Round 1 went to the NCAA. A more important Round 2 is set to be decided next week. Tennessee's legal clash with the NCAA is continuing to play out in the courtroom, and the state's attorney general doesn't seem too demoralized that a judge did not grant a temporary restraining order this week that would have halted the NCAA's NIL guidelines. That's because a bigger, longer-lasting ruling awaits next week. Tennessee is under NCAA investigation. Again. This time, the investigation involves potential violations to the NCAA's flimsy NIL guidelines. And, this time, Tennessee is fighting back. UT Chancellor Donde Plowman has her elbows sharpened for this fight, and so does Vols AD Danny White. Perhaps more importantly, the Tennessee attorney general, Jonathan Skrmetti, is suing the NCAA. The lawsuit alleges that the NCAA's NIL guidelines violate the Sherman Antitrust Act and unlawfully restrict athletes' ability to monetize their name, image and likeness. On today's episode, hosts Blake Toppmeyer, Adam Sparks and John Adams unpack the investigation and the lawsuit and what they could mean – for the Vols and the NCAA. This investigation comes on the heels of a separate investigation in which the NCAA determined 18 Level I violations occurred during Jeremy Pruitt's coaching tenure. If the NCAA finds that Tennessee committed NIL violations, it may intend to impose harsh penalties, because the Vols would be a repeat offender. However, the NCAA routinely loses in court, and if it loses the judgement in this lawsuit, that could further hamstring the NCAA's ability to enforce its NIL guidelines. In this episode, I sit down with former pro and college football players, Charlie Batch, TJ Lang, and Brett Petersmark to discuss the big debate around NIL (name, image, and likeness) in NCAA sports. The NIL is an agreement set by the NCAA for student-athletes to have the right to monetize and profit from their brand, which consists of their name, image, and likeness. College athletes can sign sponsorship deals with corporate brands that charge money for autographs and even create their brand or an E-commerce site. Inside of the discussion of the NIL, there are several smaller issues that exist, such as “Girls vs. Boys.” When it comes down to it, it is better for the girls because the funding for females is not equal to the males and thus NIL allows for opportunities to open up for females. Some of the issues are, for example, that if you get a sponsorship from a specific corporation, you can't show up wearing their brand. It's very difficult for athletes because they're not allowed to use one image or logo that everybody associates with you and their popularity and fame. Additionally, TJ mentions that Universities have beer advertisers but restrict athletes from ever consuming it. The NCAA has no choice but to try to get involved and regulate it at some level. They always try to have this moral ground right where it's no gambling, no casinos, no liquor, no beverages, but pretty much every university has some sponsorship. In regard to recruitment, there is a portal for recruiters where players can put their names in, and the recruiters can decide to recruit you. The system allows players to get one transfer without sitting out the rest of the season. For Charlie, the NIL would have made his life much easier after high school and college. The paradigm shift wasn't about money because he could have decided based on how he was compensated. He says he would have been able to help his family financially. Charlie also identifies that there is a lot of a gray area in the recruitment aspects for bigger schools. Some athletes play for bigger schools and then transfer to minor schools because they want to pursue a specific academic program that the bigger school doesn't have. That is just one of the loopholes that is happening with universities right now. TJ says the NIL will keep growing until something boils over. Student-athletes could end up earning millions of dollars! Penn State recruiting heads into the summer months with plenty of work ahead of them. Despite May being a quiet period for news, there's still plenty going on with the staff as they circle the country during the "evaluation period" of the recruiting calendar. Today, the BWI Daily recruiting show looks at several topics this spring, including the NCAA's NIL guideline announcement. Both books—Lucky Enough & "How to Win Friends"—make you want to serve others.On this episode, we discuss high rates of anxiety & depression among teen girls. The numbers are staggering. After 2013, the percentage of adolescent girls suffering from mental health disorders jumped 250% (source: The Coddling of the American Mind by Jonathan Haidt). With this in mind, Chris & I discuss how parents can navigate today's hyper-connected online environment.Chris is a native of South Louisiana. In a past-life, he was a college athletics administrator at "The U" (University of Miami), Georgia Tech & Baylor. I ask him how common it was to see high-profile alumni on campus. Guys like Jimmy Graham, Michael Vilma, Michael Irvin, Bernie Kosar, Vinny Testaverde, Edgerin James. And whether having them hanging around the facilities helped with recruiting.We also talk about NCAA's new "name, image, and likeness" (NIL) policy. Chris believes one of the reasons he was pushed out of college athletics is because he didn't like how student-athletes were treated. After all, coaches were making millions of dollars, while young men and women got nothing. But now, thanks to the new NIL rule, every NCAA athlete is given the opportunity to profit off their name, image, and likeness.Chris is a strong advocate for higher education. He said he's always believed: you'll get somewhere in life based on your education. In fact, he recalls a pivotal moment in high school when his teacher said to him, "You'll never amount to anything in life until jackasses learn how to fly."His teacher's words left a mark. But by taking those words personally, they also inspired him. He found himself newly-motivated to get better grades. He earned a PhD.Now 39 years old, Chris recently moved his family home to Louisiana. He said he's enjoying re-connecting with his daughter.This conversation was the highlight of my week.
