles over more traditional offerings. The list of states rallying against the EPA isn't identical, but it remains hefty in lineup. Alabama, Alaska, Arkansas, Florida, Georgia, Idaho, Indiana, Iowa, Kansas, Kentucky, Louisiana, Mississippi, Missouri, Montana, Oklahoma, South Carolina, South Dakota, Tennessee, Texas, Utah, Virginia, West Virginia, and Wyoming all stand alongside Nebraska in this legal dance. Poised and ready, these states presented their case in front of the U.S. Court of Appeals for the District of Columbia Circuit. The legal filings imply a concern of industry and infrastructure transfiguration orchestrated by California and an out-of-touch EPA. Lamenting the potential of facing heightened inflation and an already-taxed electrical grid, they put forth that their operations could be devastated by such transformative measures. These trucking and logistics industries, vital arteries to the American body economic, risk severe trauma from such regulatory shifts. With costs inevitably passed down the supply chain, these measures come with the promise of price rises for everyday consumers. Pockets, it is suggested, could start to feel a little lighter, and soon. Furthermore, harking a tolling bell for the labor market, countless jobs across these states could feel the shockwave from these industry shifts. The ripple effect from policy to industry to worker's livelihood illustrates the interconnected nature of such regulatory measures. It shows that the environmental fork in the road may present survival challenges to more than just the natural world. To quote Nebraska Attorney General Mike Hilgers, these changes might impact an 'untold number of jobs across Nebraska and the country'. It's a litigator's thesis statement of sorts, zeroing in on the cost of environmental change and those who stand to bear the brunt of it: the workers, their families, and indeed the stability of local economies within these states. Whether this legal challenge will alter policy trends towards clean energy remains to be seen. In tackling climate change, states like California and federal bodies like the EPA walk a razor's edge: one side being the protection and nurturing of our fragile environment and the other, catering to the immediate and practical needs of industry, labour and economics. It's a balancing act of stewardship and pragmatism. As the narratives of environmental stewardship, practicality, and legality intertwine, decisions made in courts and policy-making chambers today will have wide-ranging effects on the futures of economies, societies, and our planet. It will be up to those in leadership roles to strike the right balance, encompassing not only the realities of today but also the necessities of tomorrow. 1864. That's the year Arizona's abortion ban was passed. The archaic law has remained dormant since 1976, when Roe v. Becky Harper, the named plaintiff in Moore vs. Harper, is a citizen-activist who cares deeply about free and fair elections.  She joins us to tell her story about the journey to the Supreme Court and what lies ahead for voting rights and representation. In a 6-3 ruling in the case Moore v. Harper issued June 27, 2023, the U.S. Supreme Court has rejected an extreme version of the so-called “independent state legislature” theory that posed serious challenges for the conduct of elections and would have allowed state legislatures to engage in election subversion (something that was attempted in the 2020 election). In its opinion, the Supreme Court upheld the long-running interpretation of the term “Legislature” in the Elections Clause in Article I, Section IV, Clause 1 and in the Presidential Electors Clause in Article II, Section 1, Clause 2 of the Constitution, making clear that state legislatures do not wield free floating power in the conduct of elections and that their power must be understood in the context of the system of state government, including judicial review. The court also affirmed its 2015 ruling in Arizona State Legislature v. Arizona Independent Redistricting Commission that states legislatures do not violate this interpretation when they use voter initiatives to create independent redistricting commissions to draw congressional lines. Harper, the upcoming case that asks the Court to consider the constitutionality of the Independent State Legislature Theory, you'll be glad you listened to today's episode. That's because it provides an excellent review of the precedent and history of the Election Clause's use of the word "legislature." Arizona voters passed Proposition 106 in 2000, amending the Arizona state constitution to remove congressional redistricting authority from the legislature and, instead, gave that authority to the new Arizona Independent Redistricting Commission (IRC). When the IRC approved a new congressional district map in 2012, the state legislature sued the IRC, claiming that prop 106 violated the Constitution's Election Clause. The legislature argued that the Elections Clause gave redistricting authority to the state legislatures, which made prop 106 unconstitutional and, therefore, invalid. The federal district court disagreed, holding prop 106 did not violate the Elections Clause. In a 5-4 decision, the Supreme Court affirmed the district court's decision. Episode 594 Walt Blackman is a First Class Father, Combat Veteran and Arizona State Representative. He served in the United States Army for nearly 22 years as a Front Line Tank Commander and Sexual Harassment and Assault Prevention Senior Program Manager Specialist. He earned a Bronze Star for combat action in Iraq as well as a Meritorious Service Medal. He served seven tours of duty in some of the most dangerous battlefields on Earth, including Kosovo, Afghanistan, and Iraq, where he fought in the Second Battle of Fallujah, the bloodiest battle in the Iraq War. His desire to serve his country continued after his military service and he ran for the Arizona State Legislature. Walt won a contentious primary election in 2018 and went on to win the general election. He repeated this victory in 2020. He is currently running for Congress in Arizona. Today the Biden administration issued a sweeping plan aimed at battling COVID. That plan includes  mandating vaccinations for employees of companies  that have more than 100 workers.  Is that even legal?We begin this episode with a true story. It's a story of a former pastor and his son. They were both quite healthy.  In the town where they lived, there was an ordinance that required everyone of a certain age to get a vaccine from a terrible disease, or go to jail and pay a fine. They objected to this mandate - asking why, if they were completely healthy,  should they be forced to take something into their bodies they didn't trust. Sound like a familiar story? Noah Karvelis, Co-Founder of Arizona's Educators United If you've been in Arizona or on the internet lately, chances are you've heard of the #RedforEd movement for increased public education funding. Support has been posted in business windows, written on vehicles, discussed on national news, worn on shirts, and resulted in a historic teacher walkout across the state. This week, we sit down with one of the people who helped to start it all. Noah Karvelis co-founded Arizona Educators United and helped spark the #RedforEd movement in Arizona. We discussed the reality for Arizona educators today, how teachers mobilized, and what leading a movement has been like every step of the way. The movement continues. 270,000 signatures were recently submitted to the Arizona Secretary of State to place the Invest in Education Act on the state's ballot this November. Due to the inaction of the Arizona State Legislature earlier this year, this ballot initiative seeks to raise the revenue necessary to restore some of the $1 billion that has been cut from public schools since 2008. Javelina is excited and honored to be a partner in this effort as the general consultant on the campaign moving forward.

State Representative Reginald Bolding is an educator, community leader, and social entrepreneur. Bolding a first generation college student is an outstanding scholar in both education and justice studies. After graduating at the top of his class from the University of Cincinnati, where he earned an undergraduate degree in Criminal Justice and International Security, Reginald turned down a full-ride law school scholarship to become a Special Education teacher in South Phoenix to teach underserved youth. Growing up in an underserved neighborhood himself, Bolding understood firsthand the obstacles and barriers faced by youth and families in these communities and wanted to help create change. He started a non-profit to provide students from low-income communities’ access to internships opportunities at top companies in Arizona. At the age of twenty-eight, Bolding was elected to the Arizona House of Representatives representing downtown Phoenix, South Phoenix, Laveen, Tempe, and the Gila River Indian Community. During his first term, Bolding was one of the most successful Democrats in the Arizona State Legislature. Representative Bolding introduced bills that would increase access to early child education, create tuition free higher education options, and worked to develop job training programs. Additionally, Bolding led a criminal justice reform agenda introducing bills that require body-worn cameras of law enforcement officers, sentencing reform, and reduced private prison contracts.
