In apertura il punto di vista di Paolo Mieli sulle principali notizie della giornata.L'intervista politica: approvato in Cdm il decreto energia. Nella bozza del provvedimento non è prevista alcuna proroga del mercato tutelato. Nessuno slittamento dunque di 6 o 12 mesi, come ventilato in precedenza, per il passaggio al libero mercato dei contratti di luce e gas che dovrebbe quindi entrare in vigore il prossimo 10 gennaio. Nella prima parte collegato con noi Gilberto Pichetto Fratin, Ministro dell’Ambiente e della sicurezza energetica. Infine, sentiamo anche il parere di Carlo Stagnaro, direttore Ricerche e studi dell' istituto Bruno Leoni.

“Bruno Leoni mi ha convinto che, anche se la codificazione del diritto fu intesa ad aumentare la certezza del diritto, essa aumentò tutt'al più la certezza del diritto di breve periodo (e non sono più sicuro che sia rigorosamente vero), mentre l'abitudine di alterare il diritto mediante la legislazione diminuisce certamente la certezza del diritto di lungo periodo” — F.A. von Hayek, “Bruno Leoni the scholar”, 1968“Il grande contributo di Leoni consiste nel suggerire anche ai nostri più leali sostenitori del laissez-faire un'alternativa alla tirannia della legislazione. Piuttosto che accettare l'alternativa tra diritto amministrativo e legislazione, Leoni invita a tornare alle antiche tradizioni e ai principi del “diritto di produzione giudiziale” come metodo per limitare lo Stato e assicurare la libertà.” – Murray N. Rothbard a proposito di Bruno Leoni Bruno Leoni, nato nel 1913, è il pensatore che con maggiore rigore e coerenza ha interpretato la tradizione del liberalismo classico all'interno della filosofia del diritto del ventesimo secolo. Studioso poliedrico, che oltre al diritto e alla filosofia si appassionava anche alla scienza politica e alla teoria economica, dopo l'armistizio militò nelle fila dell'A Force britannica, contribuendo a salvare prigionieri e soldati alleati. Tornato poi alla sua cattedra presso l'università di Pavia, Leoni ha messo discussione i dogmi più consolidati della filosofia del diritto, a partire dal normativismo kelseniano sostenuto dai suoi contemporanei. E' stato inoltre un infaticabile promotore della cultura della libertà in Italia: organizzatore culturale, direttore della rivista Il Politico presso la sua università, preside di facoltà, commentatore per l'allora 24 Ore. Era in rapporto con i maggiori pensatori del suo tempo e con generosità cercò di portarne gli insegnamenti anche nel nostro Paese.Il contributo innovativo di Leoni alla teoria evolutiva del diritto si esprime nella sua esplorazione della nascita delle norme come risultato dell'incontro tra le pretese degli individui. Per lui ogni ordinamento giuridico, nella sua effettività, vive grazie a una negoziazione sociale che si svolge autonomamente e in maniera indipendente dallo Stato. In economia il liberismo (o liberalismo economico) è una teoria economica, appartenente alla storia del pensiero economico, che sostiene e promuove la libera iniziativa e il libero mercato come unica forza motrice del sistema economico, con l'intervento dello Stato limitato al più alla realizzazione di infrastrutture di base a sostegno della società e del mercatostesso. È considerato da molti come l'applicazione, in ambito economico, delle idee politiche liberali, sulla base dell'assunto di base che "democrazia vuol dire anche libertà economica" coniato da Friedrich von Hayek. I filosofi del diritto di orientamento liberista, come ad esempio Bruno Leoni, si considerano in antitesi col pensiero del filosofi del diritto come Hans Kelsen, che i liberisti definiscono "statalista". Patrik Schumacher, director of Zaha Hadid Architects shares his ideas on the contribution of architecture to the progress of freedom, which in his opinion is one way to think about societal progress. He says, this contribution takes several forms, such as the free-flowing space of modernism, the freedom afforded by the indifference of the grid, the freedom of long spans, the three dimensional space of flying, the freedom of unbounded city expansion. The degree of freedom designers nowadays have, is definitely increasing in architecture, urbanism and in every scale. Schumacher defines what freedom is, and discusses economic and social concepts from different thinkers and authors: Hegel, Daniel Dannet, Bruno Leoni, Adam Smith, Friedrich A. Hayek, Karl Marx, Ludwig von Mises, and others. Later talks about prosperity as a continuously accelerating process that we need to keep promoting, social structure and order throughout history in different societies, the relation between wardrobe design and spatial arrangements, and the aspects architects should take in account in their designs. "The architect's task is ordering social processes, we should always look at our designs with how it distinguishes groups, brings together, and orders the actors in particular spaces.” Other societal organizations are also discussed by the architect, from the perspective of material freedom versus social freedom, as well regimes of social control in terms of architectural contribution to territory, property, access, exclusion and protocols. "Architecture is a necessary substate of society”. He gives a historical sequence of socio-economic periods and the urban morphology that represents them. Patrik argues that the question of freedom vs equality, of market vs state needs to be posed anew in each historical epoch. Particularly in post fordism and neoliberalism he explains that central urban planning faces an insurmountable complexity barrier with respect to knowledge problems. "That's why radical transformation on style or paradigm are forced upon us by the change of societal conditions and also perhaps more opportunities”. Currently, we have a societal structure that Schumacher describes as “Collage City”, a global post-fordist network society. Since 2008, Patrik proposes Parametricism, a style within contemporary avant-garde architecture, that relies on programs and algorithms to manipulate equations to create designs. Finally, he explains the concept of this type of design, how it works and exemplifies with several of his projects and talks about the components he believes the new postmodern cities should have to promote progress.

Kinsella on Liberty Podcast, Episode 129. This is a lesson/lecture I presented to a group of "Upper Elementary" Montessori students today at my son's school, The Post Oak School (Upper El includes 4th, 5th, and 6th grade students, and there were also a few third graders visiting from lower el, who are moving up next year). The students (25 or 30 or so) sat in a group at my feet, and were polite and interested the whole time. They asked many very intelligent and fun questions. I tried not to get too complicated, but did speak in fairly frank and sophisticated terms, tried not to talk down to them or dumb the talk down too much, and almost all of them hung in there till the end. The original plan was to speak for 40 or so minutes then take questions for another 15 or so, but we ended up going about an hour and 7 minutes, and then during lunch I had throng of students throwing more questions at me for another half hour. What amazing students; what an amazing school and educational approach. (This is one reason I love the Montessori approach; see my Montessori, Peace, and Libertarianism.) I included here only the main talk and Q&A, not the lunch banter. (An article prepared by 6th graders in the class, describing the lecture, appears in the first couple of pages of this issue of the class newsletter.) I think this talk is suitable for kids from ages 9 to 16 or so. The notes I used and handed out are reproduced below, with a few links added. For more background on these topics, see the links below, as well as my short article Legislation and Law in a Free Society, adapted from my 1995 JLS article Legislation and the Discovery of Law in a Free Society, which contains detailed references; and my more detailed speech The (State's) Corruption of (Private) Law, from the 2012 Annual Meeting of the Property and Freedom Society. Update: Some people have asked me for further recommended readings, in legal history, etc. Unfortunately my library is packed away in boxes now for a renovation so I cannot peruse my legal theory/history titles, but from memory and some other notes I have, here are some suggested readings related to the talk. Mestre (Universidade de Turim) e doutor em teoria política (Universidade de Gênova), o italiano Adriano Gianturco está há dois anos no Brasil. Nascido na Catania, Sicília (Itália), trabalha como professor do departamento de Relações Internacionais do Ibmec de Belo Horizonte (MG) e nos apresenta, neste podcast, sua perspectiva comparativa sobre os ataques e ameaças à liberdade na Itália e no Brasil. "Na Itália, além das coisas mais famosas, como uma dívida pública de 120%, um mercado de trabalho muito fechado, especialmente para os jovens, e corporações profissionais muito mais regulamentadas até do que no Brasil, mas que em parte vocês copiaram exatamente da Itália, neste momento o debate público está baseado na evasão fiscal. Está quase que se criando o que podemos chamar de um estado policial no que se refere à cobrança de impostos. O empresário já é visto como um potencial sonegador. Não há presunção da inocência, um dos pilares fundamentais do direito em quase todos os ordenamentos jurídicos. No Brasil, pelo que vejo, além dos aspectos mais evidentes, como um protecionismo muito forte e um welfare state que está crescendo, há também pequenas proibições, um higienismo de estado, onde se regula até guardanapos e canudos. E um dos aspectos mais problemáticos que eu vejo é a proibição dos trabalhos informais, especialmente para os estratos econômicos mais baixos, como limpar carros, vender pipoca, comida na praia etc. Isso limita as possibilidades dessas pessoas." Adriano também disserta sobre o ambiente acadêmico italiano, no que se refere ao interesse e estudos das ideais liberais e do pensamento Austríaco. "Já tivemos professores e pesquisadores estudando a Escola Austríaca na Universidade de Luiss (Roma), mas, infelizmente, hoje a situação está declinando e não sei se vai aumentar o número de professores austríacos." Ele próprio estudioso da Escola Austríaca, Adriano produziu trabalhos acadêmicos sobre a justificativa moral da propriedade, a imoralidade da redistribuição, além da ação e função empresarial na obra de Israel Kirzner e sobre a obra de Bruno Leoni, autor do excelente A Liberdade e a Lei. O professor do Ibmec também comenta seus estudos atuais sobre o problema dos votos brancos e nulos, e das abstenções.
