It may be best known for CourtListener, its flagship project that houses an immense collection of court orders and opinions, and for its RECAP suite, which is the largest free collection on the internet of court filings and dockets.  But there is a lot more to the Free Law Project, as you will hear from our guest on today's episode, Michael Lissner, the Free Law Project's cofounder, executive director, and chief technology officer. Lissner started the Free Law Project while earning his master's degree at the University of California Berkeley School of Information, with the assistance of cofounder Brian Carver, who was then an assistant professor at the school and who is now copyright counsel at Google. John is joined by Professor Song Sang-Hyun, retired Professor of Law at Seoul National University and former President of the International Criminal Court.  Professor Song explains the origins of the Korean civil justice system which is based upon the German system by way of Japan.  He discusses  how after World War II, American Army officers drafted many of Korea's statutes and, in the past two decades, American law in fields such as corporate law, shipping and aviation law, antitrust law, securities regulations, intellectual property, and class action lawsuits have increasingly influenced Korean law.  They then discuss Korean pretrial practice which does not involve voluminous document discovery or any depositions and often involves the trial judge also acting as a mediator.  Professor Song explains some of the unique aspects of Korean trial practice including Korea's recent adoption of juries that render advisory decisions on disputed facts and that cases average less than a year from filing through trial.  They also discuss that the loser must pay the winner's attorneys' fees, although, in practice, courts tend to award less than all the fees incurred.  Finally, they discuss some of the emerging issues in Korean law including labor, environmental and privacy law as well as the protection of personal information.Podcast Link: Law-disrupted.fmHost: John B. NFTs may not be fungible, but they are transferable, and they are sometimes stolen with no traditional recourse. The police were unable to assist.   [ 01:06 ] - An NFT or “Non-Fungible Token” is a digital certificate of ownership residing on a blockchain. In the art world, someone may be the true owner of a piece of art while the actual piece of art is stored elsewhere, and even if someone makes a copy. NFTs apply that same logic to digital art and other media.   [ 06:03 ] - Several courts have held that the loss of NFTs is not considered a “direct physical loss.” The microchip is physical, but the information on it is not.   [ 09:00 ] - Special Limits of Liability likely do not apply. However, an argument could be made that NFTs fall under the policy language for “securities, accounts, deeds, evidences of debt, letters of credit, notes other than bank notes, manuscripts, personal records, passports, tickets and stamps.”   [ 11:17 ] - Newer “Property Not Covered” provisions often discuss digital currency, but NFTs are not considered currency. The defining characteristic of currency is that it is fungible: any dollar is exchangeable with any other dollar. Legal information is essential for individuals to understand their rights and obligations under the law, but not everyone has equal access to this information. We begin by discussing the challenges that people face in accessing legal information, including the cost of legal services and the complexity of legal language. We also examine the impact that this lack of access can have on individuals. Lawrina is really ambitious in content creation and Inna explains what kind of processes they have developed to keep updated and how the members of the lawyer directory can participate in the work. Since Lawrina's story began in Ukraine and Inna and some of her team members work from Kyiv, we also talk about the Russia's massive assault against independent Ukraine. We examine if legal design and legal tech can play a role in the reconstruction and healing of Ukrainian society. In 1995, Leslie received her J.D. from New York University School of Law, where she was an editor of The Review of Law and Social Change and a member of the Family Defense Clinic. She received her B.A. with Honors from Swarthmore College in 1990.    Leslie has served on various boards and committees in the nonprofit and public sectors and currently sits on the Board of Managers of Swarthmore College and Board of Trustees of New York University School of Law. In the year following her law school graduation, Leslie founded Legal Information for Families Today (LIFT), which provides legal information and support to Family Court litigants, and now serves 30,000 litigants annually; she continues to serve as a member of LIFT's Board of Directors. Hallie has done amazing work making law better by designing legal information and one of her goals is to democratize legal information. As we know, legal information is often hard to obtain and even harder to understand because it's full of legal jargon and sentences so long that publishers have to minimize the print in law books. But Hallie is here to change this. She's known for her amazing work as a cartoonist and visualizing legal information in general. She explains the “threats and opportunities” of using comics, or images and visualization in legal communication. Hallie gives examples on projects she has been working on at the Graphic Advocacy Project and tells us about finding the Creative Advocacy Lab at the University of The University of Utah S.J. Quinney College of Law. We talk about the bigger picture and how access (or lack of it) to legal information has an impact on big things like democracy and how we make decision makers understand how vital access to legal information is to justice systems. Making legal information more comprehensible and easier to use is a central theme in legal design. It is also a topic that has recently gained increasing research interest, sparking new ideas on how to enhance the usability of contracts and other legal documents in practice. After all, as research has shown, understanding what a document says is all about human metacognition. If users are enabled to connect the content of a legal document with ideas that are meaningful to them, it can help avoid “cognitive accidents” and work as a proactive method to promote legal wellbeing of the users and other parties. When users can understand what is expected of them, legal conflicts and misbehavior due to misunderstandings are less likely to occur. In this episode we have the honor to interview two pioneering experts in the field of legal information design, Helena Haapio and Rob Waller. Helena Haapio is a lawyer and a contract strategist at Lexpert Ltd, and an associate professor of business law in the University of Vaasa, Finland. Rob Waller is an experienced information designer, researcher, consultant and a teacher, and the current President of the International Institute for Information Design. Rob and Helena share insights from their various projects and collaborations, like the contract simplification project with an energy industry facility and Canadian aboriginals. May 1st began phase one of the reopening efforts for the State of Texas. Governor Abbott's order specifically lists libraries as one of the businesses which can open at a 25% capacity rate (and social distancing), but not all libraries are ready to open right away. I talk with Joe Lawson, Deputy Director of the Harris County Law Library about how he and the staff in Texas' largest metropolitan area are preparing to open later this month, and how they are providing vital services to the courts, the bar, and the general public.
