A senior state employee filed a lawsuit last week alleging that Governor Jared Polis has violated state law by cooperating with a subpoena for information from ICE. Anti-ICE protesters have been marching in Denver's streets all week and Polis was already in hot water with Democrats after he set his personal record for vetoing bills, so why would he do this now? David Seligman is a candidate for state attorney general and the executive director of Towards Justice, a non-profit law firm that just joined the lawsuit against Polis, and he's on with host Bree Davies to break down the case and try to imagine what the governor is thinking. After we recorded this conversation, we heard back from Governor Polis's spokesperson. She send us the following statement:  “The Governor is committed to preventing the illegal exploitation and trafficking of children. This lawsuit is unfortunately delaying an investigation focused on looking into child exploitation and trafficking. The decision to respond to this federal subpoena to support the investigation into crimes against vulnerable minors was carefully considered in accordance with Colorado law, which allows for sharing information to support timely criminal investigations. Keeping kids safe is a top priority, child exploitation is a deeply concerning issue, and has no place in our state. Complying with this federal subpoena meets the requirements laid out in state law and providing this information is in service of investigating and preventing  criminal activity, which Governor Polis is deeply committed to.”  What do you think about this lawsuit? Two new ‘non-financial' sanctions have come into force today for beneficiaries, who, in the words of the MSD, do not meet their obligations or, as other people might put it, who do not get off their arses and go and look for a job. Some people may have half their weekly benefits put onto a payment card for four weeks, that can only be spent on essential items at approved shops. Others may also have to find volunteer work for at least five hours each week, again for four weeks. Remember though, as the Minister for Social Development confirmed, it's only a tiny proportion of job seekers who are having a laugh – 98% are complying with their obligations and are doing what they can to get off the benefit, so it's only really going to apply to 2% of those on the benefit. But as former Welfare Expert Advisory Group member Phil O'Reilly told Ryan Bridge on Early Edition this morning, sanctions can and do work. Sanctions do work. Exactly how well they work is always open to debate. They work for two reasons. One is they encourage people to get off the benefit. But secondly, very importantly for people like you and me who are paying tax in order to give persons a benefit, they keep our faith in the system too. That if you're not going to play by the rules, there's going to be a bit of a sanction on you, so they do actually work in those two contexts. And I think that's important to remember too, it's not just about those who are on the benefit, it's about those people who are paying, in effect, the benefit. There has to be faith in the system to keep the system going. People won't suffer a financial loss per say, and since they'll be restricted as to what they can spend their benefit on if they are failing to meet their obligations. I'm less enthusiastic about the volunteering requirements. The poor old charity sector is doing it tough enough as it is without some hapless souls turning up reluctantly, looking for things to do because they have to. I don't see why voluntary organisations should be charged with the task of straightening out recalcitrant beneficiaries on top of everything else they do. Compulsory training courses or upskilling by MSD should be the way to go as far as I'm concerned. If there are people who want to volunteer, who have something to offer, fine - fill your boots. But I imagine they'd be doing that already if they felt they had something to offer. What on Earth are you going to do with a couple of individuals who don't want to go and get a job? We're talking the tiny proportion of beneficiaries there who don't want to go and get a job, who don't know how to go and get a job, who don't believe they have anything to offer anyone - they'll have had the stuffing knocked out of them after being on a benefit for years - turning up at your local Hospice shop or your SPCA or whatever, what on Earth are you supposed to do with them? David Seymour, whose party campaigned on the policies, said sanctions should go further. He said no country can succeed with one in six working age people on a benefit and ACT wants to see money in kind given as a benefit instead of cash. If you want the freedom, he says, to spend cash as your own, then earn it yourself. Which is all very well and good when the jobs are there but it's widely acknowledged that we're seeing unemployment rise. Hopefully it will peak very shortly, but we are at a time of high unemployment relative to the circumstances of this country. I'm all for getting the sanctions out for the 2% putting restrictions on what they can spend the money on so that taxpayers will have faith in the system, but the volunteering, no. Also, some of you may have a different view now about being on a benefit. Prior to the Covid years, many people had never experienced the shock of losing a job. During the Covid years, people lost work almost overnight. And they were extraordinary times trying to find something to do in a in an industry that had disappeared for a time or in the recession that followed. You might have suddenly found yourself surplus to requirements because the company you had worked for years was in really straightened circumstances and had to ditch people overboard to survive, so you might have a different view about what it means to be unemployed and looking for work. Large-scale detention operations in international armed conflicts (IACs) pose significant humanitarian, legal, and operational challenges. International humanitarian law (IHL) provides detailed rules governing the treatment and protection of persons deprived of liberty, whether they are prisoners of war, other persons interned for security reasons, or other protected persons. These obligations, enshrined primarily in the Third and Fourth Geneva Conventions, require not only compliance once the armed conflict begins, but advance planning during peacetime. Without the appropriate institutions, infrastructures, and trained personnel in place beforehand, states risk falling short of their legal obligations when hostilities erupt, to the detriment of detainees' rights and dignity. In this post, ICRC Legal Advisers Sylvain Vité and Isabelle Gallino explore what it takes to comply with IHL in large-scale detention operations during IACs, focusing on the preparatory measures that states must undertake long before the first capture. Building on the previous post in this series, they highlight the critical need to establish functioning legal and administrative mechanisms, ensure the availability of adequate facilities and resources, and embed IHL training across relevant personnel.

As states increasingly focus on strengthening their defense capabilities, discussions on military preparedness are gaining prominence, particularly in relation to large-scale conflicts. Such conflicts, involving major powers, advanced weaponry, and extensive resources, would unfold with considerable intensity, scale, and tempo. The humanitarian consequences would be far-reaching and severe, potentially causing mass casualties, mass displacement, and the disruption of essential services. The Geneva Conventions, adopted in the aftermath of two world wars, were designed precisely to help mitigate the suffering in armed conflict. Yet ratification alone is not enough: for these rules to be upheld in practice, extensive legal and operational preparations must begin in times of peace. This introductory post sets the stage for a new series examining the steps needed to ensure compliance with international humanitarian law (IHL) in large-scale conflicts. Isabelle Gallino, ICRC Prevention Adviser, and Sylvain Vité, ICRC Senior Legal Adviser, argue that states must do more than recognize their legal obligations. Applicable rules must be understood, internalized, and backed by legal and practical measures today if they are to be effective once an armed conflict erupts. Ultimately, failure to prepare can undermine even the best-intentioned efforts to comply with IHL.

In the last week, we have learned that Any media outlet criticizing Trump is corrupt and should be in jail; Any DOJ lawyer or investigator looking into Trump's many crimes is corrupt and will be fired; Any member of Congress investigating Trump's many crimes should go to prison; Any non-white person whether in the country legally or illegally can be snatched up by Homeland Security and immediately sent to an El Salvador prison; We apparently are at war, much to the surprise of a Congress which has the sole power to declare war; Complying with federal court orders is optional; Any judge ruling against Trump policies should be impeached; and Chief John Roberts may actually have a spine.  In Michigan  Governor Whitmer confirms she's not running for the U.S. Senate; New polling shows that the woman she beat by 10 points in 2022 is a contender to win the GOP's nomination for either Governor or the Senate; State House Speaker Matt Hall believes he, like the Governor, has the right to veto legislation; The battle over fixing the damn roads is escalating;  Republican state Representative Bryan Posthumous, a leader in the GOP's election integrity talk, may be engaged in a little election fraud of his own; and  Michigan Republicans continue to duck face-to-face Town Hall meetings, while Democrats schedule as many as they can. In late 2024, the Stop Campus Hazing Act was signed into law, amending the Clery Act – a consumer protection law designed to enhance transparency around campus crime policies and statistics. Beginning in 2025, institutions receiving federal student aid must comply with these new requirements. But what does this really mean for colleges and universities? On Monday, September 30th, United States District Court Judge Mary Geiger Lewis ruled that the Department of Energy (DOE) and its National Nuclear Secrurity Administration (NNSA) violated the National Environmental Policy Act (NEPA) because the federal agencies failed to take a “hard look” at the alternatives to fabricate plutonium pits, or the triggers, for nuclear weapons at two of its sites. Los Alamos National Laboratory (LANL) was created to design and fabricate the atomic bombs used during World War II.
