Big Data is one of the most important resources in the world, yet the rules for its protection are just beginning to develop. The danger comes into focus by the possibility of a nation-state cyber operation attacking Big Data and having a major detrimental impact on the functioning of another nation-state. Consider, for example, a cyber attack corrupting, stealing, or destroying the records of important financial institutions, causing widespread confusion and panic. Would such an attack warrant a kinetic, lethal response, with bullets and bombs? This issue implicates the UN Charter, the Law of War, International Humanitarian Law, jus in bello and jus ad bellum, attempts to formulate rules in the Tallinn Manual, conflicting priorities among nations, and pure geopolitics. Professor Paul Stephan of the University of Virginia Law School and John Eisenberg, Former Deputy Counsel to the President and NSC Legal Advisor, joined us to explore the issue. Mike Lewis was a naval aviator, and then a renowned law professor, widely admired by other scholars and practitioners. Thursday, December 22nd, 2022   Chris Kang is the Co-Founder and Chief Counsel of Demand Justice. He served in the White House for nearly seven years as Deputy Counsel to President Obama and Special Assistant to the President for Legislative Affairs. We talk about court reform from diversifying the bench of judges to expanding the Supreme Court.   The Supreme Court of the United States is actually the only court in the entire country that does not have a binding code of ethics. Congress has changed the size of the Supreme Court seven times before. It's very much within their power and ability to change the size of the court again now to restore balance. On Mar 3, 2022, the Court decided United States v. Zubaydah, a case which concerned whether the 9th circuit erred when it rejected the United States' assertion of the state secrets privilege based on the court's own assessment of potential harms to national security, and required discovery to proceed further under 28 U.S.C 1782(a) against former CIA contractors on matters concerning alleged clandestine CIA activities. In a 7-2 opinion authored by Justice Breyer, the Court held that the U.S. Court of Appeals for the 9th Circuit's judgment that the district court erred in dismissing Zubaydah's discovery request on the basis of the state secrets privilege is reversed, and the case is remanded with instructions to dismiss Zubaydah's current discovery application.Joining us today to discuss decision this is Kate Comerford Todd, managing partner at Ellis George Cipollone in Washington, DC. Ms. Todd formerly served as Deputy Counsel to the Office of the President, Chief Counsel for the U.S. Chamber Litigation Center, and has held teaching positions at both George Washington University Law School and Cornell. Ms. Todd has also clerked for Justice Clarence Thomas and Judge J. Michael Luttig of the US Court of Appeals for the Fourth Circuit, and is a graduate of Harvard Law School.

Attorney Olubunmi “Bunmi” Kusimo-Frazier is Dr. Foster's guest on this episode of Fostering Solution. Bunmi was born and raised in Charleston, West Virginia. A magna cum laude graduate of Florida A& M University, Bunmi also holds a juris doctor from Washington and Lee University School of Law, in Lexington, Virginia. After law school graduation, Bunmi returned to Charleston to work as an Assistant Prosecuting Attorney and as a criminal defense lawyer for a private firm.     As a criminal defense attorney, Bunmi represented numerous clients in federal, state, and municipal courts, and was named one of the "Top 40 under 40" by the National Trial Lawyers Association. She also worked as a Deputy Counsel for the West Virginia Supreme Court of Appeals. Bunmi currently works as the Director of Magistrate Court Services the West Virginia Supreme Court of Appeals, where she manages over several hundred employees, and the operations of the fifty-five magistrate courts in the State of West Virginia.     Bunmi served on the WVU Continuing Legal Education (CLE) Faculty, in Fall and Spring of 2021, presenting a course on magistrate courts. She currently serves as a Commissioner on the WV Juvenile Justice Commission; and is a member of the State of West Virginia's Traffic Records Coordinating Committee. Bunmi is also the co-Chair of the Minority Lawyer's Committee of the West Virginia State Bar.     Bunmi is married to Stuart Frazier, and they have one daughter, Naomi. Uttam Dhillon is a principal of Michael Best Consulting LLC, a management consulting firm specializing in drug-related and law enforcement issues.  He is also a member of the board of directors of Opioid Clinical Management, Inc. and a member of the board of advisors of DisposeRx, Inc., and Gatekeeper Innovation, Inc., companies dedicated to reducing drug addiction and drug overdose deaths. Mr. Dhillon served as the fifteenth director of INTERPOL Washington—the U.S. National Central Bureau (USNCB)—until January 2021.  As Director, Mr. Dhillon acted as the official U.S. representative to the International Criminal Police Organization (INTERPOL), the world's largest police organization, and its 194 member countries. From 2018 to 2020, Mr. Dhillon served as the Acting Administrator of the Drug Enforcement Administration where he led a workforce of over 15,000 and oversaw a budget of $3.2 billion. Mr. Dhillon was responsible for DEA's enforcement, intelligence, administration, and regulatory activities worldwide. On May 27, 2021, the Sixth Circuit issued a decision in Vitolo v. Guzman. Over a dissent written by Judge Donald, the Court held that the Small Business Act of the American Rescue Plan Act created unconstitutional racial, ethnic, and gender-based priority preferences in distributing covid-relief grants to small businesses. My guest on this episode is Michael Mongan, the Solicitor General for the state of California. Mr. Mongan has more than 15 years of experience in both private law and government. He's worked in Congress, served as a clerk for the DC Circuit Court of Appeals and the United States Supreme Court, and was Deputy Counsel for Vice President Joe Biden during the first two years of the Obama Administration. ⁣ Mr. Mongan has argued three cases before the Supreme Court: a defense of DACA which was upheld by the Court in 2020; a defense of the Affordable Care Act in California v. Texas; and the defense of a California rule that grants union organizers temporary access to farms for the purposes of meeting with employees. Decisions for the latter two cases are still pending and are expected in late June. ⁣ Tune in for a conversation about his journey to a career in the law and public service and what it's like to argue before the Supreme Court, in-person and remotely.

It was called Humble at the Top: Why These CEOs Still Write Thank You Notes One of the people they profiled was Frank Blake: Former CEO, The Home Depot Frank Blake learned the art of writing notes from one of America's masters of the practice, President George H.W. Bush. He served as Deputy Counsel when Bush was Vice President. “Vice President Bush started every day by typing notes to people,” Blake said. “You knew they were typed by him because some of the letters were off line and there could be misspellings. I saw the power of taking the time to write a nice word to someone.” When Blake became CEO of The Home Depot in 2007, he established a process for writing notes: regional and district managers sent him recommendations of store associates whose work or service deserved recognition. Blake spent a half-day or more each weekend writing notes by hand – and was inspired by what he learned. “Our people did amazingly generous things for others,” he said. “It was a great way for me to end the week.” It is important, he added, to be specific in the notes. And they don't have to be long – most of his are two or three sentences and usually cover only the front of a monogrammed card. “In an age of email and texts, there is something personal and special about a handwritten note,” Blake said. “I have saved every meaningful note I have ever received.” Pretty awesome!
