Today's daf is dedicated in memory of Shiri Bibas and in honor of the release of Tal Shoham, Omer Shem Tov, Omer Wenkert, and Eliya Cohen who returned to Israel after 505 days, and Avera Mengistu and Hisham Al-Sayed who returned after being held for a decade. Wishing them a refuah shleima and praying for the safe release of the rest of the hostages. The Mishna quoted Rabbi Akiva who said in the name of Rabbi Yehoshua that two people can gather cucumbers - one uses sorcery and will be liable, and the other who makes it look like they are gathered, but they are not really, is exempt. The Gemara brings the story of the death of Rabbi Eliezer ben Hyrcanus to question this, as in the context of that dramatic story, a different incident is recounted where Rabbi Eliezer shows Rabbi Akiva how using magic one can gather cucumbers. Upon his death, the rabbis wanted to see if Rabbi Eliezer ben Hyrkanus changed his mind and if they could repeal the ex-communication they had placed upon him. However, he was still strongly holding onto his position. But since the word "pure" (*tahara*) was on his lips as he died, they took it as a sign that they could repeal the ex-communication. A rebellious son, ben sorer u'moreh, can only be convicted if he has reached puberty and until he has significant hair growth by his genitals. Rav Yehuda in the name of Rav derives this from the verse in the Torah regarding a rebellious son that juxtaposes the words son and man. Rav Chisda learns a different drasha from that verse, that if the father of the child was a minor when the son was born, he cannot become a rebellious son. How can both be derived from the verse? Rabba disagrees with Rav Chisda as he holds that a minor is not capable of fathering a child.

Finishing chapter 7 and beginning chapter 8. First, a story about Rabbi Eliezer ben Hyrcanus and his death, put in context. The backdrop includes the oven of Akhnei and the fact that Rabbi Eliezer was put into cherem/ostracized for his different approach in that case. When Rabbi Eliezer became ill, Rabbi Akiva (and others) went to visit him, apparently in violation of the cherem. Plus how he was received, his teachings of halakhah, and his knowledge of sorcery, with regard to cucumbers (or squash), in particular. Plus, the rush to have Rabbi Eliezer transmit his Torah, despite his personal harshness. Also, chapter 8, with a new mishnah: the ben sorer u-moreh (gluttonous and rebellious child). This status is only applicable under very specific conditions, including age, sex, conduct. But why does the Torah need to exempt the potential minor from culpability? Because this person is always judged "now" for the sake of what greater sins he will be guilty of, down the road. But preventing later sins sounds like it should be anathema to Judaism, and its focus on repentance.

It was night, there were torches, a dispatch of soldiers, swords, groggy disciples and a kiss of betrayal. What a painful moment for Jesus. He knew where this was all going. In the midst of the scene of Jesus being arrested, a disciple grabs a sword and cuts off the ear of the servant of the high priest. Why this? Well, apparently it was a repeat of history: generations before, Antigonus cutting off Hyrcanus' ears to prevent him from serving in the Temple. It seems the disciple's action was no accident; it was a retaliation. In the midst of the commotion Jesus demands a halt to all of this. He is not leading a rebellion, and there is no need for swords and clubs. He knows what he has been called to do, and he is willing to go to the place God has in store for him. He does not blame, condemn or even retaliate. This teaches us something about the heart of Jesus – a heart that is set on the things of God – not on the ideas of human beings. In this teaching, we will dwell on the heart of Jesus revealed in this story. In the midst of betrayal he calls Judas “friend.” In the midst of violence against his enemies, he announces peace and pardon. For Jesus this is the start of the manner in which he will walk to the cross. One defined by love.

Episode Overview The episode begins by tracing the origins of Roman-Jewish relations to a small treaty between the Roman Republic and Jewish Maccabees in 161 BC. This pact would foreshadow future Roman interference in Judea. A request for Roman arbitration in a later Jewish civil war opened the door for conquest under Pompey in 63 BC. Judea lost independence and became a Roman client state under figurehead leaders like the ethnarch Hyrcanus. Eventually, Herod the Great, a ruthless Roman puppet king, rose to power. After his death, Judea came under direct Roman governance. Unrest led Emperor Augustus to install procurators like Pontius Pilate to oversee the territories. Jesus emerged from this matrix of Jewish culture and identity shaped by centuries of foreign domination. The political climate set the stage for the dawn of Christianity. Discussion Questions How might the loss of self-rule in Judea shaped Jewish hopes for a messiah who would liberate them? In what ways did Roman toleration of Jewish customs create space for early Christianity to spread? How did God use the tense relationship between the Roman Empire and Judea to prepare the way for Jesus? John Gill Bible Commentary Matthew 2:1 "Herod the first, called Herod the Ascalonite, was the son of Antipater, a friend of king Hyrcanus and his deputy; him the senate of Rome made king in the room of Hyrcanus his master. This Herod whilst he was a servant of king Hyrcanus (so in the Talmud Herod is said to be a servant of the family of the Asmonaeans) king Hyrcanus saved from death, to which he was sentenced by the sanhedrim of Shammai; that they might not slay him for the murder of one Hezekiah, as is related by Josephus, l. 6. c. 44. and Herod took to him for wife Miriam, the daughter of Alexander the son of Aristobulus, who was the daughter's daughter of king Hyrcanus.'' This writer tacitly owns afterwards that Jesus was born in the days of this king; for he says, that in the days of Hillell and Shammai (who lived in those times) there was one of their disciples, who was called R. Joshua ben Perachiah, and he was, adds he, "the master of the Nazarene", or of Jesus of Nazareth. Herod reigned, as this same author observes, thirty seven years; and according to Dr. Lightfoot's calculation, Christ was born in the thirty fifth year of his reign, and in the thirty first of Augustus Caesar, and in the year of the world three thousand nine hundred and twenty eight.

Rabbi Eliezer ben Hyrcanus would not say anything he did not hear from his rabbi. Did he hear this law from his rabbi? What things did he learn from his rabbi, Rabban Yochanan ben Zakkai, and how? Rabban Yochanan ben Zakkai was the smallest (in stature) of the students of Hillel and yet was great! Yonatan Ben Uziel was the greatest of his students. The dispute between Beit Shamai and Beit Hillel over the matter of the minimum size of a sukkah appears in our mishna. Women, slaves and young ones are exempt from the sukkah. From where is this derived? First, that same word came to include women in the obligation to fast. They conclude that one is really derived from the verse and the other from a halacha l'Moshe b'Sinai. Why are these even necessary to exempt women from a sukkah and obligate on Yom Kippur - after all, a sukkah is a positive mitzva that is time-bound, so women are exempt and Yom Kippur is a negative mitzva of which women are bound by just as men are! The gemara brings answers to these questions. What is the law for minors? From what age/stage is one obligated to sit in a sukkah? A person is supposed to make his sukkah his permanent home and his apartment arai (temporary) for the Sukkot holiday. How does one observe this halacha?

He [Rabbi Johanan] used to list their outstanding virtues: Rabbi Eliezer ben Hyrcanus is a plastered cistern which loses not a drop; Rabbi Joshua ben Hananiah happy is the woman that gave birth to him; Rabbi Yose, the priest, is a pious man; Rabbi Simeon ben Nethaneel is one that fears sin, And Rabbi Eleazar ben Arach is like a spring that [ever] gathers force. He [Rabbi Yohanan] used to say: if all the sages of Israel were on one scale of the balance and Rabbi Eliezer ben Hyrcanus on the other scale, he would outweigh them all. After the death of Antipater, Antigonus became high priest after mutilating the high priest Hyrcanus. Herod had been quickly rising to prominence, marrying into the house of Hasmon, sending his wife into exile, and Herod sought to have the Romans proclaim him leader of the Jews. Rome did declare him King of the Jews, a title never before declared for someone who was not of nobility. To ensure that the Hasmonean dynasty never returned to challenge his position, the remaining heirs to the Hasmonean dynasty suspiciously died. Alexandra, the mother of one of these heirs, sent to Rome to request an inquiry, and Marc Antony requested that Herod defend himself. Herod went to Rome, but left instructions that if Antony killed him, his wife must die as well. His wife discovered this plan and this caused much intrigue and eventually his wife's death when Herod returned alive.Herod built a new temple in Jerusalem and also several temples to Roman gods. It is against this backdrop that the magi arrived in Jerusalem and ask Herod ''where is the king born of the Jews?'' Herod, who was not born king, was outraged at this and sought to eliminate this threat. The Romans came to rule Judea in 63 BC. Leading up to that, the high priests of the Hasmonean Dynasty were the de facto kings in Israel, though their official title was Ethnarch. This dynasty began from the Maccabees, and lasted roughly eighty years. They did not want to be seen as usurping the rightful place of the line of David, since they were dependent on the pious Jews. The line of David was still known through this period, but it had fallen into obscurity. In this sense, the Hasmonean state is a biblical anomaly, lacking any leaders truly chosen by God. These rulers tended to be despots of a sort similar to Oriental and Hellenistic despots. These rulers were also expansionist, reacting to the rising birth rates of the neighboring countries. These circumstances give rise to a large upsurge in Messianic hope. Salome Alexandra instituted a number of changes that pleased the Pharisees, and was fondly remembered by them for this. Her sons, Aristobulus II and Hyrcanus, fought for the high priesthood. At this point, Pompey comes to Israel and seeks an alliance with Hyrcanus, since Israel had sought such an alliance before. Hyrcanus was confirmed as high priest, but the position of king was saved for Rome, with local political authority resting in Hyrcanus' minister, Antipater the Idumean. Antipater made his son Phasael governor of Jerusalem and his other son Herod, who would be called the Great, was made governor of Galilee.
