Este acontecimiento promete información científica relevante. Pero un detalle inesperado complica el panorama: Athena aterrizó en una posición inclinada, lo que podría limitar ciertas operaciones previstas, como el uso de taladros y el despliegue de un robot saltarín para explorar cráteres en sombra perpetua. Los ingenieros trabajan sin descanso para recuperar la comunicación y habilitar funciones clave. ¿Podrá esta nave sobreponerse a los contratiempos y aportar datos esenciales para futuras misiones humanas en la Luna y la ansiada presencia duradera?Un aterrizaje suave, pero ¿vale la pena con riesgos altos?La misión IM-2, impulsada por Intuitive Machines, llevó a Athena hasta la región Mons Mouton, a unos 160 kilómetros del polo sur lunar. Allí, la NASA esperaba probar un taladro llamado PRIME-1, capaz de penetrar un metro en la superficie para buscar posibles reservas de hielo. Además, la nave transporta un vehículo saltarín llamado Grace, diseñado para explorar cráteres permanentemente sombreados. Si bien el aterrizaje logró su objetivo de aproximarse a un lugar inexplorado, la inclinación de Athena podría complicar la activación de esos equipos. Aun así, la comunicación inicial indicaba que la nave generaba energía solar y enviaba datos, factor que brinda cierto optimismo.El principal inconveniente radica en la orientación de la nave. Un sistema de sensores láser, que debía ayudar a medir con precisión la distancia al suelo, presentó lecturas inestables durante la maniobra final. Este imprevisto pudo causar un descenso en ángulo, repitiendo un problema similar al de la sonda Odysseus, también de Intuitive Machines, que quedó de lado en el suelo lunar hace un año. Si Athena se encuentra recostada en el terreno, la energía solar podría verse reducida y la comunicación por antenas podría fallar en ciertos momentos. Este panorama reduce la capacidad de desplegar experimentos clave, como el robot MAPP y el rover japonés Yaoki, que requieren un escenario estable para moverse. ¿Qué tanto se podrá recuperar? Algunos ingenieros temen daños estructurales irreversibles.Intuitive Machines confirmó que, pese a la inclinación, Athena sigue enviando señales y generando algo de energía con sus paneles solares. Confiamos en resultados sorprendentes.Esta llegada forma parte del programa de Servicios Comerciales de Carga Lunar (CLPS) de la NASA, un acuerdo que promueve vuelos más económicos al satélite natural. Dentro de la misma misión, se incluyó la sonda Odin, de la firma AstroForge, cuyo objetivo era investigar un asteroide rico en platino. Odin tampoco logró mantener comunicación y se cree que está girando sin control en el espacio. Estos acontecimientos refuerzan la idea de que la exploración privada, aunque más flexible y veloz, asume riesgos elevados para abaratar costos. Por otro lado, la empresa Firefly Aerospace consiguió recientemente un alunizaje exitoso con su módulo Blue Ghost, demostrando que el sector privado puede cumplir metas ambiciosas. La NASA, por su parte, considera que incluso los intentos fallidos generan valiosos datos. El interés radica en explorar cráteres oscuros y hallar hielo que sirva para abastecer asentamientos futuros, pasos esenciales en la conquista del espacio.Athena logró un aterrizaje incierto, pero sigue enviando datos y generando energía. Los equipos podrían activarse parcialmente y aportar información valiosa sobre posibles reservas de hielo. Summary of Criminal Procedure – Day 2 Introduction Day 2 covers criminal defenses and an introduction to criminal procedure, focusing on legal justifications and constitutional protections under the Fourth Amendment. Key Topics: Defenses to Crimes: Insanity, infancy, intoxication, self-defense, duress, necessity, and entrapment. Fourth Amendment: Search & seizure rules, warrant requirements, and exceptions. Exclusionary Rule: Preventing use of illegally obtained evidence in court. I. Defenses to Crimes Criminal defenses fall into two categories: capacity defenses and justification/excuse defenses. A. Capacity Defenses Insanity: Defendant lacked mental capacity to understand wrongdoing. Tests: M'Naghten Rule, Irresistible Impulse Test, Durham Rule, MPC Standard. Infancy: Juveniles may not be held criminally responsible (common law: under age 7 presumed incapable). Intoxication: Voluntary intoxication: Not a defense unless it negates specific intent crimes. Involuntary intoxication: Can be a defense if it causes loss of control or awareness. B. Justification & Excuse Defenses Self-Defense: Use of force must be proportional and necessary. Deadly force allowed if defendant faces imminent threat of death or serious harm. Defense of Others & Property: Same rules as self-defense, but no deadly force to protect property. Duress: Defendant coerced into committing a crime under threat of death or serious harm. Not a defense for homicide. Necessity: Defendant committed a crime to prevent a greater harm (e.g., breaking into a cabin during a blizzard). Entrapment: Law enforcement induced crime that defendant was not predisposed to commit. II. Introduction to Criminal Procedure The Fourth Amendment protects against unreasonable searches and seizures by law enforcement. A. Probable Cause & Warrants Probable cause: Reasonable belief that a crime has been committed. Warrant requirements: Issued by a neutral judge, based on sworn affidavit, specifying place and items to be searched. Arrests require probable cause, but warrants are not always needed if arrest occurs in public. B. Warrant Exceptions Some searches do not require a warrant due to public safety concerns or exigent circumstances: Search Incident to Arrest – Limited search of arrestee and immediate surroundings. Exigent Circumstances – Immediate threat to safety or evidence destruction. Consent Searches – Voluntary consent waives Fourth Amendment rights. Automobile Exception – Cars have reduced privacy, allowing searches with probable cause. Plain View Doctrine – Officers can seize evidence in plain sight if lawfully present. Stop and Frisk (Terry Stop) – Officers may briefly detain and pat down suspects if there is reasonable suspicion of criminal activity. C. The Exclusionary Rule & Fruit of the Poisonous Tree Illegally obtained evidence is inadmissible in court (Mapp v. Ohio (1961)). Exceptions: Good Faith Exception: Police relied on a warrant later found invalid. Inevitable Discovery: Evidence would have been found legally. Independent Source: Evidence came from separate, legal investigation. Conclusion Day 2 covered criminal defenses and the Fourth Amendment's search and seizure protections. These legal principles help determine when a defendant is legally excused and when law enforcement actions violate constitutional rights. Next time we will continue with Fifth and Sixth Amendment protections and trial procedures.

Individual Rights and Due Process Under the Fourteenth Amendment Source: ConLaw Lecture 2 of 5: Individual Rights and Due Process Main Themes: The Fourteenth Amendment as a cornerstone of individual rights: The Fourteenth Amendment, ratified in 1868, serves as a "second constitution" safeguarding individual rights against state actions. It guarantees fairness, equality, and liberty through its Due Process and Equal Protection Clauses. Due Process of Law: This clause mandates fair and legitimate government actions when impacting individual rights. It has both procedural (fair procedures like notice and hearing) and substantive (protection of fundamental rights regardless of procedures) aspects. Equal Protection of the Laws: This clause prohibits discrimination and ensures equal application of laws, playing a vital role in dismantling racial segregation, gender discrimination, and other inequalities. Incorporation Doctrine: This doctrine extends most Bill of Rights protections to the states via the Fourteenth Amendment, ensuring consistent protection of fundamental freedoms across the nation.
