You might remember him from his previous appearance where both he and his business partner Tim discussed the (then) impending changes to the Dungeons & Dragons license agreement (the Open Game License of OGL) - here's a link to that episode.But before any of that, it was important to have Rob talk about Gold Mountain Games in his own words:So, Gold Mountain Games: we are a small tabletop RPG production studio. And one of the things that's changed since last time we spoke is that we are now a tabletop production company rather than a [D&D] fifth edition production company, which is quite... I think that lots of people have done that because of what happened.But yeah, so we have our own setting, as you've mentioned, the Salt Reach Isles. We've had a successful Kickstarter for a Zine... And that focuses on one of the cities that we've written. It's got some species in it, it's got some monsters, some spells, and we are currently editing the second magazine for that. So that's going to be coming to Kickstarter in a couple of months.We've got some streams being recorded, so we've got one in our setting. We're about to start Baldur's Gate: Descent into Avernus, partly because Baldur's Gate 3 is coming out, which is very exciting. I'm desperately stopping myself starting another playthrough before they release it fully. And that's also interesting because we've got two complete noobs playing it. So they know nothing about D&D at all....And then the other thing we've got going on at the moment, which I'm really excited about, is Dark Legacies is an amazing franchise written by Chris McCauley and Claudia Christian from Babylon 5 fame. And they've got two comics out of four out so far. There's going to be a miniatures game, there's going to be, apparently an animated TV series. There's a card game.And we've just signed a contract with them to publish their RPG, which is like Dark Legacy's Corporation Wars, it's called. I actually got some of the content yesterday and had a read through it and it's really good. It's a mixture of that kind of the Cyberpunk that you know and love with a bit of that really Dark Judge Dredd style in it. It's got bits of the Expanse in there as well. It's really interesting and I'm really excited that we're going to be publishing that... We'll be publishing the main book and then we'll also be creating more content for it. We're going to have a live stream of it as well. Which reminded Rob of his first video game memory:I was in Great Ormond Street Hospital when I was six or seven. And in there they had, like, a play area on the children's ward, and they had a computer in there and they had this text based game where you were walking through the woods and you had to find the witch's hut and avoid getting killed by the witch. And that was all.I'd completely forgotten it until you started talking about that. But yet that's probably my earliest memory of a computer game is exactly that. Codega explained that while the original OGL granted a "perpetual, worldwide, non-exclusive license" it also included language around authorized versions of the license – "according to attorneys consulted for this article, the new language may indicate that Wizards of the Coast is rendering any future use of the original OGL void, and asserting that if anyone wants to continue to use Open Game Content of any kind, they will need to abide by the terms of the updated OGL, which is a far more restrictive agreement than the original OGL". The document also states that the intention of the OGL was not "to fund major competitors and it wasn't intended to allow people to make D&D apps, videos, or anything other than printed (or printable) materials for use while gaming". In a statement to EN World, Dancey – former VP of Wizards of the Coast and the architect of OGL1.0 – said, "my public opinion is that Hasbro does not have the power to deauthorize a version of the OGL. If that had been a power that we wanted to reserve for Hasbro, we would have enumerated it in the license. I am on record numerous places in email and blogs and interviews saying that the license could never be revoked". Following an apology issued by Wizards of the Coast, the company released a new draft (titled OGL 1.2) for public comment on January 19. It would put some of the Dungeon & Dragons mechanics under a Creative Commons license, while other material would be covered by OGL 1.2. Unlike the leaked OGL 1.1, the proposed OGL 1.2 contains "no royalty payment, no financial reporting, no license-back, no registration, no distinction between commercial and non-commercial". The proposed OGL 1.2 does de-authorize the OGL1.0a; it would also be "irrevocable, although there's still a severability clause should a part of the license is held to be unenforceable or invalid". Along with the proposed OGL 1.2, Wizards released a separate virtual tabletop (VTT) policy. On January 27, 2023, Wizards of the Coast announced that following feedback during the open comment for OGL1.2 they had decided to release the System Reference Document 5.1 (SRD 5.1) under an irrevocable creative commons license (CC-BY-4.0) effect immediately and would no longer pursue deauthorizing the OGL1.0a. Are you currently looking for an alternative the the D&D roleplaying gaming? But still committed to medieval-style fantasy gaming? Dan & Paul review the current top retroclones on the market -- and what what the state of affairs going forward may be if the Open Game License is thrown into disarray! Some D&D fans prefer earlier editions, and new games address the perceived inability of newer editions to preserve the tone of classic D&D while fixing some of the perceived rules issues of older versions. Castles & Crusades is one example, using the unified d20 mechanic from 3rd edition while dropping what the developers perceived as complications (including feats, skills, and prestige classes). Role-playing game publisher Matthew Finch was involved in the development of Castles & Crusades, serving as editor of the Player's Handbook, and was the initial author of OSRIC, which was afterward taken up by Stuart Marshall and released to the public in 2006 as a retro-clone of the first edition of Advanced Dungeons & Dragons (1977–1989). The release prompted another game designer, Daniel Proctor, to write and release Labyrinth Lord in 2007, a more complete retro-clone of the 1981 version of the Dungeons & Dragons Basic Set and its accompanying Expert Set. The following year, Finch announced the release of Swords & Wizardry, a retro-clone of the original Dungeons & Dragons game. Many variants have appeared since the original release of OSRIC, as well as restatements of other editions of D&D and other adventure role-playing games. So for folks out there, what I do is the boring corporate stuff, but it's also very necessary stuff for when we get to the point of getting the products out there, really letting them shine.- TimWhat's The Saltreach Isles Isles All About?Discussion turned to that of their new campaign (due out soon) called "The Saltreach Isles", and it's amazing just how much world-building the team at Gold Mountain Games has put into this campaign:The Saltreach Isles is a massive archipelago world. We've got 24 islands ranging from kind of big central, kind of multiple kind of species and empires on them. We've got tiny little islands that have a one group may occupy more than one of them.It came about really from there isn't really a setting for D&D - which is what it was written for - there isn't one that kind of takes in the scope and the differences that you get in kind of island nations and archipelagos. And I think it gave us this really interesting mechanism we could use with kind of over time, the islands breaking up from a - I forget the word now - a Pangaea, one big continent. So a lot of the world is tied into kind of the evolution of the planet as a whole.We've got Gods that aren't really Gods. We've got real kind of unique takes on a lot of the species that people would be used to from DnD. And we've also added orcs, trolls and goblins because I love me a green skin. I think they're all great. My very first Warhammer were orcs back when I was like 12 or 13 and I've just loved them ever since.But one of the things I really wanted to do is I wanted to bring them kind of into the modern age. I wanted to get rid of this idea that they are unintelligent roots who kill and maim for fun. That had its place. I think the Middle earth needed its bad guys and the orcs were amazing. However, I wanted to do something more interesting with them.- RobWhilst the game uses the typical creatures and species you might find in most DnD fantasy campaigns, the team have spent the time to really think about why the creatures should exist:And for me, I really wanted to do everything I could to make certain that they felt like there was a reason for them being in this world other than like, hey, I made a monster throw it against your players. Every creature I wrote has a reason for being there.- TimAnd Rob went on to talk about how they are creating deep culture and lore around the histories of the different species, and the factions within them. The team behind the game have also thought very clearly about diversity and inclusion in creating this campaign...one of the other things we've tried to do, and I think we've been very successful with it, is we've tried to be very open and accepting and inclusive with our writing.We have very many kind of NPCs named characters, some of the Gods as well. They're male, female, and they/them. Inclusivity is really important to us as a company, right? Whether that's because of life choices, whether that's because of religion, whether that's because of disability; whatever it is, I think it's really important that everyone gets the chance to play who they want to be in a game.So that's kind of that's influenced a lot of our decision making through it, especially because we're not writing a kind of Eurocentric or Western centric setting, we've kind of made sure that we've talked to people from cultures similar to the one in the Saltreach Isles. The tabletop RPG community has been turned upside down recently (as of Jan 2023) ever since Dungeons & Dragons' owner Wizards of the Coast (and their parent company, Hasbro) were caught flat-footed when a new version of the company's previously well-regarded Open Game License was leaked to the community. Since then, it has been a war between Hasbro/WotC and the community (players/GMs/third-party publishers), as the big company tries to achieve its bottom-line goals, and the community tries to hold on to a well-fostered ecosystem that has delivered D&D record numbers in recent years while also creating a small-but-strong industry for third-party content creators. Word has leaked that WOTC aims to terminate the OGL license used for 3rd-party D&D-compatible products for the last 20+ over years. Can they do it? Are all existing 3rd-party products about to be made illegal? What can it mean for the hobby and industry going forward? In August 2022, Wizards of the Coast launched a public playtest of the next version of Dungeons & Dragons under the One D&D initiative. In November 2022, there was reported speculation that the OGL would be discontinued for this new iteration of Dungeons & Dragons based on unconfirmed leaks. In response to the speculation, Wizards of the Coast stated in November 2022: "We will continue to support the thousands of creators making third-party D&D content with the release of One D&D in 2024. While it is certain our Open Game License (OGL) will continue to evolve, just as it has since its inception, we're too early in the development of One D&D to give more specifics on the OGL or System Reference Document (SRD) at this time". Following concerns raised by third-party Dungeons & Dragons creators on the potential changes to the OGL, in December 2022, Wizards of the Coast released additional details on the upcoming OGL 1.1 which will go into effect in 2023. This new license will clarify that it only applies to "printed media or static electronic files (like epubs and PDFs)" and "only covers material created for use in or as TTRPGs"; OGL 1.1 will not cover other content such as video games or virtual tabletops (VTTs). Content creators using OGL 1.1 will be required "to put an official OGL badge on their products". Revenue related to OGL content must be reported to Wizards of the Coast if that revenue exceeds $50,000 annually; creators who make at least $750,000 in income annually will be required to pay a royalty starting in 2024. Anthony fills us in on the history of the League, the background of Foundry, and the open source module that was created. He also tells us about a really cool game he made, how he found it easier to make friends through the league, more about the Open Game License, and advice on how you can get started in this community. You've probably heard of "tabletop Role Playing Games" (or, tabletop RPGs) before, but what are they? In this episode, Bob Tarantino, an entertainment lawyer at Dentons Canada LLP in Toronto and a PhD candidate at Osgoode Hall Law School, discusses his dissertation, "If You Love Something, Set It Free: Open Content Copyright Licensing and Creative Cultural Expression." Tarantino's dissertation uses a study of the Dungeons & Dragons "open game license" to illustrate and investigate the use of open content licensing in practice. He begins by describing the prevailing consequentialist and deontological theories of copyright, as well as the "communicative" theory of copyright, and how it differs from the prevailing theories in prioritizing dialogue over control. He also explains the origin and purpose of the open content movement. He reflect on the creation and evolution of the Dungeons & Dragons role-playing game. And he describes his qualitative study of participants in the commercial market for Dungeons & Dragons products and their subjective assessments of the open game license.
