Colonel Lawrence Wilkerson (retired) joins us once again to give his unvarnished view of the now yearlong ethnic cleansing of Gaza, an assault that has now extended into Lebanon, Syria, and Iran. Plus, our resident constitutional expert, Bruce Fein stops by to give us a quick take on how U.S. material support of the Israeli aggression in Lebanon, an ally of ours, is a clear violation of The Neutrality Act.Lawrence Wilkerson is a retired U.S. Army colonel. Over his 31 years of service, Colonel Wilkerson served as Secretary of State Colin Powell's Chief of Staff from 2002 to 2005, and Special Assistant to General Powell when he was Chairman of the Joint Chiefs of Staff from 1989 to 1993. Colonel Wilkerson also served as Deputy Director and Director of the U.S. Marine Corps War College at Quantico, Virginia, and for fifteen years he was the Distinguished Visiting Professor of Government and Public Policy at the College of William and Mary. He is currently a Senior Fellow at the Eisenhower Media Network, senior advisor to the Quincy Institute for Responsible Statecraft, and co-founder of the All-Volunteer Force Forum. The Jewish state in the Levant is finished. Now, if it wants to be a liberal democracy— if it wants to become a real democracy, it could possibly remain. But this Jewish state, especially in its current manifestation, which is the ultimate manifestation, has ended. It's through. The rest of the world, if nothing else, will terminate it just as it did the South African apartheid state. And it will happen—and it will happen despite the Empire's (The U.S.) protestations to the contrary. In fact, I predict ultimately when the Empire smells the tea leaves, it will probably join the crowd and tell them they have no choice but to be a liberal democracy—to invite what that means, which is ultimately a Palestinian Arab majority, and to even change their name to Israel-Palestine or Palestine-Israel or whatever. Lawrence WilkersonNetanyahu talks about Joshua who moved on after Moses had given him instructions, and after the leadership had sort of fallen apart, and Joshua takes over. And they go in, and under God's instructions they are to kill everything in sight— leave no human being alive. And that's Netanyahu. Netanyahu thinks he's a latter-day Joshua, and that's what they're doing. They brought a thousand years of history's most rude, most bloodthirsty, most unbelievable procedures in waging war against another state or another people back into vogue again. And we're supporting it.Col. Lawrence WilkersonBruce Fein is a Constitutional scholar and an expert on international law.  Mr. Fein was Associate Deputy Attorney General under Ronald Reagan and he is the author of Constitutional Peril: The Life and Death Struggle for Our Constitution and Democracy, and American Empire: Before the Fall.The Neutrality Act of 1794 in substance prohibits anyone in the United States from directing or supplying arms or assistance— or otherwise engaging in war—that is against a country with which the United States is formally at peace. The United States at present is at peace with Iran. It's at peace with Lebanon. Indeed, Lebanon's an ally. We already know that President Biden had ordered Navy ships to use their Aegis Ballistic Missile Defense in collaboration with Israel to shoot down Iranian missiles—an act of war. And now they basically said we are combatants with Israel and probably planning covertly to join military forces on the next initiative that Israel takes against Iran. So it's a clear violation of the Neutrality Act.Bruce FeinListeners, you have your Senators and Representatives campaigning, as we speak, in your communities. You ask them to come to your town meetings where they can hear you out, and where you require them to respond. This is their moment of vulnerability before the election.Ralph NaderIn Case You Haven't Heard with Francesco DeSantisNews 10/9/241. In These Times reports “U.S. Jewish Institutions Are Purging Their Staffs of Anti-Zionists.” This piece, based on interviews with 18 Jewish professionals at 16 different Jewish organizations over several months, yielded descriptions of “being fired, quitting under pressure, or seeing their roles disappear since October 7 for issues surrounding criticism of Israel or support for a permanent cease-fire.” The magazine identifies this trend as part of “a radical rightward turn in mainstream Jewish organizational life over the past year...[where] Support for Israel and its government's assault on Gaza appear to have become a defining feature of employability.” Shaul Magid, who teaches modern Judaism at Harvard Divinity School is quoted saying “More than an exercise in pro-Israel muscle, this is…an act of desperation. The liberal Zionist center is collapsing.”2. In a statement, the Hind Rajab Foundation – named for the five year-old girl killed by Israeli forces – has filed a complaint with the International Criminal Court accusing 1,000 Israeli soldiers of “war crimes, crimes against humanity, and genocide in Gaza.” The statement goes on to say “These individuals, all of whom have been identified by name, are accused of participating in systematic attacks against civilians during the ongoing genocide in Gaza,” examples of which include destruction of civilian infrastructure, illegal occupation and looting, and use of inhumane warfare tactics, among others. The Foundation alleges that this complaint is supported by over 8,000 pieces of verifiable evidence, including “videos, audio recordings, forensic reports, and social media documentation.”3. In a clash of the fast food titans, the Washington Post reports McDonald's has filed a lawsuit against Tyson Foods, Cargill, JBS and National Beef Packing alleging that the meat packing giants engaged in a “conspiracy…to fix, raise, stabilize and/or maintain the price of beef…at supra-competitive levels — that is, prices artificially higher than beef prices would have been in the absence of their conspiracy.” In this complaint, McDonald's alleges that “the price per hundred pounds of cattle had historically stayed within $20 to $40 of the average price per hundred pounds of wholesale beef…. [but] By 2021, the difference had ballooned to $156.50.” The meatpackers have been under increasing scrutiny for the past several years. “In 2020, the Justice Department…sent subpoenas to the four meatpackers in an antitrust probe. A year later, nearly 30 members of Congress sent...a letter, suggesting it was time ‘to determine whether the stranglehold large meatpackers have over the beef processing market violate our antitrust laws and principles of fair competition,'” and in 2022, JBS agreed to a $52.5 million settlement with direct purchasers.4. In the final days before the 2024 election, Republicans are launching a full-scale assault on the regulatory state. The National Review reports House Oversight Committee chairman James Comer is opening an investigation into Federal Trade Commission chair Lina Khan, accusing her of politicizing the agency by appearing at events with progressive lawmakers. These events have centered on policy – an event in Texas with Bernie Sanders and Greg Casar was focused on “corporate power and worker freedom,” while others have dealt with grocery prices, health care, and price gouging, per Punchbowl News – but Comer is alleging that these events were political in nature and thus prohibited by the Hatch Act. Meanwhile Mark Joseph Stern reports “Fourteen Republican attorneys general are suing to block a new [Federal Communications Commission] rule that would prohibit prisons from charging inmates extortionist rates for phone and video calls,” which can cost as much $54 each. It seems unlikely that these attacks on consumer protection rules will deliver political dividends for Republicans come November.5. In another bizarre GOP misstep, Indiana Senator Mike Braun recently said “the U.S. Supreme Court was wrong to legalize interracial marriage in…1967,” and that the decision should have “instead been left to individual states,” FOX59 Indianapolis reports. Braun then tied himself in knots saying that he condemned “racism in any form” but maintained that “We're better off having states manifest their points of view.” The Indiana Democratic Party condemned Braun's statements, calling his rhetoric “an endorsement of…dangerous white nationalist views.”6. Airline Geeks reports “Boeing has cut health care coverage for 33,000 of its workers and their families as [the] machinists union strikes continue to halt production in the Pacific Northwest.” International Association of Machinists and Aerospace Workers International President Brian Bryant responded to this clear attempt at strikebreaking by saying “Boeing executives cannot make up their mind…One day they say they want to win back the trust of their workforce. The next moment…Boeing executives are…tripping over dollars to get pennies by cutting a benefit that is essential to the lives of children and families, but is nothing compared to the cost of the larger problems Boeing executives have created …over the last ten years. Their missteps are costing not just the workers but our nation.” The Machinists have been on strike since September 13th, and Bryant said “Our members continue to be strong in their resolve and will not settle for anything but a fair contract that recognizes and rewards the critical and dedicated work they perform.”7. According to Documented NY, “U.S. Immigration and Customs Enforcement (ICE) has run a secretive program for years where ICE agents have trained hundreds of civilian volunteers on how to operate multiple types of firearms, conduct investigations and surveillance of immigrants, and use lethal force on human beings.” Documents from this quasi-fascist program, revealed via FOIA request on October 1st, include “detailed images showing where to strike with a baton or a weapon to cause differentiated harms on the body…presentations on how to shoot a gun, point at targets, and stand in positions to fire…[with] One presentation slide suggest[ing] yelling ‘drop the gun' as a potential cover when employing lethal force against someone.” Ian Head, Open Records project manager at the Center for Constitutional Rights, calls this “a violent and racist program, where people pretending to be violent ICE officers got to hold guns and fire them in role-play situations where agents pretended to be immigrants.”8. More fascist news comes to us from Canada, where the Ottawa Citizen reports “The Department of Canadian Heritage is being told that more than half of the 550 names on the Memorial to the Victims of Communism should be removed because of potential links to the Nazis or questions about affiliations with fascist groups, according to government records.” Documents show the department had already determined that 50 to 60 of the names or organizations were directly linked to the Nazis. As the article notes, “The memorial was supposed to be unveiled in November 2023 but…was put on hold after members of Parliament honoured Yaroslav Hunka, a Ukrainian soldier with the Waffen-SS Galicia Division, a voluntary unit that was under the command of the Nazis. That incident became an international embarrassment for Canada.”9. In more positive news from our Southern neighbor, incoming Mexican President Claudia Sheinbaum has announced a new “Health at Home” program for seniors and persons with disabilities, per Latina Republic. The program, intended to reach 13.6 million people, “will bring healthcare personnel to the homes of all seniors across the country,” starting with a census to collect comprehensive health data to “establish a personalized care plan,” to be performed by over 20,000 new doctors and nurses. This ambitious program of preventative medicine is unimaginable in this country despite boasting a GDP almost 20 times the size of Mexico's.10. Finally, in Nebraska, a new poll from the Independent Center finds Independent Senate candidate Dan Osborne leading two-term incumbent Republican Deb Fischer by a remarkable 5 points. Currently the candidates stand at 42% for Fischer, 47% for Osborne, with 10% undecided. Voter registration in Nebraska totals 49% Republican, 26% Democrat, and 25% Independent, meaning Osborne has a path to victory via a Democratic-Independent coalition. If successful, Osborne could provide a model for victory in red states: run as a left-wing populist and jettison the toxic Democratic Party brand.This has been Francesco DeSantis, with In Case You Haven't Heard. That's the thing about the future's work and foresight work is you need a very broad range of thinkers. You need people from different perspectives who speak different languages and who recognize different worldviews. I think that's always why artists will be important in that process, because they are not necessarily coming from sort of mainstream culture. They may be immersed, raised in mainstream culture, but they're often trying to say, hey, there are other ways of seeing the world, and there are other ways of responding to the world that we're in right now.I first met Zan Chandler in 1999 when we were both starting work at the Canada Council for the Arts running arts programs. I've kept in touch with Zan over the years and have followed her career as an arts educator and expert in foresight. I've always been fascinated with various forms of futuring so I was happy when Zan clarified, for example, the difference between forecasting and foresight. We also talked about foresight into the future of the arts and how the arts can help us anticipate better futures. Zan's journey in the arts and foresight fields began with her background in linguistics, shifting to arts through photography and film, leading to work at the Department of Canadian Heritage on arts and film policy and now at Policy Horizons Canada. During our conversation Zan notes that artists are good at sensing societal shifts and addressing various forms of injustices.  Our conversation explored the potential of art and artists in foresight work, such as storytelling and emotional connections. Zan suggests that the inclusion of artists in foresight work can help challenge our assumptions and introduce new and valuable perspectives.We also talked about the impact of COVID: While I might have been a little doom and gloom about what happened during COVID and how devastating some of the impacts were on the arts community, I think one thing that came through strongly for me was how the innate need to create together, regardless of what the context was, remained. And we have so many examples of the creative sector coming together to raise spirits and to create in ways, in new ways.My takeaway, if not my prognosis, is that we need to be prepared for multiple outcomes while remaining open and actively working on new possibilities. Zan reminds us that:That's the idea around foresight. Featuring the insights from film creatives and professionals from Sápmi, Canada and Yakutia, this episode will shine a light on the ground-breaking work of the Witness Program, a film training and mentorship programme for emerging Indigenous filmmakers from the Circumpolar Arctic that is the fruit of a collaboration between Telefilm Canada and the Arctic Indigenous Film Fund (AIFF). Designed as a professional development opportunity that allows Arctic Indigenous filmmakers to share their authentic perspectives on how climate change is affecting their communities through their own storytelling and in their own filmic and spoken languages, the programme supported a first cohort of 6 filmmakers who produced 5 films and were mentored by 3 Indigenous long-feature film producers and filmmakers, under the guidance of Liisa Holmberg, CEO of the AIFF. These conversations unpack the way in which these first-hand narratives convey the sense of urgency of climate change which Arctic Indigenous communities have been witnessing for decades and the ways in which their filmmaking practices can embody acts of resistance, resilience and language revitalisation. Key to understanding these films is the notion of a worldview. The speakers, Liisa Holmberg, filmmakers Sadetło Scott and Svetlana Romanova and mentor Danis Goulet, all share their experiences of how their communities' worldview, connection and deep relationship to the land are expressed in these and other films, which they made in a context of challenges to the land and Indigenous storytelling through the compounded effects of climate change and colonization. Film commissioner Liisa Holmberg (she/her) is working in International Sámi Film Institute (ISFI) in Norway. Liisa Holmberg is a Sámi film maker originally from Finnish side of the Saamiland. She has worked in the film business as a producer, production manager and film consultant from the year 1994. Big part of her work as a film commissioner is working internationally with Indigenous film makers in Alaska, Canada, Greenland, Sápmi and Russia to establish an Arctic Indigenous Film Fund (AIFF). Holmberg is a member of European Film Academy from the year 2018. Sadetło Scott (she/her) is a Tłı̨chǫ Dene filmmaker, who grew up and lives in Sǫǫ̀mbak'è, Denendeh (Yellowknife, Northwest Territories, Canada). Sadetło has a B.A. in Indigenous Governance and a Certificate in Heritage and Culture from Yukon University, and Certificates in Motion Picture Production and Cinematography from Capilano University. Sadetło's work, such as “Edaxàdets'eetè” aims to educate on the importance of Indigenous language and the Indigenous experience. Svetlana Romanova (Sakha/Even) is an artist and filmmaker born in Yakutsk, the capital city of the Sakha Republic, Russia, located south of the Arctic Circle. Her practice centers on the importance of Indigenous visual language, particularly in the Arctic regions and gravitates towards critical self historization. Writer/director Danis Goulet's films have screened at festivals around the world including Berlinale, Sundance, MoMA and the Toronto International Film Festival (TIFF). Her award-winning feature NIGHT RAIDERS premiered in the Panorama section at Berlinale and also screened at TIFF in 2021. For television, Danis has recently directed for the acclaimed FX series RESERVATION DOGS. She is Cree/Metis, originally from northern Saskatchewan. The host Nadia Denton is a film industry specialist with over a decade of experience as a Curator, Impact Producer and Author. Her focus has been on cinema of the African diaspora, she specialises in Nigerian Cinema and is author of two books The Black British Filmmakers Guide to Success and The Nigerian Filmmaker's Guide to Success: Beyond Nollywood. Nadia is also an official V&A African Heritage Tour Guide. As a Partner of Choice, Telefilm Canada is a Crown corporation dedicated to the success of Canada's audiovisual industry, fostering access and excellence by delivering programs that support cultural resonance and audience engagement. With a lens of equity, inclusivity and sustainability, Telefilm bolsters dynamic companies and a range of creative talent at home and around the world. Telefilm also makes recommendations regarding the certification of audiovisual coproduction treaties to the Minister of Canadian Heritage, and administers the programs of the Canada Media Fund. When it comes to energy and climate, Canada is a key player and a land of contrasts. It gets more than 80% of its electricity from low-carbon sources and has a hefty carbon tax. It's also a major oil and gas producer, and has resources for the metals and minerals needed for a clean energy transition.  As the urgency of the climate crisis grows, the Canadian government has committed to accelerate its climate goals. At the same time, the importance of oil and gas to the Canadian economy, along with the thorny politics of climate, makes reducing its reliance on fossil fuels difficult. Canada also faces challenges balancing energy production and critical mineral mining with a commitment to upholding the rights and sovereignty of First Nations communities.  How is the Canadian government planning to meet its climate goals? What would a just energy transition look like for the country? And what are its leaders hoping to achieve at COP28? This week host Jason Bordoff talks with Steven Guilbeault about recent developments in Canadian energy and climate policy, and what he is hoping to achieve at COP28.  Guilbeault is Canada's Minister of Environment and Climate Change, and an elected member of Parliament. He previously served as Minister of Canadian Heritage. Prior to serving in Parliament, he was the senior director of Équiterre, Quebec's largest environmental organization, which he co-founded in 1993. He has also worked as a director and campaign manager for Greenpeace, and was a strategic advisor to Cycle Capital, a Canadian clean technology fund.

Some good education news… https://www.theblaze.com/news/hs-seniors-con-vs-lib High school senior boys nearly twice as likely to be conservative as liberal: Survey A University of Michigan survey found that boys in their senior year of high school are almost two times more likely to identify as conservative than as liberal. However, for twelfth-grade girls, they are even more likely to consider themselves liberal than conservative. On the Monitoring the Future survey, which is considered a scholarly endeavor that dates back to the 1970s, according to The Hill, political differences that were once somewhat close have drifted farther apart. For high school senior boys, the shares of conservative versus liberal were nearly identical between 2014 and 2016, around 19% for both factions. By 2022, that number had shifted to 23% for conservative, which was actually down three points from 2020. Since that 2016 marker, boys identifying as liberal in grade twelve have plummeted to 13%. The 2020-2023 numbers are the highest they've been for conservatives since the early 1990s, although the figures have nearly always hovered around the 20% mark, save for 1998-2002. Several distributors of Anheuser-Busch beer say they have accepted the fact they’ve lost money — and a lot of it — due to consumers boycotting Bud Light. And not just that, but they’ve also given up completely on trying to win back customers who have been negatively affected by the anti-American beer’s Dylan Mulvaney campaign, according to the New York Post. Hiring freezes and layoffs have been going on for four months, while some beer truck drivers have been slammed with hecklers and other harassment while Bud Light’s sales have tanked over 25%. As a result, wholesalers of Anheuser-Busch have resigned to the large number of customers they’ve lost permanently, and in response, they need to focus on a new set of beer drinkers. “Consumers have made a choice,” an unidentified executive from a Texas-based beer distributor told the New York Post. “They have left [Bud Light] and that’s how it’s going to be. I don’t envision a big percentage of them coming back.” Other Anheuser-Busch branded beers such as Budweiser, Busch Light and Michelob Ultra have also been tanking in sales since Bud Light decided to disastrously partner with Mulvaney. Starting Aug. 1, Meta begins the process of ending news availability in Canada, the company said in a statement. Over the next few weeks, all users accessing Facebook and Instagram in Canada will no longer be able to view news links and content posted by Canadian news publishers and broadcasters. Meta said the news outlets to be affected will be identified based on legislative definitions and guidance from the Online News Act, also known as Bill C-18. The bill received royal assent on June 22. Tech giant Google also said it would retaliate against the the new law. The company announced on June 29 it would remove links to Canadian news from its Search, News, and Discover products, while users in Canada will no longer be able to operate the Google News Showcase. After being appointed the new heritage minister, Pascale St-Onge said her door is "always open" to negotiate with the tech companies, but that her government would not back down. Prime Minister Justin Trudeau has called the issue a "dispute over democracy." On July 10, Heritage Canada said it would propose regulations to implement the act, which would include establishing a financial threshold for the contributions of tech companies. The Epoch Times reached out to Heritage Canada for comment but didn't immediately hear back. Meta says the new legislation is based on an "incorrect premise," that the company gains unfair benefits from news content shared on its platforms. The company also emphasized that the primary usage of its platforms doesn't revolve around news consumption, arguing instead that news outlets voluntarily share content on Facebook and Instagram to expand their audiences and bolster their financial standing. "The Online News Act is fundamentally flawed legislation that ignores the realities of how our platforms work, the preferences of the people who use them, and the value we provide news publishers," Meta said. "As the Minister of Canadian Heritage has said, how we choose to comply with the legislation is a business decision we must make, and we have made our choice." The company assured users that despite the changes regarding news content availability in Canada, their products and services would remain unaffected. However, for twelfth-grade girls, they are even more likely to consider themselves liberal than conservative. On the Monitoring the Future survey, which is considered a scholarly endeavor that dates back to the 1970s, according to The Hill, political differences that were once somewhat close have drifted farther apart. For high school senior boys, the shares of conservative versus liberal were nearly identical between 2014 and 2016, around 19% for both factions. By 2022, that number had shifted to 23% for conservative, which was actually down three points from 2020. Since that 2016 marker, boys identifying as liberal in grade twelve have plummeted to 13%. The 2020-2023 numbers are the highest they've been for conservatives since the early 1990s, although the figures have nearly always hovered around the 20% mark, save for 1998-2002. And not just that, but they’ve also given up completely on trying to win back customers who have been negatively affected by the anti-American beer’s Dylan Mulvaney campaign, according to the New York Post. Hiring freezes and layoffs have been going on for four months, while some beer truck drivers have been slammed with hecklers and other harassment while Bud Light’s sales have tanked over 25%. As a result, wholesalers of Anheuser-Busch have resigned to the large number of customers they’ve lost permanently, and in response, they need to focus on a new set of beer drinkers. “Consumers have made a choice,” an unidentified executive from a Texas-based beer distributor told the New York Post. “They have left [Bud Light] and that’s how it’s going to be. Starting Aug. 1, Meta begins the process of ending news availability in Canada, the company said in a statement. Over the next few weeks, all users accessing Facebook and Instagram in Canada will no longer be able to view news links and content posted by Canadian news publishers and broadcasters. Meta said the news outlets to be affected will be identified based on legislative definitions and guidance from the Online News Act, also known as Bill C-18. The bill received royal assent on June 22. Tech giant Google also said it would retaliate against the the new law. The company announced on June 29 it would remove links to Canadian news from its Search, News, and Discover products, while users in Canada will no longer be able to operate the Google News Showcase. After being appointed the new heritage minister, Pascale St-Onge said her door is "always open" to negotiate with the tech companies, but that her government would not back down. Prime Minister Justin Trudeau has called the issue a "dispute over democracy." On July 10, Heritage Canada said it would propose regulations to implement the act, which would include establishing a financial threshold for the contributions of tech companies. The Epoch Times reached out to Heritage Canada for comment but didn't immediately hear back. Meta says the new legislation is based on an "incorrect premise," that the company gains unfair benefits from news content shared on its platforms. The company also emphasized that the primary usage of its platforms doesn't revolve around news consumption, arguing instead that news outlets voluntarily share content on Facebook and Instagram to expand their audiences and bolster their financial standing. "The Online News Act is fundamentally flawed legislation that ignores the realities of how our platforms work, the preferences of the people who use them, and the value we provide news publishers," Meta said. We're back with another packed show of Vancouver Whitecaps, Major League Soccer, and Canadian football chat. What a busy week it's been. The Whitecaps were in action twice, in two different competitions, and we pick over the bones of both matches - against Real Espana in CONCACAF Champions League action and FC Dallas in MLS. There were highs, there were lows, there were continued frustrations, and we still don't really know how good this Whitecaps team are or aren't this year. Our feature interview this episode is with Whitecaps captain and playmaker Ryan Gauld. We chat to Ryan about preseason preparedness, the start to the season for both the team and himself, and the exciting battles ahead in four competitions for the team this year. All of that and there's still time for a one hour discussion about the Standing Committee on Canadian Heritage in Ottawa on Thursday that saw four Canadian women's national team players give testimony against Canada Soccer and the mess the game is in here. ‘Apologies without accountability' as MPs grill government official over the Laith Marouf scandal

It's been seven months since the federal government was made aware that it had awarded a lucrative training contract to a known racist and antisemite, Laith Marouf. The story broke in July 2022, after several media watchers went public about offensive tweets which Marouf had posted about Jews, Blacks, Indigenous people and French Canadians. While his contract was eventually cancelled and his training workshops for journalists halted, serious questions have been asked ever since about what government officials knew, when they knew, why it took so long for them to take action, and how Marouf could have slipped through the vetting process so easily. On Monday, a high-ranking civil servant from the Department of Canadian Heritage appeared before a House of Commons committee hearing into the affair. What followed was a 90-minute grilling by the committee's MPs, who remained unimpressed and even disappointed with the answers. On today's The CJN Daily, we'll take you to the hearings, and also get analysis from Michael Geist, a law professor at the University of Ottawa who has been critical of the government's handling of the scandal. The government’s two big Internet bills - Bill C-11 and Bill C-18, both made significant advances late last week. The Senate Transport and Communications committee concluded months of hearings on Bill C-11 by agreeing to about 25 amendments, notably including a change to the scope of user content regulation that is designed to limit the application to sound recordings as well as the removal of a provision that critics feared would limit CRTC independence. Meanwhile in the House, Bill C-18 cleared the Canadian Heritage committee with changes that invite legal challenges and make a showdown over blocking news content increasingly likely. Just prior to these closing committee meetings, I appeared on TVO’s the Agenda with Steve Paikin to discuss the bills and why they matter. The interview elicited very positive feedback and with the kind permission of TVO and the Agenda, I’m pleased to provide the audio version of that interview as this week’s Law Bytes podcast.

With Canadian Musician Editor-in-Chief Mike Raine, Patrick gets into the weeds and behind the scenes on Bill C-11, aka The Online Streaming Act, in which the federal government aims to bring streaming companies like Spotify and Netflix into the CanCon regulatory regime. Patrick has been one of the music industry representatives to testify before the Senate Committee on Bill C-11 and Music Canada has been vocally supportive of the Bill, though it also has a couple important concerns, which Patrick gets into. In this conversation, Patrick brings some fascinating and important insights based on his many years working on legislation in the federal government. Prior to joining Music Canada in 2016, Patrick worked in Stephen Harper's Prime Minister's Office from 2010-2013, and then was the Director of Policy for the Minister of Canadian Heritage and Official Languages from 2013-2015. Based on that experience, Patrick offers some insight as to why Bill C-11 is constructed like it is, for better or worse, and shares some anecdotes from his appearance in the Senate.

The Law Bytes podcast returns with a special episode focused on combatting online anti-semitism with a particular emphasis on an incident involving the department of Canadian Heritage and Laith Marouf, a well known anti-semite. As part of Heritage's anti-hate program, the government had provided funding to the Community Media Advocacy Centre (CMAC), led by Marouf, to develop an anti-racism strategy for Canadian broadcasting. While there was years of evidence of Marouf's anti-semitism, the department didn't look or didn't find it. The contract was cancelled after a public outcry, but even that led to concerns as it was left to Jewish MPs such as Anthony Housefather, Ya'ara Saks, and Melissa Lantsman to say something while many others remained silent. Housefather not only spoke out on the Marouf situation but also called on all MPs to become more vocal. Housefather has been working on online anti-semitism issues with politicians from around the world as part of an Inter-Parliamentary Task Force on Online Antisemitism and he joins me on the podcast to talk about the work of the task force and its recent hearing in Washington, DC, the Marouf incident, and the urgency for all to speak out more aggressively against anti-semitism.

The one-year anniversary of Canada's first National Summit on Antisemitism passed quietly on July 21. Last year, after violence resurged Israel and Hamas and Canadians saw a spike in antisemitic incidents, the government convened this emergency summit and appointed Irwin Cotler as its special envoy. The summit lasted seven hours, during which time Cotler met with Prime Minister Justin Trudeau and his cabinet ministers. Since then, Parliament has outlawed Holocaust denial and made progress toward an anti-hate-speech bill that would cover antisemitism, while Ottawa has earmarked $30 million in the last budget to help Jews feel safer, on top of millions pledged for new Holocaust museums across the country. Yet with all these resources devoted to fighting Jew-hatred, has antisemitism actually quieted down? To give a sense of the progress that's been made so far, and what still needs to be done, The CJN Daily sat down with Cotler for a candid self-reflection and assessment. Last week, the Standing Committee on Canadian Heritage rushed through the clause-by-clause review of Bill C-11 in a manner that should not be forgotten or normalized. Despite the absence of any actual deadline, the government insisted that just three two hour sessions be allocated to full clause-by-clause review of the bill. Once the government-imposed deadline arrived at 9:00 pm, the committee moved to voting on the remaining proposed amendments without any debate, discussion, questions for department officials, or public disclosure of what was being voted on. This week's Law Bytes podcast features clips from a hearing that one Member of Parliament described as “an affront to democracy”.

It's also fascinating to learn more about how the Canadian Government is educating itself as pertains NFTs and cultural production. The concerns with the government's approach have started to attract the attention of Canadian digital-first creators, who fear the plans could lead to lost revenues and reduced promotion worldwide of what has become one of Canada's most successful cultural exports. Darcy Michael is a B.C.-based comedian with millions of TikTok subscribers and a globally successful podcast. Last week, he appeared before the Standing Committee on Canadian Heritage to warn about the risks of Bill C-11 and to call for reform. Welcome back to the C O L L A B ZONE! Today we continue our new series of bonus episodes which we recorded with the help of students from the British Columbia Institute of Technology! As part of our ongoing engagement with Call to Action #27 of the TRC, we created a series of summaries of key Aboriginal case law decisions so that legal students, practitioners, and the public can further engage and learn about how our Canadian legal system treats Indigenous peoples. Some of these decisions are already available in full in other episodes, others we are still working on releasing as full recordings. We worked on this project with students from the British Columbia Institute of Technology, who generously donated their time to record the summaries for us. We also want to thank the 1492 Windsor Law Coalition who provided the basis for some summaries. Today we have Mikisew Cree First Nation v. Canada (Minister of Canadian Heritage) a 2018 SCC Decision. Omnibus legislation was introduced which would have significantly impacted environmental protection. Mikisew Cree Nation was not consulted and brought a JR application arguing a failure of the Crown in their duty to consult. The Majority of the SCC held that the development of legislation does not trigger the Duty to Consult.
