Un tribunal salvadoreño inició un juicio colectivo contra 486 presuntos pandilleros, el primer macro juicio bajo la ofensiva de Nayib Bukele contra las pandillas, que tiene una particularidad: no se juzga a los detenidos por sus cargos individuales, sino que se les responsabiliza de manera colectiva, al considerarlos miembros de una empresa criminal donde todos tienen responsabilidad. Esta semana, la justicia de El Salvador dio comienzo a su primer macro juicio contra pandilleros. En total, serán procesados 486 integrantes de la Mara Salvatrucha por 47.000 delitos cometidos entre 2012 y 2022, entre ellos, 29,000 homicidios, pero hay cargos de extorsión, narcotráfico o tráfico de armas. Entre los procesados hay altos cargos y cargos intermedios, pero se juzgará a los pandilleros como miembros de una entidad criminal, sin tratar sus expedientes por separado, sino responsabilizándolos de manera colectiva. "Hay un claro mensaje categórico y contundente que se le envía a las estructuras de las pandillas criminales y el crimen organizado en El Salvador y es sobre la recuperación del monopolio de la fuerza por parte del Estado salvadoreño", explica a Radio Francia Internacional Ricardo Sosa, criminólogo y experto en seguridad nacional. "Las reformas al código penal y ley contra el crimen organizado buscan que la pertenencia a una pandilla criminal por sí sola sea motivo de una condena prolongada en el sistema penitenciario. Esto lo que hace es que es tratada como una corporación criminal delictiva, donde la responsabilidad no es sólo individual, sino por la pertenencia al grupo criminal.", concluye. Esta colectivización es posible gracias a una reciente reforma judicial, que pretende acelerar los plazos judiciales. “Si se hace caso por caso estaríamos de años en juicios. Son las mismas personas las que tomaban las decisiones, las que daban las órdenes, incluso las que ejecutaban también en casi todos los casos los asesinatos y secuestros. Ellas participaban”, declara por su parte a RFI Óscar Martínez Peñate, politólogo y doctor en Ciencias Sociales. “De esta manera se logra realmente abreviar en tiempo y ser más efectivos en cuanto a la aplicación de la justicia. Las decisiones realmente no eran individuales, sino que eran colectivas”, asegura. Sin embargo, este modelo para ahorrar tiempo, despierta recelos en organizaciones, como Socorro Jurídico Humanitario, que brinda apoyo legal a detenidos durante el estado de excepción implementado por el presidente Nayib Bukele, siempre y cuando no presenten vínculos previos con las pandillas. Antonio Palacios es uno de sus fundadores, y explica que al no revisar los casos individualmente, se puede condenar a personas que considera inocentes, como los llamados colaborades forzosos, obligados por la fuerza a ayudar a pandilleros. “A muchas personas se les va a procesar por delitos que cometieron otras personas bajo la acusación de ser colaboradores de pandillas”, dice Palacios. “La figura del colaborador tiene dos caras: está el colaborador voluntario y el colaborador forzado. Actualmente, cualquier persona que es capturada bajo el régimen de excepción se le etiqueta como colaborador de la pandilla.
