Jessica Fuentes and William Sarradet discuss recent news stories in Texas, including the controversy surrounding Sally Mann's work, the destruction of artwork installed at the Austin Convention Center, and the closure of the Panhandle-Plains Historical Museum. "The Modern (Art Museum of Fort Worth) had a notification at the entrance stating that the exhibition (Diaries of Home) contained mature content. Is a museum allowed to show work that some people might deem obscene if they provide notice so viewers can make the decision whether or not they want to go in? The Modern, in particular, charges an entry fee, you make a choice to go in." Abortion rights remain top of mind in Texas - where care for women suffering from ectopic pregnancies and miscarriages is now thrown into doubt. Meanwhile, this Saturday will see a Donald Trump rally at the Austin Convention Center and a Planned Parenthood abortion rights protest at the Texas State Capitol - at the same time. This May has been the hottest for Austin on record, by a long shot - the unseasonably hot weather lately has led Travis County to issue a burn ban. Energy prices have been spiking along with high power demand, in the same effect that was seen during the February 2021 winter freeze. Texas gas prices have spiked again, reaching a record average price in Austin of $4.06 per gallon. Negotiations over pay for Austin EMS workers continue - the city is now offering $22 per hour, but the EMS union is insisting on $24.70. Not deja vu here - it's time to vote again, and you CAN vote in the primary runoff election even if you didn't vote in the primary last March. Early voting is underway now through May 20 and Election Day is May 24. The Austin City Limits Music Festival unveils its lineup for 2022, including the Red Hot Chili Peppers, P!nk, the Chicks, Kacey Musgraves, SZA, Paramore, and Lil Nas X as headliners. Tickets went on sale Tuesday at noon, and as of this morning are still available in all price levels. Last year's ACL Fest brought $369 million into the local economy. New research illustrates that yes, most newcomers to Texas are coming from California. A Dallas developer has submitted a plan to clean up and revitalize East Sixth Street. Cedar Park and Georgetown are among SmartAsset's new ranking of the best small cities in America. A space travel-themed brewery is opening soon in south Austin - its motif and beer names lead to speculation it may be tied to Elon Musk and SpaceX.

Supreme Court Opinions

City of Austin v Reagan National Advertising of Austin LLC, (2022), was a United States Supreme Court case dealing with the application of zoning restrictions on digital billboards in the city of Austin Texas. In a 6 to 3 ruling, the Court ruled that the Austin regulation against off-premise digital signs was content-neutral and thus should be reviewed as a facial challenge rather than a strict scrutiny following from the reasoning in Reed v Town of Gilbert. Background. Austin is one of 350 cities and towns in Texas that enacted bans related to digital billboards along the sides of highways, generally as a long-term effect of the Highway Beautification Act as well as to avoid distractions for drivers along these highways. Austin's city codes includes a Sign Code that distinguishes between signage that is located on-premises, including signs in shop windows and mounted street signs on the property, and those off-premises, like billboards. On-premises signs are generally unregulated and may be updated and improved without any limitations, including improvements to digital signage. Off-premises signage, however, are restricted from such improvements. In addition, the city has banned the installation of new billboards. Around 2017, two advertising companies that operated static billboards in Austin, Lamar Advantage Outdoor Company and Reagan National Advertising of Austin, sued the city as the city council denied over 80 applications to allow them to convert existing static billboards into digital billboards. The advertising companies contended that the city had allowed some digital signage such as that on the Austin Convention Center, and believed the ban was unconstitutional. They were joined by the Austin Police Association and supporters of local emergency services, believing that such digital billboards could be used to provide information such as Amber Alerts. The case was first filed in a state district court before the city moved it to the United States District Court for the Western District of Texas in 2017. The district court selected to review the matter under intermediate scrutiny based on Metromedia Incorporated v San Diego, rather than the strict scrutiny content-based standard of Reed v Town of Gilbert, as the off-premise versus on-premise standard was content-neutral. Under this distinction, the District Court ruled for the city. Though the city amended the sign code in 2017 after litigation had started, the changes did not impact the case nor render it moot. The advertisers appealed to the Fifth Circuit. In October 2020, the Fifth Circuit reversed the District's ruling in favor of the advertisers. The Fifth Circuit used the strict scrutiny standard of Reed to evaluate the city codes, as it determined that because to determine whether a sign was on or off-premises, one had to consider the message it was conveying, and that meant that this was a content-based restriction. Given this assessment, the rationale the city had given to maintain the ban against digital signage – to assure the safety of drivers and maintain the beauty of the landscape – were not sufficient reasons to violate the First Amendment rights of the advertisers, and thus ruled the city's sign code unconstitutional

The first of what's likely to be several lawsuits in that recent crash on Barton Springs Road has been filed by one of the several people injured against both of the drivers involved. Lots of real estate news this Friday: Austin homeowners should prepare for a shock when they see this year's value appraisal from the Travis Central Appraisal District - the average has jumped about $220 thousand in just one year. Real estate sales data shows a 77% increase in home prices in the Austin area over the last five years. The pace of homebuying has slowed lately but prices have not - Austin's local median home price now sits at $624,000. Among the rich and famous buying homes in Austin is Oscar-winning actress Emma Stone, who bought property in Tarrytown last summer. Watch your wallet in a more literal sense as well - pickpocketing is up 175% in downtown Austin lately. Real estate guru Gary Keller has expanded his Austin music-centric philanthropic efforts by buying the long-closed One World Theater in west Austin with plans to re-open it soon. The developer behind the project that worried the Austin LGTBQ community in threatening several bars in the traditionally gay-friendly 4th Street district says it plans to preserve the area's cultural integrity. A location has been chosen for former President Donald Trump's appearance in Austin - his "American Freedom Tour" event will happen on May 14 at the Austin Convention Center. A 100-mile trail under construction will allow Austinites to hike all the way to San Antonio - the Great Springs Project will connect Barton Springs in Austin, San Marcos Springs, Comal Springs at New Braunfels and San Antonio Springs when completed. Texas has been ranked among the best states for remote workers. And a hot and humid Easter weekend is in store, upper 80's today and mid-90's Saturday and Sunday, with a chance of storms - parts of the Texas Hill Country near Austin have returned to Extreme drought conditions, including areas surrounding Burnet, Llano, Mason and Fredericksburg.

America's economic stature in the global marketplace depends on our creativity and innovation. Educating the next generation to maximize creative thinking requires stimulating the whole brain-encouraging both right brain and left brain thinking. It demands the opposite of "teach to the test" education and acknowledges the importance of hybridization in breeding new ideas. Especially at our top universities, we must go beyond focused training for specific jobs and help create graduates who can think broadly and solve problems creatively. Larry Speck has been a faculty member at UT Austin since 1975, and served as Dean of the School of Architecture 1992-2001. His professional work includes such Texas landmarks as Austin Bergstrom International Airport, Austin Convention Center (both phases) and the architecture for Discovery Green, a twelve-acre park in downtown Houston. Over the last 25 years his design work has won 40 national design awards, 23 state or regional design awards and 51 local design awards. As well as being a prolific designer and builder, Larry has also contributed significantly to the development of ideas and direction in his field. He is the 2011 recipient of the ACSA/AIA Topaz Medallion given to one individual in North America each year in recognition of their contribution to excellence in architectural education. Presented on Nov. 7, 2011.
