A sudden pause in the war of words and legal action between the federal and Saskatchewan governments. A hearing scheduled at the Federal Court yesterday was cancelled as the Saskatchewan and federal governments are in reportedly in talks. On Monday the Saskatchewan Attorney General stated the province had sought and been granted an emergency injunction to stop the Canada Revenue Agency from any collection/garnishment action by CRA against the province's bank account under the Greenhouse Gas Pollution Pricing Act. According to CRA, Saskatchewan owes Ottawa more than $50 million under the Act, while the province argues the Trudeau government's demands are unconstitutional. This after the federal government earlier this year removed the tax on home heating oil for Atlantic Canada for 3 years, but refused to extend the tax pause to other provinces and other means of home heating. Saskatchewan has neither collected, nor remitted to Ottawa any taxes on home heating fuels since January 1, 2024, as Premier Scott Moe last December promised us first on air Saskatchewan would not do so. The federal government is clamping down on the number of migrant workers in Canada while trying to boost access to permanent residence for those already here, to rein in population growth that's contributed to a housing crisis and strained resources. After imposing a quota on the study permits issued and reintroducing a cap on international students' work hours, Ottawa will reduce the share of temporary residents of the overall population from the current 6.1 per cent to five per cent over three years. This Day in Legal History: The Attack on Pearl HarborOn this day, December 7, in legal history, the focus often turns to a pivotal event in United States history: the attack on Pearl Harbor in 1941. This surprise military strike by the Imperial Japanese Navy Air Service against the United States naval base at Pearl Harbor in Hawaii led to the United States' formal entry into World War II. While primarily a military event, the attack had significant legal and political repercussions that reshaped the global legal landscape. The aftermath of Pearl Harbor saw a swift response from the U.S. government. On December 8, 1941, the United States Congress declared war on Japan, marking the nation's official entry into World War II. This decision not only changed the course of the war but also had far-reaching legal implications for international relations and the conduct of war.One of the most controversial legal outcomes of Pearl Harbor was the internment of Japanese Americans. In February 1942, President Franklin D. Roosevelt signed Executive Order 9066, which authorized the forcible relocation and internment of about 120,000 Japanese Americans, two-thirds of whom were U.S. citizens. This order, rooted in wartime fear and prejudice, is now widely viewed as one of the most egregious violations of American civil liberties in the 20th century. The repercussions of Pearl Harbor extended to the international legal arena as well. The attack prompted a reevaluation of international laws concerning warfare, leading to the development of new standards and practices. After the war, the Tokyo Trials, formally known as the International Military Tribunal for the Far East, were convened to prosecute Japanese leaders for war crimes, including those committed during the Pearl Harbor attack. In recent years, Pearl Harbor Day has been a time not only of remembrance for those who lost their lives but also a moment to reflect on the legal and moral challenges faced during times of crisis. It serves as a reminder of the impact that pivotal events can have on the law, civil liberties, and international relations.Murray Fisher, a former employee of Airgas USA LLC who was diagnosed with liver cancer, is challenging his termination over a positive cannabis test result in the US Court of Appeals for the Sixth Circuit. Fisher, who used legal hemp to manage his cancer-related pain, alleges that the positive test was false and that his firing constituted disability discrimination. The case centers around the "honest belief rule," which protects employers from liability for employment actions based on incorrect information they reasonably trusted at the time. The lower court dismissed Fisher's discrimination claim under the Americans with Disabilities Act, citing insufficient evidence to prove that Airgas knew the test was incorrect or unreasonably relied on the results.Fisher's case raises questions about the application of the honest belief rule and whether judges are encroaching on factual determinations that should be left to juries. He argues that Airgas was indifferent to the accuracy of its drug testing and that there's evidence of "purposeful ignorance" on the company's part. Airgas, on the other hand, maintains that it made a reasonably informed decision to terminate Fisher and that he has failed to demonstrate his disability was a factor in his firing or to discredit the company's rationale for his termination. The case, which is being heard by a panel including Judges Karen Nelson Moore, David McKeague, and Raymond Kethledge, will provide the Sixth Circuit an opportunity to clarify the scope and application of the honest belief rule in employment discrimination cases. Fisher's argument hinges on the assertion that the evidence of his positive test result for THCA, not illegal THC, and the company's alleged indifference to test accuracy, should preclude summary judgment in favor of Airgas.Airgas to Defend Firing Worker With Cancer Over Cannabis TestTexas Attorney General Ken Paxton, along with conservative media companies The Daily Wire and The Federalist, has filed a lawsuit against the U.S. Department of State. The lawsuit alleges that the State Department funded technology through grants to the Global Disinformation Index (GDI) and NewsGuard, which the plaintiffs claim censors conservative news outlets. The lawsuit accuses these organizations of rendering "disfavored press outlets unprofitable" by using technologies that categorize them as high-risk for disinformation, thereby impacting their revenue and social media visibility. The lawsuit challenges the State Department's statutory authority to fund such tools and argues that this funding infringes upon the media outlets' First Amendment rights. Paxton, who has filed numerous lawsuits against the Biden administration, claims the State Department is illegally attempting to silence dissenting voices. The case, assigned to Judge Jeremy Kernodle, a Trump appointee, reflects ongoing tensions between Republican state attorneys general and the Biden administration regarding the alleged censorship of conservative viewpoints online.NewsGuard responded by stating that their work with the department's Global Engagement Center, which accounted for less than 1% of its revenue, was limited to tracking false claims in state-sponsored media in Russia, China, and Venezuela and unrelated to the plaintiffs. They also emphasized that their website reliability ratings are developed through an apolitical process. The case adds to a broader debate about the role of government in regulating online disinformation and the impact on free speech and media revenues.Texas claims US State Department funds tech that censors conservative news | ReutersIn my column this week, I discuss the IRS's recent decision to revert the 1099-K reporting threshold from $600 to $20,000 for the current tax year, with a plan to lower it to $5,000 in 2024. I argue that this approach, aimed at reducing taxpayer confusion and administrative backlog, merely postpones the problem. The central issue lies in a widespread public misconception about taxable income, particularly the belief that income is only taxable if the IRS is aware of it.By way of very brief background, Form 1099-K is a tax document used to report payments received through payment card transactions and third-party network transactions. This form is particularly relevant for businesses and individuals who receive payments through platforms like PayPal and Venmo. When payments for goods or services are received through these platforms, the platform is required to report the transactions to the IRS if they exceed a certain threshold. The 1099-K form provides a detailed summary of these transactions, helping taxpayers accurately report their income. It's an essential tool for ensuring compliance with tax laws, especially for those who engage in significant e-commerce or provide services where payments are frequently processed through these digital platforms. Importantly, receiving it does not impact whether taxes are owed – it is merely informational. Income tax is owed on all income, from whatever source derived. I highlight the importance of educating the public on what constitutes taxable income, especially with the growth of the gig economy and online marketplaces. The 1099-K form, introduced in 2012, is designed as a reminder of existing tax obligations, not as an indication of new liabilities. The form's thresholds, such as the initial 200 transactions and $20,000 limit, are informational and do not determine when tax is due.To improve tax literacy, I suggest the IRS should adopt more proactive educational methods, such as creating informative videos, social media campaigns, and advertisements explaining taxable income. Additionally, introducing tax-related curricula in schools could inform young people about tax revenue uses and personal tax obligations. These measures could help address the knowledge gap, particularly among younger taxpayers and those in the gig economy.I also emphasize the need for the IRS to demonstrate its commitment to ensuring high-income earners pay their fair share of taxes, as public perception of tax fairness is crucial. The IRS should focus on promoting an understanding of tax obligations, fairness in the tax system, and the shared responsibility of tax compliance. I critique the pattern of policy changes followed by public backlash and retraction as inefficient and ineffective in informing the public about tax policy updates. Properly addressing tax compliance and effectively communicating with taxpayers is vital for maintaining public trust and compliance in the tax system.Better Education Will Help Taxpayers Understand Telltale 1099-Ks Get full access to Minimum Competence - Daily Legal News Podcast at www.minimumcomp.com/subscribe

The Hamilton Today Podcast with Scott Thompson: The Canadian government on Friday demanded that Meta lift a "reckless" ban on domestic news from its platforms to allow people to share information about wildfires in the west of the country. Russia said on Monday a decision by Denmark and the Netherlands to donate the first F-16 fighter jets to Ukraine would only escalate the conflict, while Ukraine said the jets would help end Moscow's invasion. With wildfires burning across North America, and the smoke spreading too, we wanted to look at what Canadians think of extreme weather and climate change. If someone is injured at an encampment, is the City liable? Delegates from across Ontario began descending on London, Ont., Sunday as Ontario Premier Doug Ford and his cabinet prepared to meet municipal officials for days of detailed, local discussions. It is all coming up on the Hamilton Today Podcast! Guests: Jeffrey Dvorkin, Senior Fellow at Massey College, Former Director of Journalism at the University of Toronto-Scarborough and author of Trusting the News in a Digital Age. Developments this past week over the transfer of serial rapist/killer Paul Bernardo from an Ontario maximum security prison to a medium security institution in Quebec. Opposition calls for the resignation of public safety minister Marco Mendicino. Claims by Mendicino's staff they knew of the transfer long before it happened but did not share with their boss. PM Justin Trudeau similarly says he was long unaware of any transfer of Bernardo. Meanwhile Bernardo is scheduled for a parole hearing in November. Guest: Tim Danson. Lawyer for the French and Mahaffy families who want the killer returned to a maximum security prison. Canada is not participating in major NATO air forces exercise in Germany. Why? Because our aircraft are too old and technologically inferior (CF 18s). The F18 went into service the same year as the Soviet Mig29 (1983) which Ukraine desperately wants to replace. There is a serious story here. Guest: Vice-Admiral Mark Norman. Former Vice Chief of the Defence Staff Beauties and the Beast. Our panel of distinguished and accomplished women reassembles with their unapologetic views of issues of national concern and interest. Guests: Catherine Swift. President, Coalition of Concerned Manufacturers and Businesses of Canada. Former president and CEO of the Canadian Federation of Independent Business. Linda Leatherdale. Vice president of Cambria, Canada. Former 'Money' editor of the Toronto Sun. Michelle Simson. Former Liberal Party MP and seatmate to Justin Trudeau in Canada's parliament. Member of Access to Information, Privacy and Ethics parliamentary committee National poll shows Canadians in each demographic category and by a clear majority say Canada's justice system is too generous with bail and too lenient with violent criminals. (Nat Post). - Canadians by strong majority also support mandatory treatment for chronic drug addicts. Guest: Andrew Enns, executive VP, Leger Marketing. Today's podcast: Discussion of issues such as the Johnston Report, Carbon tax, Election issues and more. Guest: Pierre Poilievre. Conservative Party of Canada leader. The Clean Fuel Regulation of the Trudeau government analyzed by the Parliamentary Budget Officer. The PBO calls the CFR "broadly regressive" and says its price increase for gasoline and diesel will by the time it's fully implemented in 2030 be more hurtful to lower-income households in Canada. Environment Minister Steven Guilbeault calls the PBO report "unbalanced" and Gerald Butts, Justin Trudeau's former advisor ripped the report as "incompetence on climate change." - As well, Guilbeault accused the PBO of an 'unbalanced modelling approach" in the "analysis of the price of pollution." PBO report shows most Canadians will be worse off in the federal government's imposed carbon tax. - Plus, what is the expected cost of servicing the $1 trillion-plus national debt? Guest: Yves Giroux. Parliamentary Budget Officer (PBO). Says "I can understand that people are not happy when we underline that government action will have repercussions, and in this case, costs, but I stand by the analysis we provided." In 2013, England's chief medical officer warned of a health "armageddon" as bacteria learn to overcome antibiotics and new drugs aren't available to counteract the situation. She said "antibiotics are losing their effectiveness at a ratte that is both alarming and irreversible, similar to global warming. TGhe apocalyptic scenario is that when I need a new hip in 20 years I'll die from a routine infection because we've run out of antibiotics." Ten years later the World Health Organization warns of AMR as a top 10 global public health threat. AMR is "antimicrobial resistance." It is the same issue Professor Sally Edwards warned about in England in 2013. Projections are that by 2050 AMR will cost Canada's healthcare system $7.6 billion. The British medical journal The Lancet showed that in 2019, 1.27 million deaths were already caused by AMR. Between 2010 and 2019, 18 novel antibiotics were introduced across 14 develope nations. Only 2 of these new antibiotics are available in Canada. Guest: Jason Tetro. Microbiologist. Author of: The Germ Guy & The Germ Code. Host of the Super Awesome Science Show on the Curiouscast network. We'll call him Peter in B.C. A former business owner who sent me a disturbing email about an issue not talked about on radio "when China interference and Alberta election dominates". He wrote about how housing unaffordability and household debt is talked about a great deal, as are maxxed out credit cards, etc. Then Peter wrote "I hear nobody talking about all the Canadians who are ALREADY living in their vehicles. I am one of those Canadians living in vehicle. It's brutal! It's tiring. And it's not cheap. In just 4 weeks of living in my vehicle I'm exhausted from lack of sleep, I'm sore, I'm hungry, I'm job hunting feverishly and I'm watching my credit score plummet as I can't keep up with minimum payments. My little 2012 Ford Escape doedsn't have a kitchen. I hope that despite your show's full roster, there's a way to shine a little light on the plight of us who have already fallen through the cracks." Guest: Peter in B.C. Shares his experience. Says he encouters many in the same predicament. --------------------------------------------- Host/Content Producer – Roy Green Technical/Podcast Producer – Tom McKay Podcast Co-Producer – Matt Taylor & Tom Craig If you enjoyed the podcast, tell a friend! The Rich Zeoli Show- Hour 4: In a series of Tweets, political commentator Greg Price highlighted the “terrifying” details hidden within the bipartisan Bill S.686—the proposed legislation to ban TikTok known as The RESTRICT Act. According to some reports, it gives federal government officials the authority to access and monitor the personal accounts (including emails and texts) of anyone they deem a risk. Equally astounding, a minimum fine of $250,000 and 20 years in prison could be brought against any who illegally access banned applications, like TikTok, through a virtual private network (VPN). The City of Philadelphia held a press conference on Tuesday afternoon to address an estimated 8,000 gallons of water-soluble latex finishing solution which spilled into Otter Creek in Bucks County, PA on Friday. City officials stated that the “Philadelphia Water Department has declared Philadelphia's water remains safe to drink and use and will not be impacted by the spill in Bucks County. With data showing no threat to public health, the City is ending the ongoing advisories about monitoring at the Baxter Drinking Water Treatment Plant.” You can read more about the city's announcement here: https://www.phila.gov/2023-03-26-citys-response-to-spill-of-a-latex-product-into-the-delaware-river/

The Rich Zeoli Show- Hour 2: On Tuesday, NBC Nightly News aired a shocking report featuring former federal prosecutor and chief investigator of the January 6 Committee, Tim Heaphy. Heaphy stated that the federal government had prior warnings of the January 6th riot at the Capitol and were capable of preventing it from occurring had they taken the intelligence reports seriously. According to NBC anchor Lester Holt, “the January 6 Committee's final report was more than 800 pages, but some material did not make the cut, including much of its findings on the failures of federal law enforcement leading up to the attack.” The Columbia Journalism Review (CJR) has examined and subsequently denounced the New York Times' reporting on the Trump-Russia collusion allegations. House Oversight Committee Chairman James Comer (R-KY) spoke with the National Archives on Tuesday. Rep. Comer claimed the National Archives told him they have no problem with complete transparency regarding President Biden's mishandling of classified documents—leading Comer to conclude the lack of cooperation and openness is due to Merrick Garland's Department of Justice. On Wednesday, Speaker of the House Kevin McCarthy (R-CA) met with President Joe Biden at the White House to discuss the debt ceiling and out-of-control federal government spending. Will McCarthy be able to negotiate a deal that Republicans can support? While appearing on Fox News, Congresswoman Elise Stefanik suggested that the federal government could save hundreds-of-billions of dollars by simply locating unspent COVID-19 funds.

I am currently the Director for Social Security Administrationss (SSA) Division of Eastern Regional Contracts. I have almost 30 years working for the Federal Government. I started my Federal career as a Student Engineer working for the U.S. Army Corps of Engineers, Huntington WV District, Construction Division. One of the requirements at the University of Cincinnati, was for Engineering and Construction Management students to participate in the co-op program were we worked alternating quarters with a company in a field related to our major. After graduating in the mid 1980s with my Bachelor of Science degree in Construction Management, I accepted a permanent position with the Huntington District where I was assigned as an Engineer/Inspector at the Yatesville Lake, KY dam site where we were building a new earth-filled dam and appurtenant bridges and roads. Other assignments in the early 1990s with the Corps of Engineers took me to Kuwait City Emergency Recovery Offices Construction Division to assist with the re-building of Kuwait City after the Gulf War and to our Miami Office after Hurricane Andrew hit southern Florida. I transferred to the Baltimore Districts Construction Division in 1995 where I remained as a contract administrator until January 2001. In January 2001, I switched careers to become a Contract Specialist with the Department of Housing and Urban Development in Washington, DC. I transferred to SSA in August 2004. I have been in my current position since September 2009. http://nabwic.org/
