Legislation to improve federal agency oversight and management of software purchases passed the House on Wednesday, keeping top IT and software trade groups' hopes alive that the bill will get through the Senate and become law before this congressional term is up. The Strengthening Agency Management and Oversight of Software Assets Act (H.R.1695) – better known as the SAMOSA Act — was introduced by Rep. Matt Cartwright, D-Pa., last year and co-sponsored by a bipartisan group of 20 House lawmakers. Calling the rooting out of waste, fraud and abuse a “signal mission” of the House Oversight Committee, Cartwight said the bill would ensure that federal agencies are required to conduct a “comprehensive assessment of their current software assets and restructure their operations to reduce unnecessary costs.” A bipartisan group of senators introduced legislation to reauthorize and refocus the National Quantum Initiative after certain research and development activities in its initial five-year run lapsed in September. The National Quantum Initiative Reauthorization Act would authorize $2.7 billion for quantum R&D at federal agencies for the next five years and shift the initiative's focus “from basic research to practical applications.” It would also expand the initiative to include agencies like the National Institutes of Health, the State Department and the Small Business Administration, according to a news release. The federal Farm Bill expired at the end of September 2024 and was not reauthorized. Funding for the Supplemental Nutrition Assistance Program (SNAP) has been extended through a Continuing Resolution, but that is a stopgap measure. It's hard to believe, but it's been four years since Congress passed the Great American Outdoors Act and President Trump signed it into law. Under that legislation, the National Park Service has been receiving $1.3 billion a year to pay for tackling the National Park System's maintenance backlog. When the Great American Outdoors Act was passed, it was given a five-year life. That means it will have to be reauthorized next year to keep the program going. It's had wide-ranging impacts, paying for things like roadwork on the Blue Ridge Parkway, new bridges at Yellowstone National Park, improved campgrounds in the park system, and new interpretation. But will the GAOA get renewed, and what's the process to get there? Through a seemingly innocuous change to the definition of ‘electronic service communications provider,' the bill vastly expands the universe of U.S. businesses that can be conscripted to aid the government in conducting surveillance. Under current law, the government can compel companies that have direct access to communications, such as phone, email, and text messaging service providers, to assist in Section 702 surveillance by turning over the communications of Section 702 targets. Under Section 504 of the House intelligence committee's bill, any entity that has access to *equipment* on which communications may be transmitted or stored, such as an ordinary router, is fair game. What does that mean in practice? It's simple…Hotels, libraries, coffee shops, and other places that offer wifi to their customers could be forced to serve as surrogate spies. The U.S. House of Representatives considers H.R.2882, the Udall Foundation Reauthorization Act, on February 5, 2024. The bill reauthorizes the Udall Foundation through 2028. The Udall Foundation, named after former U.S. Congressmen Mo and Stewart Udall from Arizona, provides scholarships and internships to students who are working on Native issues. It also supports advocacy and research on Native issues and provides mediation and training services. The House considered the bill under a suspension of the rules. House Judiciary Committee member Lance Gooden gives his takeaways from Special Counsel John Durham's testimony before the committee earlier this week. The Texas Congressman says that Durham's testimony left him with the impression that the “the FBI is really in a sad state. There is in fact, a two tiered justice system. And the FBI has a lot of rot that has not been fully taken out, and [Congress has] got a lot of work to do.” Gooden says, the FBI has repeatedly said that they have implemented reforms, commenting that he doesn't believe that, and “the American people don't believe that.” Saying, “and what a sad statement on a once respected institution, that being the FBI. The American people have lost faith. There was in fact, no collusion, no coordination, no Russian involvement with the Trump campaign. And the the, the just constant lies that we've seen from the other side, in the effort to take down President Trump before he even took office. For it to finally come out many years later, is I think redeeming but also very sad. I am just so disappointed. And in what I saw this week, and what Mr. Durham has been working on, I'm actually also very frustrated that it took this long to come out. But nonetheless, it did. And here we are in 2023, talking about something that happened back in 2016 but it's where we are.” Gooden says, Congress will use its power of the purse, to impose change on a seemingly unwilling FBI, since the appropriations process is “number one tool at” their disposal. Gooden says, this was shown “in the debt limit fight a few weeks ago, we got some concessions from Joe Biden, through that process, and the appropriations is really the only tool that the the party has when they only control one level of government.” Saying the GOP will also look to “the FISA court device authorization is also set to expire this year. This year, a key U.S. national security law is set to expire. Section 702 of the Foreign Intelligence Surveillance Act has many moving parts, but the gist is that it allows the government to collect the communications of foreigners who are abroad, to gain foreign intelligence information, including when those people communicate with Americans inside the United States. And it can do that without a warrant. In practice, this means that intelligence agencies can order email services, like Google and Yahoo, to hand over copies of the messages of targeted foreigners to intercept the phone calls, texts, and internet communications to or from a foreign target.In the past, reauthorization by Congress was pretty much routine, and some new modifications and procedural safeguards have been added over the years. But this year could be different. A series of recent government reports and court opinions have shown extensive use of Section 702 as a domestic surveillance tool by the FBI. There have been numerous incidents of FBI agents pushing, and sometimes breaking, legal limits on accessing the data of Americans that is “incidentally” collected as part of a Section 702 search. Politics are also at play. Some members of Congress, including House Judiciary Committee Chairman Jim Jordan, have said they oppose reauthorization. To understand how the Biden administration is thinking about the Section 702 reauthorization, Just Security's Co-Editor-in-Chief Tess Bridgeman sat down with Chris Fonzone and Josh Geltzer.
