El rey abdicó de hecho, abandonando su puesto; aprovechémonos de nuestro derecho y juremos implantar en Francia la República". Condorcet lee en el Círculo Social una declaración a favor de la República. Danton también defiende la República. Barnave defiende en la Asamblea la inviolabilidad del rey y la ficción de su rapto: “Habéis concedido al rey la inviolable facultad de nombrar los agentes de su poder, pero habéis decretado la responsabilidad de estos agentes. Para ser independiente, el rey debe ser inviolable. Quien tenga contra el jefe del poder ejecutivo todos sus resentimientos le pregunto ¿profesa más enemistad al rey, que amor a la ley de su país?" La Asamblea decreta la ficción del rapto y la inviolabilidad del rey en su Decreto de 15/07/91. Los intentos de los legalistas por que no pueda criticarse en los clubs este Decreto provocan la escisión de los jacobinos en el Club de Los Feuillants donde se unen Barvane, Duport, Lameth, La Fayatte, Le Chapelier...
