In this case, the court considered this issue: Does the Bankruptcy Code authorize a court to approve, as part of a plan of reorganization under Chapter 11 of the Bankruptcy Code, a release that extinguishes claims held by non-debtors against non-debtor third parties, without the claimants' consent? The case was decided on June 27, 2024. The Supreme Court held that the Bankruptcy Code does not authorize a release and injunction that, as part of a plan of reorganization under Chapter 11, effectively seek to discharge claims against a nondebtor without the consent of affected claimants. Justice Neil Gorsuch authored the 5-4 majority opinion of the Court. Applying the ejusdem generis canon of statutory interpretation to Section 1123(b)(6), which is a catchall provision allowing "any other appropriate provision" in a bankruptcy plan, the Court reasoned that this provision should be read in light of the specific provisions that precede it, all of which concern the debtor's rights and responsibilities. Therefore, Section 1123(b)(6) cannot be fairly read to grant the radically different power to discharge debts of non-debtors without affected claimants' consent. The broader context of the Bankruptcy Code further supports this conclusion. Discharges are generally reserved for debtors who place their assets in the bankruptcy estate, and even then, certain types of claims (like fraud or willful injury) cannot be discharged. The Sacklers, as non-debtors, seek greater protection than the Code typically allows for actual debtors, without meeting the Code's usual requirements. Congress has only explicitly authorized third-party releases in asbestos-related bankruptcies, suggesting that such releases are not generally permissible in other contexts. Therefore, Section 1123(b)(6) does not authorize the nonconsensual release of claims against the Sacklers, who are non-debtors in Purdue Pharma's bankruptcy case. Justice Brett Kavanaugh authored a dissenting opinion, in which Chief Justice John Roberts and Justices Sonia Sotomayor and Elena Kagan joined. During the 2023 New Yorker Festival, three legendary staff writers got together to discuss the craft of investigative journalism: digging for information like detectives, and then presenting it in a way to rival the best thrillers. For each of these writers, the “bad guy” —whose actions usually set the story in motion – needs to be presented in three dimensions; trusting the reader to grapple with that person's perspective is key to an engrossing story. “I look at these big, boring issues often, like economic inequality or corruption in politics,” Jane Mayer says. “You take a subject like campaign finance – the Citizens United decision and how it's corrupted politics. If you can find somebody like [Charles or David] Koch and explain there actually was a billionaire behind so much of this, and he has a story, and he has a family, and there are always screwed-up fathers and sons involved in these families. . . . It means that you're able to explain the ethical choices people make.” Mayer is best known for her book “Dark Money,” about the Koch brothers; David Grann wrote “Killers of the Flower Moon” and “The Wager,” both best-sellers; and Patrick Radden Keefe covered the Sackler family's opioid dynasty in “Empire of Pain,” and a murder during the Troubles in Northern Ireland in “Say Nothing.”  They were joined by their editor, The New Yorker's Daniel Zalewski.

They have some intriguing topics lined up for you: the impact of inflation on America's spending habits, the role of bankruptcy as a shield, and the concept of "spaving".  Consumer ETFs Showing the Real Inflation Picture We're kicking things off with a look at how some ETFs are revealing the true impact of inflation on consumer behavior. The Consumer Discretionary Select Sector SPDR ETF, featuring big names like General Motors, Chipotle, and Deckers, has seen a downturn this year. In contrast, the Consumer Staples Select Sector SPDR ETF, with holdings like Procter & Gamble, Costco, and Walmart, is up more than 8%. Walmart, the nation's largest retailer, reports that it's attracting more upper-income shoppers, those earning above $100,000. CFO John David Rainey noted that these customers are spending more on essential items and less on discretionary products. Meanwhile, luxury brands like Burberry are facing significant losses, with annual profits down 34% and same-store sales dropping by 1%. Spaving Have you heard of "spaving"—spending more to save? This old concept, now rebranded, is prevalent in grocery stores, retailers, and even online gambling. Financial expert Bryan Kuderna explains that spaving encourages consumers to buy more than necessary to feel like they're getting a deal. Common tactics include "buy one get one free" offers, in-store cash for future purchases, freebies, and store credit cards. The key takeaway: avoid buying under pressure to steer clear of these marketing traps. Is Bankruptcy a Shield? We explore whether corporate defendants can use federal bankruptcy to shield themselves from legal trouble. The Supreme Court is set to consider this issue, particularly in the case involving Purdue Pharma and the Sackler family. The question at hand is whether the Sacklers can use bankruptcy to protect their personal fortunes from opioid-related liabilities. Justices are debating whether bankruptcy laws were intended to prevent personal injury victims from suing third parties not directly involved in bankruptcy proceedings. Comment Time! Everybody I knew that was my age (23) + maybe 5 years was renting. I don't know a single person from back home that owns a home. This is a replay of an interview we did with Ed Bisch in 2021.  Ed was the first real activist to come on our podcast and since then, he has introduced us to countless others who are fighting this fight. Ed Bisch lost his son, Eddie, to an oxycontin overdose (he took one pill) in 2001. While Ed grieved the loss of his son, he also took notice - never having heard of oxycontin before. He began researching and finding other parents who had lost children to this drug, and he was contacted by Purdue Pharma, who had all sorts of justifications as to why this might happen. Ed has been keeping the pressure on his group - RAPP - Relatives Against Purdue Pharma. Sam and Emma speak with Ian Millhiser, senior correspondent at Vox, to discuss some of the biggest cases before the Supreme Court this term. First, Sam and Emma run through updates on the Biden Administration's internal reckoning with their strategic failures in support of Israel, the US' minor aid to Gaza and minuscule conditions to punish violent settlers, the House's antisemitic antisemitism bill, Tommy Tuberville relinquishing his obstructive hold on military appointments, the Senate's aid to Ukraine and Israel, the upcoming GOP Debate, and the continuing extreme temperature of 2023, before parsing through the insanity of the House's “anti-zionism is antisemitism” bill, with some help from Jewish Rep. Jerrold Nadler. Ian Milhiser then joins, diving right into an assessment of the impending Supreme Court decision on Moore v. US, a case that will define the possibility of a federal wealth tax as conservatives attempt to tie the taxation of unrealized sums to the apportionment clause in the constitution. After walking through what apportionment, unrealized sums, and “direct taxation” could mean (with some help from Sonya Sotomayor), Milhiser walks Sam and Emma through the newest SCOTUS case involving the “Major Questions Doctrine” – tackling what that doctrine entails, and why the 5th circuit is using it to put the SEC, and the administrative state writ large, in their crosshairs, before working through the 5th Circuit's prominent role working under a conservative Supreme Court, and where Chief Justice Roberts, himself, stands on the doctrine. Wrapping up, they explore the upcoming case against Perdue Pharmaceuticals – as the Sacklers attempt to shirk their liabilities onto the business – and the First Amendment attacks on the BDS movement. It's Hump Day! Sam and Emma talk to Ken Klippenstein, investigative reporter at the Intercept, to discuss his recent reporting on the Pentagon's efforts to combat disinformation. Then they speak with Nick Turse, contributing writer at The Intercept, to discuss his recent series on Henry Kissinger.  First, Sam and Emma run through updates on the debt ceiling move to the House floor, the Sacklers getting shielded from accountability, conservatives' turn against Chick-fil-A, Twitter's plummeting valuation, and the SEIU's new anti-trust suit, before watching Matt Gaetz walk through the Freedom Caucus' plan to handle the debt ceiling, and what else could be pushed through. Ken Klippenstein then looks to his reports on the Pentagon's propaganda efforts, with the recent (re)establishment of a “Perception Management Office,” first, walking through the Pentagon's history of “perception management,” particularly coming out of the Vietnam war, and the complete public backlash to the eventual establishment of this office under the post-9/11 Bush administration. After touching on the lack of backlash to the recent re-establishment of this office, Ken, Sam, and Emma tackle the actual work this office engages in, and how they keep it undercover. Nick Turse then parses through his series on how Henry Kissinger's level of imperial bloodshed was somehow even greater than previously believed. First, he establishes the incredible political and media network that Kissinger still maintains to this day, before stepping back to explore his work interviewing survivors and witnesses to Kissinger's terror and the relentless violence he wrought in places like Cambodia. They also touch on Kissinger's rampant and indiscriminate bombing of Cambodia in the context of initiating the Watergate scandal, and as the original blueprint for US counterinsurgency “forever wars.” And in the Fun Half: Sam and Emma dive into the SEIU's anti-trust suit against UPMC Hospital Network's monopsony, the impeachment of Ken Paxton, and what it means that Trump is rallying behind him. They also look at the anti-LGBTarget rapper's appearance on Fox, Candace Owens' free-flowing fundamentalism, and Ken from South Carolina talks about MAMMOTH climate change solutions. Owen from LA discusses an impending real estate disaster, and Jesse Watters runs cover for DeSantis' witness to war crimes.
