Many listeners wonder why and when police can request such tests during a routine stop. In this episode, I break down the legal framework surrounding these tests, explaining the standards police must meet to justify their requests. I provide valuable insights into the process. Importantly, I clarify that while police can ask for these tests, you have the right to decline. I dissect these legal principles and answer your burning questions about DUI-related matters. Remember, this is purely informational and not legal advice. Key takeaways:Reasonable Suspicion Requirement: Police need a reasonable suspicion, like the smell of alcohol, to ask you to perform a field sobriety test, but remember, you can decline.MIMS Order: When pulled over, police can order you out of your car for officer safety, thanks to the Pennsylvania vs. Mimms ruling.Legal Standards: Understanding the difference between reasonable suspicion and probable cause can help you better navigate your rights during a traffic stop.Submit your questions to www.lawyertalkpodcast.com.Recorded at Channel 511.Stephen E. I doubt it would surprise you that I watch a fair amount of videos that involve interactions with the police. One question that comes up is when is an officers attempt to search of detain someone reasonable? One of the cases attorneys frequent refer to is Pennsylvania v. Mimms. So I decided it was worth some time reviewing that case.

In just 86 years Maya Angelou lived dozens of lives. Perhaps best known for her seminal autobiography I Know Why The Caged Bird Sings, Maya Angelou is one of the most celebrated literary minds in history, whose poetry and prose has touched generations of readers. But before Caged Bird, Angelou danced and sang on and off Broadway, earned the moniker “Miss Calypso” in the 1950s, called dozens of American cities and African nations home, and even became the first Black woman to work as a cable car conductor in San Francisco. On this episode of Making, host Brandon Pope sits down with Rita Coburn, co-director of the Peabody-Award-winning PBS documentary Maya Angelou: And Still I Rise; Randal Jelks, professor of African and African American studies and American studies at the University of Kansas; and Dr. Maxine Mimms, the founder of the Tacoma Campus of Evergreen State College and a longtime friend of Angelou. “Her main word was courage,” Dr. Mimms said, “The courage to love, the courage to walk, the courage to move.” Making tells the story of a different, iconic figure every episode. Cherokee County Fire and Emergency Services are conducting annual fire hydrant inspections throughout the county, which may cause temporary discoloration of tap water due to sediment being disturbed in the water mains. This does not pose a health risk, and residents are advised to turn on their cold water and run it for a few minutes until the water clears up. If the problem persists for over 10 minutes, residents should contact their water provider for guidance. The fire hydrants are required to have a three-foot clear space around the circumference, and for any questions about fire hydrant access, contact the Cherokee County Fire Marshal's office. The Peace, Love and Recycle community event will take place at the Public Works building on 2525 Ridge Road in Canton from 7 a.m. to noon today. Canton city residents can bring electronics, tires, paint, paper and other difficult-to-recycle materials. Tube televisions can be recycled for $25, and participants are limited to 10 gallons of oil-based and latex paint and eight tires per vehicle. There is no limit to paper shredding. FROM OUR 2020 "DIG THIS" ARCHIVES TO WISH GARNET MIMMS A HAPPY 89th BIRTHDAY!Best known for his original rendition of "Cry Baby," later a major item in Janis Joplin's repertoire, Garnet Mimms' pleading, gospel-derived intensity made him one of the earliest true soul singers. His legacy remains criminally underappreciated. Garnett Mimms was born in Ashland, West Virginia. He was brought up in Philadelphia, and began singing in church as a child. As a teenager, he was a former member of the Philadelphia-based gospel groups, the Evening Stars, the Harmonizing Four and the Norfolk Four. The latter he recorded his first record for in 1953.Garnett served several years in the military, and upon his release, he returned to Philadelphia in 1958 and formed a doo wop quintet called the Gainors. The line-up included Sam Bell, Willie Combo, John Jefferson and Howard Tate. The Gainors recorded singles for several labels over the following three years, including 'Red Top' (later picked up by the Cameo label), Mercury (from 1959-1960), and Tally Ho (in 1961).The group subsequently evolved into Garnet Mimms And The Enchanters, where the singer and Sam Bell were joined by Charles Boyer and Zola Pearnell. They met songwriter / producer Bert Berns, who signed them to United Artists, in 1963, and Bert teamed them up with another songwriter / producer, Jerry Ragovoy.Jerry's work helped create some of R & B's finest moments. The song 'Cry Baby' was an immediate U.S. hit, while 'Baby Don't You Weep' and 'For Your Precious Love' consolidated their arrival. The group split in 1964, when Garnett embarked on a solo career.Although the Enchanters found a new vocalist and continued to record, they were overshadowed by their former leader.Garnett' subsequent releases, 'Look Away', 'It Was Easier To Hurt Her' and 'I'll Take Good Care Of You' (the latter Garnett's last Top 40 hit in 1966), were well received, highlighting the singer's church roots against Ragovoy's musical backdrop.Such excellent records were not always well received, and in 1967, Garnett was sidelined to United Artists' subsidiary Veep.'My Baby' and 'Roll With The Punches' followed, but the singer's precarious artistic standing was confirmed when the latter was only released in Britain.Ragovoy then took Garnett to Verve Records (where he was also producing Howard Tate), but the four singles that appeared, although good, did not do as well as expected. It was not until 1977 that the singer returned to the chart.Credited to Garnet Mimms And The Truckin' Company, 'What It Is' was a minor R & B hit and even reached the UK chart at number 44.The track was produced by Randy Muller of Brass Construction fame.Garnett Mimms is now a born-again Christian and has not recorded for many years.

Education is top of mind for Jeffrey J Mimms, Jr., Mayor of Dayton, OH, and Dr. David Lawrence, Education Advisor for Dayton, OH. Mimms, a longtime educator himself with over forty years in education, is a pioneer in establishing equitable funding for public schools across Ohio. DisruptED's Ron Stefanski and Ceasar Mickens spoke to Mimms and Lawrence about an extraordinary concept they're championing: creating a city of learners in Dayton. Mimms said the challenge in education today, especially in underserved areas, is getting kids engaged and excited to come to school and learn every day. Mimms listed the four A's essential for education success: attendance, attitude, activities, and achievement. When schools provide the programs that allow students to hit the four A's, those lessons carry through beyond school and into life. The City of Learners concept design will make education equitable and expansive throughout Dayton and allow children to achieve their goals.“The City of Learners rests on five core principles,” Lawrence said. “Every child must attend a high-quality K-12 school. Every child must have expanded access to preschool for all children. We must grow our partnerships with businesses, recruit mentors for young children, and increase the number of high-quality summer and after-school programs.” And Lawrence knows the power of mentorship because Mimms served as his mentor, and the lessons he imparted were invaluable. Mimms has ambitious goals for education, but they are all connected with the mission to build a better, more sustainable community. “Those communities experiencing a high quality of life have three major pillars,” Mimms said. “One is high-quality education. Two is safety. We are involved in a very strong police reform effort that we started about twelve months ago. The other thing that is a key issue is recreation. We are in the process of how we can improve the quality of recreation.” Local businesses that recognize the benefits when everyone works together for the common good bolster these efforts.

Examples…. Proximity to traffic. Bad weather; Poor visibility. Suspicious gestures by passenger(s) (Never say furtive movements, explain what you saw in detail). Ability to control the movements of several occupants. Ability to control the actions of bystanders. Suspicion of Criminal Activity. NOT ONLY LIMITED TO THE ABOVE LISTED REASONS. SMITH, ET AL :: 1997 :: New Jersey Superior Court, Appellate Division - Published Opinions Decisions :: New Jersey Case Law :: New Jersey Law :: US Law :: Justia Police may not routinely ask passengers out of a vehicle that has been stopped for a traffic violation. HOWEVER, NJ law states passengers can be asked out of the vehicle, when an officer is able to point to some specific fact(s) that would warrant a heightened caution. This can be anything to include R.A.S. (State v. Brian L. Smith 1994). This does not have to include a danger factor. https://law.justia.com/cases/new-jersey/supreme-court/2017/a-9-15.html?fbclid=IwAR26bOyVmaAauWtJ54XX_Xva9JUsVpW06fTymmW7T5BWhbkCh-IRPf2mk8A (https://law.justia.com/.../supreme-court/2017/a-9-15.html)
In this archive episode, Dennis explains some case laws and tactics to apply with passengers in vehicles. Recorded on 03/24/2018. State of NJ v. Brian L Smith 1994 https://law.justia.com/cases/new-jersey/supreme-court/1994/a-28-93-opn.html?fbclid=IwAR3SIJrMktFLomB-0wZbeMlSfOKjQ7dGkagvy-QG0Vc1Vg92kn4WPtiRmDM (https://law.justia.com/.../supreme.../1994/a-28-93-opn.html) HELD: The State Trooper's order to the passenger, Geraldine Muhammad, to step out of the car stopped for a routine traffic violation, and the officer's pat-down of that passenger were reasonable, and hence, permissible under the Fourth Amendment of the Federal Constitution and Article I, Paragraph 7 of the New Jersey Constitution. Therefore, the trial court properly denied the motion to suppress the cocaine and drug paraphernalia found incident to arrest. 1. In determining whether Trooper Gacina's order to the passenger, Muhammad, to get out of the car was reasonable, the Court is guided by the seminal case, Pennsylvania v. Mimms. In Mimms, the U.S. Supreme Court balanced the driver's interest in privacy against the State's interest in protecting its police officers. The Court concluded that the State's interest in the safety of its officers far outweighed the driver's interest in not being made routinely to step out of a car after it has been stopped for a traffic violation. The Court held that the order to the driver to step out of the vehicle was reasonable and thus permissible under the Fourth Amendment. (pp. 8-10) 2. Mimms, as applied to drivers, satisfies the New Jersey Constitution. Here, the Court decides whether and under what conditions Mimms should be extended to passengers. The touchstone of the Court's analysis is the reasonableness, under all circumstances, of the particular governmental invasion of a citizen's personal security. (pp. 10-16) 3. Although the State's interest in safety remains the same whether the driver or the passenger is involved, requiring a passenger to step from the vehicle in the course of a routine traffic stop represents a greater intrusion on the passenger's liberty than it does on a driver's liberty. In applying the Mimms balancing test to passengers, the Court concludes that the Mimms per se rule should not be applied automatically to passengers. There will be instances, however, in which police officers, with less than a reasonable suspicion that a passenger is engaged in criminal activity or is armed or dangerous, may reasonably order a passenger to step out of the car. (pp. 16-20) 4. To support an order to a passenger to step out of a vehicle stopped for a traffic violation, the officer must point to some fact or facts in the totality of the circumstances that would create in a police officer a heightened awareness of danger that would warrant an objectively reasonable officer in securing the scene in a more effective manner by ordering the passenger to step out of the car. To justify a pat-down of an occupant who has stepped out of a vehicle, the officer must find specific articulable facts to demonstrate that a reasonably prudent person under the circumstances would be warranted in the belief that his or her safety or that of others was in danger. (pp. 20-22) 5. In this case, Trooper Gacina's order was objectively reasonable. The unusual movements of the passengers in the car, the early morning hour, and a largely deserted Turnpike are facts that warrant proceeding with extra caution in handling the occupants of the vehicle. Moreover, the pat-down of Muhammad was valid. The premature announcement of Officer's Gacina's intent to perform a pat-down does not debilitate the officer so that he will not later be able to perform a pat-down should sufficient facts come to light. Muhammad's actions after she stepped from the vehicle, when considered in the totality of the circumstances, were sufficient to support a reasonable, articulable suspicion that she was armed and dangerous. (pp. 22-26) Also see State v...
In this archive episode, Dennis talks about ordering passengers out of vehicles and the meaning of heightened caution. Recorded on 08/17/2017. State v Bacome 2017 http://law.justia.com/cases/new-jersey/supreme-court/2017/a-9-15.html?fbclid=IwAR2Zpok_sEctBhLVUZX3smxpBP3RjU6APUlt8XZtxnRNAX5pYZhN9EPvgfc (http://law.justia.com/.../supreme-court/2017/a-9-15.html) In April 2011, detectives were engaged in an undercover drug patrol in Woodbridge when they observed defendant Taiwan Bacome driving a blue Ford Bronco. S.R., the owner of the Bronco, was riding in the front passenger seat. Having previously encountered both men, detectives knew the men used and dealt narcotics. The police department had also received complaints from defendant's neighbors of a lot of traffic coming and going from [his] apartment, which, in the detectives' experience, is often indicative of narcotics activity. In their unmarked vehicle, the detectives followed the Bronco, losing sight of it shortly after arriving in an area of Newark known for crime and drug trafficking. In an attempt to pick up the Bronco's trail, the detectives drove back to Woodbridge, presuming that defendant and S.R. would return there with newly purchased drugs. About an hour later, the detectives observed the Bronco re-enter Woodbridge. The detectives resumed surveillance and, after they both observed S.R. in the passenger seat not wearing his seatbelt, they conducted a traffic stop. In this appeal, the New Jersey Supreme Court clarified the circumstances under which police officers may require a passenger in an automobile to exit a vehicle after a valid stop. The first detective reported that he saw defendant lean forward as if he were reaching under his seat and immediately ordered defendant to exit the vehicle. The second detective then ordered S.R. out of the passenger's seat. Both occupants complied. Defendant specifically challenged S.R.'s removal from the vehicle. The trial court found that defendant's reaching under the seat created the heightened caution that warranted S.R.'s removal. The Appellate Division reversed, finding the detectives failed to prove "heightened caution." The Supreme Court reversed, finding that while the heightened caution standard remained the proper test for determining the appropriateness of ordering a passenger from a car, defendant's movements inside the stopped car was an objectively reasonable basis to justify removal of the passenger. State v Brian L. Smith 1994 Although the per se rule under Mimms permits an officer to order the driver out of a vehicle incident to a lawful stop for a traffic violation, we decline to extend that per se rule to passengers. Instead, we determine that an officer must be able to point to specific and articulable facts that would warrant heightened caution to justify ordering the occupants to step out of a vehicle detained for a traffic violation.http://law.justia.com/cases/new-jersey/supreme-court/1994/a-28-93-opn.html?fbclid=IwAR29npF5cXbcyx62Hj_z1Tq_WIqj0_5rQO0d8PK3Og9Tj1W1SOvZI5C7TsU (http://law.justia.com/.../supreme.../1994/a-28-93-opn.html)

Growing up in the hearing world, Brandy Mimms didn’t realize for years that there was an entire other community she could participate in. “I grew up mostly in the hearing world,” Brandy explained. “So we have the deaf world and we have the hearing world. I grew up in the hearing world because my family wanted me to be hearing so badly. I appreciate them, thank you, but they never really exposed me to the deaf world as a kid.” Still, she followed her interests, which included music. To listen, she simply has to feel it. “I have to feel the vibration,” she explained. “I can hear it a little bit in my hearing aids, yes, and I’m not saying it has to be rocking loud, but it has to be loud enough for me to really feel it where I can feel, okay, this is hard or this is soft. I need to feel that. If I don’t feel it, I feel like, ah I’m lost. I don’t know where I’m going. I feel very crazy. That’s how I listen to music -- feeling the beat. And I have bluetooth hearing aids, so music is always in my ears when I’m not talking to people. I’m always listening to music. The vibration is right there. I have a love for music and music helps me with my dancing and helps me to express myself.” Find more about Brandy: Instagram - https://www.instagram.com/uniquethedeafdancer/ Unique the Deaf Dance Facebook - https://www.facebook.com/Unique-The-Deaf-Dancer-304624890492835/?ref=br_rs Listen With Your Eyes Dance Troupe Facebook - https://www.facebook.com/ListenWithYourEyesDanceTroupe/ Personal Facebook - https://www.facebook.com/brandy.mimms.35 Website - http://www.brandymimms.com/ Sustaining Craft is a passion project of Hew & Weld Writing. Self-help literature is a huge industry. It doesn't do anyone any good, except the authors. Actually, self-books make you more anxious. It's time to wean yourself off them says South Mimms U.
The Keysmash is when you're lost for words - of anger, of love, or frustration - and you smash the keys to get your feelings across. Strangely, that can lead to romance. It does for two of our South Mimms academics. And all during the recording of this podcast.
People love a good conspiracy theory, but when one of our academics fakes one to see just how easy it is for it to spread he does realise that he's actually... part of a wider conspiracy! And it's all about ravens at the Tower of London too!
Ground-breaking research into the roots of plant sentience and emotions is beging carried out at South Mimms U, but it's also uncovered a strange new sexual cult.
Bird watching is sexy again. The Twitchers are out in force. Listen to strange adventures from the hide at the edge of reason.
How many times have you heard the phrase, 'That's not art that's... nothing'? Or 'I could do that, it's nothing special!'? We debate the idea that, actually, 'nothing' can be art, and art can be 'nothing.' We've even put on exhibition (of nothing) to prove it.
Obfuscation seems to be all around us. Nothing is straight-forward, nothing is clear, everything is being obfuscated. It's done deliberately and most of it comes from our Department of Obfuscation here at South Mimms.
If we're being led by donkeys why not ditch the humans and let Artificial Intelligence have a go?! As an experiement we created an AI candidate which won an election here in South Mimms, but power seems to have gone to its head!
Steve Jobs is revered by people of all faiths and none, so why not make him a saint - an actual (dead) deity?! Our religious studies department is trying to do just that.
We need a new kind of porn, so says our Entrepreneurship lecturer as she explains why there's a gap in the crowded porn market for frills and lace and glimpses of bare ankles! Oh my! Intriguing.
‘I’d gone from a club where I didn’t know if I had a job week to week to a club at the top end of the championship’ In this episode, Rob is talking all things football with Bobby Mimms. Currently, they are both working within the coaching team who are in Bangladesh working with the next generation of football players who will forge a path in the Asian football arena. They take the opportunity of a get together for coffee to reflect on Bobby’s professional football career and the changing face of football in the UK along with an in-depth conversation about the work that’s involved in moving from playing professional football to a coaching career. Bobby was a professional player during some of the most interesting years in football to date listen in to hear what it was like on the inside. KEY TAKEAWAYS I played at a time and in clubs where playing a simple game with good players was what made the difference. I was part of a focused, sustained campaign with substance behind it aiming to reach the final and be on top. As a goalkeeper, I was used to the view of the pitch from end to end, as an outfield coach you view the pitch from side to side. At 38 I was beginning to find the training harder which was ironic because I was the one planning and delivering the training. Being a player and then being a coach is moving from one career to pursue a different career you have to be prepared to put in the work to train and gain experience in the new role. I got an introduction to Wolves and was offered the post I then stayed for 8 years. There is a historical precedent in the profession for dismissing goalkeepers early on but this is not productive they need time to develop in the role. A young goalkeeper is not the finished article as the coach it’s your job to improve on what they have and are to create the finished article. If you can add something and make them a better goalkeeper then you have done your job. You have to have a conviction as a coach and believe in what you have seen in someone. Everyone needs someone to believe in them at some point in their lives. When someone’s confidence has been knocked it’s about building it back up. When you work with a senior it’s about gaining their trust to be able to work with them successfully. It’s challenging working in different countries but international football was something I wanted to work in. Not getting to play as international player had left something unfulfilled for me. When you come to somewhere new there are challenges but as a coach, you get what you were getting 20 years ago in the UK – respect as the coach and players who want to learn. In Bangladesh football is a way out so the young players listen and want to do well. You have to have the right mentality The football looks after itself but there are lots of things around the football you want to compare with back home but it isn’t the same they are not working at the same level. You have to have the mentality of being able to understand what you can and can’t affect. More than anything else here you have a set of willing players. I don’t mind them making mistakes, if they didn’t make mistakes I wouldn’t have a job. This is a chance to move the game forward within the Asian arena. BEST MOMENTS ‘He couldn’t dive, catch or kick when he started but through hard work and perseverance he had a good career as a goalkeeper’ ‘It was adversity that brought the group together’ ‘We got promoted and challenged for the premier league training on a parks pitch, you had to clear up the dog mess and stop to let traffic to the crematorium through during training’ ‘I was told early on that they throw goalkeepers away too early on but it still happens today’ VALUABLE RESOURCES Leader Manager Coach Podcast ABOUT THE HOST Rob Ryles is a UEFA A licensed coach with a League Managers Association qualification and a science and medicine background. The re-emergence of vinyl records is more than a passing phase or a niche interest for nerdy music buffs or hipsters. It's a movement to reclaim the essence of life - human life is analogue! Digital is cold empiricism. The basis, perhaps, of the neoliberal project to turn us all into drones. Our head of music. Dave Dave David believes we need to turn on, tune in, and do more than move the needle to the first track... we have to live like vinyl. In the end, life is a pressing that we only play once, so make the most of it!
We're all fascinated by Serial Killers - you can't turn on the TV or browse through a bookstore or download a true crime podcast without stumbling across one (or two). That's why South Mimms U created its Serial Killer Studies course. It's one of a kind. And its lecturer, Mark Scitkovsky, is committed to deepening our understanding of why we're so obsessed with serial killers and what makes the real ones tick. It's all a little unsettling, especially as Mark himself seems... well... a bit unhinged. Mark illuminates the writing of Serial Killer specialist, Peter Vronsky, in this first look at the curriculum (Killiculum might be a better word!)
Modern digital life seems to be an endless flow of tweets, posts, texts, call, searches. and the a constant flurry of annoying alerts. Social media dominates our lives and we're all expected to like or re-tweet or reply to everything and anything which happens to appear on our constantly glowing screens. It's causing us anxiety from FOMO to trolling. Perhaps we need to stop and, for a while, just say nothing. Tweet, text, post... nothing. Just be ourselves, in the moment, in nature. That's what Frances Malone, Reader in Listening and Non-Dialogue studies at South Mimms U, believes and she takes us into the countryside to explain. It's about mindfulness through silence. It's about fighting back against the social media giants who dominate our lives. It's about real dialogue with real people. Protect your personal data by NOT disclosing your personal data by NOT saying anything. It's a human right!
The wrong emoji can get you into trouble - and into court! That's what resident (and highly paid) South Mimm's U lawyer. Terence Prole, says. He cites cases and research into the rising importance of emoji's in litigation. What do they mean? How can you interpret them in a legal situation? Are emoji's an entirely new language, or just a different way for the same old emotions, lies, and prejudices to be expressed pictographically? Terence is also keen to create his own emoji - and he explains why and what it is.
Will Artificial Intelligence or AI take over every aspect of our lives? Will AI take our jobs? At South Mimms University we hope not. But our Computer Studies department has created an AI Lecturer. That's making our human lecturers nervous. Can AI take over the role of the human teacher in Education? Surely not! We asked one of our flesh and blood lecturers to debate the subject and the perils and dangers of AI with this prototype AI lecturer here at South Mimms U. It's a funny, entertaining and revealing discussion that shed humorous light on the subject of the future of work, the future of human intelligence and how digital technology might change the way we are all educated in schools, colleges, and universities, as well as all instituions of higher education.
Forget the 'Tiger Mom' be an opossum or a sloth. That's the message from Head of Health and Social Care at South Mimms U, Ginger Rice. She's just written a book which debunks the active, helicopter parent myths that are making our kids and, more importantly, most parents stressed and careworn. We're all rushing around trying to do everything we can to make our kids happy and successful, and none of it matters. The kids will be alright on their own. In fact, they'll be happier and more successful for a little bit of neglect. Not too much, but just enough. The Tiger Mom trope is one which underpins the neoliberal obsession with numbers and money. It's not parenting - it’s management. Transform your family life by lying on the sofa and letting you kids explore the world for themselves. Within reason of course. Ginger's recipe is set to take parenting theory by storm.
The world of politics is in turmoil. Populists are on the rise everywhere. With every Tweet Donald J. Trump propels that trend forward. But is it so bad? Why are many of the world’s commentators experiencing such high levels of anxiety? There’s another way to look at this situation. It might actually be good for us – philosophically. What if Trump is the best thing to happen to the world? Why? Because precisely because he is absurd. That’s what the head of Philosophy at South Mimms U believes. Dr. Leonard Box has started a group called Absurdist’s for Trump to help finance he campaigns. He links it to Albert Camus and his idea of futility and the existential crisis which we all feel from time to time. His argument is persuasive from a philosophical point of view, if not in terms of politics.
Google makes you feel unoriginal. It's a great search engine sure, but it's too good. When you want to know something, it finds it for you in a millisecond, but when you've thought up what you believe is a great idea, it takes that same millisecond to show you that someone else - perhaps millions of other people - have thought of it long before you did. It makes you feel bad. You get depressed, demotivated, you lose the will to think creatively anymore. At South Mimms U we think that's bad for our wellbeing and our mental health. We reveal research that proves the point. It's about reclaiming our humanity from all-seeing-digital. Google isn't the enemy, our knee-jerk need to search is.
What value are CEO's? They get paid a lot but do they deliver value for money? At South Mimms U we've uncovered experiments which show that you might as well give a baboon an expense account and a big corner office to play in. It's get your stock price rising and your employees will be happier as the arbitrary, self-serving orders from the boardroom dry up. South Mimms U's professor of Corporate Development has some challenging views and advice for corporate c-suite players. You will never look at organizational development in the same way again. Your executive renumeration budget will shrink and all you'll need to do is keep up a steady supply of bananas. It's a radical new way to do corporate governance. The boardroom will never look or smell the same again.
It's a bold claim but striving for excellence is a dead end. Not only philosophically but biologically. In fact, evolution isn't about the 'survival of the fittest' it's about the triumph of the 'good enough'. That's what the head of Mediocrity Studies at South Mimms U believes. She uses the thesis in the new book by Daniel S. Milo, Good Enough, to argue that we'd all be happier if we accepted mediocrity - being somewhere in the middle, not too good and not too bad and definitely not a genius - and got on with our lives instead of worrying about being perfect or trying to optimize everything we do and everything we own. It's a new psychological approach based on research, which enables mindfulness as well as a Zen-like calm in the face of rampant consumerism and the sterile pursuit of optimization. It's true in our personal lives and in business too. Having some slack to fall back on - redundancy - is the way species survive in nature. Humans are going against the grain when they pursue excellence. So, kick back, relax, and enjoy the easy middle!
Writing was not San Antonio teacher Emily Mims’ first love-in fact, she wrote her firstnovel on a dare. “I had just finished a romance novel and it was so awful I pitched it across the floor and said I could do better. My husband Charles promptly dared me to do so.” She did and although that book didn’t sell, she sold her second book and seventeen more to Candlelight Ecstasy Romances under the name ‘Emily Elliott’. To date, she has over 30 books in print with her latest, Wade's Dangerous Debut, the 3rd book of her Durango Street Theater series out now. You can find Emily at her website, Facebook and Twitter.

As we move into 2019, how do we transition from who we were in 2018 to who we want to be this time next year? What things have we done this year that we will not do, and what things have we left undone in 2018 that we want to do in 2019?
Maxine Mimms was born on March 4, 1928, in Newport News, Virginia, to Isabella DeBerry Buie and Benson Ebenezer Buie. Influenced by her grandparents' love for Marcus Garvey and educational lectures by Howard Thurman and other black leaders at nearby Hampton University, Mimms attended Booker T. Washington School and graduated from Huntington High School with highest honors in 1946. She earned her B.A. degree from Virginia Union University in 1950. In the early 1950s, Mimms served as a social worker in Detroit, Michigan. There, she was married and would eventually earn her Ph.D. in educational administration from Union Graduate School. Accompanying her husband to Seattle, Washington, in 1953, Mimms taught at Leschi Elementary School, where Jimi Hendrix was a student. In 1961, Mimms taught in Washington's Kirkland Public Schools until working for the Seattle Public School Administration in 1964. In 1969, Mimms served as the assistant to the director of the Women's Bureau in the United States Department of Labor. In 1972, Mimms returned to the education field, working as a faculty member at Evergreen State College. At Evergreen State College, Mimms focused on developing an educational program that would serve place-bound working adult students. Her focus on serving the educational needs of urban, African American adult learners combined with an interest in teaching inner-city adults, led to the founding principles of the Tacoma Campus. Mimms eventually became the first Director of the Tacoma Campus, where she used her position to help satisfy the African American community's demand for adult education programs. In our season Finale, Dr. Mimms talks about her live, love, work, and perspective on freedom at the age of 89 years young.
