Myth: Tax Return and Tax Refund are InterchangeableThese two terms are often confused, but they are not the same thing. A tax return is the form you fill out and submit each year, like the 1040 form for most people. A tax refund is money you get back if you overpaid your taxes. Many people mistakenly say they're waiting on their tax return when they mean their refund. 2. Myth: You Need a License to Prepare Tax ReturnsYou don't actually need a license to prepare tax returns. While there are professional credentials like the Enrolled Agent (EA) or Certified Public Accountant (CPA), they are not required. All you need is a Preparer Tax Identification Number (PTIN) from the IRS to file tax returns electronically. Check your tax professional's credentials, as many practitioners are uncredentialed. 3. Myth: Living in a Home for Two Years Makes It's Sale Tax-FreeMany believe that simply living in a home for two out of the last five years allows you to sell it tax-free. However, the IRS has rules regarding "non-qualified uses" for periods when the property was not your primary residence. Even if you lived in it for two years, gains related to earlier non-qualified use periods will be taxable. 4. Myth: LLCs Provide Tax SavingsAn LLC is a legal entity and does not provide tax benefits by itself. If you set up an LLC and are the sole owner, it is disregarded for federal tax purposes. The taxes you pay and deductions you claim remain the same whether or not you have an LLC. Its primary purpose is legal protection, not tax savings. 5. Myth: You Don't Need To Issue W-2 When Employing Your KidsIf you employ your children in your business, you still need to file W-2s and comply with all employer filing requirements. Just because their income may be non-taxable doesn't absolve you of this responsibility. Issuing W-2s also allows them to qualify for benefits like funding a Roth IRA. 6. Myth: Gifts Over $18,000 Cause Taxable EventsThe $18,000 annual gift tax limit is just a threshold for when you need to file a gift tax return, not a trigger for tax liability. Taxes on gifts only become relevant once you exceed the lifetime exclusion amount, which is currently over $13 million. So, making gifts beyond $18,000 in a year does not mean you'll owe taxes.7. Myth: Bonuses are Taxed at a Higher RateBonuses are not taxed at a higher rate. They are subject to withholding at a higher rate, generally 22% or even higher if the bonus exceeds a million dollars. At the end of the year, your actual tax rate is calculated, and you may receive a refund if too much was withheld.8. Myth: 0% Capital Gains Rate Only Determined By Gain AmountThe 0% capital gains rate applies to your total income, not just the capital gain itself. If your combined income and capital gains exceed the threshold, only the portion of income within that bracket qualifies for the 0% rate. 9. Myth: Income Below $600 from Self-Employment Isn't TaxableRegardless of whether you receive a 1099 form, all earned income from self-employment is taxable. If you earn over $400 in self-employment income, you are required to file a tax return, even if no single client paid you more than $600.10. Myth: Moving Into a Higher Tax Bracket Taxes All Income at The Higher RateOnly the portion of your income that falls within the higher tax bracket is taxed at the higher rate. For instance, if you earn enough to move from the 10% to the 12% bracket, only the income above the 10% threshold is taxed at 12%, not your entire income. This misconception often deters people from accepting bonuses or promotions unnecessarily.

So what separates us apart in short, is that we are actively looking at our client's financial position, and coming up with strategies to ultimately assist them with minimizing their tax bill.This gives us the opportunities for that business owner to reinvest those savings either back into the business, back into themselves or personal professional development and or into their future.Can you explain what the difference is between an enrolled agent and a certified public accountant?Absolutely. So when we look at the tax space, the tax industry as a whole, there's four types of people. You have your tax preparers that do not have to be licensed at all. This could be someone who just understands how to file taxes using a particular software. Don't need a license, do not need a degree, just need to be able to file taxes.And then we have tax attorneys. And then we have certified public accounts. And then after certified public accounts, we have folks like myself, which are enrolled agents. And so the primary difference between an enrolled agent and a certified public accountant is our specialty is tax. And we get our designation directly from the department of treasury, which houses the Internal Revenue Service. Certified public accountants that get their designation, their license from state boards.And we actually partner with a ton of certified public accountants because they don't have an interest in tax. And some of them don't know tax. And many of them, their focus is on the accounting portion. And a lot of folks stay co associate accounting with taxes when accounting is nothing more, nothing less, but understanding and being able to read and produce financial statements. P and L's, balance sheets, cashflow projections, not more so taxes. Now there are

Here are the primary changes that have been implemented in the flexibility act: Originally you had 8 weeks to bring your payroll up to normal numbers/use the funds. Now, the time has been extended to 24 weeks—if necessary—and will end December 31st, 2020. Originally, at least 75% of the loan had to be spent on payroll to be forgiven. The other 25% could be spent on rent, utilities, and interest charges. Now it’s been changed to a 60/40 split—60% minimum on payroll and 40% between rent, utilities, and interest. Lastly, if you spent the money in other areas the money would roll into a loan versus being forgiven. The original loan repayment terms were to be over a 2-year period. Now you have 5 years to pay back the loan—at only a 1% interest rate. Currently, you still have until June 30th to apply for the PPP loan. For some business owners, that date is reaching your original 8 weeks. So if you can’t get your payroll numbers up by then, consider extending to the 24 weeks. What is the next step for designers? If you haven’t yet applied for the PPP loan because of the repayment terms, inability to operate your design firm, etc. you still have time to apply. The repayment terms are favorable even if you can’t get your loan forgiven. So if you need the funds, there is still approximately $120 billion left in the program (at the time of recording). If you’ve applied for and received the loan, you’re probably wondering how to apply for forgiveness. The current application is linked in the resources above. However, Aaron points out that it’s likely to be revised. When banks begin accepting the forgiveness paperwork, you’ll bring the application to the bank you received the loan through. You’ll need to be prepared with documentation. Aaron recommends reading over the application so you can begin gathering the necessary information, which may include: payroll reports (quarterly and weekly), proof of differences or reductions in pay, canceled checks, bank statements indicating amounts for payroll, canceled rent checks, etc. For discussion about each of these topics, detailed descriptions from Darla and Natalies’ go-to tax professional, and other need-to-know information, tune in to this important episode of the Wingnut Social podcast! As of April 3rd, registration will open online for the CARES act. The Payroll Protection Program (PPP) was part of the legislation that was passed. So what is it? At its core, it’s a forgivable loan from the government to help cover payroll for 8 weeks. You’re allowed to borrow 2.5x the monthly average of your yearly payroll costs (wages, independent contractors, health insurance costs, and retirement benefits are included in the calculation). It also includes owners’ compensation. As a simple example, if your average payroll is $10,000 a month, you can borrow up to $25,000 through the PPP. Eligible expenses that can be considered for forgiveness are rent, utilities, interest payments, and payroll. The caveat is that you HAVE to keep people on the payroll. If you do not have people on payroll (or wages being paid out), only an amount up to 25% of what is borrowed can be forgiven for rent, utilities and interest. If you’ve already laid some people off, you have until June 30th to hire them back and prove that you’re consistently paying the payroll that you were prior to the coronavirus pandemic. If your numbers track correctly and you’ve proven you’ve retained your employees, the whole loan amount will be forgiven. At this time, the assistance is for 2 months. If the Coronavirus pandemic persists longer than projected, they may need to pass further legislation. Keep listening as Aaron covers some details for S-Corps, interest rates if your loan is not completely forgiven, and more. Consider the Economic Injury Disaster Loan Aaron points out that small business owners should apply for the Economic Injury Disaster Loan (EIDL)—where the first $10,000 is technically a grant. Supposedly, you should have access to the funds within 3 days of applying and no proof is necessary (unlike the records required for the PPP). You can still apply for the PPP, but the $10,000 will be subtracted from the amount that would be forgiven. So if you qualify for $50,000, $40,000 would be forgiven to account for this $10,000 grant. The EIDL is the best option for solopreneurs as it is eligible to cover their wages AND it can roll over into a loan if necessary. During this time, payroll taxes that you owe can be deferred for a period of time. Aaron implores you to pay this if at all possible. If you go out of business, you as the owner will be personally liable for those taxes and required to pay them back. Aaron points out that we are all facing uncertainty and that you need to step back and evaluate and make the correct decision for your business despite your emotions. Aaron poignantly states,“Don’t make short-term decisions that have long-term consequences”. UPDATE: We told you this was moving fast. A recent update disallowed the payment of 1099 contractors from the definition of “payroll costs” going into the equation of what can be borrowed. The definition is now: Payroll costs consist of compensation to employees (whose principal place of residence is the United States) in the form of salary, wages, commissions, or similar compensation; cash tips or the equivalent (based on employer records of past tips or, in the absence of such records, a reasonable, good-faith employer estimate of such tips); payment for vacation, parental, family, medical, or sick leave; allowance for separation or dismissal; payment for the provision of employee benefits consisting of group health care coverage, including insurance premiums, and retirement; payment of state and local taxes assessed on compensation of employees; and for an independent contractor or sole proprietor, wage, commissions, income, or net earnings from self-employment or similar compensation.
