While police advocate for establishing a legal buffer zone that would keep not just police safe but spectators who at times are inserting themselves and getting either hurt or arrested with interfering with police activity, some are not in favor of the Act believing it infringes on the public's “right to know” and fear police could abuse the law. Send us your feedback In this episode, Partner Richard Wells and Senior Associate Suzy McMillan from our firm's Corporate and Commercial team, provide valuable insights on the draft Biometric Processing Privacy Code (Code) proposed by the Office of the Privacy Commissioner (OPC). [01:09] Suzy begins the episode outlining the background to the proposed Code, discussing the OPC's exposure draft, the current draft of the Code and the consultation process that is now underway.[02:15] Suzy and Richard discuss the purpose of the Code; to establish clear rules for the collection, use, storage, and processing of biometric information. They outline the types of data the Code will capture, including facial recognition and fingerprint scanning, emphasising that its application is limited to the processing of biometric information by a machine-based system.[03:38] Richard highlights the important interplay between the Code and existing IPP principles under the Privacy Act 2020. They analyse certain rules under the Code that will modify existing information privacy principles, focusing first on Rule 1 which requires organizations to justify the necessity of collecting biometric information by undertaking a proportionality test and ensuring adequate privacy safeguards are in place to protect the information. Suzy and Richard consider the potential impacts this may have on organisations who collect and use biometric information. [07:48] Richard then examines the transparency and disclosure requirements imposed by the Code, noting how these new obligations for organisations to clearly inform individuals about biometric information processing, represent an elevated standard of disclosure from existing privacy laws.[10:55] Suzy explains Rule 10 of the Code, which sets restrictions on how biometric information can be used and outlines prohibited uses, such as inferring sensitive personal attributes.[12:40] Richard summarises the Code's status with the OPC, highlighting the submission deadline of 14 March 2025. In this episode, Richard Wells, a Partner in our Corporate and Commercial team, and Senior Solicitor, Hannah Snelling, discuss the legal basics of confidentiality agreements; talking listeners through various considerations that are needed when drafting or reviewing this fundamental type of commercial agreement.[00:27] Richard and Hannah begin the episode noting the importance of confidentiality agreements in commerce; how they preserve the confidentiality of information, define its scope, and set out the rules for its use and disclosure.[01:58] Hannah explains what she looks for when reviewing a confidentiality agreement, highlighting the importance of defining the parties accurately and the difference between a one-way and a two-way confidentiality agreement.[03:16] They then consider different approaches to defining confidential information, the risks associated with marking information as confidential, and the importance of defining the purpose of confidential information. Richard notes how it can be equally as important to consider what hasn't been defined as confidential information as what has been; what lies inside versus outside the box so to speak.[05:56] Hannah discusses the main exclusions to the obligations attaching to confidential information, including information that is already in the public domain, information in the prior lawful possession or control of the recipient, and information received from a third party.[08:47] Richard and Hannah then examine the rules around the use and disclosure of confidential information once a recipient is in possession of it. In this episode, Richard Wells, a Partner in MinterEllisonRuddWatts' technology team, talks to Shona Foster, a Senior Associate in the same team, about the interaction between standard form small trade contracts and the unfair contract terms regime, with a focus on the use of such contracts by tech companies and online businesses.[1:22] Richard and Shona start off by giving a brief overview of the unfair contract terms (UCT) regime itself. They cover what it is, and when and where it applies, especially in the context of companies doing business in New Zealand. They also discuss why standard form contracts might be used.[2:10] They then move on to discuss what are the elements of an unfair term: what is the statutory “test” that might make a term in a contract unfair? Richard and Shona explore the three limbs to this test, focusing on the challenge of protecting a legitimate interest without creating a term that is “unfair”.[3:20] Richard and Shona explore the test in the context of actual contract terms, discussing the “grey list” of types of clauses likely to be considered unfair terms and what these might look like in practice.[5:40] The two discuss the management of risk, in light of what they describe as a paradigm shift towards standard form contracts that are now more balanced between parties. They also look at some key contractual termsand touch on what might be a fair scenario for those terms.[8:30] Richard and Shona explore the topic of the apportioning of liability while complying with the UCT regime – noting that this is a particularly complex area.[11:00] Finally, they look at international vendors, and how the consideration of the UCT regime in New Zealand may require them to make changes to how they deal with New Zealand businesses. In this episode, Richard Wells, a partner in MinterEllisonRuddWatts' Privacy team, talks to Suzy McMillan, a senior associate in his team, about how to comply with New Zealand privacy law when sending personal information overseas.Richard and Suzy give an overview of Information Privacy Principle 12 (IPP12) and talk about the key considerations need to take into account when disclosing information outside of New Zealand.[1:18] Richard and Suzy start with a brief look at IPP12 and how it was introduced with the new Privacy Act 2020. They talk about how it reflects requirements set out in the EU's General Data Protection Directive and Australian legislation. [2:26] They then talk about IPP12 from the perspective of New Zealand entities and ask: what do they need to ensure when asked to disclose personal information to a foreign entity? They discuss the criteria for disclosure set out in IPP12 and how to assess whether they are met.[4:47] Next, they talk about the concept of “agency” and what agencies need to do to comply with IPP12, in particular focussing on the due diligence that should be done to understand the foreign entity with which the personal information will be disclosed.[7:54] They also consider the ability to disclose personal information to entities in countries with comparable protections to New Zealand, and some of the difficulties that might arise when assessing this.[10:15] Finally, Richard and Suzy talk about contractual provisions that can be put in place to give New Zealand entities comfort that they are meeting the requirements of IPP12. The HQ of Vodacom in Cape Town experienced a fire incident, with the fire apparently starting in the solar panels – according to news reports. Recent research has highlighted that solar panels can pose a risk, and red flags have been raised in the fire engineering industry. The number of incidents in South Africa appears to be relatively low, but as installers race to place power generating panels on roofs across the country, due to loadshedding, the associated fire risk could be increasing. Some concerns include poor installation, short circuits, fire spread between roofs sheets and panels, materials of solar panels being combustible and associated lithium-ion batteries experiencing thermal runaway(uncontrolled burning). Christie was joined by Prof. Richard Wells, Professor in Structural and Fire Engineering and an expert in fire safety at Stellenbosch University to discuss these concerns.

Live From The Center of the Aviation Universe No other radio show can make the claim that they broadcasted from the center of the aviation universe. Yet, that's exactly what SimpleFlight Aviation Radio did with their on-location radio show at..... you guessed it.... Aviation Universe Pilot Shop in Bensenville, IL! We were pleased to find a packed house of over 20 visitors who came by to enjoy the show and Pizza. Now that's the way to spend Sunday night. Many of you remember the special trips to the pilot shop, which meant plenty of "window" shopping and great conversations with those around you. The Internet has served to take that piece of the community away, but Lora Yowell and Richard Wells have shown the value of the pilot shop by being home to all aviation enthusiasts, including pilots, plane-spotters, and anyone that looks to the sky with dreams in their hearts. Lora and Richard talked of the community of loyal customers that are part of the Aviation Universe family, and how it has developed into a partnership with the local police, homeland security, and O'Hare Airport.
