Eddie Dabdoub: Fresh Ideas for Scaling Your Law Firm

BE THAT LAWYER

In this episode, Steve Fretzin and Eddie Dabdoub discuss:Falling in love with your practice area but remembering it is a business.Transitioning from general law practice to a niche law practice.Getting buy-in from your team for the law firm growth.Taking care of your team to stop the turnover. Key Takeaways:There is a barrier of entry for those transitioning from a PI practice to a Disability Insurance practice. If you structure your practice like a well oiled machine, even less lucrative niches will pay off financially.Build a core team that allows your firm to grow together. Even when you're in different rolls, you want the core team to all be focused on the same business goals.Your firm does not need to be built like everyone else's. You are different, build your firm to reflect what is important to you. "My big advice is, if you want to scale a law firm, breakaway from the traditional model of assigning assistants and paralegals to attorneys. Instead, create different departments (even if they're tiny), train your folks to be experts in that department, and have cases go through those departments as the lifecycle of the case carries it through the firm." —  Eddie Dabdoub Read more from Steve at Above the Law: AboveTheLaw.com/tag/Steve-Fretzin/ Thank you to our Sponsors!Ready to go from good to GOAT? Episode 01 - Success Starts from Within with Rick FriedmanYou don't want to miss the Elawvate interview of Rick Friedman, one of America's pre-eminent plaintiff trial lawyers and teachers.  In this episode Ben (Ben Gideon | Gideon Asen LLC)  and Rahul ((Rahul Ravipudi (psblaw.com) )talk to Rick about his latest book, The Way of the Trial Lawyer: Beyond Technique (published by TrialGuides and available here:  The Way of the Trial Lawyer – Trial Guides). What Will You Learn From Listening to this Episode?               The Power of Moral Advocacy.  In this episode, you will learn about the power the comes from developing what Rick calls ethos, or the authenticity and credibility that stems from advocacy tied to core more principles and beliefs.  Rick explains that lawyers are trained to become skilled technicians in logical argument (logos) and to harness the power of emotion (pathos), but few develop the ability to “run on all cylinders” by adding the power of moral advocacy (ethos).                Personal Understanding and Growth.  Rick provides a roadmap that lawyers can follow to develop the strength that comes with moral advocacy.  The first step involves looking inward—to resolve any cognitive dissonance or moral conflict you may have, and to achieve clarity of mission.  Rick explains how the “zealous advocacy,” “win at all costs” model lacks is a cynical model built on corporate values, and deprives the civil trial lawyer of moral model built on human values. Instead, Rick advocates for an approach in which the cause must include something more than just winning—there must be some larger (moral) principle at stake.               Rick explains that to harness the power of moral advocacy, the lawyer must “enter the dark alley” and confront honestly and overcome personal demons that may be stunting growth.  These demons include over-emphasis on personal ego, a knee-jerk resort to self-pity or macho “tough guy” image to avoid truly confronting the hardest aspects of trial law, like fear of losing, performance anxiety, or loss of a carefully cultivated image.  Rick explains how therapy has helped him and many successful trial lawyers achieve the kind of growth necessary for self-awareness and authenticity.               Moral Energy and Steadiness.  Once a lawyer has done the hard work to grow as a person and to commit to a moral advocacy model, Rick explains that the lawyer can then marshal these powerful forces as a means of persuasion.  To do so requires identifying the  core moral issues and forces that bear on a dispute, and to understand which of those will reasonable more strongly with the decision maker (in the case of a trial, the jury). About Rick FriedmanRick started his career in a small town in Alaska as a lawyer with no staff, where he developed a love for studying the books and transcripts of great trial lawyers. He built his career representing the poor, injured, and mistreated, sharing with jurors the truth about his clients' injuries and what caused them. His trial method is to present the truth to the jury, and effectively counter defense tactics to distort the truth. He has developed methods for clearly showing jurors how defendants have broken the rules that protect all of us. Lawyers all over the country now ask him for help in trying their cases.Among Rick's landmark cases are Bellott v. State Farm, a $152,000,000 jury verdict on behalf of a client whose insurance agency agreement was terminated in retaliation for his refusal to engage in dishonest marketing practices; Washington v. Endoscopy Center of Southern Nevada LLC, a $104,000,000 jury verdict for the infection of his client with Hepatitis C due to the defendant's multi-dose vials of Propofol; Myrick v. Mastagni, a jury verdict believed to be the first case in California holding a building owner liable for injuries sustained in an earthquake; and Robinson v. State Farm, which exposed State Farm's use of false doctor's reports to deny claims. He has obtained four verdicts that ranked in the top ten verdicts of the year in the United States. He is a member and past president of the Inner Circle of Advocates as well as a member of the International Academy of Trial Lawyers and the American College of Trial Lawyers.Rick is a graduate of Harvard Law School and in addition to The Way of the Trial Lawyer: Beyond Technique is the author or co-author of four other bestselling legal books: Rules of the Road: A Plaintiff Lawyer's Guide to Proving Liability, Polarizing the Case, Becoming a Trial Lawyer, The Elements of Trial. These books have revolutionized how thousands of lawyers try their cases. Rick is licensed to practice in Alaska, Washington, Nevada, Kentucky and California, but also regularly appears pro hac vice in other state and federal courts around the country.About ElawvateThe Elawvate Podcast – Where Trial Lawyers Learn, Share, and Grow is where the practice of trial law meets personal growth. India is a major problem. The situation is aggravated by delhi's geography. The city is landlocked and it sits in a kind of a natural bowl surrounded by industrial and agricultural areas. There's no coastal breeze. So the pollution just hovers over the city to emissions from cars and trucks and even dust from the roadside contributes almost 80% of the particulate matter. That nasty 2.5 that we talk about and then to make it even worse. Once a year at harvest time farmers across the neighboring States set fire to their fields to clear them for the next season. That's known as stubble burning. I'll have more about that in a minute. Back to Delhi, the public works department installed 23 anti-smog guns throughout the city and 150 water tankers that sprinkle water on the trees, roads, and construction sites all over the city. So what are they doing? They're spraying water into the air, hoping that it sticks to some of the particulate matter and it falls to the ground like what rain does. Of course rain lowers the level of air pollution, but this is just a cheap attempt and a waste of time and money and resources fix the problem. Don't cover it up with a squirt gun, a big squirt gun, but still it's just spraying water. The best solution obviously would be to reduce the pollution at their source. Yeah, it'll be expensive to fix India's air pollution problem, just like anybody, but people are dying in huge numbers in India from air pollution in 2019 more than 1.5 million people died from air pollution. All right. So let's talk about stubble burning. I never even heard that phrase until last year. Rick... Do you believe a single moment can bring about significant change? In today’s episode with Rick Friedman, he shares how finding a simple book sparked a passion for bringing a voice to climate change and the issues facing our planet.  Many CausePods are born from a single moment of inspiration where a few months in the rearview mirror, you can easily say that was a great 90-degree turn in a new direction, and it was a simple moment that started it. The Breath of Fresh Earth podcast brings a creative format to his podcast to keep people engaged in the episode.  Creating a podcast that takes full use of the production process to create something unique each time is a technique that is often overlooked.  Like the book that influenced Rick, he hopes the episode sparks a listener to see climate change a little bit differently.        Key Topics: How did Rick settle on a particular format, and where did the idea for the show come from (1:30) How does he use his podcast to highlight the work that has already been done for climate change (4:04) Why does climate change get a bad wrap (8:36) Where did he first get into the fight against climate change (10:51) What lessons did Rick learn while launching the show (12:50) What is the biggest lesson for Rick trying to grow his podcast during uncertain times (14:21) What does the Climate Reality Project do (15:55) What advice does Rick have for someone looking to start a Cause based Podcast (18:27) Website link: https://abreathoffreshearth.captivate.fm/ Podcast Links: Apple: https://podcasts.apple.com/us/podcast/feed/id1498287880?at=11lo6V&ct=podnews_podcast Google: https://podcasts.google.com/?feed=aHR0cHM6Ly9mZWVkcy5jYXB0aXZhdGUuZm0vYWJyZWF0aG9mZnJlc2hlYXJ0aC8= Spotify: https://podcasts.google.com/?feed=aHR0cHM6Ly9mZWVkcy5jYXB0aXZhdGUuZm0vYWJyZWF0aG9mZnJlc2hlYXJ0aC8= Social Links Twitter: https://twitter.com/bofepodcast Twitter: https://twitter.com/climatereality (https://twitter.com/climatereality) Facebook: https://www.facebook.com/richard.friedman.566 Instagram: https://instagram.com/friedman5744 Charity Name: The Climate Reality Project Charity Website: https://www.climaterealityproject.org/donate/donate-climate-reality-project?utm_segment=GeneralWebHomepageButton Thanks for Listening! The way a large segment of the population in the United States is facing the pandemic by avoiding wearing masks and not socially distancing is a good analogy to climate change. These people either don't believe anything, bad will happen to them, or it will happen to someone else or they believe what the current president tells them. He's giving them false hope and bad information, much like fossil fuel proponents seek to confuse deflect and deny. What is crystal clear? Fossil fuels are killing us toss in a gazillion pieces of plastic everywhere, including inside us. And we'll hear from you later at the end of the show today, we're going to switch things up a bit. Our lead story is also our climate hero of the week. So let's do this right Speaker 1: (https://www.rev.com/transcript-editor/Edit?token=hOBHXHnDS9WVA7eqZfy6WEtmVnowbHym-cAzll_lx7KQdMgS0fMG99p7SHOFLgAkhXDUWPP5ANX8gK7k50lHftvifoY&loadFrom=PastedDeeplink&ts=49.88 (00:49)) It's time for the climate hero of the week. He devoted his high school science project to understanding the problem and research why cleanup was considered impossible. It became clear that a cleanup using vessels and nets would take thousands of years, cost tens of billions of dollars and harmful to sea life. There are five major plastic accumulation zones in the world where ocean currents converge. We learned about them when we featured Marcus Erickson and his company five gyres in episode 12, these accumulation zones are commonly called garbage patches. The majority of ocean plastic will not go away by itself, but instead it slowly breaks down into microplastic. Boyan came up with an idea to develop a passive concentration system. Rick: (https://www.rev.com/transcript-editor/Edit?token=hOBHXHnDS9WVA7eqZfy6WEtmVnowbHym-cAzll_lx7KQdMgS0fMG99p7SHOFLgAkhXDUWPP5ANX8gK7k50lHftvifoY&loadFrom=PastedDeeplink&ts=108.2 (01:48)) Instead of going after the plastic, he lets the plastic come to him, led by slot. Now 26, the ocean cleanup is designing and developing cleanup systems to what is already polluting our oceans into intercept plastic on its way to the ocean via rivers. Speaking of rivers, slot belt, the interceptor, the interceptor is the first scalable solution to prevent plastic from entering the world's oceans. Coming from rivers, it is a hundred percent solar powered extracts plastic autonomously, and is... Now your host, Rick Friedman, thanks Rick: (https://www.rev.com/transcript-editor/Edit?token=hOBHXHnDS9WVA7eqZfy6WEtmVnowbHym-cAzll_lx7KQdMgS0fMG99p7SHOFLgAkhXDUWPP5ANX8gK7k50lHftvifoY&loadFrom=PastedDeeplink&ts=38.63 (00:38)) Stuff for the intro, Steph. Rick: (https://www.rev.com/transcript-editor/Edit?token=hOBHXHnDS9WVA7eqZfy6WEtmVnowbHym-cAzll_lx7KQdMgS0fMG99p7SHOFLgAkhXDUWPP5ANX8gK7k50lHftvifoY&loadFrom=PastedDeeplink&ts=56.72 (00:56)) Dutch vendor Boyan Slat founded the ocean cleanup at the age of 18 in his hometown of Delphi, the Netherlands, it all started when then 16 year old Boyan was diving in Greece and saw more plastic than fish. Support this podcast

Deforestation is the clearing, destroying, or removal of trees through deliberate, natural or accidental means. It occurs in any area densely populated by trees and other plant life, but most of it is happening in the Amazon rain forest. I remember going to the Cleveland zoo and seeing the display showing deforestation. There was the sound of buzz saws zipping through trees above it. There was a running total of acreage lost. Deforestation is the clearing, destroying, or removal of trees through deliberate, natural or accidental means. It occurs in any area densely populated by trees and other plant life, but most of it is happening in the Amazon rain forest. Now, your host, Rick Friedman, Rick: (https://www.rev.com/transcript-editor/Edit?token=gWljQa7gMC2PJ0a3ZIFZowzo9bjyHGBZnCpyN7bH6KEEUPI96D7YabaiTjkC051jyXdPVUvA7ncItHVR8oOmCo7RZqE&loadFrom=PastedDeeplink&ts=38.43 (00:38)) April 22nd, 2020 will mark the 50 year anniversary of the first earth day. The theme for earth day 20 20th climate action covid- 19 ruined all the in-person festivities for earth day, but you can still contribute by going to earth day.org on April 22nd for 24 hours of action with Earthrise. Every hour on the hour, you'll find suggestions to support a cleaner planet. The first earth day was a unified response to oil spills, smog, and rivers so polluted. They literally caught fire. That happened to the Cuyahoga river in my hometown, Cleveland, Ohio. Rick: (https://www.rev.com/transcript-editor/Edit?token=gWljQa7gMC2PJ0a3ZIFZowzo9bjyHGBZnCpyN7bH6KEEUPI96D7YabaiTjkC051jyXdPVUvA7ncItHVR8oOmCo7RZqE&loadFrom=PastedDeeplink&ts=71.88 (01:11)) In 2016 the United nations chose earth day as the day when the countries signed the Paris agreement on climate change. The founder of earth day was a man named Gaylord Nelson, a Republican Senator from Wisconsin. In 1969 he witnessed the remains of a massive oil spill in California that got him thinking about how he could tap into the power of the antiwar protests and bring that to environmental action. It worked. Nelson received the presidential medal of freedom award in 1995 as a tribute for his efforts. Another Republican Congressman, Pete McCloskey, convinced the 25 year old man named Dennis Hayes from Harvard to run the first earth day after the success of the first earth day. Hayes founded earth day network and helped expand the earth day network to more than 180 countries and was named hero of the planet by time magazine. In 1999 the founders chose April 22nd for earth day because it fell between spring break and final exams for college students. The first earth day led to the creation of the United States environmental protection agency in the passage of the clean air, clean water and endangered species act. Why do they treat climate change like it doesn't exist? Money, money from donors urging them to stay the course to keep oil and gas, profits high, no matter the cost to the planet or our health. Your host, Rick Friedman, will crown the climate hero and villain of the week, along with discussing worldwide environmental issues, showcasing new products designed with the longevity of our planet in mind, and putting the spotlight on the individuals making a big impact in helping the climate and policing crisis through social media. Now, your host Rick Friedman,  The biggest political football this year is fracking. Hydraulic fracking is the process of extracting natural gas from rocks in the earth by breaking them apart. chemicals are pumped into a targeted area and after the rocks are broken, gas is released up through a pipe and shipped off in a truck to whatever plant wants it. One of the many problems with fracking is that methane gas escapes during the mining process, polluted flow back water may get injected into a deep storage well recycled or sent to a treatment plant. fracking fluid is forced to underground at high pressure and toxic chemicals seep into the bedrock. The toxins in the bedrock seep into the drinking water aquifers and contaminate the water from the aquifers that enter the drinking water systems. That's gross. Natural gas from fracking produces the same amount of energy as carbon dioxide, but only admits half the emissions. That sounds like a good thing. Well, it is in some aspects, but it's not perfect because methane is a powerful greenhouse gas more powerful in carbon dioxide, and methane enters the atmosphere. It doesn't stay in there a long time. Only 20% of the methane emitted today will still be in the atmosphere after 20 years. However, when it first enters the atmosphere, it's about 120 times more powerful than carbon dioxide at trapping heat. And scientists say 86 times stronger over a 20 year period. The oil and gas industry has been expanding fracking for decades. The industry won't disclose the ingredients used in fracking keep that a secret? That doesn't seem fair. What are they hiding? Time's up. Did any of you say a nurdle? A nurdle? What's a nurdle. Nurdles are small plastic pellets. That's the raw material used to make items out of plastic. The nurdles are melted and formed to make the desired product. Nurdles are small. They're less than five millimeters in size about the size of a lentil. They start out small and over time they fragment into smaller particles and they take hundreds to thousands of years to degrade and disappear. These little pieces of plastic can be mistaken for food by smaller animals lower down on the food chain. Even tiny animals like plankton, once they eat them, microscopic plastic particles can pass straight into an animal's bloodstream and get stuck in their tissues. Unlike larger pieces of plastic, there is no practical way of removing these nurdles from the sea. This is why we need to stop nurdle pollution at the source. There's a lot of talk about wind power. Let's look at some of the facts. Here's the good news. The cost of wind energy keeps falling. Business is growing and putting people to work. Cities around the world are looking at the benefits of wind power, finding them hard to ignore. Wind energy produces no emissions, no pollution. It's clean and it's an unlimited resource. For farmers. The wind, a wind farm gives them a new crop to sell. Rick: (https://www.rev.com/transcript-editor/Edit?token=-EX8M7NDgjSiqU517XW_01_vI_9aPT9VPc3Q9Hf7E3mDvuNJvpLPMCV0P59IBf6-l3DuP9AONl6yTJHIu75uNz4Kpbs&loadFrom=PastedDeeplink&ts=67.67 (01:07)) Here's kind of a short version of how it works. Each land owner who allows a turbine on their field receives three to $7,000 a year for each turbine. Wind farms usually consist of somewhere between 50 and a hundred turbines. They're all connected by buried wires that link them up to a central transmission. The turbines are mounted on a high metal tower. You've all seen that. The turbines are run in offset lines, so they're not lined up directly in a row. They skipped some space about a half a mile apart, so they don't steal each other's wind. Farmers grow crops, animals can graze underneath the turbines while they're humming along. Wind energy went from a little over 2% of the United States electricity mix in 2010 to almost 7% last year. It's also one of the cheapest ways to produce energy. Now it's even less than natural gas. Why are farmers turning to wind? A lot of them have gone bankrupt. Rick: (https://www.rev.com/transcript-editor/Edit?token=-EX8M7NDgjSiqU517XW_01_vI_9aPT9VPc3Q9Hf7E3mDvuNJvpLPMCV0P59IBf6-l3DuP9AONl6yTJHIu75uNz4Kpbs&loadFrom=PastedDeeplink&ts=119.99 (01:59)) The bankruptcy rates in 2019 jump 20% for farmers. It's an eight year high. The trade war didn't help, The low prices for commodity crops and unpredictable weather. Those are all factors that affect farmers. One farmer in Iowa said "wind is just another crop." Another opportunity to capture resources. This is a tough energy problem for Republicans to deal with because 90% of the wind farms are... Now your host, Rick Friedman. Rick: (https://www.rev.com/transcript-editor/Edit?token=-EX8M7NDgjSiqU517XW_01_vI_9aPT9VPc3Q9Hf7E3mDvuNJvpLPMCV0P59IBf6-l3DuP9AONl6yTJHIu75uNz4Kpbs&loadFrom=PastedDeeplink&ts=39.41 (00:39)) Hi and welcome to episode two. Sonora Chase is an actress and writer living in Los Angeles. She has now survived not just one, but TWO acoustic neuromas – benign, fast-growing brain tumors that have affected her hearing, balance, spatial awareness, and facial nerves. In this episode, she shares her brave story – which involved a battle with health insurance companies, the steep learning curve of discovering her rights as a patient, and one big happy ending: getting the doctors she wanted and having both tumors removed. In addition to her experience surviving her own invisible illness, Sonora is also the survivor of others’…she shares about the importance of finding community as you navigate mental illness and addiction, and how Al-Anon has been an irreplaceable resource for her as the loved one of individuals with addiction. Join us as Sonora shares… - what an acoustic neuroma is - that a fellow actor who also had an acoustic neuroma: Mark Ruffalo - the difficulties of navigating the health insurance system with an acoustic neuroma - that as her symptoms continued, she experienced facial paralysis without pain (but with numbness); and that it took her longer to discover the hearing loss associated with her acoustic neuroma - that she didn’t realize something was really wrong until she realized the extent of the hearing loss in her left ear - that the tech at her MRI was especially nice to her – and she suspects it’s because he could see the growing tumor in her brain - that her acoustic neuroma was pushing her brain stem over, which causes trouble breathing and contributed to intense fatigue and balance issues, as well as constant nausea - that visual stimulation also contributed to fatigue – half her brain was working twice as hard to keep up. Her fatigue persists to this day. - that her inner ear was removed with her tumor, and she had to relearn how to walk after surgery - how daily chores and tasks look when you are a Spoonie – and how she has to be deliberate in her choices - her amazing surgeon, Dr. Rick Friedman, neuro autolaryngologist, and the translabyrinth surgeries he has performed to treat her acoustic neuromas – which involve a medically-induced coma - that acoustic neuromas are generally considered inoperable at 4 inches…and Sonora’s first one was 3.8 inches! - that, based on continuity of care, patients can push for the same doctors for major health interventions – even if health insurance providers say “no” - for three months, she spent 8-9 hours a day on the phone pushing her health insurance providers for the care she needed - that CA Dept of Managed Healthcare exists to assist patients in imploring health insurance companies to do the right thing - that the fight for proper healthcare taught Sonora about her rights as a patient – but it took three months, because several operators weren’t even aware of their company’s legal obligations - how important patient education is; that it is key to know your healthcare rights, and to be KIND to the messengers on the other end of the line - how getting her surgery at UCSD was one of the best experiences of her life, because the Acoustic Neuroma Center at UCSD is incredibly well-designed with patient sensitivities in mind - that she is still waiting for a surgery to “install” a bone-anchored hearing device (Baha) so she regains some hearing in her left ear - how she connects to spirituality to manage her health from a psychological perspective – through Buddhism and crystal healing - some of the complications of brain surgery, including a brain leak – which Sonora suffered after her second surgery (and is relatively rare) - a personal analysis of the pain scale – that all pain is relative - that Sonora is not only a survivor of invisible illness where her tumors are concerned, but that she has also survived loved ones with addiction problems, and regularly attends Al-Anon meetings - that she credits the Centre for Neuro Skills in Encino for helping her get back on track after her first surgery
