A new report from Mercy Catholic Medical Center in Pennsylvania shows that trans patients who undergo hormone therapy are up to SEVEN times more likely to have a stroke, six times more likely to have a heart attack, and five times more likely to develop a pulmonary embolism than those who aren't prescribed hormones. Sean talks with Elle Herman about the varieties and modalities of fascism and the carceral dynamics at stake in the institution of criminal prosecution. Elle recently gave a talk for the Karasu Philosophical Society in Albuquerque titled "The Problem of Prosecuting Fascism." In the talk, she focuses on two recent prosecutions of notorious 2020 American vigilantes: Kyle Rittenhouse's trial for fatally shooting Anthony Huber and Joseph Rosenbaum and non-fatal shooting of Gaige Grosskreutz at the Jacob Blake protests in Kenosha, WI; and the trial of the McMichaels and William Bryan for the pursuit and murder of Ahmaud Arbery around Brunswick, GA.On Monday, the McMichaels were each sentenced to life in prison +, while Bryan received a sentence to serve 35 years. While Sean interviewed Elle last week, the problems she approaches in her talk are all the more significant to consider in light of these sentencings. Check out EP 34 as we talk about Kyle Rittenhouse and the three men who shot and killed Ahmaud Arbery while running in Satilla Shores, Georgia. Rittenhouse murdered Joseph Rosenbaum, 36, and Anthony Huber, 26, and injured Gaige Grosskreutz, 27, when he blasted them with an assault rifle as he walked the roads of Kenosha with other armed men acting as a self-described militia during marches in August 2020, after a white police officer murdered a Black man, Jacob Blake. Travis McMichael was found guilty on all counts, while his father, Gregory McMichael, was found guilty on all counts but malice murder. William “Roddie” Bryan was guilty of felony murder and a slew of other charges such as aggravated assault, false imprisonment, and criminal attempt to commit a felony. Can Self-Defense Laws Survive in a Gun-Rich Country? Taking the law into our own hands and claiming self-defense when someone is shot is the subject of the Kyle Rittenhouse and Ahmaud Arbery cases. During two closely watched murder trials in two different states this past week, juries heard strikingly similar stories: men bought guns in the name of protecting the public and then told juries they killed unarmed people in self-defense. In one case, Kyle Rittenhouse fatally shot two men and wounded a third in the unrest following a police shooting in Kenosha, Wis. Another case involved Ahmaud Arbery, a Black man, who was shot after being pursued by three white men suspected of breaking into a house in the neighborhood. In both cases, the defendants started shooting as the victims were trying to steal their guns. In other words, their own decision to carry a gun became a justification to use it, lest it be wrested away from them,” said Eric Ruben, an expert on the Second Amendment at the S.M.U. Dedman School of Law in Dallas. It is evident, from these two cases, that; our concept of self-defense has deep flaws that are treasured, but not prepared to deal with an era of gun rights expansion, political extremism, and rising violence in a situation where race is heavily influencing perceptions of threat. A powerful vigilante strain. As a result of the fact that our citizens have guns, every line has become blurred. The combination of "stand your ground" provisions and citizen's arrest laws has granted people license not only to defend themselves but to go after others as well.[See Source] Defense is the act of defending. But what constitutes reasonableness? At what point must one retreat? And when is a citizen allowed to act as an aggressor on behalf of the state? Rifts have appeared in several debates, starting with whether openly displaying firearms makes people feel safer at the expense of everyone else, whether brandishing a gun constitutes a threat or self-defense, and whether people may benefit from self-defense claims if their actions contributed to the danger. Migrant militia members accused of plotting to kidnap Michigan Gov. Gretchen Whitmer clashed with elected officials trying to make a so called citizen's arrest. It was argued in St. Louis whether white residents who aimed guns at Black Lives Matter protesters were assaulting them or defending their homes. They pleaded guilty to misdemeanor assault and harassment, then were pardoned by the governor. Nine plaintiffs who were among those injured or traumatized by the Unite the Right rally in Charlottesville, Va., in 2017, are suing the rally's organizers, alleging a plan and intent to engage in violence, but the defendants claim that the violence, in which one counterprotester died, was justified by self-defense. People have the right to self-defense when they reasonably believe there is an imminent threat of harm, whether or not they are right. It is possible to mistake a realistic prop gun for a real weapon, for instance. Some statutes, however, stipulate that someone cannot claim self-defense if they were the "initial aggressor" - in other words if they provoked or were doing something wrong at the time of the use of force. If an initial aggressor withdraws or backs away from an encounter they may regain their self-defense claim. The aggressor must also pose a threat of imminent harm. It is provocation if you assault someone without justification. If you ask for an explanation of offensive words, address a sensitive subject, engage in an inconsiderate act, or travel near someone, it does not constitute provoking an encounter. In the Arbery case, According to defendants Gregory McMichael, Travis McMichael and neighbor William Bryan, they were pursuing Mr. Arbery as part of a citizen's arrest, and he was shot after trying to grab one of their guns. There is no mention of Mr. Arbery's voice in the proceedings, who may have had his self-defense claim. What makes the perception that Ahmaud Arbery would have lived if he had complied instead of reaching for a gun, and hence it was his duty to comply. It would be good framing for Ahmaud Arbery if three guys rolled up on him with guns, he didn't know what their intentions were? There has been a tendency in the United States to increase the right to self-defense rather than to protect those whose actions may harm others. As a result of "make my day" laws, people who harm intruders in their own homes are presumed to have acted in self-defense. Classic self-defense theory's "duty to retreat" has been undermined by laws requiring people who are in an area where they have a right to be to retreat, such as at a public protest, to retreat. Most states require prosecutors to demonstrate that the defendant did not act in self defense, rather than requiring defendants to demonstrate that they did. A new law in Utah, except for those accused of attacking a police officer, enables defendants to request a special hearing at which prosecutors must prove the accused was not acting in self-defense. Despite the expansion of the legal framework for self-defense, experts say it has left certain key concepts like the "initial aggressor" poorly defined. As part of the trial of George Zimmerman, Mr. Zimmerman was accused of killing Trayvon Martin. In 2012, while visiting relatives in a gated community. Mr. Zimmerman, who was Hispanic, was deemed the first aggressor by prosecutors. He followed Mr. Martin on foot and in his car before Mr. Martin knocked him down. Mr. Zimmerman initially identified Mr. Martin as suspicious. The jury disagreed and acquitted Mr. Zimmerman. Mr. Zimmerman was the only person armed in that case. In a situation where two strangers are armed, who is the "primary aggressor"? In the Kenosha trial, Mr. Rittenhouse, now 18, was armed with a semiautomatic rifle that he was not legally allowed to own. After he shot and killed a man who he believed was trying to grab his gun, as well as a man who hit him with a skateboard in an apparent attempt to stop him, a nearby paramedic named Gaige Grosskreutz raised his hands in the air. In that moment, Mr. Grosskreutz said this week, he believed Mr. Rittenhouse racked his rifle and refused to accept his surrender. Grosskreutz pointed his handgun toward Mr. Rittenhouse, although his concealed-carry permit had expi d. Mr. Rittenhouse fired one shot at Grosskreutz. Both Grosskreutz and Rittenhouse said they were trying to save their own lives. According to philosopher Renee Jorgensen, who has researched self-defense and reasonable mistakes, one can look at the parking lot as a Wild West situation where neither man wrongs the other and neither is wronged by the other. As white men, Mr. Rittenhouse and Mr. Grosskreutz took the law into their own hands to varying degrees that night, offering themselves as private guardians of public safety. According to experts, self-defense, vigilantism, and policing are related practices rooted in deeply racialized American traditions in which Black people, particularly men, are seen as threats and white people are given the benefit of the doubt. In an analysis of homicides after Trayvon Martin's death, the Urban Institute discovered that white perpetrators and black victims were 281% more likely to be ruled justified than white perpetrators and white victims. In the Arbery case this past week, a defense lawyer objected to having high-profile Black pastors in the courtroom, arguing that their presence was “intimidating.” The standard of reasonable fear applies to both self-defense cases and police use-of-force cases, although officers are given greater leeway than civilians. Many police killings have been viewed as being the product of implicit bias due to the reasonable fear standard. Based on our research, scholars are considering ways to adapt self-defense laws to a nation awash in guns and counteract prevailing prejudices. GW law professor Cynthia Lee has begun work on a universal definition of what is considered an initial aggressor. Lee is known for her model statute on police use of force. A law like Wisconsin's would give prosecutors another option, allowing them to prove that the aggressor intended to provoke violence with a plan of retaliation, something that is difficult for prosecutors to do. There would also be special scrutiny when guns are involved, regardless of whether they were legal. Displaying a firearm or pointing it at another person is a threatening act that could reasonably lead to death or serious bodily harm, in my opinion. In closing, this writer would contend that walking around in public with a symbol of hate and white supremacy strapped to your shoulder period much less at a Black Lives Matter riot makes Rittenhouse the real initial aggressor in this case and we feel here in the House of Public Discourse that justice was not only not served in this case it was purposely circumvented by a racist judge.

Testimony and video footage shown during the two-week trial revealed that Mr. Rittenhouse was chased into a parking lot, at one point byJoseph Rosenbaum, 36 who was unarmed and behaving erratically. Mr. Rittenhouse turned and shot him at close range, killing Mr. Rosenbaum, who had been living in Kenosha. Mr. Rittenhouse then shot two other people - Anthony Huber and Gaige Grosskreutz - who pursued Mr. Rittenhouse as he fled, testimony showed. Over the course of the trial, prosecutors sought to portray Mr. Rittenhouse, a former resident of Antioch, III., as an instigator who had behaved with criminal recklessness, inserting himself into a volatile scene of demonstrators and then firing his gun with little provocation. It appears that the entire nation, for one reason or another, is focused on the trial brought by the thoroughly woke State of Wisconsin surrounding Kyle Rittenhouse for the deaths of Anthony Huber, Joseph Rosenbaum and the shooting of Gaige Grosskreutz. At the same time, DHS Secretary Mayorkas has stated, "Justice is our priority. That includes securing our border and providing relief to those [migrants] who qualify for it under our laws." In other words, DHS Secretary Mayorkas was telling the Senate committee that Americans should not have a secure border until they also provide justice for migrants. This whole discussion of what "justice" means to the Biden Administration is vitally important for everyone to understand. Is there a different "justice" for those considered oppressed by the Biden Administration as opposed to those of us that they have placed in an “oppressor” category? If so, are there two systems of justice in the United States? The answer to this question is that the only "justice" that is of any concern to the Biden Administration is "social justice." This is Father Jared Cramer from St. John's Episcopal Church in Grand Haven, Michigan, here with today's edition of Christian Mythbusters, a regular segment I offer to counter some common misconceptions about the Christian faith. As I write this week's episode, deliberations have just begun in the trial of Kyle Rittenhouse for homicide in the deaths of Joseph Rosenbaum and Anthony Huber, along with the gunshot injury to Gaige Grosskreutz. Alongside of Rittenhouse's trial, we have been watching the prosecution make its case against Greg McMichael, his son Travis, and their neighbor William “Roddie” Bryan, who chased down Ahmaud Arbery before Travis McMichael allegedly shot him (supposedly) in self-defense. Both of these trials are tremendously polarizing and have resulted in significant pressure on all sides of the political aisle. They involve questions of gun rights, self-defense, freedom of speech, freedom to protest, among a host other questions… not the least of which are the persistent realities of racism in our country. This is all seen in the context of the Black Lives Matter movement, the continued controversies surrounding that movement's condemnation of the continued deaths of people of color in our country. All that political heat can make it hard to see, sometimes. So, I'd like to take a moment, now, before I even know what the results of Rittehouse trial are or what the results of the trial of the men whose actions led to the death of Ahmed Arbery, I'd like to take a moment and talk about the church and the question of “Black Lives Matter.”Because we need to be honest, brutally honest, that one of the reasons our society does not seem to value black lives as much as the lives of white people is because of the ways in which Christianity supported and is complicit in narratives of white supremacy. The transatlantic slave trade was founded on Christianity. A series of popes in the fifteenth century argued for the enslavement of non-Christians as “an instrument for Christian conversion.” Thomas Aquinas drew from Aristotelian understandings of slavery to insist that the slave was the rightful and natural instrument and property of the owner. Christians merged Aquinas's understanding of the “natural slave” with the idea of Ham's curse in the Hebrew Bible, insisting (without any true proof in the text, I might add) that Africans had inherited that curse and that slavery was their natural state.And so it was that Christians insisted slaves should obey their master, that masters were at total freedom to punish—even kill—any slave that resisted. When the Civil War concluded, Christianity was a driving force behind segregation, insisting that this was a biblical principal and that the government must not infringe upon our freedoms… And so one of the founding principles of the Ku Klux Klan and other white supremacist groups after the Civil War was their belief that they were protecting their Christian nation. And it's not just a question of Christian support of racism and slavery, it is also about the hesitance of the broader church to speak out and denounce those views when they occurred.In the book The Color of Compromise, author Jemar Tisby tells the story of what happened after four young girls were killed in the bombing of the 16th Street Baptist Church in Birmingham, Alabama, during the Civil Rights Movement. A white lawyer got up in front of an all-white business club and asked them who was responsible for throwing the bomb. He then answered his own question, saying, “We all did it.” Tisby goes on, noting, “Every time that the white community—especially Christians—failed to confront racism in its everyday, mundane forms, they created a context of compromise that allowed for an extreme act of racial terror like planting dynamite at a church. That's the idea of complicity.”All of this Christian complicity with racism lies uncomfortably under the deaths of black people in our country right now. The church must own that history. The church must repent of that history. The church must do something to make right the history we have helped write.And in the trials currently happening in our country, Christians must demand justice. They must demand justice for a system that lets a cop go free when he shoots a twelve-year old black child who has a toy gun. A system that also seems to suggest that a seventeen-year old white boy with an assault weapon posed no threat.The reason it doesn't feel to many people like Black Lives Matter right now is because Christians have spent centuries saying they don't matter the same. Christians today must stand up and say, enough. Christians today must make good upon the calling of God to resist injustice, to affirm the dignity of every human being. If Christians cannot say Black Lives Matter and repent of our complicity in the sins of racism… then Christians should not be surprised if the rest of the modern world has no interest anymore in our religion. On August 25, 2020, after the police shooting of Jacob Blake in Kenosha, Wisconsin, Kyle Rittenhouse, shot and killed two men and wounded another during confrontations at two locations. He was armed with a Smith & Wesson M&P15 rifle. Rittenhouse, a then 17-year-old from Antioch, Illinois, said he was there to provide medical aid as he was carrying a medkit. At the first location, Rittenhouse was pursued by a group, including a Kenosha resident Joseph Rosenbaum. A gunshot was fired into the air by a third party, and Rosenbaum lunged at Rittenhouse and attempted to take his rifle. Rittenhouse then fired four times at Rosenbaum, who died shortly afterwards. At the second location, Rittenhouse tripped while fleeing and was kicked by a man. Rittenhouse fired twice at the man, but missed. Protesters approached Rittenhouse while he was still on the ground. Then Silver Lake resident Anthony Huber struck Rittenhouse with a skateboard and struggled for control of his rifle. Rittenhouse then fired at Huber once, killing him. West Allis resident Gaige Grosskreutz then approached Rittenhouse while holding a handgun, and Rittenhouse shot him once, severing his right bicep. Now he is 18, and being tried as an adult, facing homicide and several other serious charges. The Kyle Rittenhouse trial begins - with ABC News legal correspondent Royal Oakes. If you run into a riot and start shooting, can you claim self defense? The trial will feature a bevy of video showing Rittenhouse's movements that night, including infrared video filmed from above Kenosha. The heart of the trial is the analysis of Rittenhouse's actions and whether they can be considered "reasonable." Rittenhouse, now 18, fired an AR-15-style weapon eight times in all during the unrest: four shots at an unarmed Joseph Rosenbaum, two shots at an unarmed unknown individual, one shot at an unarmed Anthony Huber and one shot at an armed Gaige Grosskreutz. Rittenhouse is charged with five felonies: first-degree intentional homicide, first-degree reckless homicide, attempted first-degree intentional homicide and two counts of first-degree recklessly endangering safety. He is also charged with misdemeanor possession of a dangerous weapon under the age of 18 and a non-criminal violation of failure to comply with an emergency order. He has pleaded not guilty. Rosenbaum was a registered sex offender who was out on bond for a domestic abuse battery accusation and was caught on video acting aggressively earlier that night. Huber was a felon convicted in a strangulation case who was recently accused of domestic abuse. Grosskreutz was convicted of a crime for use of a firearm while intoxicated and was armed with a handgun when shot.
