Chubb Must Pay for Cancellation of Tina Turner Concert Because of Order of State of New York Tina Turner Musical LLC v. Chubb Insurance Company of Europe SE, Appeal No. 16804, Index No. 651607/21, Case No. 2022-02269, Supreme Court of New York, First Department (December 6, 2022) In an appeal from an order of the Supreme Court, New York County (Andrew Borrok, J.), entered on or about December 30, 2021, that denied defendant's motion to dismiss the complaint, the New York Appellate Court unanimously affirmed the decision of the trial court. New York appellate courts are noted for the brevity of their opinions, and this one is no exception. The appellate court concluded that the trial court, the Supreme Court, New York County, correctly concluded that plaintiff's losses resulting from the cancellation of its Broadway show during the COVID-19 pandemic did not fall within the communicable disease exclusion in the insurance policy. The exclusion precluded from coverage: any loss directly or indirectly arising out of, contributed to by, or resulting from... any communicable disease or threat or fear of communicable disease... which leads to: [1] the imposition of quarantine or restriction in movement of people or animals by any national or international body or agency; [2] any travel advisory or warning being issued by a national or international body or agency. The appellate court noted that the exclusion did not clearly and unmistakably preclude from coverage losses caused by communicable diseases that were of such a systemic nature as to lead to quarantine or travel advisory orders by a national or international body or agency. Rather, giving the exclusion a strict and narrow construction, and resolving any ambiguities against defendant, the appellate court found that it precluded from coverage losses resulting from quarantine or travel advisory orders issued by a national or international body or agency in response to a communicable disease. Since plaintiff's losses stemmed from Executive Orders issued by the New York State Governor and New York City Mayor banning performances and gatherings in theaters, the exclusion did not apply. ZALMA OPINION Whenever there is an issue of whether an insurance policy must provide coverage to an insured it is necessary to read the full policy. The New York Appellate court did just that: it read the exclusion relied upon by Chubb to refuse coverage to Ms. Turner, and found that her losses resulted from Executive Orders issued by the Governor of New York state and the mayor of New York City. Since the exclusion only excluded orders of a: "national or international body or agency," and since neither the Governor nor the Mayor were national or international bodies or agencies, the exclusion did not apply. Larry is a Husband, Father, Marine Veteran, Entrepreneur, Teacher and Political Activist. His mission is to help people find happiness through community and purpose, and as he sees it, that often happens by overcoming bad policy decisions in government. He was the 2018 Libertarian New York State Gubernatorial candidate and garnered about 100,000 votes (more than any previous Libertarian candidate) and is running again for New York State Governor this year. I really enjoyed getting to talk to Larry, given his beliefs and aspirations. A lot of what this show is about is to try and really dig in to understand who the guest really is. Obviously it starts with what they value, but also goes to how they think, what they are motivated by, how aware they are, etc. So it was really cool to have that type of conversation with someone looking to achieve what Larry is looking to achieve. He started the conversation off with "empathy" as his most important value. He had a unique take on empathy, in that it is valuable because it allows for more efficiency in solving the big problems we are trying to solve as a society. That naturally led to a conversation about government and the issues Larry sees. We debated some real life scenarios of how his policies would try to address issues like over spending, misaligned incentives, lobbyism, the military industrial complex, and much more. What I found really interesting about all of this was how pragmatic and incremental Larry's approach is. Most politicians today promise perfection or some utopia that will solve all of the world's problems. Larry's view is, "if you measure my plan against perfection, I'll lose every time" because perfection isn't realistic. But if you are looking for progress and improvement then you should seriously consider his pragmatic approach. Everyone will not agree with his policies or views and that is OK; but it is hard to argue that we are not better off with thoughtful, empathetic leaders in charge rather than dogmatic, unrealistic ones we mostly see today.

This week the Supreme Court of the United States announced that in December oral arguments will be heard in a case that could overturn Roe v. Wade. Speaking of the courts, a Christian adoption and foster care agency in Central New York finds itself defending its right to serve children in need and their families in a manner consistent with the ministry's faith. We'll have more details a little later in today's program. Next up, Governor Kathy Hochul continues to make appointments to her administration and one with strong ties to Planned Parenthood is raising eyebrows in the pro-life community. Then, the presumptive Republican and Conservative Party candidate for New York State Governor in 2022, Lee Zeldin, disclosed that he has been diagnosed with cancer, but thankfully he also announced that he is in full remission. Last, there is a troubling story out of the Finger Lakes Region. There, a fertility doctor was allegedly and fraudulently serving as the sperm donor for women seeking assisted reproductive services. It's still the wild west in many ways when it comes to these types of services and at the very least the state needs to start reining in some of these rogue individuals. When Matthew Fernandez Konigsberg isn't working his day job as an in-house attorney at a large international law firm, he's actively working within the Puerto Rican and Jewish communities, fighting for the rights of Puerto Ricans and against antisemitism. Over his storied career, which included years as a special counsel for ethics, risk and compliance in the New York State Governor's Office, he's held a number of leadership and educator roles within the Jewish and Latino communities, aiming to bridge the divide and support both minority populations in and around New York. But he still has big dreams. Among the biggest: creating a Birthright-style trip for Puerto Ricans living in the diaspora. Inspired by what Israel has done for young Jews around the world, he envisions a program that would give Puerto Ricans in New York and elsewhere, who've never had the chance to visit their homeland, an opportunity to travel, connect with locals and get engaged with the community. One of the big administrative responses to these uprising was in New York State Governor, from Governor Andrew Cuomo in the form of Executive Order 203. The order offered serious affirmation to what many in America were saying: police departments across the country serve to oppress marginalized communities of Americans, especially black Americans. Every village, town, and city were required to reassess their police department's trainings, use of force policies, and consult with the community to change policing. But what came of this order? We take a look at the differing approaches and results in the cities of Syracuse, and Ithaca. Katie Neer is the Head of Industry Affairs at Lantern, an e-commerce marketplace that facilitates cannabis home delivery. During her time in the Governor's Office, Katie was responsible for negotiating and overseeing the implementation of several key policy initiatives, including Paid Family Leave, Ride-Share, and the DFS's cybersecurity regulations. Katie was listed as an attorney on The Best Lawyers in America, āOnes to Watch,ā List for Administrative and Regulatory law in 2021. In 2018, she was profiled as an Albany 40 Under 40 Rising Star. I empathize with those desiring that the name of the 3.1 mile bridge should revert to Tappan Zee; other recommendations would undoubtedly include renaming the structure for a deceased serviceman or woman, the 9/11 attack victims, or a different New York State Governor. In this special episode, we chat with Kurt Morrow about the time he spent with Milt Hinton.Ā Milt's wife Mona asked Kurt if he would live in faculty housing with Milt.Ā Kurt shares some of these life-changing experiences with us today. More about Milt Hinton Milt āThe Judgeā Hinton was regarded as the Dean of jazz bass players. He was born in Vicksburg, Mississippi in 1910, and at the age of eleven moved to Chicago with his family. He began his musical education by taking private violin lessons, but while attending Chicago's Wendell Phillips High School and playing in a band sponsored by the Chicago Defender newspaper, he learned to play bass horn, tuba, cello, and eventually the bass violin. Like many aspiring Southside musicians of his generation, he was influenced by the legendary educator, Major N. Clark Smith. During the late 1920s and early 30s, Milt worked as a freelance musician in Chicago and performed with legendary jazz artists including Freddie Keppard, Zutty Singleton, Jabbo Smith, Erskine Tate, and Art Tatum. His first steady job was with a band led by Tiny Parham, followed by a stint with violinist Eddie Southās Orchestra. Miltās earliest recording come from this era. In l936, Milt joined Cab Calloway and for fifteen years performed with Calloway and renowned sidemen such as Danny Barker, Chu Berry, Doc Cheatham, Cozy Cole, Dizzy Gillespie, Quentin Jackson, Illinois Jacquet, Jonah Jones, Ike Quebec, and Ben Webster. During this period he was also featured on numerous recordings accompanying Benny Carter, Benny Goodman, Lionel Hampton, Coleman Hawkins, Billie Holiday, Ethel Waters, and Teddy Wilson - to name just a few. Most of these sessions have become jazz classics. After leaving Calloway in the early 50s, Milt began working as a studio freelancer in New York City. For two decades he played on thousands of jazz and popular records. He also played on hundreds of jingles and film soundtracks and numerous radio and television programs. In addition, he made concert and festival appearances around the world and toured extensively with Louis Armstrong, Pearl Bailey, and Bing Crosby. Milt has played with virtually every jazz and popular artist from Ellington, Coltrane and the Marsalis Brothers to Streisand, Midler and McCartney. In the late 80s Chiaroscuro Records released Old Man Time , a double cd featuring Milt along with many life-long friends from the music world. Laughin' at Life, was released by Columbia Records in 1995 and Chiaroscuro recently released The Judge at His Best, a selection of his recordings on that label over three decades, and the Bassment Tapes, which features Milt performing with groups he assembled. Milt received honorary doctorates from William Paterson College, Skidmore College, Hamilton College, DePaul University, Trinity College, the Berklee College of Music, Fairfield University, and Baruch College of the City University of New York. He won the Eubie Award from the New York Chapter of the National Academy of Recording Arts and Sciences, the Living Treasure Award from the Smithsonian Institution, and he was the first recipient of the Three Keys Award in Bern, Switzerland. In 1993, Milt was awarded the highly prestigious American Jazz Master Fellowship from the National Endowment for the Arts, in 1996 he received a New York State Governorās Arts Award, in March 1998 he was awarded the Artist Achievement Award by the Governor of Mississippi, and in 2000 his name was installed on ASCAPās Wall of Fame. Milt began taking photographs of his friends in the l930s, and he has continued ever since. Over the years his collection has grown to more than 60,000 images. The work depicts an extensive range of jazz artists and popular performers in varied settings - on the road, in recording studios, at parties, and at home - over a period of six decades. In June 1981, he had his first one-person photographic exhibition in Philadelphia and since then he has had exhibits across the country and in Europe. In addition to being published in major periodicals, Miltās photographs have appeared in documentary films including The Long Night of Lady Day (Billie Holiday), The Brute and the Beautiful (Ben Webster), and Listen Up (Quincy Jones). A Great Day in Harlem a 1994 documentary about Esquireās photographic shoot of jazz legends in 1958, features numerous photographs by Milt as well as a home movie shot by his wife, Mona Hinton. In 1988, Bass Line: The Stories and Photographs of Milt Hinton, by Milt Hinton and David G. Berger was published by Temple University Press. It was selected Book of the Year by JazzTimes. In 1991, OverTime: The Jazz Photographs of Milt Hinton, was published by Pomegranate ArtBooks. In 1990, Milt's 80th year, WRTI-FM in Philadelphia produced a series of twenty eight short programs in which Milt chronicled his life. These were aired nationwide by more than one hundred fifty public radio stations and received a Gabriel Award as Best National Short Feature in 1990. In June 2000, a concert was held to pay tribute to Milt on the occasion of his 90th Birthday. Milt passed away six months later. In late 2002, Keeping Time: The Life, Music & Photographs of Milt Hinton, a one hour documentary film was completed. It was produced and directed by David G. Berger and Holly Maxson. It debuted at the London Film Festival, won the Audience Award at the Tribeca Film Festival in 2003, and has been shown at film festival both here and abroad. Milt and Mona Hinton were married for fifty-seven years and have a daughter Charlotte and granddaughter Inez who live in Atlanta. The Hintonsā life-long involvement in their Queens, New York community, their strong commitment to family, and their ongoing contribution to music and photography made them both role models and an inspiration to younger generations.
